PROPOSAL
In February 2016, the Planning Department received a proactive enforcement complaint relative
to the keeping of horses on residentially-zoned property. A stable and a fenced pasture area are
maintained on the 6.1 acre property for the keeping of three (3) horses. According to the property
owner, horses have resided on the property since 1965.
The Zoning Ordinance includes the keeping of horses under the definition of a farm. A farm that
includes a minimum of three (3) acres in an Agricultural (A) District permits the keeping of horses.
A farm use in a Residential District, regardless of the property’s size, is limited to the keeping of
chickens, and requires a conditional use for other types of farm animals to include horses.
The following table provides an overview of conditions recommended by staff to minimize the
potential impacts of the use on adjacent property owners.

Given the size of the request property, and if maintained as outlined in the recommended
conditions, the use should not adversely affect area residential uses. In addition, the keeping of
horses has been approved in other residential areas on similarly large parcels with no apparent
adverse impact.

There is an existing four (4) inch water line extending along the east side of Quailoaks Avenue from
Woodfin Drive and terminates adjacent to the southern property line of Parcel 793-667-7050. An
eight (8) inch water line extends along the northwest side of Perlock Road, approximately 275 feet
from the northwest property line of parcel 793-667-5487.

There is an existing eight (8) inch wastewater collector line extending along Perlock Road
approximately 255 feet northwest of parcel 793-677-5487 as measured along the right-of-way of
Quailoaks Avenue. The request property is not required to connect to public water and sewer. The
proposed request will not impact the public water and wastewater systems.

the proposal at this time.

2.Non-Transferable Ownership:This Conditional Use approval shall be granted exclusively
to Shirley Simpson, and shall not be transferable with the land. (P)
3.Commercial Activity:No commercial activity, such as the breeding or sale of animals,
shall be permitted in conjunction with this use. (P)
4.Animal Waste:All areas associated with the keeping ofhorses (pastures, stables,
shelters, etc.) shall be cleaned and made free of waste on a regular basis. In addition,
the property owner shall employ a means of eliminating any odor problems and
