On motion Of Mr. Britton, seconded by Mr. Apperson, it is resolved that the following water and gas contracts be and they hereby are approved: AR-597.F - Deering Manor $ 2,809.60 AC-431 - Meadowdale, Sect. A 25,209.50 AC-~33 - Fawnbrook, Sect. A 20,855.00 On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that this Board awards to the Fred Barnes Construction Company, contract AR-597F to install water and gas in the Deering Manor Subdivision in the amount of $2809.60. On motion of Mr. Martin, seconded by Mr. Apperson, it is resolved that the Chair- man be requested to appoint a Committee to discuss the installation of gas in the County of Chesterfield. On motion of Mr. Martin, seconded by Mr. Britton, i$ is resolved that this Board awards to Contractors, Inc. contract 6602-2 in the amount of $41,310.O0 for the installation of the Pocono Pumping Station. Engineer be requested to seek the payment accorMing to contractual agreements On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that the Count~ for installing water and sewer service to the Park-Lee Gardens Apartments. On. motion of Mr. Britton, seconded by Mr. Apoerson, it is resolved that the County Engineer be authorized to install water service on Collier Road, provided the citizens who want said service at this time pay a minimum of $500.00 and 'consideration be given to obtaining sewer easements from Falling Creek and the necessary easementa for the public road to said area. On motion of Mr. Britton, seconded by Mr. Martin, it is ~esolved that sewer contract S-66-52D for the installation of sewers in Jefferson Village, Section 2, ~i be approved. The Commonwealth's Attorney presented new standards and specifications for the construction of utility facilities, setting out revised design standards and specifications for same. Upon consideration whereof, and on motion of Mr. Brittom, seconded by Mr. Goyne, it is resolved that the revised design standards and specifications be approved, subject to the review snd approval by the Common- wealth's Attorney. On motion of Mr. Britton, seconded by Mr. Martin, it is resolved that this Board aliows Mr. Linwood J. Reynolds to connect to the County's sewer sys'tem for the sum of $200.00 due to an error made by the County Utility Department in billing Mr. Reynolds for service not received. It is here noted that Mr. Browning does not vote and Mr. Apperson and Mr. Goyne vote "No." On motion of Mr. Britton, seconded by Mr. Browning, it is resolved that the following Ordinance be and it hereby is adopt.ed: AN ORDINANCE to amend and reordain Section 17-9 of Chapter 17 of The Code of the County of Chesterfield~ Virginia, by adding thereto subsection (h} to make County-owmsd sanitary landfill operations a principal use permitted in an A (agricultural} District. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA: 1. That Section 17-9 of Chapter 17 of The Code of the County of Chester- field, Virginia, be amended and reordained as follows: Sec. 17-9. A districts. The following regulations shall apply in all A districts: Uses permitted. (a} Same as specified for R-1 districts. (b) Farming, dairy farming, livestock and poultry raising, including all buildings necessary to such use and the keeping, storage, or operation of any vehicle or machinery necessary to such use. (c) Forestry operations, saw mills, and box mills, together with incidental uses thereof. (d) The sale or offering for sale, by the owner or tenant of any form of goods produced on said farm. The construction of a stand or shelter for this purpose on highway frontage of any such farm shall be a permitted use. (e) Sand, clay and gravel pits, granite quarries, mines and other opera- tions for the mining of materials and removal of natural earth resources from the earth or subsoil, subject to the regulations that are soecified in section 17-11. · (f) Such other uses as may be granted by the governing body upon applica- tions to the board of supervisors. Such use to be governed by restrictions aoplicable to such uses. (g) House trailers; provided, that a use permit is obtained from the board' of zoning appeals, which permit shall specify the location of such trailer on the premises and assure compliance with health and sanitary requirements of the countM. The permit shall be valid for a period not to exceed two years. At the expiratior~ of the time specified on the oermit, a new application may be made for a new use permit. The board of zoning ~ppeals may take action on such application without prior notice being published in a newspaper of the date the board will act on such apolication and no notice to adjoining landowners shall be required unless directed by the board of zoning appeals. (h) County-owned sanitary landfill operations having a lot area not less than fifty acres. Regulations governing location of buildings. (a) No building shall be located closer to the nearest side line any state highway than a distance of fity feet. (b) No dwelling shall be located closer to the sie property line of the oarcel of land on which such dwelling is situated than a distance or'ten feet nor closer to any Other dwelling on ~he same parcel of land than a distance of ~;wenty feet. (c) No commercial building shall be located closer to the side property line of the parcel of land on which such building is situated than a distance of fifteen feet, nor closer to any dwelling on the same parcel of land than a distance of twenty feet. 2. This Ordinance shall be in full force and effect from and after its date of passage in accordance with law. On motion of Mr. Britton, seconded by Mr. Apperson, it is resolvedthat the following ordinance be and it hereby is adopted: AN ORDINANCE to vacate an unimproved 50-foot road designated as Charlotte Avenue, and an unimproved ~-foot road designated as Warwick AVenue at the eastern~ end of Ampthill Park Subdivision, plat of which is recorded in Plat Book 5, Page 60, the extent of said roads to be vacated being shown on plat made by Robert M. Blankenship III,. dated October l~, 1966. WHEREAS, Thurston Motor Lines, Inc. has petitioned the Board of Supervisors~ of Chesterfield County, Virginia, to vacate an uaimproved 50-foot road designated as CharlOtte Avenue and an unimproved &&-foot road designed as Warwick Avenue, at the eastern end of Ampthill Park Subdivision, plat of which is recorded in Plat Book 5, Page 60, the extent of said roads to be vacated being shown on plat made by Robert M. Blankenship, III, dated October it, 1966, and notice of the adoption of such Ordinance has been given in accordance with Section 15.1-~31 Code of Virginia, 1950 as amended; , NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY CHESTERFIELD, VIRGINIA: 1. That pursuant to Section 15,1-482, Code of Virginia, that unimproved 50-foot road designated as Charlotte Avenue, and unimproved ~-foot road designated as Warwick Avenue, at the eastern end of Ampthill Park Subdivision, plat of which is recorded in Plat Book 5, Page 60, the extent of said roads to~ be vacated being shown onplat made by Robert M. Blankenship, III, dated Octobe~ 14, 1966, are hereby vacated, reference being made to said plat by Robert M. Blankenship, III, attached hereto. This ordinance shall be in full force and effect in accordance with Section 15.1-&~2, Code of Virginia, 1950, as amended and a certified copy thereof shall be recorded in the Clerk's office of the Circuit Court of Chesterfield County. On metion of Mr. Goyne, seconded by Mr. Apperson, it is resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System the following roads: This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Atmore Drive in the Clover- dale Subdivision, Midlothian Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Goyne, it is resolved tha~i Atmore Drive inthe Cloverdale Subdivision, Midlothian District, be and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be andi it hereby is requested to take into the Secondary Road System, Atmore Drive, from the intersection of Rt. 570 and Rt. 869, eastwardly .07 mi. to the end of construction. This road serves 3 houses. And be it further resolved, that the Board of Supervisors guarantees to thei~ Virginia Department of Highways, a 50-ft. right of way for this road. Plat recorded in Plat Book 8, Pages 3& and 35 on October 31, 19~l. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Bertram Road in the Seaton Acres Subdivision, Section 2, Manchester Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Goyne, it is resolved that Bertram Road in the Seaton Acres Subdivision, Section 2, Manchester District, be and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System, Bertram Road, from the intersection of Rt. 22&5 and Rt. 1658, northwardly .09 mile to a cul-de-sac. This road serves houses. And be it further resolved, that the Board of Supervisors guarantees to the! Virginia Department of Highways, a 50-ft. right of way for this road. Plat recorded in Plat Book 15, Page 30 on May 2, 1966. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Greenbay Road in the Deerbourne Subdivision, Section "J", Manchester Magisterial District, which shows that in the opinion of the County Road Engineer it is experient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. G0yne, it is resolved that Greenbay Road in the Deerbourne Subdivision, Section "J", Manchester District, be and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System,Greenbay Road, from a point on Route 637, ilO mi. north of its intersection with Route 2375, eastward~ ly .15 mi. to a cul,de-sac This road serves 10 houses. And be it further resolved, that the Board of Supervisors guarantees to the Virginia Department of Highways, a 50-ft. right of way for this road. Plat recorded in Plat Book 15, Page 34 on May 2g, 1966. This day the County Road Engineer in accordance with directions from this Board made reoort in writing upon his examination of Forrestal Road in the Lake Forest Subdivision, Bermuda Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of blt. Geyne, it is resolved that Forrestal Road in the Lake Forest Subdivision, Bermuda District, be and it hereby is established as a public road. And be it further resolved, that the. Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System, Forrestal Road, from a point on.Rt, lAA, .12 mi. north of its intersection with Rt. 1557, westwardly .lA mi. to a cul-de-sac. This road serves 2 houses. Virginia Department of Highways, a 50-ft~ right of way for this road. recorded in Plat Book 15, Page 18 on January 10, 1966. And be it~further resolved, that the Board of Supervisors guarantees to the Plat This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Sykes Road in the Bon Air Manor Subdivision, Midlothian Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a oublic road. Upon consideration whereof, and on the motion of Mr. Goyne, it is resolved that Sykes Road in the Bon Air Manor Subdivision, Midlothian District, be and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and ~ it hereby is requested to take into the Seconardy Road System, S~es Road, from ~ a point on Rt. 8&3, .08 mi. south of its intersection with Rt. 8&&, southeastward ly .08 mi. to the end of construction. This road serves 2 houses· And be it further resolved, that the Board of Supervisors guarantees to the Virginia Department of Highways a 50-ft. right of way for t his road· Plat recorded in Plat Book 9, Pages lA and 15 on ~4ay l, 1951. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Sunset Boulevard in the Westover Farms Subdivision, Bermuda Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Goyne, it is resolved that Sun,et Boulevard in the Westover Farms Subdivision, Bermuda District, be and ,it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondar~ Road System, Sunset Boulevard, from a point on Rt. 618, .31 mi. northeast of its intersection with Rt. 10, southeastwardly .31 mi. to a cul-de-sac. This road serves 16 houses. And be it further resolved, that the Board of Supervisors guarantees to the Virginia Department of Highways, a 50-ft. right of way for this road. Plat recorded in Plat Book &, Pages ll8 and ll9 on February ll, 1928. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that the followin~ roads have been officially taken, into the State Secondary System of the Highway Deoartment and will be recorded in the minutes of the Board of Supervisors: ADDITIONS SALISBURY SUBDIVISION, SECTION "C": Kings Lynn Road - from a point on Kings Lynn Road 0.11 mile north of Route 902 and running north 0.08 mile to Kingsmill Road. LENGTH O. O8 Mi. Kingsmill Road - from a point on Kings Lynn Road 0.19 mile north of Route 902 and running northeast 0.42 mile to turn around. ADDITIONS Thomas Dale Nigh School - from a point on Route 10, 0.13 mile east of Route 14~ and running north 0.08 mile to circle, then around circle 0.10 mile. Manchester Senior High School - from a point on Route 360, 0.30 mile west of Route 650 and making a loop 0.18 mile back to Route 360. Matoaca High School - from Route 722, 0.05 mile south of Route 628 and running east 0.05 mile then south 0.02 mile, then west 0.05 mile to Route 722. Meadowbrook High School - from a point on Route 638 and running south 0.05 mile then west 0.08 mile then north 0.05 mile to Route 638. Huguenot High,School - from a point on Route 683, 0.09 mile east of Route 1888 and running south 0.03 mile then around circle 0.09 mile. Huguenot High School - from a point on Route 683, 0.01 mile east of Route 1888 and running south 0.03 mile to circle and around circle 0.09 mile. A. M. Davis Elementary School - from a point on Route 678, 0.38 mile south of Route 60 and running east 0.02 mile then south 0.04 mile then west 0.02 mile to Route 678. Falling Creek School - from a point on Route 637, 0.06 mile south of Route 2346 and running west O. O1 mile, then south 0.06 mile and east and south 0.05 mile to Route 637. Chester Intermediate School - from a point on Route 10, 0.02 mile west of Route 1519 and running north O.11 mile to Route 1519. UPon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Browning, it is resolved that due to the existing circumstances involved in getting fire trucks on Route #1 during heavy traffic, this Board again requests the Highway Department to allow some kind of a traffic control light at this intersection so that the property of the citizens of this area might be protected in an efficient manner from the hazmrds of fire and that the school buses and other traveling public having to enter the stream of traffic on Route #1 during peak hours will not be subject to the hazards currently existing. There was held a discussion concerning the possibility of constructing a grade crossing at the intersection of Stragford Road and the Southern RR. The Highway~ Department and the County Engineering Department agree that such a crossing would cost approximately$79,000.OO including signalling equipment. Mt.Bernard Davis residing on Elkhardt Lane states he does not approve of the depth of the zoning and cites the fact that other furniture stores are not zoned to such. an extensive depth. Mr. Willis, owner of 3 acres on Hey Road states that he does notobject to the proposed zoning if it is limited to a depth of &OO feet. Mr. Fred Gray, Attorney, comes before the Board in behalf of the Woodstock Home and Land Comoany, Inc. requesting the rezoning from Agriculture to General Business .(~-2}, including a hospital, convalescent home and multiple family dwellings on a~ 137-acre parcel of land of irregular shape, fronting 2250 feet, more or less, on the South line of Hull Street Road (Rte. 360) and extending southward!y to the rear of those lots fronting along the western line of Alaska Drive, said parcel also having a frontage of 2255 feet along the eastern line of Warwick Road and extending eastwardly to the A.C.L. Railroad, said parcel located 350 feet of Warwick Road on the south line of Route 360, and 217 feet south of Hull Street Road on the east line of Warwick Road, and shown as parcel 5 on tax map section 2-15, in Manchester Magisterial District, and presents Dr. William Sanger, who states that one out of every seven citizens in the County required hospitalization last year and estimated that the need for the area is much greater than that which~ is planned for at this time. He states that it is necessary to locate a hospital near public transportation, where traffic accessibility is good and particularly where the property and the hospital is compatible with its operation. Dr. C. C. Bell, Methodist Minister from Matoaca states that boundary lines have nothing to do.with the need of the people as far as hospital services are concern-. ed. A hospital must be placed where the need is greatest. Mr~ Buford Hayden, Professional Planner, states that this plan will have no detrimental impact on existing homes, that the proposed use is the highest and best use of the land. Mr. Browning and Mr. Britton asked about the possibility of putting one street parallel to Alaska Drive so that the houses can back up to the citizens of Alaska Drive and also questions the. feasibility of.widening Rt. 360 for a stack-up lane or a service road. Mr. Hayden states that the Planning Commission should handle the traffic require- ments and that single family homes are not the highest and best use of this land. Mr. Timmons, representing Hospital Site Committee, states that the service clubs in the Chesterfield area have soent approximately $20,000.00 to start this project~ that leaders of Chesterfield ha~e been studying this site for over a year and approximately one hundred people stand to support the project. Mr. Timmons oresented 1500 signatures of peoole who have stated that they were in favor of thi~ proposal. Mr. Cimino and the Rev. Lewis Garrett, speak for the rezoning. Mr. David M. White, Attorney, representing the Woodstock citizens states that it would be his personal opinion that a hospital should not be located where Richmnnd is sure to annex same, that the lots on Alaska Drive were sold with restricted residential quarters, that the owners cannot be bound by contract because they have not lived up to prior commitments. Roads to apartments differ according to plans. Mr. Bloxton, President, Woodstock Civic Association, states there are aporoximate- ly 500 homes in the Woodstock Sub$ivision valued at $10,000,000 and that~all of these people do not want business in the area and p~esented a petition signed by 500 people opposing same. Mr. Reams, Mrs. Gilman, Mr. Robert Palmer, Mrs. Kember and Mr. Garland Wells, speak in this order, generally opposing the request for various reasons. Mr. Ralph Elmore states that the Corporation will not compromise since the plans are set, that the people in the area are for the hospital and requests that the Board of Supervisors grant the hospital rezoning but deny the rest of the proposed zoning. Mr. Gray states that a contract can be made binding by making the Board of Super- visors a oart~ to the contract, that stub streets were closed because oeople wanted th~m czosed, that traffic will continue to increase whether the~hospital is, placed there or not, that the zoning will be beneficial since it will sta~U~ize the entire area. Mr. Timmons states that in 1950 the Woodstock Home and Land Corporation had in mind to use the lan~ for residential purposes, however, the uses of land change. We need now to zone the land for its highest andbest use, that the Board ~hould do what is best for the entire C~nty and that the Board has the right'to se~ that such apartments are well built and maintained properly. He states further that this is a well-conceived plan, it is urgent that the program proceed and if the zoning is turned down this hospital program will fail. Mr. Cecil Goolsby and Mr. Stanley Hague speak briefly in favor of the proposal. Mr. Britton states that this is a serious problem, that he has tried to vote for what is best for the majority of the people and the County as a whole, and states further that the Board of Supervisors has not been on this site as a group and moves that the proposal be deferred to January ll, 1967. That a Committee be established composed of three people from the citizens in the area, three people from the Hospital BOard and a representative of the Woodstock Corporation in an · effort to work with the Board of Supervisors to effect some sale that would be in the best interest of all concerned. Mr. Goyne seconds the motion which is carried unanimously. Since there is no one here to propose or oppose the request for a Use Permit for Frances I. Browning, it is resolved that due to the. proposed increase in rates for Blue Cross-Blue Shield Hospitalization insurance, it is ordered that bids be sought from Insurance companies on a similar service as is now being received by the County employees. On motion of Mr. Browning, seconded by Mr. Aooerson, it is resolved that the Notice of pUblic Hearing at the State Coroor~ion Commission for a Certificate of Public Convenience and Necessity as a common Carrier by the Tri-City Coaches, Inc.~, be filed with the Board's papers. On motion of Mr. Aooerson, seconded by Mr. Browning, it is resolved that the request of the Dale~volunteer Fire Department for an additional pumper be referre4 to the Fire Committee. On motion of Mr. Apperson,seconded by ~4r. Britton, it is resolved that the County pay its share of the telephone expenses of the Commissioner of the Revenue in the amount of $1125.00v.for the calendar year 1966 and $565.00 for the first six months of 1967. ~ And be it further resolved, that this Board requests the State Compensation Board to pay its share of this expense. On mOtion of Mr. Apperson, seconded by Mr. Goyne, it is resolved that a bill from Robinson & Dulaney, Auditors, in the amount of $13,000.00 be and it hereby is aoproved for payment and it is here noted that the Auditor of Public.Accounts notified the County that formal acceptance of the County's audit has been given. There was presented a report from Systems Engineering Corporation by J. D. Moore, which Corporation was employed to study the Data Processing System of the County and its immediate needs, particularly the area of specifying the type of equipmenD. and orocedure in relation with the Treasurer's Department. A report recommendin'~ the renting of an I.B.M. System 360 Model 20 computer was received by the Board. Upon consideration whereof and on motion of Mr. ~4artin, seconded by Mr. Apperson, it is resolved that the Executive Secretary be authorized to obtain the equipment as soon as possible and not later than February 15, 1967, so that Real Estate bills may be completed on time. On motion of Mr. Aoperson, seconded by Mr. Britton, it is resolved that the proposed Land Use Plan be referred back to the Planning Commission for re-study and re-submission to the Board of Supervisors. On motion of Mr. Browning, seconded by Hr. Martin, it is resolved that the Police Department and the Game Warden be requested to enforce the law on hunters firing guns or hunting on or near road rights-of-way. Mr. Browning makes the following motion, which was seconded by Mr. Apperson: Be it Resolved that this Board requests the County's Legislators to seek the abolishment of a State Sales Tax on groceries. A vote being taken: Mr. Browning and Mr. Apperson vote Aye. Mr. Horner, Mr. Goyne, Mr. Britton and Mr. Martin vote Nay. On motion of Mr. Britton, seconded by Mr. Martin, it is resolved that the proposedl plans for the construction of a Texaco Service Station at the intersection of Turner Road and Rt. 360 be and it hereby is aporoved, provided an 18-ft widening strip is given on Turner Road. WHEREAS, the Department of Highways of the Commonwealth of Virginia has recently embarked upon the enforeement of 'a policy adooted November 23, 196~ regarding utility lines crossing subdivision~roads and~secondary roads throughout the State of Virginia; and WHEREAS, for many years and on many different occasions the Highway Deoart- ment has accepted roads into the system for maintenance which roads had easements crossing said roads without any quitclaim or release of these easements by the utility companies; and WHEREAS, there are several subdivisions in the County as of the date of this resolution in which the roads have been constructed to Highway Department specifications and are ready to be taken into the system and which the Highway Department at the e~eventh hour declined to take into the system until easements which cross these roads were quitclaimed by the various utility companies in exchange for a work permit across the road; and WHEREAS, the sole question involved in most of the above-mentioned utility line crossings is the question of who shall bear the cost of relocation in the event of a future change in grade in these roads; and WHEREAS,~ it is highly unlikely, especially in the case of subdivision roads, that the grade will ever be changed and if changed would not involve additional acquisition of right of way; and WHEREAS, this entire action on the part of the Department of Highways is apparently one of oolic¥ and not of law; NOW.,i THERF~ORE, be it Resolved by the Board of Supervisors of Chesterfield County, Virginia, that the Highway Department be requested to re-examine its established policy in the light of the probability of future occurrences of the facts mentioned above and cooperation with the localitie~s, utility companies and real estate developers throughout the Commonwealth by adopting a policy which would allow the exercise of discretion by local highway officials in the acceptance of roads into the Secondary System. BE IT FURTHER RESOLVED, that in the case of existing subdivision roads in Chesterfield County which were built to Highway Department specifications and approved by the Highway Department be taken into the system immediately to relieve the deveIopers of the cost of maintenance temporarily at least until the Highway Department re-examine its existing policy in this regard.
