AN ORDINANCE to amend and reordain Chapter 7, Section 7-2, paragraphs 1 and 2 to prohibit the sale of beer and wine during certain hours, and to provide penalties for violation. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD,VIRGINIA: 1. That Chapter 7, Section 7-2, paragraphs 1 and 2 of the Code of the County of Ches- terfield be and they are hereby amended and reordained to read as follows: SECTION- 7-2 SALE AND CONSUMPTION OF BEER AND WINE PROHIBITED DURING CERTAIN· HOURS: PENALTY FOR VIOLATION. ~tIt shall· be unlawful for any person licensed under the provisions of the Alcoholic ~ Beverage Control Act or his agents, servants, or employees, to sell beer or wine or i~ipermit the consumption thereof on the premises mentioned in such license between !'~the hours of 12:00 o'clock midnight o.f each Saturday and 6:00 o'clock A.M. of each Sunday. ~!!Each such offense shall constitute a separate violation punishable by a fine not ex- i ceeding five hundred dollars ($500.00) or by confinement in jail not exceeding i twelve months (12), or both, in the 'discretion of the jury or of the trial justice or of the court trying the case without a jury. Mr. Homer absents himself from the Board because of possible conflict of interest. Mr. Browning, Vice-Chairman, conducts the meeting. Mr. Ivey P. Blue, Jr., sums up the arguments of the proponents by stating that the merchants in the County should have the same competitive advantage as those in the · City, that the advisory Referendum showed that the County citizens want the sale of beer and wine on Sunday, that the remainder of the County after annexation will need the revenue, that Tourist attractions will be boosted, that he understands that the .Board would follow the outcome of the advisory Referendum. ~Mr. George Harvey, representing the Food Industry, Mr. John McDonald, owner of Indian Hills Motel, and Mr. Fred Bender, owner of the Half'Way House spoke briefly in favor of the Ordinance. ' Rev. Roy Miller, pastor of Woods Methodist Church, states that the real issue is one i of profit and that the County must maintain law and order, that tax benefits to the ! County will not pay for cleaning up the problems alcohol causes, that public safety ~, should take precedence over profit. i Rev. Roland Powell, pastor of the Matoaca Baptist Church, stated that the growing concern across the Nation is the increasing lack of morals, that there are children ii living in Matoaca who have no father because of alcohol and that the question of !i this Ordinance is really a moral one. Mr. Finley R. Albright speaks against the passage of the Ordinance. lin rebuttal, Mr. Blue states that the Board was not elected to legislate morals, ~ that this is not an emotional argument, that his clients do not deal in dirty money. ~The Rev. Miller states that the governing body must provide for public order and whereas it cannot legislate morals it can make the churches' job easier. ~Mr. Wallace Tucker, Pastor of the Harrowgate Baptist Church, speaking with special !permission from the Board states that we are following in the steps of Rome, that the apparent fall of the Roman Empire is a pa~t. tern which this Nation is following I!iand that the evils of alcohol should be eliminated at least on Sunday. i!Upon consideration of the arguments presented, Mr. Apperson makes the following ~tmotion which was seconded by Mr. PurdY: That the Ordinance in question be adopted il as presented. li'~Whereup°n Mr. Dietsch seeks to amend the Ordinance by extending the prohibition time i! from 12:00 midnight each Saturday to 12:00 Noon each Sunday. iiA vote t~eing taken on the amendment, Mr. Dietsch votes Aye. Mr. Purdy and Mr. Apperson vote Nay. ~ !i~Mr' Martin abstains from voting. ii Speaking on the original motion, Mr. Apperson states that in our Society we cannot ilive without temptation and that Dale District voted for the sale of Sunday beer imf. Purdy states that Bermuda District also voted for the sale of Sunday beer. !Mr. Dietsch states that the County of Henrico experienced no increase in disorder in changing its ordinance to allow the sale of the Church should examine itself and do a better Sunday job on beer. the moral He states decay further evident in that every walk of life. Mr. Martin states that alcOholics are symptomatic of our Society and alcohol is a huge syndrome of decay. Upon consideration of the original motion: Those voting Aye - Mr. Dietsch, Mr. Apperson and Mr. Purdy. Nays - Mr. Martin and Mr. Browning. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of German School Road Extended in Man- chester Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Dietsch, it is resolved that Ger- man School Road Extended in Manchester District, be, and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and it here- by is requested to take into the Secondary Road System, German School Road Extended, from its intersection with U.S. Rt. 60, southwardly and westwardly 0.55 mi. to War- wick Road. This road serves as a connecting road. And be it further resolved, that the Board of Supervisors guarantees to the VirginLa Department of Highways a 66-ft. right of way for this road. Plat recorded in Deed Book 949, pages 368, 369, 370, 374 and 375 on March 17, 1969. On motion of Mr Purdy, seconded by Mr. Dietsch, it is resolved that the School Board's request by resolution dated December 10, 1969, for approval of offering statements of intent~D employ current teachers, plus one hundred and twenty addiL tional teachers, for the 1970-' 71 S~hool session be and it hereby is approved. It is here noted that Mr. Browning votes Nay, citing the fact that the School Board can do this act without Board consent.
