of December 23 and December 29, 1970 and January 5, 1971~ be~ and they hereby
are approved.
On motion of Mt.Martin,seconded by Mr. Dietsch, it is resolved that the following
water contr&cts be and they hereby are approved:

On motion of Mr. Dietsch~seconded by ~Ur. Purdy, it is resolved that contract
W71-4C be awarded to the lowest responsible bidder since this work is of an
emergency nature.
On motion of Mr.Browning, seconded by Mr. Purdy, it is resolved that the following
sewer contracts be and they hereby are approved:

On motion of Mr. Browning~ seconded by Mr. Purdy, it is resolved that the
Purchasing Agent be and he hereby is authorized to purchase three (3) motor
vehicles for the Utilities and ~.ngineering Departments as per the lowest bid
received.
On motion of Mr.Dietsch, seconded by Mr.Browning, it is resolved that a g-inch
CentrifUgal pump~ a 3-inch Diaphragm pump and Arc welder~ an acetylene welder
and cutting outfit be purchased as per the low bid received and a steam cleaner
be purchased if cooperative use of the pre~ent facilities cannot be arranged.
On motion of Mr. Purdy,seconded by Mr. Dietsch~ it is resolved that Contract
6511-45A for the installation of a sewer trunk line along Powhite Creek be
awarded to the Stamie E. Lyttle Company, using 42" concrete pipe at the low bid
price of RD3,969.00.
On motion of Mr. Purdy,seconded by Mr. Dietsch~ it is resolved that Con~ract
6511-g5B be awarded to the Roanoke Construction Company, Inc.,who submitted
the low bid of $178~719.50 for the installation of the 42" concme~e pipe.
On motion of Mr. Martin,seconded by Mr. Dietsch, it is resolved that the CoJlmon-
wealth's Attorney institute condemnation proceedings against R.Leslie and Julia
Brown, Jr. owners of the pr perry across which an easement must be obtained
for Project 6511-69/1~ if the amount of $300.00 offered by the County is.not
acceptable. An emergency existing, this resolution shall be'and it is hereby
declamed in full force and effect immediately upon its passage~ provided the
Executive Secretary notify Mr. and Mrs. Brown by registered mail ofthe County's
intention to enter upon and take the property which is to be the subject of the
said condemnation proceedings.
Mr. W.R.Davidson, Resident Engineer~ of the Highway Department, presents to the
Board one copy of a traffic count book containing the roads in Chesterfield
County.
Mt.Martin presents Mr.J.J.Jewett, who speaks for a petition requesting the Board
to construct the old roadway from Halisboro Station to State Route 670.
It was generally agreed that Mr. Martin would review this with Mr. Davidson.
Mr. Dietsch compliments the Highway Department on its efforts, in snow removal.
On motion of Mr. Browning, seconded by'Mr. Apperson, it is resolved that this
Board requests the Highway Department to accept into the State Secondary System
on a Rural Road basis, Simmons Street in the Village of Ettrick~ which is
described as follows:
A 30-ft. roadway, leading off Main Street (Rt.lll6), between Rt.36
(Chesterfield Avenue) and Route 1117 (Pannill Street) in the Village
of Ettrick, said roadway being 130 feet in length.
Mr. Longmire presents Mr. Jacob Mast, the new Nursing Home Administrator to
the Board of Supervisors.
Mr. Sam Wagstaff complains to the Board that the Precinct of Wagstaff Circle
is scheduled to be changed to Elkhardt.
It was stated that this was the time and place to discuss further the Dog
Ordinance proposed previously and deferred to this date, which Ordinance is
as follows:
AN ORDINANCE to amend Chapter 2, Article 3, by adding thereto
Section 2-14(d) to provide for the sale of unclaimed or stray dogs to bona fide
medical research laboratories.
BE IT ORDAINED BY TTE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD,
VIRGINIA:
1. That Chapter 2, Article 3~ Section 2-14 of t~e Code of the County of
Chesterfield be and it is hereby amended and reordained to read as follows:
SECTION 2-14(d)
Notwithstanding any other provision of this Ordinance to the contrary, the
Dog Warden or his deputies may dispose of dogs confined at the County Dog
Pound at any time after the confinement period for such dog or dogs expired
by selling such dog or dogs to bona fide medical research laboratories.
The purchaser of such dogs shall certify to the Dog Warden on forms furnished
by the County Dog Warden that the animals shall be used for medical research
purposes only.
Mrs. Mary Culley read a short statement citing the fact that the current
law is inadequate and presents abuses which need to be curbed.
Mrs. Inez Hartley, President, Virginia Kennels Club~ speaks in opposition.
Mrs. Mary F. Morrissette, President of the Humane Society, speaks in opposition~
Mrs. Pearl Tw~an, Executive Director of the Virginia Humane Society3' speaks
against using pets for experimentation.
Mr. Dale Hylton and Mr. John LaRocque, of the Humane Society of the United
States~ speak at length against the proposed Ordinance.
Mrs. Edna Cook from Alexandria~ Virginia, speaks in opposition.
Detective Mason Chalkley, of the Chesterfield Police Department, states that
he is in charge of the Dog Pound~ that the arguments are not with the County
but State and Federal Governments controls on research.
Dr. James Wolfe, Chief of Research of McGuire Hospital~ agrees that humane
treatment is necessary but there are many animals needled for experimental, for
transplants and other medical uses, that they are governed by Federal law, that.
McGuire buys from Henrico County and the City of Richmond as well as ChesterfLetd
and adjacent areas.
Mr. Apperson raises a point that the Ordinance as it is drawn will not allow
the County to sell dogs to anyone except to "bona fide medical research
laboratories."
Mr. Mason agrees that this is the intent of the Ordinance.
Mr. Browning states that he does not favor the sale of dogs to jobbers.
Upon consideration whereof, and on motion of Mr.Martin,seconded by Mr. Dietsch,
it is resolved that the Ordinance as proposed be and it hereby is. adopted.

Mr. Purdy votes Nay.
On motion of Mr.Apperson~secon~ed by Mr. Browning~ it is resolved that the

There was presented a Notice of a Pubiic Hearing before the SCC with reference
to the change of ownership by the Metropolitan Coach Corporation.
There was presented a petition from the Bon Air Junio~ Woman's Club signed by
44 County residents requesting some expansion to the Bon Air Library facilities.
On motion of Mr. Apperson, seconded by Mr.Browning~ it is resolved that the
Judge of Circuit Court~ the Honorable Ernest ~ Gates~ be and he hereby is
requested to appoint George Frederick Paul~ III~ as a Police Officer for the
County of Chesterfield.
There Was read a resolution from the Russell County Board of Supervisors concerning
Virginia Code Section 63.1-122 and 123.
On motion of Mr. Purdy~ seconded by Mr. Dietsch~ it is resolved that this Board
expresses its commendation to the Board of Social Services of the County of ~
Chesterfield in its recent actions in prosecuting false Welfare claims and
highly recommends that additional efforts be made to control any abuse of the
Welfare Program.

MroBer~ Eo Ghidotti~ represented by Mr.George Robertson~ comes before the Board~
requesting the rezoning from Agricultural to Res~ntial (R-2) of a parcel of
land of irregular shape, fronting 450 feet on Meridian Avenue and 50 feet on
South Street, having an east-west depth of 917.3 feet and a north-south depth
of 1800 feet~ being located approximately 750 feet~ northeast of the intersection
of Meridian Avenue and South Street in Bermuda ~agisterial District° Refer to
Tax Map 149-9~ 10, 13 and 14 (2) and (3) Blk. D.
There appearing no nne in opposition to this request and the Planning Commission
having recommended approval, it is on motion of Mr. Apperson, seconded by Mro
Browning~ resolved that the aforedescribed parcel of land be and it hereby is
rezoned for Residential-2 purposes.

Mro James H. Douglas comes before the Board requesting the rezoning from Agri-
cultural to General Business (C-2) of a parcel of land of irregular shape~
containing 2.76 acres~ fronting 467.79 feet on the east side of Turner Road~
327.97 feet~ on the west side of Goodes Bridge Road~ and 716 feet on the north-
west side of Walmsley Blvd., being located in the north quadrant of the inter-
section of the aforementioned streets~ better known as 2722 Goodes Bridge Road
in Manchester Magisterial District° Refer to Sec.40-2 & 6 (1) parcel 12.
Mr o Douglas cites that he will accept the C-1 zoning as recommended by the
Planning Commission and states he will give the 18' widening strips necessary
on the roadway.
Mr. James Cooper~ owner of two houses adjacant to this tract of land~ states
that he is opposed to having a business next door.
Upon consideration whereof~ and on motion of Mr.Dietsch~seconded by MroMartin~
it is resolved that the request of Mr. Douglas be and it hereby is denied.

The request of Mr° C.E.Wood=ock was read which request is as follows:
In Midlothian Magisterial District~ C.E.Woodcock requests the rezoning from
Agricultural to General Business (C-2) of a parcel of land of triangular shape
fronting approximately 240 feet on Midlothian Turnpike (§rate Rout% 60) extendi~§
southwardly ~o a depth of approximately 330 feet being located approximately
1050 feet west of the intersection of Wadsworth Road and Midlothian Turnpike.
Refer to Tax Map SeC.28-2(1)~ parcels 4 & 5.
There appearing no one for or against this zoning request~ it was cited that
the Planning Commission had recommended denial~ it is on motion of MroMartin~
seconded by Mr. Dietsch~ resolved that the request of Mr. Woodcock be and it
hereby is denied.
Ail vote Aye.

Mr. George B.Sowers, Jr. comes before the Board requesting the rezoning from
Agricultural to Townhouses (TH-i) of a parcel of land of irregular shape~
containing approximately 25 acres~ fronting 160.0 feet on South Providence Road
~nd 134.2 feet on Ruthers Road~ having an east-westdepth of approximately
2200 feet and a north-south depth of approximately 720 feet, being located
approximately 375 feet north of the intersection of South Providence Road and
Trout Lane in Manchester Magisterial District. Refer to Tax Map Sec.28-3, lot 23
and Sec. 28-4 (1).
Mt. Sowers states that he has planned for roadways, for the installation of water
and sewer and that there are sufficient schools in the area.
~r. Gordon Goode presents a petition signed by some 90 citizens in opposition
to the requested zoning and states that the Providance Road and Ruthers Road
ara both overcrowded during peak traffic hours.
Mrs. Virginia Mann, who lives immediately north of the proposed project states
that she has lived there 21 yeard and objects to the proposed use.
Mr. A.W.Orange, Mrs. James High and Mrs. Gladys Mann~ speak in opposition because
of the traffic problem involved with this Townhouse Project.
Mr. Sowers states that the schools will lose children next year and that in
time when all of the Townhouses are constructed perhaps there will be 20 children
in the Intermediate school and 20 children in the Elementary school. He states
further that he will dedicate the necessary widening strips for Providence Road
and Ruthers Road.
Upon consideration whereof~ and on motion of Mr. Dietsch,seconded by Mr. Martin,
it is resolved that the aforedescribed parcel of land be and it hereby is zoned
for TH-1 purposes, provided Mr. Sowers will locate the road leading to Providence
Road according to the desires of Mrs. Virginia Mann and to screen the project
from adjacent residSnces as planned.

Mrs. Sheila S. Moore comes before the Board requesting a Use Permit to operate
a child care center on a parcel of land of rectangular shape fronting 66 feet
on Caldwell Avenue and extending eastwardly to a depth of 210 feet,being
approximately 500 feet north of the intersection of Caldwell Avenue and Failing
Creek Avenue in Dale Magisterial District. Refer to Tax Map Sec.42-14 (5) Lot 7.
Mrs. Moore states that this proposed use is for pre-school children.
Mr.Warren DuChene and his sister~ oppose the requested use, stating that it will
devalue the property.
On motion of Mr. Dietsch~seconded by Mr.Martin, it is resolved that a Use Permit
to operate a child-care center be given toMrs. Moore only for a period of
two (2) years, provided there are no signs erected and that 'this Board will
re-hear the case in two (2) years if there are complaints.

Mr. Irvi~.C. Peoples comes before the Board requesting a Use Permit to construct
and operate a rooming house on a 54.72 acre parcel of land of irregular shape
fronting approximately 1600 feet on Woodpecker Road (Rte.626) and ~xtending
southwardly to a depth of approximately 2600 feet~ being located southwest of
the intersection of Woodpecker Road (Rt.626) and Woodpecker Road (Rt.627) in
Matoaca Magisterial District. Refer to Tax Map Sec. 174, parcel 58.
Mr. People states that he wishes to constDuct a rooming house of five to 10
units and is somewhat undecided as to serving meals.
Mr. Mike Elso~ Jr. opposes the request stating that a rooming house would not
be compatible with other areas.
Mr. James R. Bowm~n thinks that a concentration of students certainly would
not benefit the area and speaks in opposition.
Mr. Ormand Smith states they have a good community now and opposes the request.
Mr. Peoples states that he has lived in the area for 9 years and would not
be a party to anything that would devalue the neighborhood.
Mr. Browning states that he ~as sonfidence in Mr. Peoples but this is still
a business venture and should not be located in this area.
On motion of Mr. Browning, seconded by Mr. Purdy, it is resolved that the
request of Mr. Peoples be and it hereby is denied.
On motion of Mr. Apperson, seconded by Mr. Dietsch, it is resolved that the
sum of $163~14~00 be transferred from the unappropriated surplus of the
General Fund to capital outlay account -11-500-601.1 of the Nursing Home to
complete the building program of the signed contract.
On motion of Mr. Dietsch~seconded by Mr. Purdy, it is resolved that Mr.T.W.Fisher,Jr.,
of 11433 Surry Road be appointed to the John Tyler Board of Directors~ from
the County of Chesterfield.
On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved that this
Board adjourns at 5:00 P.M. to 4:00 P.M. on January 20~ 1971.
