On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that this
Board go into Executive session to discuss legal and other matters to be the
subject of future public hearings.
Reconven'ing at 9:10 P.M.
It is on unanimous motion of the .Board, hereby resolved, that the Board of
Supervisors authorizes and directs the Commonwealth,s Attorney and its Special
Annexation counsel to petition the three Judqe Annexation Court to reconvene'and
as a ground for said petition to inform the ~ourt of the action of the United
States Attorney General regarding the Richmond-Chesterfield Annexation and
the pendancy in the United States District Court of the Case ~151-71-R wherein
the validity of said annexation is at issue and to request the following action
by the Court:
That the Court take the necessary steps to protect the taxpayers in
the annexed area as to the taxes due June 15, 1971.
That the Court suspend further capitol improvements by the City in
the annexed area for which the City might-seek reimbursement from
the County in the event of de-annexation.
That the Court determine the affect of the action of the Attorney
General of the United ~tates on the duties of the City of Richmond
and the County of Chesterfield with respect to providing services
to the citizens in the annexed area.
That the Court determine such other matters relative to the carrying
out of the decree of the Annexation Court as may be affected by the
action of the United States Attorney General.
A vote being taken on this motion -
Ayes: Irvin G. Horner, J. Ruffin Apperson, F. F. Dietsch, A. R. Martin and
C. J. Purdy.
Nays: None
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the follow-
ing Amendments to the Zoning Ordinance be authorized for advertisement for a
public hearing at 11:00 A.M. on June 9, 1971:
¥~-1 (Mobile Home Parks), MH-2 (Mobile Home Subdivisions), R-M (Modular
Homes), and C-T (Travel Trailer Park) Districts with appropriate
regulations[ and provisions for elimination of single mobile homes
permitted under use permit in the Residential (R-2) districts by
January 1, 1976.
On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that this
Board adjourns at 10:00 P.M. until 1:00 P.M. May 26, 1971.
