06-28-1971 MinutesVIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on June 28, 1971 at 7:00 P.M. Present: Mr. Irvin G. Homer, Chairman Mr. H. O. Browning, Vice-Chr. Mr. J. Ruffin Apperson Mr. F. F. Dietsch Mr. A. R. Martin Also Present: Mr. Morris Mason, Asst. Comm. Atty. Mr. M. W. Burnett, Exec. Sec'y. Absent: C. J. Purdy This was the time advertised for public hearing on the proposed Re-districting Ordinance. Four persons come to request a change in the line in the Beach vicinity, between Dale and Matoaca, stating that they would like to remain in the Beach Precinct. Mr. Mason, Asst. Commonwealth's Attorney, states that the Board can make the change legally, that Mr. Rudy has agreed, and that the re-districting ordinance will again have to be approved by the United States Attorney General. Upon consideration whereof and on motion of Mr. Apperson, seconded by Mr. Browning, the following ordinance is adopted: WHEREAS, THE PROPOSED REDISTRICTING line in the Bmach community splits the community by road lines such that it results in causing some who are within sight of the vo~ting place, having to travel several miles to vote, and causes some to travel past their accustomed voting place, Beach Precinct, to a voting place in Matoaca: and · HEREAS, the presently proposed line takes a small number of voters, 26 approximately, out of the district and precinct, where they have been accustomed to voting; and, WHEREAS, the presently proposed district line has up-set some of those affected by the change to the extent that they indicate they will in the future not ~other to vote, NOW, THEREFORE, BE IT RESOLVED, thmt the Matoaca=Dale boundary be changed to preserve the peace of mind of the affected persons. The boundary change is roughky described as following the former boundary from Qualla Road to Nash Road. The specific change is to begin at Qualla Road (Route 653) and Courthouse Road (Route 655}, to follow westwardly along the center line of Courthouse Road to Second Branch Road (Route 653), thence southwardly along the center line of Second Branch Road to Second Branch Creek, thence eastwardly along Second Branch Creek to Nash Road (Route 636), thence northwardly along the center line of Nash Road to the present boundary Woodpecker Road (Route 626), Where the boundary thence continues eastwardly along the present Matoaca-Da~e boundary. Ayes: Mr. Apperson, Mr. Horner, Mr. Martin and Mr. Browning, who states that his vote is baaed on the opinion of the Commonwealth's Attorney, that he has some concern as to the number of people in Matoaca District. Upon further consideration of this matter, it is on motion of Mr. Apperson, resolved that the following ordinance be and it hereby is adopted= AN ORDINANCE to provide for the apportionment of members of the Chester- field County Board of Supervisors, to establishe boundary lines of the magisterial districts, and to name each magisterial district. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIEL D, VIRGINIA: 1. Pursuant to authority contained in the Code of Virginia of 1950, as amended, Sections 15.1-37.4 through 15.1-37.8 and Sections 15.1-371 and 15.1-571.1., the magisterial districts of Chesterfield County, Virginia, are hereby created and established as set forth in this ordinance. 2. The magisterial districts with populations as set forth as follows: Bermuda 16,497 Clover Hill 15,771 Dale 16,324 Matoaca 15,113 Midlothian 15,606 3. The boundaries of the respective magisterial districts are as set forth on schedule A attached hereto. 4. One supervisor shall be elected from each magisterial district created by this ordinance by the qualified voters of each magisterial district.' 5. Should any section or provision of this ordinance be decided to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of any other section and provision of this ordinance. 6. This ordinance shall be in full force and effect upon its adoption and enactment by the Board of Supervisors of Chesterfield County, Virginia~ providing° howe~er, that the several magisterial districts of Chesterfield County, Virginia, with boundary lines and names thereof respectively as constituted and known on the day before this ordinance be~mes effective shall continue to be represented on the Board of Supervisors until January 1, 1972. Further candidates for the office of county supervisors to be elected on November 2, 1971, shall offer for election from the magisterial districts as established by this ordinance. SCHEDULE A BERMUDA MAGISTERIAL DISTRICT Containing 66.50 square miles Beginning at a point where the center line of the Seaboard Coast Line Rail- road right-of-way intersects with the northern boundary between Chesterfield County and the City of Colonial Heights, said point being further described as situated at said intersection east of U. S. Route No. 1 and west of U. S. Interstate Route No. 95; thence running northwardly along said center line of the said Seaboard Coast Line Railroad right-of-way to its intersection with the center line of H~ppy Hill Road (State Route No. 619); thence along the center line of Happy Hill Road as it runs in a northerly and westerly direction intersecting U. S. S. Route No. 1 and becomes Alfalfa Lane east of U. S. Route No. 1 and continuing along the center' line of Alfalfa Lane to its inter section with the center line of a spur line of the Seaboard Coastline Railroad right-of-way; thence northwardly along the center line of sai~ Railroad right-of-way to the center line of Falling Creek; thence eastwardly along the c~nter line of Falling Creek to its inter- section with ~he boundary lines between Chesterfield County and Henrico County; thence along the boundary line between Chesterfield County and Henrico County as it meanders southeastwardly with the James River to its intersection of that boundary line with the boundary line between Chesterfield County and Charles City County; thence along the boundary line between Chesterfield County and Charles City County, the City of Hopewell, Prince George County and the City of Colonial Heights to the point of beginning. MATOACA MAGISTERIAL DISTRICT Containing 93.24 square miles Beginning at a point where the center line of the Seaboard Coast Line Railroad right-of-way intersects with the northern boundary line between Chesterfield County and the City of Colonial Heights, said point being further described as situated at said intersection east of U. S. Route No. 1 and west of U. S. Interstate Route No. 95; thence running northwardly along said Seaboard Coast Line Railroad right-of-way to its intersection with the center line of Happy Hill Road (State Route Ho. 619); thence along the center line of Happy Hill Road as ~ runs in a northerly direction and a westerly direction intersecting U. S. MIDLOTHIAN MAGISTERIAL DISTRICT Containing 49.26 square miles Beginning at the point of intersection of the center line of U. S. Route #60 with the boundary line between Chesterfield County and the City of Richmond; thence along said boundary line in a northwestwardly direction to its inter- section with the boundary line between Chesterfield Coundty and Henrico County; thence westwardly along the boundary line between Chesterfield County and Henrico County to its intersection with the boundary line between Chesterfield County and Powhatan County; thence southwestwardly along said boundary to its intersection with the center line of Swift Creek; thence southeastwardly along the center line of Swift Creek as it meanders to its intersection with the center line of Genito Road (State Route #604); thence northeastwardly along the center line of Genit~Road to its intersection with the center line of Coalfield Road (State Route #754)~ thence northwardly along ~e~ center line of Coalfield Road to its intersection with the center line of Luck's Lane (State Route #720)~ thence eastwardly along~he center line of Luck's Lane to i~s intersecti~with the center line of Courthouse Road (State Route #653); thence northwardly along the center line of Courthouse Road to its intersection with the center line of Courthouse Road to its intersection with the center line of U' S.Route 60; thence eastwardly along the center line of U. Nays: Mr. Dietsch, who states that he is in favor of a 6 or 7 district division to give the rural vote more voice. Abstaining: Mr. Browning. On motion of Mr. Apperson, seconded by Mr. Dietsch, it is resolved that the request of the Superintendent of Social Services for an addition to the Welfare building be deferred until the matter of the State,s participation in Local Welfare is cleared by the General Assembly. And be it further resolved, that the Engineering Department be requested .,to consult with Miss Corr to ascertain the extent of space needed and to draw up some preliminary sketches as to how this can be accomplished. Mr. Glen Richardson, Mr. Willis Pope, Mr. William Prosise, Mr. Marshall Jones, Mr. James Chuduba, Mr. Mack Spencer, Mr. Raymond Birdsong and Mr. Michael Ritz, come before the Board to discuss a proposed Erosion Control Policy. Mr. Richardson shows a number of colored slides, depicting the effect of certain erosion evils in the County. There was discussed the kind of bond which developers must get~ Upon further consideration of this matter, it is on motion of Mr. Martin, seconded by Mr. Browning, resolved that the proposed ordin&nc~ be referred to the Commonwealth,s Attorney for a ruling on its legality. On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that the Board here~y requests the Highway Department to install a 25-mph speed sign on Seminole Avenue, if same is feasible. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that the request for a street light at the intersection of Falling Creek and Huband Avenue be and it hereby is referred to Mr. LongmirefDr a report. All vote Aye. Mr. Browning presented a petition signed by a number of people living at the intersection of River Road and Hickory Road, requesting certain properties be zoned for industry and for general business purposes. Upon consideration whereof, and on motion of Mr. Browning, seconded by Mr. Martin, it is resolved that the Board on its own motion requested the Planning Department to adver- tise the properties in question for the requested rezoning~ Ail vote~Aye. On motion of Mr. Dietsch, seconded by Mr. Apperson, it is rexolved that this Board goes into Executive Session to discuss a legal matter.
