Proposal
A two (2) lot subdivision is planned. Both lots are proposed to be served by public water and
private septic system.
Exception to Mandatory Water and Wastewater Connections
Section 18-60 of the County Code requires the use of public systems. An exception to the use of
public systems must be evaluated by the Directors of Utilities and Planning, the Planning
Commission, and subsequently by the Board of Supervisors. The decision of such exceptions must
be based upon the following criteria:
Would the use of private systems encourage future area development inconsistent with
the Comprehensive Plan; and
Would the ability to extend the public system to other property be adversely affected.
Comprehensive Plan and Future Area Development
Area Residential (R-40) zoning would yield a density consistent with the 1.0 dwelling per acre
suggested as appropriate by The Comprehensive Plan.
The subject property is adjacent to established neighborhoods such asOld Gun Acres, recorded
in 1969, the Preserve at Old Gun, recorded in 2011,and Foundry Run recorded in 1975,allof
whichuse private septic systems. Three (3) larger properties to the east and west, 3400, 3500
and 3301 Old Gun Road West (containing 16.3, 21.9 and 13.3 acres respectively) may have
redevelopment potential given their size,and are currently not served by public sewer. While
3400 and 3500 Old Gun Road Westare closer in proximityto the existing sewer line, failure to
incrementally extend public sewer may adversely affect potential connection for 3301 Old Gun
Road West, and the ability to facilitate future sewer extension for surrounding properties
should existing private septic systems fail.

Additional Utility Comments:
This site is located within the mandatory water and wastewater connection areas for residential
development, stipulated by the Chesterfield County Code of Ordinances Section 18-60 A.1.c and
A.2.c.
An existing gravity wastewater line is located approximately 1,450 linear feet from the
subject property that terminateson lot 26within the Clarke’s Forge Subdivision wherean
easement exists for future extension.
An offsite extension of an 8-inch gravity wastewater line would be required,and the
applicant would be required to obtain easements across 3400 and 3500 Old Gun Road West
for the construction of the wastewater line.
An extension of the public wastewater line to serve this site could provide closer access to
the public wastewater system for some of the existing homes in the Preserve at Old Gun,
Old Gun Acres and Foundry Run Subdivisions.
UTILITIES RECOMMENDATION
The Utilities Department does not support the exception to public wastewater connection:
• Connecting to the existing sewer from Clarke’s Forge subdivision is a viable option to
provide public sewer to the subject and surrounding properties
• If this sewer is not extended to serve the subject parcel, the ability for sewer to be
extended to other properties (Preserve at Old Gun, Old Gun Acres and Foundry Run
subdivisions) may be adversely affected
Should the Commission determine it is appropriate to grant the exception, wastewater
easements should be provided to facilitate future utility extensions. (Condition 1)

parcel shall provide and dedicate public easements in locations acceptable to the
Utilities Department to accommodate the future extension of the public wastewater
system. Such easements shall be dedicated prior to plan approval or in conjunction with
