REQUEST
Conditional use planned development to permit exception to ordinance requirements relative to
buffer and setback requirements in a Residential (R-15) District.
Note: Conditions may be imposed or the property owner may proffer conditions. A proffered condition and exhibit
are located in Attachments 1 and 2.
SUMMARY
Subdivision of the property into three (3) single-family lots is planned. Exceptions to the front yard
setback and buffer width along West Huguenot Road are requested to 1) retain a single-family
dwelling, constructed in 1959, on one of these three (3) proposed lots and 2) provide a sewer
easement should properties to the east desire to connect to the public sewer system.
RECOMMENDATIONS

Proposal
The request property contains a single-family dwelling, constructed in 1959, with two (2) accessory
structures. The applicant proposes to subdivide the request property into three (3) lots, each to
accommodate a single-family dwelling. The existing dwelling would remain while the accessory
structures would be removed prior to the recordation of the subdivision plat.
The subdivision of the property requires that a buffer be recorded along West Huguenot Road as
well as a minimum front yard setback, exclusive of the buffer, for the existing dwelling. The typical
50’ buffer width, and 40’ front yard setback for the existing dwelling, cannot be achieved on the lot
fronting West Huguenot Road. Consequently, exceptions to the minimum buffer width and front
yard setback are requested.

Existing vegetation along the frontage of the property will continue to provide visual separation
between the existing dwelling and West Huguenot Road. As conditioned, this vegetation will be
maintained in its current form or be replanted according to the buffer exhibit (Attachment 2) if a
sanitary sewer line extension removes any of the existing vegetation from the buffer on the
property.

PROFFERED CONDITION
Note:
Both the Planning Commission and staff recommend acceptance of the following proffered
condition, as offered by the applicant.
1.Setback & Buffer along West Huguenot Road. A minimum eleven (11) foot buffer and
twenty-five (25) foot front yard setback shall be provided along West Huguenot Road, as
shown on the “Landscape Buffer Exhibit”, prepared by Balzer and Associates andlast
revised November 28, 2016.
a.Existing vegetation located within the buffer and existing easement areas between
the “Approx.Location of Ex. Fence” and the right-of-way boundary of West
Huguenot Road, as shown on the exhibit, shall be maintained.
b.In the event that the existing vegetation in Item 1.a. is removed for the installation
of a sewer line along West Huguenot Road, the buffer shall be landscaped in
