Variance withdrawn
17AN0108 Staff and the Board of Zoning Appeals could not support the Variance requests
and as they were in conflict with the zoning district classification, more closely
17AN0109 conforming to the standards within the Residential (R-12) District.
Parcel Background
Subject property was divided in 1983 without County approvalpursuant to the Will of
Lily Kate Pinkleton.
When split, the property did not comply withZoning Ordinance standards for lot area
(15,000 square feet) or width (100 feet).
Adjacent property to the west (5808, also created by the Will of Lily Kate Pinkleton), was
rezoned from Agricultural to Residential (R-12) (Case 90SN0308) and went through
subdivision approval in order to builda single-family dwelling meeting Ordinance
standards.
The property ownerpurchased the subject property in 2009with the intent to build one
(1) single family dwelling.
As zoned, a building envelop does not exist on this lot that meets minimum setback
requirements for an Agricultural (A) District.

The request property is surroundedby established lots, each containing a single-family
dwelling. As such, optionsto obtain additional propertyto bring the request property into
compliancewith Ordinance requirements are limited. Rezoning to R-12 would rectify the
deficiencies of the request property as it relates to lot area, width and setbacks, and would
allow the propertyowner to continue through the subdivision process to build one (1) single-
family dwelling.
