Two general rules prevail in the United States with
regard to surface water and the drainage of same. The two
'fP, mm
rules are _o _on Law Rule" and "Civil Law Rule". The Common
Law Rule is as follow~:
"2urface water is regarded as a common enemy, and every
landed proprietor has the right, as a general proposition to
take any measures necesssry to the protection of him property
from it~ ravages. The proprietor of the lower tenement or estate
may at hi~ option lawfully obstruct or hinder the flow of such
water thereon, and in so doing may turn it back or away from his
own land~ and on to and over the land~ of other proprietors with-
out liability of such obstruction or diversion. The gist of the
rule i~ that one may do a.~ he please~ with his property regardle,~.~
of the effect on surface water." 56 Am. Jut. 552, ~ec. 69 War
Virginia follow~ the Common Law Rule subject to the
qualification herein recited. The rule a~ followed in Virginia
is .~tated in a situation ~imilar to the one before the Board at
thi,~ time and I quote pertinent passages from this ca~e, Third
Buckingham Community vs. ~uder~on, 178 Va. 478, 17 ~.E. 2d
at page ~+36:
"Vfhile it is true that the so-called common-law doctrine
prevail~ in Virginia, it is nevertheles~ ~ubject to the important
qualification that the privilege~ conferred by it 'may not be
exercised wantonly, unnece~,~arily or carelessly; but i~ modified
by that golden maxim of the law that one must ~o use his own
property a~ not to injure the right~ of another. It mu~t be a
rea=onable use of tho land for its improvement or better 6njoyment,
and the right mu~t be exercised in good faith, and with no purpose
to abridge or interfere with the right~ of other~, and with ~uch
care with respect to the property that m~.y be affected by the use
or improvement as not to inflict any injury beyond what i~ necessary.'"
The question now arises as to whether a land owner ~aay
divert water t~mt collects on his property on to the adjoining
land owner by increasing the natural flow by installation of a
drainage ditch. In the ca~e above recited the rule in Virginia is
a~ follow~:
"It i~ the generally recognized rule both of the civil
and co~muon law that a landowner cannot collect ~urface water into
an artificial channel or volume, or precipitate it in greatly
increased or unnatural quantitie~ upon hi~ neighbor to the ~ub~-
tantial injury of the latter. Thi~ i~ true although no more weter
is collected than would have naturally flowed upon the property in
a different condition for it i~ evident that, while a given piece

of land may receive a large amount of nurface water without
injury thereto when it flown gently thereon from natural ca~aes,
yet when collected and discharged in considerable volume at a
given point, it may become vary de~tructi,~e and injurious."

It has be~u held that the owner of thc aervient entate
i~ not liable for hastening the flow of th~ surface water therefrom,
although it results in inJur~ to the dominant ~atat~ ~uch a_~ the
wearing of ditches therein. It ia the general rule that the owner
of land~ through or along the bou~dary of which a natural water
cour,~e flows ma~,y accumulate ~urface water falling upon lands
adjacent thereto and ca,~t thc ~ame into such stream without liability
to a lower riparian owner for da~age~, although the flow of the
water is thereby accelerated and the volume iitcrea~ed, provided that
thi~ ia done in the reasonable u,~e of hi~ own land.
Therefore, it ia ~,' opinion that a land owner may open
a drainage ditch that now exiatn on hi.~ property and discharge said
water on to the adjacent land owned by another, provided that he
does not do it wantonly, u~meceaaarily or carele,~,~ly and subject to
the qualificf,,tion that an increased amount of water does not flow
a~ ~ result of ~aid con,~truction or opening of ditch. I recommend
that the County proceed with caution and a~certain by competent
authorities the amount of water tt~t will be discharged on to the
adjacent land and the injury that might result thereto. The
question resolves itself into a factual determination with respect
to tl:e circum~,tancea prevailing. The rule in Virginia is well
,~ettled and follov~a the Coniston La~w Rule ~ubject to the qualification
herein recited.

1952, at ll:00 o'clock a.m., at its meeting room at Chesterfield Courthouse
take under consideration the rezoning of the following properties in
Chesterfield County:
In M~uchestor Hegisterial District, s parcel of land beginning
162 feet west of Rt. 1673, lying 355 feet on the south side of

WHEREAS, the General Assembly of Virginia by Chapter 15 of the Acts of
Assembly, 1927 and amendments thereto which is contained in the 1950 Code of Virginia
as Sec. 15-855 authorized the board of supervisors of certain counties to divide
areas of said counties in districts and to adopt a zoning ordinance; and
WHEREAS, Chesterfield County did on December 11, 1945 adopt a zoning
ordinance under the statute; and
WNEREAS, the General Assembly of Virginia did provide in Chapter 595 of the
Acts of Assembly, 1952 that any county in the State that has adopted a zoning ordi-
nance as provided for in Sec. 15-855 of the Code of Virginia may appoint a planning
commission to assist it in the administration of the zoning ordinance and other
matters concerning the growth and development of the county and to provide by ordi-
nance where deemed necessary for the powers and duties of such planning commission;
and
WHEREAS, the board of supervisors of Chesterfield County has considered
the matter of appointing a planning commission and deems it wise so to do;
NOW, THEREFORE, upon motion of be it resolved that a
planning commission be appointed to assist the board of supervisors of Chesterfield
County in the administration of the zoning ordinance and other matters affecting the
growth and development of the county; and
BE 1T FURTHER RESOLVED, that in addition to a member of the board of super-
visors and the executive secretary to the board of supervisors as provided in the
law, the ~h~l~appoint seven ~eminent residents of the county of Chester-
field to serve without compensation for terms coincident with the board of super-
visors now in office or until their successors have been appointed.
AN ORDINANCE
TO define the authorities and duties of a planning commission appointed by the board
of supervisors of Chesterfield County.
WHEREAS, it is provided by an act of General Assembly of Virginia, approved
April 3, 1952 (Chapter 595, Acts of 1952) that any county that has adopted a zoning
ordinance as provided by Chapter 15 of the Acts of 1927, as amended, may appoint a
planning commission and by ordinance define its powers and duties; and
WHEREAS, the board of supervisors of Chesterfield County has appointed a
planning commission under this act;
NOW, THEREFORE, be it ordained by the board of supervisors of Chesterfield
County, Virginia as follows:
Section 1. The county planning commission is authorized to appoint from
its membership an executive committee, consisting of the chairman and not less than
four other members, which committee may exercise between meetings of the comnission
all powers of the commission, or such powers as the commission determines.
Section 2. County planning commission - organization, rules, staff and
finances.--The county planning commission shall elect from amongst the appointive
members a chairman, whose term shall be for one year with eligibility for reelection,
and the commission may create and fill such other offices as it may determine. It
shall have the power and authority to appoint such employees and staff as it may deem
necessary for its work, and may contract with planners and other consultants for such
services as it may require. The expenditures of the commission, exclusive of gifts,
shall be within the amounts appropriated for the purpose by the county beard of super-
visors.
The commission shall adopt rules for transaction of business and shall keep
a record of its resolutions, transactions, findings, and determinations, which record
shall be a public record. Upon request of the commission, the county board of super-
visors, or other county officials or the chief executive officer of any municipality
may, from time to time, for the purpose of special ~urveys under the direction of the
planning commission, assign or detail to the commission any members of staffs of
eo~nty or municipal administrative departments, or may direct any such department to
~'~e for the commission special surveys, or studies requested by the commission.
Section 3. County master plan.~It shall be the function and duty of a
county planning commission to make and adopt a master plan for the physical develop-
ment of the unincorporated territory of the county. Any such plan may include the
planning of incorporated towns to the extent to which, in the commission's Judgment,
they are related to the planning of the unincorporated territory or of the county as
a whole, provided, however, the plan shall not be considered as a master plan for any
incorporated to~s without the consent of the planning commission and council of said
incorporated town, and further provided that the county plan shall be coordinated
with the plans of the State Department of Highways, insofar as it relates to highways
or thoroughfares under the jurisdiction of that department.
The master plan of a county, with the accompanying maps, plates, charts,
and descriptive and explanatory matter, shall show the county planning commission's
recommendations for the development of the territory covered by the plan, and may in-
clude, among other things, the general location, character, 'and extent of streets or
roads, viaducts, bridges, waterways, and waterfront developments, parkways, play-
grounds, places and spaces; the general location and extent of publicly owned utili-
ties and terminals, and other purposes; the acceptance, widening, removal, extension,
relocation, narrowing, vacation, abandonment, or change of use of any of the fore-
going public ~Tays, grounds, places, spaces, buildings, properties, utilities or termi-
nals; the general character, location and extent of community centers, town sites or
housing developments; the general location and extent of forests, agricultural areas,
and open-development areas for purposes of conservation, food and water supply, sani-
tary and drainage facilities, or the protection of urban development; a land-classifi-
cation and utilization program; the distribution of population, and the uses of land
for trade, industry, habitation,

Section 4. General purposes of the plan.--In the preparation of a county
master plan, a county planning commission shall make careful and comprehensive sur-
veys and studies of the existing conditions and probably future changes of said con-
ditions within the territory under its jurisdiction. The county master plan shall_ be
made with the general purpose of guiding and accomplishing a coordinated, adjusted
and harmonious development of the county which will, in accordance with present and
future needs and resources, best promote the health, safety, morals, order, conveni-
ence, prosperity, or the general welfare of the inhabitants, as well as efficiency
and economy in the process of development, including amongst other things, such dis-
tribution of population~and of the uses of land for urbanization, trade, industry,
habitation, recreation, agriculture, forestry and other purposes, as will tend to
create conditions favorable to health, safety, transportation, prosperity, civic
activities, .and recreational, educational, and cultural opportunities; will tend to
reduce the wastes of physical, financial, or human resources which result from either
excessive congestion or excessive scattering of population; and will tend toward an
efficient and economic utilization, conservation, and production of the supply of
food and water, and of drainage, sanitary, and other facilities and resources.
Section 5. Adoption of master plan.mA county planning commission may
adopt the county master plan as a whole by a single resolution, or, as the work of
making the whole master plan progresses, may from time to time adopt a part of parts
thereof, any such part to correspond generally with one or more of the functional
subdivisions of the subject matter which may be included in the plan. The commission
may from time to time amend, extend, or add to the plan, or carry any part of it into
greater detail. The adoption of the plan or any part, amendment, extension or addi-
tion shall be by resolution carried by the affirmative votes of not less than a majo-
rity of the entire membership of the commission. The resolution shall refer expressly
to the maps and descriptive matter intended by the commission to form the whole or
part of the plan, and the action taken shall be recorded on the map or maps and des-
criptive matter by the identifying signature of the secretary of the commission.
Section 6. Certification of plan to counties and m~nicipalities and sub-
sequent adoption by municipalities.--The county planning commission shall certify a
copy of its master plan or an adopted part or amendment thereof or addition thereto
to the board of supervisors of the county. The county planning commission shall
certify such copies to the planning co~issions of all incorporated to,ms within the
county. Any planning commission of an incorporated town which receives any such
certification may adopt so much of the plan, part, amendment, or addition as falls
~ithin the territory of the town as a part or amendment of or addition to the master
plan of said town, and when so adopted it shall have the same force and effect as
though made and prepared, as well as adopted, by a planning commission of such town.
Section 7. Miscellaneous powers of the commission.mit shall be the fur-
ther duty of a county planning commission to promote the cooperation of the planning
commissions of any incorporated towns within the county and coordination of the plans
of such towns and the coordination of such plans ~[th the county plan, and generally
to confer with and advise town and county executive and legislative officials for the
purpose of promoting a coordinated and adjusted development of the county. Any such
commission may also advise county commissioner with respect to the formulation of
public improvement programs and the financing thereof.
Ail public officials shall, upon request, furnish to the commission, within
a reasonable time, such available information as it may require for its work. The
members and employees of the commission, in the performance of its functions, may
enter upon any land and make examinations and surveys and place and maintain necessary
monuments and marks thereon. In general, the commission shall have such powers as may
be necessary for it to perform its functions and to promote county or regional plan-.
ning.
Section 8. Legal status of plan--Whenever any county planning commission
shall have adopted a master plan of the county or any part thereof, and said master
plan or part thereof shall have been approved by the board of supervisors of such
county, then and thenceforth no road, park, or other public way, public ground, or
public space, no public building or structure, or no public utility, whether publicly
or privately o~med, shall be constructed or authorized in the unincorporated terri-
tory of the county or region until and unless the proposed location and extent there-
of shall have been submitted to and approved by such county planning commission;
provided, ho~Tever, that in case of disapproval, the commission shall communicate its
reasons for disapproval to the board of supervisors of the county in which the public
way, public ground, public space, public building, public structure, or public
utility is proposed to be located; and such board shall have the power to overrule
such disapproval, and upon such overruling said board or other official in charge of
the proposed construction or authorization may proceed therewith. The failure of the
commission to act with thirty days from and after the date of official submission to
it shall be deemed approval, unless a longer period be granted by the submitting
board, body or official.
Section 9. Cooperation ~rith the State Division of Planning and Economic
Development. It shall be permissible for the county planning commission to cooperate
with the State Division of Planning and Economic Development in the preparation of so
much of State-wide plans as may affect the county under the jurisdiction of said
county planning commission. It shall also be the duty of the county planning commis-
sion to file with the State Division of Planning and Economic Development copies of
all surveys, reports and master maps conducted or prepared by said commission.
~ Section tO. Definitions.mFor the purpose of this ordinance, "unincorpora-
ted'' means situated outside of cities, and incorporated towns. "Incorporated," con-
sequently, means situated within cities and incorporated towns. The term "municipa-
lity' "municipalities," or "municipal" includes or relates to cities and incorporated

close all such openings in a neat and workmanlike manner. In case of openings in stucco or asbestos shingles, it is sometimes im-
possible to match perfectly the color of the old stucco or asbestos shingles, and the Company will not be responsible in case of its
inability to do so.
(B) The Company shall not be responsible for damage or delay due to strikes, fires, accidents, or other causes beyond its
reasonable control. The Company carries Workman's Compensation and Public Liability insurance, but does not assume risks of
any character under this contract other than covered by such insurance.

To help you keep your Burroughs equipment in satisfactory and efficient operation, as weft as to extend the perlod of its
usefulness, Burroughs Adding Machine Company, upon your acceptance hereon in writing, will render mechanical service on
your premises where the Burroughs equipment is located, consisting of mechanical adjustments and the furnishing of such
replacement parts as may be necessary to complete such adjustments on said equipment hereinafter described, subject to
the following terms:
Services Rendered by Burroughs. Forthe purpose of mlalmlzing mechanical
interruptions, authorized Burroughs Servlcemen will inspect, clean, oil and adiust
the eqdpment at least once during each semiannual Inspection period; and If
Burroughs should fail to so servlce said equipment, proper adjustment of charges
will be made.
If mechanical service on this equipment is required in the user's office between
inspections, no extra charge will be made for such service.
Burroughs. ribbons supplied by the Company at its established prices will be
attached free of charge by the Company's ser~cemon whenever he is present
for the purpose of rendering other service hereunder, but an appropHote charge
