The Board deferred the policy again at its December 17, 2003, meeting at the request of staff to afford additional time to address the impact to older existing subdivisions when connections are req~_ired. Staff examined many different ways to describe how such decisions could be made but in the final analysis was unable to develop criteria that would not be subject to reasonable debate over their application and which would clearly lead to the same conclusion. Staff is of the opinion that including such divisive criteria in the policy would lead to further debate rather than serve to facilitate logical resolution of when connections should be made. Staff, therefore, recommends the Board adopt the policy as presented (it is generally as recommended by the Planning Commission except for minor clarifications) and recognizes that occasionally due to unique circumstances some connections should not be made when the resulting detriment to the overall character of the area and quality of life is of greater consequence than the resulting benefit to the health, safety and welfare of the community. Attachment A CHESTERFIELD COUNTY RESIDENTIAL SUBDIVISION CONNECTIVITY POLICY Purpose The purpose of street interconnectivity shall be to (a) improve public safety response time to residents by providing multiple means of access; (b) reduce travel time and distance between neighborhoods by providing alternative travel paths; (c) maintain an acceptable quality of life in the residential neighborhoods by preventing excessive through traffic on local streets where individual lots have direct access onto the street; and (d) maintain the traffic carrying capacity of arterial and collector streets. Standards 1. New streets shall be stubbed to undeveloped land unless an evaluation of the adjacent property at the time of tentative subdivision plat review determines that: (a) the undeveloped property at that location has development constraints such as but not limited to, wetlands, topographic features, size, etc; (b) a through street is not required to conform to access requirements in the Subdivision Ordinance; (c) the street connection creates a violation of the Planning Commission's Stub Road Policy; or (d) the connection would provide sole access to non-residential property. 2. Streets in new subdivisions shall connect to all adjacent stubs unless the resultant local street pattern would create a traffic count that exceeds the Planning Commission's Stub Road Policy. Cor~nection to a stub street within a subdivision that complies with street access requirements as specified in Section 17-76 (h) of the Subdivision Ordinance may be waived if: (a) there are a sufficient number of other stub streets to adequately disperse the traffic and not cause a concentrated use of any one stub street connection; or (b) the connection to a particular stub will cause a concentrated traffic at that location. 3. Subdivision design shall facilitate interconnectivity within its limits through the layout of the overall street network. The design concept of solely using multiple unconnected cul de sacs shall be evaluated and approved based upon circulation, topographic and environmental constraints. The following table depicts the recommended guidelines for spacing of through streets to facilitate travel through residential areas. The subdivider shall initially install and maintain thorough the life of the project signs(s) on all stub roads. The purpose of such signs shall be to advise the public that the extension of the stub is planned. Applicability This policy shall apply to any zoning case filed or any tentative subdivision plat that receives approval after (INSERT DATE). Any property that received zoning or tentative subdivision plat approval prior to the effective date of this policy and has conditions that conflict with provisions of this policy shall be governed by those conditions. Subject: Advertisement of Tax Rates for the FY2005 and FY2006 Biennial Financial Plan and Set Public Hearings County Administrator's Comments: County Administrator: Board Action Requested: Authorize Advertisement of Tax Rates, the Proposed ~Y2005 and FY2006 Biennial Financial Plan, Proposed FY2005-FY2010 CaLDi tal Improvement Program, Proposed FY2005 Community Development Block ~rant Program, and other ordinance changes and set public hearings for March 24, 2004 for these items as outlined below. Summary of Information: Public hearings are scheduled for March 24, 2004 on proposed tax rates, the Proposed FY2005 and FY2006 Biennial Financial Plan, the Proposed FY2005- FY2010 Capital Improvement Program, the Proposed FY2005 Community Development Block Grant Program, and other 0r ~inance changes. Advertisement requirements differ depending on the item- The County Administrator's FY2005 and FY2006 Proposed Biennial Financial Plan will include a recommendation for an increase in the following revenues to cover the cost of services. Fees Requiring A Public Hearing and Ordinance Amendment Treasurer Fee Chanqes: The Proposed Biennial Financial Plan includes a recommendation to implement an increase in the administrative fee from $20 to $30 for collection of delinquent taxes and other charges and in the administrative fee from $25 to $30 if taxes are collected after judgement. These fees only apply in collection cases (primarily tax liens) where the taxpayer is unresponsive. This occurs in less than 1% of all taxpayers affected by this fee. The Treasurer's cost to pursue such cases exceeds $40 per case. This increase is expected to generate an additional $35,000 per year and will be used to help offset postage costs in the Treasurer's Office. Buildinq Inspection Fee Chanqes: The proposed fee increases will fund additional staff for the Building Inspection Department. Three positions in the inspections area will help address workload (both the volume and complexity of plax~s have increased) as well as maintain quality and timely inspections. One additional residential plans reviewer will assist with the workload and allow for a reasonable plan review turnaround time. The proposed ix%creases will also fund technology enhancements to expedite the inspection process for customers. Residential inspection fees are proposed to increase aploroximately $5 per inspection and will increase a typical single family dwelling permit from $840 to approximately $945. The commercial fees are proposed to increase ~Droportionally by approximately 12%. The last commercial fee increase was in 1998 and was used to fund 2 Fire Department plans review positions. Fee Adjustments Not Requiring A Public Hearing Waste and Resource Recovery Proposed Fees: The proposed user fee changes will move toward the approach of a "pay as you throw" system and will eliminate citizens paying f0L- programs in which they do not participate. It is believed that the recommended fee increases will promote private sector competition particularly in the leaf collection and refuse collection service areas. Currently the general fund subsidizes 00OO&7 CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 4 the costs of these services and thereby creates an artificially low price for leaf and refuse collection making it more difficult for the private sector to compete. The recommended fee increases sl~ould not have a significant impact on most citizens who typically use only one or two of the programs regularly. The curbside recycling program that is offered to all county homes will continue to be a free service. In addition, the citizens that qualify for tax relief will continue to receive the leaf vacuum, refuse collection, and bagged leaf services free of charge. These fee increases will help to create a self-supp0rting waste program that will cover an estimated 88% (excluding curbside recycling and the household hazardous waste prograras) of projected expenditures in FY2005 and 97% in FY2006. These increases will generate approximately $1.5 million to help offset general fund costs. These fees are not governed by an ordinance; and therefore, adjustments do not require a ~Dublic hearing. Fee imposed for collecting delinquent taxes. Any person who fails to pay taxes or other charges to the county when due shall be charged a delinquent collection fee. The delinquent collection fee shall consist of administrative costs, attorney's fees, and collection agency fees. Administrative costs shall be: (1) Thirty ~ dollars ($20.00 30.00) if the treasurer collects subsequent to 30 or more days after notice of delinquent taxes or other delinquent charges but prior to judgment; and (2) Thirty ~ dollars ($25.00 30.00) if the treasurer collects the taxes or other charges after judgment. Attorney's fees and collection agency fees shall not exceed 20 percent of the taxes or other charges collected. Summary of Information: During the construction of improvements to the digesters at FCWWTP, it was necessary to remove the floating covers from the digesters. These 60' diameter circular covers consist of a steel structural frame covered on both top and bottom by steel plate. Once the covers were removed, significant corrosion was observed that compromises the structural integrity of the covers. This corrosion could not be observed while the covers were in place due to the nature of the assembly of the digester unit. After consultation with our consultant, R. Stuart Royer, and the cover manufacturer, it was determined that the covers must be replaced to assure future operation of the units and to assure rated capacity of the plant is protsected. The cost of replacing these covers is $466,318.00. The amount remaining in the project budget is $194, 600.00. The Board is therefore requested to authorize the transfer of $325,000 from 89-8601, Sewer Facilities Reh~Lb to 00-0126, FCWWTP Digester Equipment, and to authorize the County Administrator to approve a Change Order to the contractor, English Construction Company, in the amount of $466,318.00. This project will continue to proceed with available lease/purchase proceeds and other funding sources. As a result, the issuance of Certificates of Participation is scheduled for March 2004 to finance the County Jail Replacement, the Community Development Building, the Emergency Systems Integration Project, the Chester House Rehabilitative Facility, and Airport Hangar Space at the Chesterfield County Airport. This item requests that the Board set a public hearing date of March 10, 2004 to consider the approval of a ground lease of real property which encompasses the Community Development Building site at the Chesterfield County Government Complex, the Chester House Rehabilitative Facility site at 11814 Chester Road, and Airport Hangar Space at the Chesterfield County Airport. Section 15.2-1800 of the Code of Virginia, 1950, requires that a public hearing be held prior to the leasing of real property owned by the County. With respect to the County Jail site at the Chesterfield County Government Complex, a ground lease for this site was executed as part of Certificates of Participation financing in 2003. Summary of Information: The Virginia Department of Transportation (VDOT) Enhancement Program is intended to creatively integrate transportation facilities into the surrounding communities and the natural environment. Projects eligible for funding include pedestrian and bicycle facilities, pedestrian and bicycle educational/safety activities, scenic easement, historic site acquisition, scenic/historic highway programs, landscaping, historic preservation, rehabilitation of historic transportation buildings, preservation of abandoned railroad corridors, control/removal of outdoor advertising, archaeological planning and research, mitigation of water pollution and wildlife protection, and establishment of transportation museums. It is estimated that a $16 million enhancement fund will be available statewide this year for VDOT to carry out the program. Transportation Enhancement Projects are financed with 80% VDOT funds and a minimum 20% local match. The local match is usually provided from County funds, from others and/or by in- kind contributions. VDOT staff will evaluate project applications and make a recommendation to the Commonwealth Transportation Board for inclusion in the FY05-FY10 Virginia Transportation Six-Year Program. (h) This Board deems it advisable and in the best interest of the County to authorize and provide for the issuance, sale and delivery pursuant to such Article 5 of the Public Finance Act of 1991 (Sections 15.2-2643 through 15.2-2649, both inclusive, of the Code of Virginia, 1950, as now in effect) of an issue of General Obligation Public Improvement Refunding Bonds, Series of 2004, for the purpose of refunding in ad'vance of their stated maturities all or a portion of the Refunded Bonds. SECTION2. Authorization of General Obligation Public Improvement Refunding Bonds. For the purpose of refunding in advance of their stated maturities all or a portion of the bonds described in Section 1, there are hereby authorized to be issued, sold and -3- delivered an issue of general obligation public improvement refunding bonds of the County in a principal amount not exceeding $80,000,000 to be designated and known as "General Obligation Public Improvement Refunding Bonds, Series of 2004" (the "Bonds"). The Bonds are to be issued pursuant to the provisions of Chapter 26 of Title 15.2 of the Code of Virginia, 1950 (the same being the Public Finance Act of 1991). SECTION 3. Approval of the Details and Sale of the Bonds. (a) The Bonds shall be dated such date and shall bear interest from their date payable on such date and semiannually thereafter, as shall be determined by the County Administrator. The Bonds shall mature and become due and payable on such date or dates not exceeding twenty (20) years from their date and in such principal amounts on each such date as shall be determined by the County Administrator. (b) (i) The Bonds shall be issued only in fully registered form. One Bond representing each maturity of the Bonds will be issued to and registered in the name of Cede & Co., as nominee of The Depository Trust Company, New York, New York ("DTC"), or in the name of such other nominee of DTC as may be requested by an authorized representative of DTC, as registered owner of the Bonds, and each such Bond shall be immobilized in the custody of DTC. DTC will act as securities depository for the Bonds. Individual purchases will be made in book-entry form only, in the principal amount of $5,000 or any integral multiple thereof. Purchasers will not receive physical delivery of certificates representing their interests in the Bonds purchased. (ii) Principal and interest payments on the Bonds will be made by the County by wire transfer to DTC or its nominee, Cede & Co., or such other nominee of DTC, as registered owner of the Bonds, which will in turn remit such payments to the DTC participants for subsequent disbursal to the beneficial owners of the Bonds. Transfers of principal and interest payments to DTC participants will be the responsibility of DTC. Transfers of such payments to beneficial owners of the Bonds by DTC participants will be the responsibility of such participants and other nominees of such beneficial owners. Transfers of ownership interests in the Bonds will be accomplished by book entries made by DTC and, in turn, by the DTC participants who act on behalf of the indirect participants of DTC and the beneficial owners of the Bonds. (iii) The County will not be responsible or liable for sending transaction statements or for maintaining, supervising or reviewing records maintained by DTC, its participants or persons acting through such participants or for transmitting payments to, communicating with, notifying, or otherwise dealing with any beneficial owner of the Bonds. So long as the Bonds are in book-entry only form, the County Treasurer will serve as Registrar and Paying Agent for the Bonds. The County reserves the right to designate a successor Registrar and Paying Agent for the Bonds if the Bonds at any time cease to be in book-entry only form. (c) The Bonds shall be subject to redemption at the option of the County prior to their stated maturities, in whole or in part at any time, on such dates and with such redemption premiums, if any, as shall be determined by the County Administrator. 0001; 9 444512.3 027031 RES -4- (d) In accordance with and subject to the provisions of the Detailed Notice of Sale of the Bonds, bidders may provide that all the Bonds shall be issued as serial Bonds or may provide that any two or more consecutive annual principal amounts shall be combined into one or more term Bonds. If the successful bidder designates principal amounts to be combined into one or more term Bonds, each such term Bond shall be subject to mandatory sinking fund redemption commencing on such date in the first year which has been combined to form such term Bond and continuing on such date in each year thereafter until the stated maturity date of that term Bond. The amount redeemed in any year shall be equal to the principal amount of serial Bonds that would otherwise have matured in such year. Bonds to be redeemed in any year by mandatory sinking fund redemption shall be redeemed at par and shall be selected by lot from among the Bonds then subject to redemption. The County, at its option, may credit against any mandatory sinking fund redemption requirement term Bonds of the maturity then subject to redemption which have been purchased and cancelled by the County or which have been redeemed and not theretofore applied as a credit against any mandatory sinking fund redemption requirement. (e) If any Bond (or any portion of the principal amount thereof in installments of $5,000) shall be subject to redemption and shall be called for redemption, notice of the redemption thereof, specifying the date, number and maturity of such Bond, the date and place or places fixed for its redemption and if less than the entire principal amount of such Bond is to be redeemed, that such Bond must be surrendered in exchange for the principal amount thereof to be redeemed and a new Bond or Bonds issued equalling in principal amount that portion of the principal amount thereof not to be redeemed, shall be mailed not less than thirty (30) days prior to the date fixed for redemption by first class mail, postage prepaid, to the registered owner of such Bond at his address as it appears on the books of registry kept by the Registrar for the Bonds. The Registrar shall not be required to exchange or transfer any Bond later than the close of business on the forty-fifth (45th) day next preceding the date fixed for redemption of such Bond or any portion thereof. If notice of the redemption of any Bond shall have been given as aforesaid, and payment of the principal amount of such Bond (or the portion of the principal amount thereof to be redeemed) and of the accrued interest payable upon such redemption shall have been duly made or provided for, interest on such Bond shall cease to accrue from and after the date so specified for redemption thereof. So long as the Bonds of any series are in book- entry only form, any notice of redemption will be given only to DTC or its nominee. The County shall not be responsible for providing any beneficial owner of the Bonds with notice of redemption. SECTION 4. Appointment of County Treasurer as Registrar and Paying Agentg Payment of Bonds; Books of Registry; Exchanges and Transfers of Bonds. (a) Appointment of Registrar and Paying Agent. The County Treasurer is hereby appointed Registrar and Paying Agent for the Bonds (hereinafter referred to as the "Registrar"). (b) Payment of Bonds. (i) At any time during which the Bonds shall be in fully registered form, the interest on the Bonds shall be payable by check mailed by the Registrar to the registered owners of the Bonds at their addresses as the same appear on the books of registry as of the record date for the payment of interest on the Bonds, and the principal of the Bonds shall be payable at the office of the Registrar; provided, however, that so long as the O00l.,.qO 444512.3 027031 RES -5- Bonds are in book-entry only form and registered in the name of Cede & Co., as nominee of DTC, or in the name of such other nominee of DTC as may be requested by an authorized representative of DTC, interest on the Bonds shall be paid directly to Cede & Co. or such other nominee of DTC by wire transfer. (ii) At any time during which the Bonds shall be in book-entry form, the principal of and interest on the Bonds shall be payable in accordance ,with the arrangements made with the depository for the Bonds. (iii) The principal of and interest on the Bonds shall be payable in such coin or currency of the United States of America as at the respective dates of payment is legal tender for public and private debts. Interest on the Bonds shall be calculated on the basis of a 360-day year consisting of twelve 30-day months. (c) Books of Registry; Exchanges and Transfers of Bonds. (i) At all times during which any Bond remains outstanding and unpaid, the Registrar shall keep or cause to be kept at its office, books of registry for the registration, exchange and transfer of the Bonds. Upon presentation at the office of the Registrar for such purpose, the Registrar, under such reasonable regulations as it may prescribe, shall register, exchange, transfer, or cause to be registered, exchanged or transferred, on the books of registry the Bonds as herein set forth. (ii) Any Bond may be exchanged at the office of the Registrar for a like aggregate principal amount of such Bonds in other authorized principal amounts of the same interest rate and maturity. (iii) Any Bond may, in accordance with its terms, be transferred upon the books of registry by the person in whose name it is registered, in person or by his duly authorized agent, upon surrender of such Bond to the Registrar for cancellation, accompanied by a written instrument of transfer duly executed by the registered owner in person or his duly authorized agent, in form satisfactory to the Registrar. (iv) All transfers or exchanges pursuant to this Section 4(c) shall be made without expense to the registered owners of the Bonds, except as otherwise herein provided, and except that the Registrar shall require the payment by the registered owner of any Bond requesting such transfer or exchange of any tax or other governmental charges required to be paid with respect to such transfer or exchange. All Bonds surrendered pursuant to this Section 4(c) shall be cancelled. SECTION 5. Execution and Authentication of Bonds; CUSIP Identification Numbers. (a) Execution of Bonds. The Bonds shall be executed in the name of the County by the manual or facsimile signatures of the Chairman and the Clerk of the Board of Supervisors, and the corporate seal of the Board of Supervisors shall be impressed, or a facsimile thereof printed, on the Bonds. (b) Authentication of Bonds. The County Administrator shall direct the Registrar to authenticate the Bonds and no Bonds shall be valid or obligatory for any purpose unless and until the certificate of authentication endorsed on such Bond shall have been manually 000 .3 . ~.~d512.3 027031 RES -6- executed by the Registrar. Upon the authentication of any Bond the Registrar shall insert in the certificate of authentication the date as of which such Bond is authenticated as follows: (i) if the Bond is authenticated prior to the first interest payment date, the certificate shall be dated as of the date the Bonds are delivered to and paid for by the initial purchasers thereof, (ii) if the Bond is authenticated upon an interest payment date, the certificate shall be dated as of such interest payment date, (iii) if the Bond is authenticated on or after the record date for the payment of interest on the Bonds and prior to such interest payment date, the certificate shall be dated as of such interest payment date and (iv) in all other instances the certificate shall be dated the date upon which the Bond is authenticated. The execution and authentication of the Bonds in the manner above set forth is adopted as a due and sufficient authentication of the Bonds. (c) CUSIP Identification Numbers. CUSIP identification numbers may be printed on the Bonds, but neither the failure to print any such number on any Bonds, nor any error or omission with respect thereto, shall constitute cause for failure or refusal by the successful bidder for the Bonds to accept delivery of and pay for the Bonds in accordance with the terms of its bid to purchase the Bonds. No such number shall constitute or be deemed to be a part of any Bond or a part of the contract evidenced thereby and no liability shall attach to the County or any of its officers or agents because of or on account of any such number or any use made thereof. SECTION 6. Tax Covenant. The County covenants and agrees to comply with the provisions of Sections 103 and 141-150 of the Internal Revenue Code of 1986 and the applicable Treasury Regulations promulgated thereunder throughout the term of the Bonds. SECTION 7. Sources of Payment of Bonds. The full faith and credit of the County shall be and is hereby irrevocably pledged to the punctual payment of the principal of and interest on the Bonds as the same become due. In each year while the Bonds, or any of them, are outstanding and unpaid, the Board of Supervisors is authorized and required to levy and collect annually, at the same time and in the same manner as other taxes in the County are assessed, levied and collected, a tax upon all taxable property within the County, over and above all other taxes, authorized or limited by law and without limitation as to rate or amount, sufficient to pay when due the principal of and interest on the Bonds to the extent other funds of the County are not lawfully available and appropriated for such purpose. SECTION 8. Form of Bonds. The Bonds shall be in substantially the form set forth in Exhibit A with such necessary or appropriate variations, omissions and insertions as are incidental to their numbers, interest rates and maturities or as are otherwise permitted or required by law or this resolution. SECTION 9. Preparation and Distribution of Preliminary Official Statement and Preparation, Execution and Delivery of Official Statement; Preliminary Official Statement "Deemed Final" for Purposes of Securities and Exchange Commission Rule 15c2-12. (c) The County Administrator is hereby authorized to execute and deliver to the representative of the purchasers of the Bonds the final Official Statement relating to the Bonds in accordance with the provisions of the Detailed Notice of Sale relating to the Bonds. (d) The Preliminary Official Statement shall be "deemed final" as of its date for purposes of Rule 15c2-12 promulgated by the Securities and Exchange Commission pursuant to the Securities Exchange Act of 1934 ("Rule 15c2-12") except for the omission of information permitted to be omitted by Rule 15c2-12. The County Administrator is hereby authorized to execute and deliver to the representative of the purchasers of the Bonds a certificate dated the date of the Preliminary Official Statement stating that the Preliminary Official Statement is deemed final by the County for purposes of Rule 15c2-12 as of its date. SECTION 10. Sale of Bonds. (a) There is hereby delegated to the County Administrator authority, without further action by the Board of Supervisors, to sell the Bonds authorized for issuance under this resolution in accordance with the provisions hereof at competitive sale at such price, plus accrued interest thereon from their date to the date of delivery thereof and payment therefor, and on such other terms and conditions as shall be provided in the Detailed Notice of Sale relating to the Bonds. Subject: Public Hearing to Consider the Effects of MtBE on the County's Public Water Supply County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to consider the staff recommendations attached to the item as Exhibit A. Summary of Information: In response to concerns raised by Mr. Richard Page, a County citizen, staff reported to the Board on November 12 the status of MtBE levels in Lake Chesdin and the potential health impacts of MtBE. During that meeting, Mr. Page reiterated his concerns to the Board and requested that the Board consider banning ~two-stroke" engines, some of which expel small amounts of MtBE, from operating on Lake Chesdin. In response to those concerns, the Board scheduled a public hearing and requested staff to prepare a report and recommend what action, if any, the Board should take with regard to MtBE. Recommendations and a report are attached. MtBE is a gasoline additive, which has been used in recent years to decrease air pollution. While it has been successful in reducing air pollution, it has, itself, become a water pollutant when present in significant quantities. The United States EPA is studying the effects of MtBE and has established an advisory level of between 20-40 parts per billion as a level at which the substance can be tasted and smelled, but the EPA has not yet established a level for MtBE that would represent a health concern. A small number of states have established their own acceptable MtBE levels for health purposes, which range betweenl3 parts per billion and 200 parts per billion. Quarterly testing at Lake Chesdin, which has been performed since 1998, has never produced an MtBE level in treated drinking water any higher than eight parts per billion, and over the past two years, testing has not revealed MtBE at a level high enough to be detected, which means its level has been below five parts per billion. Micas, County Attorney ~ February 18, 2004 Regulation of Motorboats on Lake Chesdin In conjunction with the February 25, 2004 public hearing on the effects of MtBE on the County's water supply, I am writing to explain the options available for regulating the use of motorboats with "two-stroke" engines, which expel MtBE on Lake Chesdin. Authority of the Appomattox River Water Authority (ARWA). The land on which the water of Lake Chesdin is impounded is owned by ARWA. ARWA has the inherent authority to regulate recreational activity on the Lake and may prohibit the use of motorboats with "two- stroke" engines from being used on the Lake through the use of criminal trespass laws. Although a number of landowners have been granted license agreements which allow them to build docks and engage in recreational boating activity on the Lake, those agreements do not preclude ARWA from prohibiting a certain type of boat, such as motorboats using "two-stroke" engines, from being used on the Lake. Authority of the County. Counties have statutory authority to adopt regulations to prevent water pollution on water sources which they own, operate and control. Va. Code § 15.2- 2109. However, since the County does not own, operate or control Lake Chesdin, the Board does not have independent authority to adopt regulations prohibiting the operation of motorboats using "two-stroke" engines on Lake Chesdin. However, the restriction would only go into effect if DGIF chose to adopt it, and we can expect DGIF to consider strongly the views of ARWA since it is the owner of the Lake. 0505:64357.1 000186 Report on Methyl Tertiary Butyl Ether (MtBE) February 2004 Department of Health Office of Water Quality 000:1.87 Executive Summary The Board has asked staff to review the potential implications upon the County's water supply of the existence of methyl tertiary butyl ether (MtBE) in Lake Chesdin. The Office of Water Quality and the Department of Health have worked together on this effort and have developed the findings listed below. Findings Current levels of MtBE in both Lake Chesdin and Swift Creek Reservoir are below the Environmental Protection Agency's Drinking Water Advisory (for taste and odor) of 20 to 40 parts per billion. Since Appomattox River Water Authority began testing treated drinking water in 1998, all MtBE test results of treated drinking water have been below 10 parts per billion. EPA has not established a drinking water standard for MtBE, but has placed the substance on a list of candidate contaminants. By so doing, major public water suppliers are now required to conduct monitoring for MtBE and report the results to EPA. Both the Swift Creek Water Treatment Plant and the Appomattox River Water Authority have complied with this requirement. In the absence of an EPA standard for MtBE, many states have adopted their own statewide standards. Some states have chosen to adopt drinking water standards for MtBE, while others have established a groundwater standard used to determine the level of clean up required from gasoline leaks. Both types of standards are enforceable. Still other states have adopted advisory or guidance levels for MtBE. The primary basis for such standards has been new or existing health risk studies. The levels of MtBE found in tests on treated drinking water conducted by Appomattox River Water Authority have been lower than the levels established by any state as a health risk for MtBE. } A review of the scientific literature on the human health effects of MtBE indicates that there is no clear consensus that is related to specific health effects. O00 L SS Report on MtBE I. Background As requested by the Board of Supervisors, staff conducted research on Methyl Tertiary Butyl Ether (MtBE), an oxygenate found in gasoline. Concern was raised about the potential health effects of the existence of MtBE in Lake Chesdin, which serves as one of the County's principle sources of drinking water. This concern prompted a citizen to request the County to recommend that the Appomattox River Water Authority eliminate watercraft with two-stroke engines on Lake Chesdin. Office of Water Quality (OWQ) staff inventoried other states to determine what, if any, standards have been established for MtBE and the basis for those standards. OWQ staff also reviewed data compiled by the Appomattox River Water Authority (ARWA) on concentrations of MtBE in Lake Chesdin. At the same time, the Health Department reviewed the findings of several scientific organizations on the potential human health impacts of MtBE. The result of this combined research is presented in this report. II. History of the Use and Regulation of MtBE Amendments to the Clean Air Act, promulgated in 1990, required that "reformulated gasoline" contain at least two-percent oxygen. The addition of oxygen results in cleaner burning fuel and has significantly reduced carbon monoxide and ozone emissions. While there are a number of products that oxygenate gasoline, the one that has been used the most is MtBE. The other major alternative oxygenate is ethanol. During the past several years, a growing number of water- monitoring studies have detected MtBE in both ground and surface water sources. Due to rising concern about potential health risks, the Environmental Protection Agency (EPA) has taken several actions. In 1997, EPA issued a Drinking Water Advisory that stated, "concentrations of MtBE in the range of 20 to 40 parts per billion (ppb) of water or below will probably not cause unpleasant taste and odor for most people." This Advisory remains in place to date. In 1998, MtBE was placed on the EPA Candidate Contaminant List. This action required major public water suppliers to conduct sampling to determine levels of MtBE in their supplies and to submit the data to the EPA. This nationwide sampling effort was conducted between January 2001 through December 2003, and the EPA is currently analyzing the information. EPA is also in the process of finalizing a detailed Health Risk Assessment of MtBE. This report will contain recommendations as to the level at which MtBE poses a human health threat, but will not be completed until the end of 2004. EPA will use the results of the nationwide sampling of MtBE and the Health Risk Assessment to determine whether or not to establish a drinking water standard for the substance. If the agency determines to regulate MtBE, the earliest the standard will be finalized, based on the formal regulatory process, is 2008. Due its chemical make up, MtBE is highly soluble in water. Studies have found that the greatest concentrations are typically found in the upper layers of lakes and other water bodies. Computer modeling on MtBE in the environment has shown that 46% of MtBE in the environment exists in surface water, while only 0.5% of MtBE is found in soil or sediments. Based on this information, there is little likelihood that MtBE will accumulate in the bottom sediments of Lake Chesdin. 000'189 IlL Actions Taken by Other States After reviewing the actions taken by other states in regard to MtBE, the Office of Water Quality determined that states that established drinking water standards or advisories did so due to contamination of public and/or private drinking water wells from nearby, leaking underground storage-tanks. Staff review also revealed that MtBE is fast becoming a significant problem in urbanized areas not meeting National Ambient Air Quality Standards for carbon monoxide (CO) and where the primary source of drinking water comes from wells. A number of states that have established standards or advisories for MtBE have also required the phasing out MtBE as an oxygenate in gasoline. The table below illustrates the variation between the standards, or guidance levels. In most instances, the established standards were primarily based on research by health agencies in the individual states. Those health agencies either conducted the analyses themselves, as did New Jersey, or reviewed analyses of other scientific organizations. Differing interpretations of those assessments resulted in adoption of varying standards and guidance values by the different states. Levels of MtBE in County Water Supplies Both the Appomattox River Water Authority and the Swift Creek Reservoir Treatment plant have conducted the sampling for MtBE in conformance with EPA guidelines. All samples taken from the Swift Creek Treatment Plant have been below detection limits. The graphs of the MtBE monitoring data for Lake Chesdin on the following pages illustrate that for the past several years, MtBE levels in the lake and in the treated water have been below the limits of detection established by EPA. The second set of graphs show the frequency of occurrence of MtBE in the lake "raw" water and the "finished" water. It is also important to note that the Appomattox River Water Authority has consistently tested for other components of gasoline, including benzene, toluene and xylene. Levels of these substances have also been below the limits of detection. Health Effects of Methyl Tertiary-Butyl Ether Multiple national and state organizations have reviewed the scientific literature on the human health effects of MtBE. Questions continue to be raised about the health effects of MtBE, but there is no clear consensus that it is related to specific health effects-especially at the low levels encountered in most drinking water supplies. Below is a summary of the findings from these various groups. EPA - December 1997 - MtBE has the potential for causing cancer and non-cancer effects in humans at high doses. MtBE's presence in drinking water has primarily caused odor and taste concerns. EPA Blue Ribbon Panel - Sept. 1999 - reformulated gasoline provides considerable air quality improvement, but MtBE is more likely to contaminate ground and surface water than the other components of gasoline. Concern over health effects expressed, but no clear evidence is presented. National Academy of Sciences - 1996 - Some people have experienced acute symptoms associated with exposure to gasoline containing MtBE. No data are yet available to link MtBE exposure to measurable adverse public-health effects. 5 000193 National Institutes of Health - National Institute of Environmental Health and Safety - Jan. 1997 - Human health effects of short-term and long-term exposures to large amounts of MtBE are not known. Animal studies have shown adverse effects on the nervous system, renal system and fetal development. There is also some indication of cancer development in animals. Maryland Task Force on the Environmental Effects of MtBE Final Report - December 2001 - MtBE poses quality of life problems including objectionable taste and odor and may cause adverse health effects. Connecticutt Department of Environmental Protection Recommendations Concerning the Use Of MtBE as a Gasoline Additive - Feb. 2000 Because of the concerns about the possible health consequences of contamination, the DEP supports a regional approach to significantly reduce and cap the use of MtBE. American Water Works Association - Jan 2000 - At high levels, MtBE may pose a public health threat. V. Conclusions Given the high variability between standards and guidance levels adopted by other states and lack of scientific consensus on MtBE's impact on human health, staff concludes that there is a strong need for consistent methods for conducting human health assessments of MtBE. Staff requested a copy of the health study currently being finalized by the EPA and was advised that the document will not be completed until the end of 2004. The findings of that health study once provided should form the basis for decisions regarding acceptable levels of MtBE in Chesterfield County's public water supplies. The State of Virginia currently mandates quarterly monitoring of MtBE and requires reporting of results exceeding 15 ppb to DEQ. Pending legislation may potentially eliminate this requirement.
