11-24-1971 MinutesVIRGII~IA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on November 24, 1971 at 1:00 P.M. Present: Mr. Irvin G. Horner, Chairman Mr. H. O. Browning, Vice-Chr. Mr. J. Ruffin Apperson Mr. F. F. Dietsch Mr. A. R. Martin ~{r. C. J. Purdy Also Present: Mr. Oliver D. Rudy, Comm. Atty. Mr. Morris Mason, Asst. Comm. On motion of Mr. Purdy, seconded bv Mr. Apperson, it is resolved that this Board go into Executive Session to=consider the purchase of land, the Current Court case and a subject for a future open hearing. Ayes: Mr. Horner, Mr. Browning, Mr. Apperson, Mr. Dietsch and Mr. Purdy. On motion of Mr. Dietsch, seconded by Mr. Browning, it is resolved that the minutes of November 10 and 15, 1971 be approved. Ayes: Mr. Homer, Mr. Browning, Mr. Apperson, Mr. Dietsch, Mr. Martin and Mr. Purdy. Dr. W. P. Wagner, Mrs. Dennis and Mrs. Miller comes before the Board to speak for the Educational Therapy Center. Mrs. Dennis states that 19 Chesterfield children have applied for service in this center and would like the Board to pay $1,500.00 the cost of i0 children from January 1, to June 30, 1972, at which time the County's Mental Health Program should be in a better position to take care of the juvenile Problems. Upon consideration whereof and on motion of Mr. Dietsch, seconded by~'Mr.Martin, it is resolved that the sum of $1,500.00 be appropriated from the unappropriated surplus of the General Fund to Item 11-093 and the sum of $600.00 be paid immediately. Ayes: Mr. Homer, Mr. Browning, Mr. Apperson, Mr Dietsch Mr. Martin and Mr. Purdy. · , The County Planner presented the Board with a proposal for raising the zoninc fees and initiating fees on Use Permits, variances and the recording of sub_~ division plats. After some amendments to the proposal, it is on motion of Mr. Dietsch, seconded by Mr. Purdy, resolved that the proposed rates for zoning and subdivmsions be advertised for a public hearing. Ayes: Mr. Homer, ~r. Browning, Mr. Apperson, Mr. Dietsch Mr. Martin and Mr. Purdy. , Mr. Mason Chalkley explains 'to the Board and the representatives of the Bensley-Bermuda and Ettrick Matoaca Resque Squads the reasons for recommending the boundary lines of these two Rescue Squads. He states that he took every- thing possible into consideration and justifies his recommendations under questioning from both departments. Mr. Ronnie Nicholas presented a petition from the Searcy Subdivision requesting the Ettrick-Matoaca Squad to serve this area. After much discussion of this matter, Mr. Browning submits the following motion: Be it Resolved, that the line be established on South Street, thence to Milhorn Avenue, thence across the Pike to the Railroad and southwardly to Swift Creek. A vote being taken on the m~tion _ Ayes: Mr. Browning and Mr. Apperson Nays: Mr. Martin, Mr. Dietsch and Mr. Purdy Mr. Horner abstains and the motion fails. Upon further consideration and on motion of Mr. Dietsch, seconded by Mr. Martin, i~ is resolved that the line proposed by Mr. Mason Chalkley be and it hereby is approved. - Ayes: Mr. Dietsch, Mr. Martin and Mr. Purdy. Nays: Mr. Browning Mr. Hornet and Mr Apperson abstain. On motion of Mr. Browning, seconded by Mr. Martin, it is resolved that the approximate sum o~ $3,300,00 be spent to purchase a de-compression chamber for the dog pound, after it was cited that such a method of killing dogs was the most humane method developed at this time Ayes: Mr. Horner, Mr. Browning, Mr. Apperson, Mr. Dietsch, Mr. Mar~in and Mr. Purdy. !Mr. W. W. Herring comes before the Board seeking a Variance on a 5-acre tract i!fronting 105 feet on Turner Road. Upon consideration whereof, and on motion !i of Mr. Dietsch, seconded by Mr. Browning, it is resolved that a Variance be ?g~anted to Mr. Herring to allow the construction of a dwelling, provided 33-ft. ? from th~center line of the road be dedicated for utilities and future widenin~ -ii°f Turner R°ad' It is here noted that the applicant agrees and a plat is filed with the papers of this Board. Purdy. , ' Mr. Richard Williams comes before the Board seeking a Variance to construct a dwelling on a lot fronting on Courthouse Road 120 feet, being a gift from relatives. Upon consideration whereof and on motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that a variance be granted to Mr. Williams, provided he will sign an easement for a water line across his lot. It is here noted that the applicant agrees to the conditions of this variance. Ayes: Mr. Horner, Mr. Browning, Mr. Apperson, Mr. Dietsch Mr. Martin and Mr. Purdy. ' ' There was presented a proposed Ordinance, the same having been duly advertised, requiring a change in the method of giving notice to affected taxpayers on changes of assessments and the filing of protests s~ainst said charges and there appearing no one in opposition'to this Ordinance, it is on motion of imf. Apperson, seconded by Mr. Browning, resolved that the following ordinance be and it hereby is adopted: AN ORDINANCE to amend and reenact Chapter 11, Article 1, Section 11-8 of the Chesterfield County Code by providing for the compilation of records upon which assessments and changes in assessments are made, the giving of notice to affected taxpayers, the filing of protests against assessments and hearings before the Board of Equalization. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD VIRGINIA: , That Chapter 11, Article 1, Section 11-8 of the Code of the County of Chester- field Virginia be and it is hereby amended and reenacted to read as follows: · , The assessor and the Board of Equarlization of real estate assessments shall i!be boverned by the following general procedures in the assessment and changes of assessment of real estate in the county: (a) The Assessor shall assemble and compile records showing the facts and data upon which assessments and changes in assessment are made, separately for each piece or parcel of real estate in the county, filing with such records any letter, statement or documentary evidence submitted by the owner or affected taxpayer of such real estate, or by any person on his behalf concerning the valuation or assessment of such real estate. ' ' (b) The real estate assessment office shall notify each affected taxpayer in writing on or before the fifteenth day of February of any year in which a new or changed assessment for such property is made or proposed by the assessor. Such notice shall be given by mail addressed to the last known address furnished to county tax officials by the affected taxpayer. If the address of such affected taxpayer is unknown, then notice shall be made by publication of such notice on or before such date in a newspaper having general circulation in the county. (c) Any owner of real property or affected taxpayer, any person with a substantial legal or equitable interest in the property involved, or any authorized representatives of such persons, or any authorized representative of the ~ounty Board of Supervisors may file protest against any assessment affecting such property within sixty days after the date of notice. Such protest shall be filed in duplicate with the real estate assessment office, and may be in any form, including the form of a letter. One copy of such ~protest shall be transmitted forthwith to the Board of Equalization of real estate assessments, which shall grant appeal of the assessment or change of assessment as a matter of right, and shall accord the protestant an opportunity for hearing in person, with witnesses, by counsel, or by submission of meroranda verified under oath. The Board of Equalization of real estate assessments may in its discretion grant an appeal and opportunity for hearing for just case shown and on any protest filed after such date. d) Hearings shall be scheduled by the Board of Equalization of real estate assessments with due regard for the convenience of the protestant and with due regard for the time required by the assessor to investigate the protest and to prepare justification of the protested assessment. The Board of Equaliz- ation of real estate assessments shall publish notice in a newspaper having circulation in the County, giving the regular time and place of its hearings. The Board of Equalization of real estate assessments shall determine and rule upon all protested assessments and all proposed reduced assessments within ninety days from the date of hearing. All actions of such board affecting assessments of real estate in such county shall be certified by such board~to the assessor on forms prepared by and prescribed by the assessor.
