This business has operated on the request property since 2011. The applicant has operated this
business without any complaints since approval of a conditional use was granted in March 2011. A
landscape contracting business and storage yard is first permitted by-right in the General Business
(C-5) and General Industrial (I-2) Districts.
Proposal
The applicant is seeking to renew a conditional use for an existing landscape contracting business
and storage yardabiding by the previous conditions approved by the Board. A new access to the
use has been constructed to reduce theimpact to the existing single-family dwelling which is
occupied by the applicant’sparents. (Exhibit)
Use
The use restricts the operation to a landscape contractor’s shop and storage yard for the applicant
only, with no time limitation on the conditional use (Condition 1). Generally, the applicant’s
operation consists of employees entering the property to retrieve and return equipment, perform
repairs on equipment, and attend periodic employee meetings. No clients would be permitted on
the property (Condition 9).
Site Design
The use continues to be located a minimum of 550 feet from the ultimate right of way of Branders
Bridge Road as depicted on the Exhibit (Attachment 2). A new driveway has been constructed to
access the use providing for safer ingress/egress since small children are being cared for within the
existing single family dwelling occupied by the applicant’s parents. The operation is limited to
existing onsite improvements (Condition 4), which precludes additions and exterior alterations to
any structures on the property for this use (Condition 6).

transportation needs that are expected to mitigate traffic impacts of future growth. The

CONDITIONS
Note: The following conditions are recommended by both the Planning Commission and Staff.
1. Non-Transferable Ownership: This Conditional Use shall be granted to and for Thomas K.
Fink, exclusively, and shall not be transferable nor run with the land. (P)
2.Use Permitted: This Conditional Use shall be for the operation of a landscape
contractor’s shop and storage yard. (P)
3.Equipment: All vehicles, equipment storage and improvements associated with this
business, exclusive of access, shall be located a minimum of 550 feet from the ultimate
right of way of Branders Bridge Road as generally shown on the attached map (Exhibit).

4.Limits of operation: Exclusive of access, this operation shall be limited to the existing
improvements noted as follows:
a. Garage (1300 square feet)
b.Two Carports (400 square feet each)
