Zoning Case 72-5U having been deferred from the February 9 1972 meeting
was discussed by the Board. '
Mr. Irvin C. Peoples, Sr. requests a Use Permit to operate a Child ~ ~
~aI~ Center
on a parcel of land of irregular shape, containing approximately 55 acres,
fronting appro~[imately 1,600 feet on Woodpecker Road (Rt. 626) and extending
southwardly to a depth of approximately 230~ feet, being locate(~ in the south-
west quadrant of the intersection of ~'~0odpecker Road (Rt. 626) in i, latoaca
Magisterial District. Refer to Tax MaD Sec. 174 (1) parcel 58, and gives a
list of the improvements which he proposes to accomplish. There appearing no
one in opposition to this request, it is on motion of Mr. O'Neill, seconded by
Mr. Krepela, resolved that a Use Permit for a Child Day Care Center on the

On motion of Mr. Myers, seconded by ~Ir. Krepela, it is resolved that the
following ordinance be and it hereby is adopted:
AN ORDINANCE to vacate portions of five (.5) unimproved thirty-six (36)
foot wide road rights-of-way in the subdivision of Bellwood Heights Development,
known and designated as Bellwood Street, Bermuda Street, Chesterfield Street,
Kingsland Street, and Ballard Avenue, a plat of which made by i.~. ~?. L%Prade
Brothers, retraced and plotted by G. T. Bishop, Surveyor, of Swan Quarter, N.C.
dated March 21, 1945, recorded June 8, 1946, in ~he Clerk's Office of the
Circuit Court of Chesterfield County, Virginia, in ~lat Book 8, pages 60 and 61,
said portions of unimproved thirty-six (36) foot wide road rights-of-way to be
vacated being more particularly shown on a copy of the aforesaid plat marked

~HEREAS, notice of the adoption of this ordinance has been given in accor-
dance with Section 15.1-431 of the Code of Virginia, 1950, as amended.
NOW, THEREFORE, BE IT ORDAINED, by the Board of Supervisors of the County
of Chesterfield, Virginia: ~
1. That pursuant to Section 15.1-482, of the Code of Virginia, 1950, as
amended, that portions of the ifve (5) unimproved 36 feet wide road rights-of
way as described above and shown marked in "red" on the copy of plat of
Bellwood Heights Development attached hereto, namely: that portion of Bellwoo?
Street described and shown as aforesaid, that portion of Bermuda Street
described and sh~m as aforesaid, that portion of Chesterfield Street described
and shown aforesaid, that portion of Kingsland Street described and shown as
aforesaid and that portion of Ballard Avenue described and shown as aforesaid
be and they are hereby vacated. ,
2. This ordinance shall be in full force and effect in accordance with
Section 15.1-482 of the Code of Virginia, 1950, as amended, and a certified copy
thereof, together with the plat attached, shall be recorded in the Clerk's
Office of the Circuit Court of Chesterfield County, Virginia.

The Executive Secretary presented a request of Hr. Nayne McMillian for a
Variance to construct a dwelling on Parcel B at the western end of Broad Moor
Road, as shown on a plat drawn by Robert M. Blackenship dated September 24, ].969,
and presented a letter from the adjoining property owners stating that they had
no objection to the granting of such. a Variance. ~
Upon consideration whereof, and on motion of Mr. Horner, seconded by Hr. }lyers,
it is resolved that a Variance to allow the construction of a d~.;e!ling on the
aforesaid parcel be and it hereby is granted to ~4r. NcMillian, subject to the
dedication of a 50-ft. right-of-way as shown on the said plat.

an entrance road for the Chesterfield County airport in accordance with the

receiv~ a resolution from the LJ. brary Board requesting the Board of Supervisors
to take the necessary action to haw~ a Bond Referendum on $1,750,000.00 for
capital improvements to the Library System.

There was read a resolution passed by the Enon Elementary PTA stating certain
opposition to the Court decree on forced busing. -"
'Mr. Homer Handy comes before the Board again seeking approval of the site lay-
°ut in construction plans for an apartment complex lying generally east of
North Arch Road and south of Route 60. Mr. Horner states that be'l-as t

with most of the Civic organizations in 'the area and upon consideration of
this matter, it is on motion of Mr. Homer, seconded by ~r. Myers, resolved
that the plans for constructing apartments in the name of "ChiDmar Inc."

On motion of ~r. Myers, seconded by ~r. O'Neill, it is resolved that contract
S72-6CD for the construction of sewers in Sections 2 and 4, in Hidden Valley
in the amount of $25,281.25, be and it hereby is approved.
And be it further resolved, that sewer agreement S72-2D for the installation,
of sewers in Section 3 of Hidden Valley, be ahd it hereby is approved.
On motion of Mr. Krepela, seconded by Mr. Myers, it is resolved that the
request of the Feazel Realty Company for extending sewer lines to lots 6B and
7C- Hidden Valley Estates be approved provided it is agreed to pay service ~
charges within six (6) months. '
There was presented a request from J. K. Timmons & Associates and R. Stuart
Royer & Associates for the payment of an additional fee on the se%~er study
recently completed.

extension of time be granted on contract 6511-33(; for work performed by the
Leadbetter Construction Company. ~

On motion of Mr. Homer, seconded by Mr. Krepela, it is resolved{ that a
contract for water and sewer in the Scottingham Subdivision be approved
with the understanding that the County will pay 85¢ per foot for '{ncreasing
the sewer from 8" to 10" and $2.94 per foot for increasing the water line from
8" to 12".

Cloverleaf Mall Shopping Center be allowed to install paving, curbing and

On motion of Mr. O'Neill, seconded by Mr Myers it is ]resolved that a ,at,anco
be granted to Mr. E. A. Lutterman for the construction of a dwelling on 6-acres
of land on an unimproved road lying south of Graves Lane on t~arcel 9 of Tax
Map 171, with the understanding that the County has no responsibility for the
construction or maintenance of said road.

On motion of Mr. Myers, seconded by Mr. O'Neill, it is resolved that the
following resolution be and it hereby is adopted:

proclaimed April 10-22, 1972, as "Keep Virginia Beautiful %leeks", and .~
WHEREAS, it is the desire of the Board of Supervisors to cooperate with
the Governor and promote a clean-up program for Chesterfield County,

There was read a letter from the Rowan Technical Institute thankincf the
County for the services of a training school with Chief Eanes and congratulatin%~

that the County has no obligation to construct or maintain a roadway to the

There arose a discussion concerning some possib].e differences of opinion
between the PTA leadership in the County and various groups working acainst
forced busing. ~
After some discussion of this matter, it is on notion of Mr. Myers, seconded
by Mr. O'Neill, resolved that this Board in view of the long-range benefits
to the citizens of the County, it is imperative t~.~ every effort be made to
sav_e our schools from consolidation with the scho of Henrico and Richmond
ann with this in mind urges the present PTA leaders to select for officers in
the coming year those citizens who are categorically opposed to forced busing
and.'~ those who will give exemplary leadership in the fight against consolidation
and drive for the passage of a Constitutional Amendraont.
