The Board of Supervisors this day approved all claims presented to the County
for the month of February, 1972, and authorizes the Treasuter of the Ccunty
to issue warrants as follows:

2. This ordinance shall be in full force and effedt in accordance with
Section 15.1-482 of the Code of Virginia, 1950, as amended, and a -certified copy
thereof, together with thVplat tLttached, shall be recorded in the Clerk's Office
of the Circuit Court of Chesterfield County, Virginia.
There were presented eleven (11) bids for the construction of the Juvenile
Detention Home ihvokving three alternates.
Upon consideration whereof, and on motion of Mr. Apperson,seconded by Mr. Krepela,
it is resolved that this Board accepts the low bid submitted by the Kenbridge
Company in the amount of $3772380.00, said acceptance being subject to the
approval of State officials.
Mr. A.L. Ewing comes before the Board requesting a Variance to allow the construction
of a building on a parcel of land in the vicinity of the intersection of Osborne
Road and Route 10 and it was generally agreed that this matter be delayed to
allow the Supervisor of the District to investigate the matter further.
Ayes: Mr. Horner, Mr. Myers, Mr. Apperson, Mr. Krepela and Mr. O'Neill.
Mr. James A. Jones comes before the Board seeking a Vaaiance to allow the construction
of a dwelling on a parcel of land lying about 29000 feetsoutheast of Rt.699.
There appearing that an easement to this tract of land is in question,it is
agreed that the matter be deferred for thirty (30) days.
Fir. Joe Mizelle, Attorney, representing Mr. iavid A. Trevillian, comes before the
Board at the request of the Board, to show cause why a Use Permit to sell nursery
stock on the Bon Xr Road should not be revoked and states that his client is
willing to clean up the property, that he has done nothing in violation of the
Present zoning ordinance.
Mrs. Rosa Brown, Mr. Kenneth Barner and Mrs. Townes speak of the problems Mr.
Trevillian has caused in the neighborhood.
Mr.Rudy cites the zoning law and states that in his opinion the use of the
property is.nc;t contrary to agricultural zoning.

The Thomas B. Jolly Estate being represented by Mr. Cf aham Jennings, who comes
before the Board requesting the rezoning from Agricultural (A) to Residential(R-2)
of a parcel of and of irregular shape, containing 22.76 acres, fronting approxi-
mately 1200 feet on Hull Street Road (Rt.360) and approximately 1200 feet on
Walmley Blvd. (Rt.647), being located approximately 250 feet east of the inter
Rection of the aforementioned roads in Clover Hill Magiaterial District. Refer
to Tax Map Sec. 39-12 (1) parcel 19, and states that he wishes the R-2 zoning
as the first step in his application for apartments in this area. He states
further that he will answdr any opposition to this request.
There were cited two letters of opposition.
Mr. Julius Smith, Attorney, speaks in opposition, About 40 people appear
against the request.
Petitions involving 321 names are presented in opposition.
Mr. Smith states that most of tie land in the area is used for R-2 or R-1 purposes,
that there are no multi -family zonings in this area, that there are too many
apartments coming to the County at this time and ask that the request be denied.
Mrs. Barbara Murrary states that there are 2.4 children in each apartment
in the City of Richmond which fact is attested by a survey.
Mr.Thomas O'Neill states that the citizens of Longwood do not want multi -family
reaidences in the area.
Mr. Robert Wolf states that the Board of Supervisors should protect the people
in the area to the extent that the neighborhood would not degenerate, that the
Board has procrastinated in passing the new Zoning Ordinance.
Mr. J.L. Hamirck moved into the County go get open spaces and does not want this
land to be developed into apartments similar to those in Arlington County.
Mr.Paul %arp, Consulting Engineer, states that his Company did a land use
study and showed the apartment plans, stating that traffic will be channeled to
one outlet on Rt.360 and one outlet on htlmsley Blvd' that the land has such
contours that it would make anything other than apartmentr._difficult to construct.
Mr. Phillip Perdue, Professional Apparaiser, states that the completion of the
project will enhance the value of the surrounding land, that in Chesterfield
it is difficult to find land with utilities and that it is ridiculous to resist
growth if it is to be orderly.
Mr.Horner states that he has no alternative but to recommend R-2 zoning, but in
doing so he is not recommending apartments.
On motion of Mr.Horne r, seconded by Mr. Myers, it is resolved that the afore -
described parcel of land be and it hereby is rezoned for R-2 purposes.
Ayes: Mr. Horner, Mr.Myers, Mr. Apperson and Mr. O'Neill.
Mr. Krepela abstains from voting.

It was explained that a request had been feceived for the withdrawal of the
request of the H&E Corporation.
On motion of Mr. Myers, seconded by Mr. Krepela, it is resolved that this Board
accepts the withdrawal of this request.

Mr. A.T. Linegar comes before the Board requesting the rezoning from Local
Business (C-1) to Residential (R-2) of a parcel of land of irregular shape
having a north -south depth of 250.64 feet and an east -west depth of 805.96 feet,
being located approximately 240 feet northwest of the intersection of Beulah
Road (Rt.641) and Hopkins Road (Rt.637) in Dale Magisterial District. Refer to
Tax Map Sec. 66-8 (1) parcel 1.
Mr. Linegar states that he is requesting that this matter be deferred for thirty (30)
days in order that a right-of-way deed can be completed.
On motion of Mr. Apper son I seconded by Mr. O'Neill, it is resolved that this matter
be deferred until April 12, 1972.

Mr.H.O. Browning. comes before the Board requesting the rezoning from Agricultural (A)
to Mobile Home Subdivision (MH -2) of a parcel of land of irregular shape fronting
approximately 1050 feet on Hickory Road (Rt.628) and extending southwardly to a
depth of approximately 1900 feet, being located approximately 1-4- miles east of the
intersection of Hickory Road (Rt.628) and River Road (Rt.602) in Matoaca Magisterial
District. Refer to Tax Map Sec. 171-(1) parcels 22 and 23.
Mr.Browning states that the land is suitable for septic tanks, that all lots in
the Mobile Home Subdivision have at least 15,000 square feet and that this fulfills
his idea of the requirements of the Mobile Home Subdivision Ordinance and the
reasons why same was adopted.
Mr. Harvey Lowe presents a petition signed by 75 people against the request for
the reason that this property is too for removed from the built-up areas of the
County.
Mr. Howard Clayton, Mrs. Rosa Cole, Mr. Martin Moyer and Mrs. Bruce Bryant, all
speak in opposition to this request.
Thirteen people stand to oppose the zoning request.
After some discussion of this matter, it is on motion of Nr. O'Neill, seconded
by Mr. Krepela, resolved that due to the strong opposition to this request,
that this rezoning be denied.
Ayes: Mr. Horner, Mr.Myers, Mr. Apperson, Mr. Krepela and Mr. O'Neill.
Mr. Myers states that he feels that more and more trailers should be placed in
trailer parks but did support this motion.
Whereupon, Mr.Browning .asked that the property be zoned for R-2 purposes.
On motion of Mr. O'Neill, seconded by Mr. Apperson, it is resolved that the afore --
described parcel of land be and it hereby is rezoned for R-2 purposes.

Mr. William Ira Crouch, Jr comes before the Boardrequesting the rezoning from
Agricultural ( A) to Residential (R-1) of a parcel of land of triangular shape
fronting approximately 1,150 feet on Burnett Drive (Rt.743) and extending
northwardly to a depth of approximately 1,500 feet, being located approximately
1,500 feet northeast of the intersection of Burnett Drive and Courthouse Road
(Rt.604) in Clover Hill Magisterial District. Refer to Tax Map Sec. 64 (1) part
of parcel 22.
Mr.Marshall Bosher states that he is concerned with the drainage of this area,
that since the new road was constructed partd of his land are subject to inundation,
that the County should not approve this zoning until the drainage of the area is
effected.
It was pointed out that the drainage should be checked by the County aigineering,
Department, that drainge has nothing to do with the zoning, that a drainage plan
for the subdivision should be approved by the County before same is recorded.
Upon consideration whereof, and on motion of Mr.Horner,seconded by Mr.Krepela,
it is resolved that the aforedescribed parcel of land be and it hereby is rezoned
to R-1.

Mr.James F.Hubbard comes before the Board requesting the reaoning from Agricultural
(A) to Residential (R,-21 of a parcel of land of irregular shape, conta,6,ning
29075 acres, fronting 1,537.13 feet on Otterdale Road (Rt.667) and 1697.10 feet
on Old Hundred Road (It.652), being located in the north wuadrant of the inter-
section of the aforementioned roads, in Midlothian Magisterial District. Refer to
Tax Map Sec. 24 (1) parcel 31-7.
Mr. Hubbard States that he would like to have R-2 zoning because he,can build
a larger home on a 100 -ft. lot but will accept R-1 if that is the will of the
Board, that there will be no new roads as all lots front on existing roads.
Mr. Hugh Woodle speaks for the 24 homes in the area requesting a wider lot and
presented a petition in support of R-1 zoning.
Upon consideration whereof, and on motion of Mr. Krepela, seconded by Mr. Myers,
it is resolved that the aforeddscribed parcel be and it hereby is rezoned for
R-1 purposes.
It is here noted that Mr.Hubbard accepts the R-1 zoning.

Mr.James Hubbard comes before the Board requesting the rezoning from Townhouses
(TH-11 to Residential (R-2) of a parcel of land of irregular shape having a
north -south depth of 1572.47 feet and an east -west depth of approximately 695 feet,
being located approximately 420 feet south of the intersection of Midlothian
Turnpike (Rt.60) and Pocoshock Creek in Clover Hill Magisterial District. Refer
to Tax "'apec. 17-11 (1) part of parcel 6-2.
Mr. Hubbard states that he already has a Use Permit for this apartment property
and wishes the TH-1 zoning to be eliminated.

intersection of Dupuy Road and E.River Road ( R t.360 in Matoaca Magisterof ial District.

Mr. Tipton states that he already has a Use Permit for constructing apartments
should the land be zoned R-2.
There appearing no opposition to this request and the Planning Commission having
recommended approval, it is on motion of Mr. O'Neill, seconded by "r. Apperson,
resolved that the aforedescribed parcel of land be and it hereby is rezoned for
:Residential -2 purposes.

Mr. Pierce comes before the Board requesting the rezoning from Agricultural (A) to
Residential (R-2) of a parcel of land of irregular shape fronting approximately
530 feet on Lakeview Road (Rt.626) and abproximately 780 feet on Branders Bridge
Road (Rt. 625), being located approximately 700 feet northeast of the intersection
of the aforementioned roads in Matoaca Magisterial District. Refer to Tax Map
Sec. 175-5 (1) parcel 1.
There being some questions on this rezoning, it is on motion of Mr. O'Neill,
seconded by Mr. Apperson, resolved that the matter be deferred until April 12:1972.

Mr. Lloyd Colbert comes before the Board requesting the rezoning from Agricultural
(A) to Residential (R-2) of a parcel of land containing 127.30 acres, fronting
1224.0 feet on Matoaca Ibad ( Rt.600) and extending northwestwardly to a depth of
approximately 4650 feet, being located approximately 1950 feet northeast of the
intersection of Matoaca Road and Hickory Road ( Rt. 628) in Matoaca Magisterial
District. Refer to Tax Map Sec. 173, parcel 49.
There appearing no one in opposition to this request and the Planning Commission
having recommended approval, it is on motion of Mr. 01" eill, seconded by Mr.
Apperson, resolved that the aforeddscribed parcel of land be and it hereby is
rezoned for R-2 purposes.

being located at the intersection of the aforementioned roads in Clover Hill

There appearing no one in opposition to this request and the Planning Commission
having recommended approval, it is on motion of Mr.Horner, seconded by Mr-Apperson,
resolved thlkt the aforedescribed parcel of land be and it hereby is rezoned for
R-2 purposed.

Mr. Kenneth Barton, representing Mr.Curtis Rudolph, comes before the Board

of land of triangular shape, containing 15 acres, fronting 1372.3 feet on
Qualla Road (Rt. 653) and extending eastwardly to a depth of 1026.9 feet, being
located opposite the intersection of Qualla Road and Family Lane (Rt.756) in
Clover H ll Magisterial District. Refef to Tax dap mac. 63 (1) parcel 56.
There appearing no one in opposition to this request and the Planning Commission
having recommended appooval, it is on motion of Mr.Horner, seconded by Mr. Apperson,

Mr. Richard henshaw, representing Mr. Fred R. Pearce, comes befoie the Board
requesting the rezoning from Agricultural (A) to Local Business (C-1) of a
parcel of land of rectangular shape fronting approximately 138 feet on
Midlothian Turnpike (Rt. 60 ) and extending southwestwardly to a depth of
approximately 205 feet, b6ing located approximately 485 feet northwest of the
intersection of the Midlothian Turnpike and Tuxford Road, in Clover Hill Magisterial
District. Refer to Tax Map Sec. 18-13 (1) parcel 3-1.
111r.Henshaw states that the property in question fronts on Rt. 60 and should be
zoned for business. He cites a letter stating that C-1 zoning is much better
on which tosecure a loan than a Use Permit status.
Mr.Robert Hastings, Pastor of Saint Marks United 1'llethodist Church,stated that
C-1 zoning could be detrimental to the Church which is approximately 300 feet off
Rt.60.
Mr.James Ridgeway, President of the Shanandoah Civic Association, opposes the
request and presents numerous petitions against the same.
Mr.Howard Burton, a retired Safety tirector, cites traffic problems.
Mr. Krepela states that he still would like to see a zoning plan for Rt.60.
On motion of Mr. Horner, seconded by Mr.Apperson, it is resolved that the zoning;
re.;uests be and it hereby is denied.

1"jr.C.K.Wilson comes before the Board requesting the rezoning from Agricultural (.A)
to General business (C-2) of a parcel of land of rectangular shape fronting
approximately 200 feet on Hull Street Road (Rt.360) and extending northwestwardly
to a depth of approximately 285 feet, being located approximately 1070 feet northeast
of the intersection of Hull Street Road and W lmsley Blvd. (Rt.647) and better
known as 8140 Hull Street Road in Clover Hill Magisterial District.
Refer to Tax 1"lap Sec. 39 (1) parcel 6.
Mr. Wilson states that he wi!.,Ihes to improve tris property and continue with the:.
general repair of automobiles.
It was cited that the Planning Commission had recommended the denial of C-2
zoning and the approval of a Use Permit subject to several conditions.
Ten people appear in opposition to C-2 zoning.
1"1r.J.L. Hamrick, "Ir. Bob Lee Bates and 1"lr. Jensen, all state that they are
opposed to C-2 zoning but would approval a Use Permit for the continued use of
this property.
Upon consideration whereof and on motion of Mr.Horner, seconded by Mr. Myers,
it is resolved that a Use �ermit to operate an automobile garage be, and at
hereby is granted with the following six conditions:
1. Utility (Water and sewer) plans shall be submitted to and
approved by the County Engineering Department prior to the
issuance of any building permit.
2. No junked or abandoned automobiles or parts thereof,shall be
stored on the property.
3. No outside storage of materials or supplies shall be permitted.
4. All inoperable automobiles shall be stored within an enclosure
(fence) of having 100% solidity during the period of repair.
Such structure shall be no less than 7 feet in height and shall
be erected flush with the front bearing wall of the existing
structure.
5. All driveways and parking areas shall be paved.
6. All site plans shall be approved by the Planning Department
prior to the issuance of any building permit.

Mr. E.J.'Willis, Jr. comes before the Board requesting the rezoning from Agricul�,
tural (A) to Residential (R-2) (91.6 acres) and General Business (C-2) 015.1
acres) of a parcel of land of irregular shape fronting 1329.49 feet on Robious
Road and extending northwardly to a depth of approximately 3550 feet, being
locatrd approximately 200 feet northwest of the intersection of Knollwood Drive
and ibbious Road in Midlothian Magisterial District. Refer to Tax Map Sec.
17-3 (1) parcel 3.
Mr. .lames Hayes, Engineer, representing Mr. Willis, states that the commercial
area should be reduced and the rk._quest is now for only 4 -acres on Robious Road.
Mr. Willis states that he only wants 4 -acres for a small neighborhood center
to be designed by Stuart 'Drner.
Eighteen persons oppose the commercial area.
George Cook, J.W. Willooghby,- James Henshaw, arid 1"1rs. Conway all speak in
opposition to the business area at this location.
Upon consideration whereof, and on motion of Mr. Krepela, seconded by Mr.
Apperson, it is resolved that the aforedescribed parcel of land beand it hereby
is rezoned for R-2 purposes in its entirety.
Ayes: Mr. Horner, Mr. Myers, Mr. Apperson, Mr. Krepela and Mr. O'Neill.
72-9U.
Mr. John Smart, Attorney, representing the Creative Country Day School in
Beechwood, Inc,, comes before the Board requesting a Use Permit to operate a
day care nursery on a parcel of land of rectangular shape fronting 168.0 feet
on Hopkins Road and 318.72 feet on Bonniebank Road, being located in the north-
west quadrant of the intersection of the aforementioned roads in Dale Magister-
ial District. Refer to Tax Map Sec. 52-8 (1) parcel 2.
Mr. Smart states that this school wishes to go to the third grade and expand
greatly the number of students and there appearing no opposition to this
request, it is on motion of Mr. Apperson, seconded by Mr. Myers, resolved that
a Use Permit for the operation of a Day Care Nursery and private school on
the aforedescribed parcel of land be and it hereby is granted with the follow-

ing restrictions:
1. That there will be one (1) sign permitted between the two buildings,
2. No ingress or egress shall be allowed on Hopkins Road.
3. Off street parking shall be provided.
4. A fence shall be provided to enclose the entire operation.
5. Site layout and landscaping plans be approved by the Piannincj Department.

Mr. H. Robert Simpson, comes before the Board re

having an east -Vest depth of approximately 1,530 ft., and a north -south depth
of approximately 2,610 feet, being located to the south of the intersection
of Brambleton Road and Niles Road, and better known as 5700 Turner Road in
Clover Hill Magisterial District. Refer to Tax Map Sec. 51-11 (1) parcel 1.
Mr. Simpson states thst this will be a family operation, that they will live
on the property leasing same from Mr. W. S. Carnes.
Eight persons appear to oppose this request.
Mrs. Helen Slater and Mr. Jim Cain state that the area is being depreciated
because of the manner in which the horses are kept.
Mr. Simpson states that he will have a well run stable acid will be an asset
to the area.
On motion of Mr. Horner,.seconded by Mr. Apperson, it is resolved that this
matter be deferred until April 12, 1972.

Mr. H. A. Nunn, representing the Nunn Construction Co., Inc., comes before the
Board requesting a Use Permit to clear, grade and level a parcel of land of
irregular shape fronting approximately 1,200 feet on Walmsley Boulevard and
�i extending northwestwardly to a depth of approximately 920 ft. being located
Opposite the intersection of WaIMAley Boulevard and Newby*s Bridge Road,
and better known as 7500 Walmsley Blvd. in Clover Hill Magisterial District,
Refer to Tax Map Sec. 40-9 (1) parcels 6 and 7. Mr. Nunn states that he wants
a Use Permit to have a borrow pit from which he will get dirt to use in the
construction of Chippenham Parkway, that he will level top soil and seed the
property and left according to States specifications.
Dr. Edward Peple questions the manner in which the borrow

Mr. R. J. and Lelia B. Ellis come before the Board requesting a Use Permit to
park a mobile home on a parcel of land of rectangular shape fronting approxi-
mately 115 feet on Pickett Street (Rt 600) and extending westwardly to a depth
of approximately 265 feet south of the intersection of Pickett Street and
Mahone Street in Matoaca Magisterial District. Refer to Tax Map Sec. 186-3
(2) lot 23.
There appearing no one in opposition to this request, it is on motion of
Mr. Myers, seconded by Mr. Apperson, resolved that a Use Permit to park a
mobile home on the aforedescribed parcel of land be and to park a mobile home
on the aforedescribed parcel of land be and it hereby is granted for a period
of two (2) years.

Street light be installed at Foster and College Park Avenue at the intersection
of Genito and Clintwood Roads, and the request for a street light on the
western end of North Street and the request for an additional light at College
Park be referred to the Light Committee.

Chief Mike Lohr and Chief Van Bowen come before the Board stating that they
would like to meet with the Board again before the budget is finally adopted.

sum of $26,700.00 be appropriated from the unappropriated surplus to
11 -189 -230 -Legal Fees.

sum of $6,000.00 be added to the appropriation - Item 11 -041 -204 -Bidding and
Micro Filming in the Clerk's Office and that Revenue Account 11-000-620.9 be
increased $6,000.00 in shared expenses of the. clerk's office.

There was presented a request to transfer the amount of $10,000.00 from
13 -185 -105 -Compensation of Librarians to 13 -185 -205 -Architect's fees, and it
was generally agreed that this matter be held for further investigation.
On motion of Mr. Krepela, seconded by Mr. Apperson, it is resolved that this
Board records publicly its approval of the dredging of a slip belonging to
the Virginia Power Boat Association and the distribution of the silt in an
?' orderly manner.

On motion of Mr. Apperson, seconded by Mr. O'Neill, it is resolved that

Board requests the Commonwealth's Attorney to prepare an Ordinance providing
for penalties for the failure to file Personal Property returns and for non-
payment on time.

There was read a letter of commendation to Patrolman H. M. Herndon in alertness
in detecting a fire at the Old Coach Village Subdivision.
On motion of Mr. Apperson, seconded by Mr. O'Neill, it is resolved that this
Board approves the summertime program on hiring students through the State
and Federal grants to do temporary work at the Courthouse and to limit the
hiring of such students at no more than twelve.

There was presented to the Board by Mr. Krepela a report of the National
Action Group Seminar in Pontiac, Michigan, February 26-27, 1972, which report
is filed with the papers of this Board.
This day the County Road Engineer in accordance with directions from this
Board made report in writing upon his examination of Conte Drive, Wiesinger
Lane, Keith Lane, Framar Drive, Leovey Lane and Lynru Drive, in Briarwood
Subdivision, in Midlothian Magisterial District, which shows that in the
opinion of the County Road Engineer it is expedient that said roads be
established as public roads.
Upon consideration whereof, and on motion of Mr. Krepela, it is resolved that
Conte Drive, Wiesinger Lane, Keith Lane, Framar Drive, Leovey Lane and Lynru
Drive, in Briarwood Subdivision, Midlothian District, be, and they hereby are
established as public roads.
And be it further resolved that the Virginia Department of Highways be and it
hereby is requested to take into the Secondary Road System, Conte Drive, from
its intersection with Route 711 southwestwardly .08 mile to Wiesinger Lane,
thence southwestwardly .08 mi. to Framar Drive, then southwardly .08 mile to
Keith Lane, thence southwardly .10 mile to Lynru Drive; Wiesinger Lane, from
its intersection with Route 711, southwardly and westwardly .16 mi. to Keith
Lane, thence westwardly .08 mile to Conte Drive, thence westwardly .04 mile;
Keith Lane, from its intersection with Wiesinger Lane, southwestwardly .20 mi.
to Conte Drive; Framar Drive from its intersection with Conte Drive, westwardly
.07 mi. to Leovey Lane, thence westwardly .03 mi; Lynru Drive, from its inter-
section with Conte Drive, eastwardly .08 mi. to a cul-de-sac and from the
same intersection with Conte Drive, westwardly .10 mi. to Leovey Lane, thence
westwardly .03 mi.; Leovey Lane, from its intersection with Framar Drive,
southwardly .23 mile to Lynru Drive. These roads serve 65 houses.
And be it further resolved, that the Board of Supervisors guarantees to the
Virginia Department of Highways, an 80 -ft. right-of-way on a portion of Conte
Drive and 50 -ft. rights-of-way on all other roads including portions of Conte
Drive. Plat recorded in Plat Book 16, pages 93 & 94 on December 11, 1968.
On motion of Mr. Apperson, seconded by Mr. Myers, it is resolved that this
r Board adjourns at 8:30 P.M. to 5:00 P.M. on March 15, 1972.
