She provides ongoing assistance to Board members and other clerks in the region and across the Commonwealth. On April 22, 2004, Lisa was selected from among 16 worthy candidates as the recipient of this prestigious award at the annual meeting of the Virginia Municipal Clerks Association. Summary of Information: The purpose of the agenda item is to request the Board of Supervisors adopt a resolution recognizing Joan Fogg and Mary Jane Jones for representing Chesterfield County on the national level. Joan Fogg and Mary Jane Jones were invited to meet with President George W. Bush in Washington, D.C. to discuss the need for prescription drug coverage for Medicare recipients. Both were invited to return to Washington to witness President Bush sign the Medicare Modernization Act on December 8, 2003. Mary Jane Jones was chosen to appear in a video produced by the U. S. Department of Health and Human Services about the prescription drug coverage. This video will be distributed across the country to senior centers and senior organizations. Joan Fogg and Mary Jane Jones represented Chesterfield County with grace and distinction and advocated on behalf of older residents in Chesterfield County and the United States. Summary of Information: Reach Out Now Teach-in Week is a national initiative to prevent underage alcohol use by educating fifth-grade students and parents about the harmful effects of underage alcohol use. Child safety officers in the Chesterfield Police Department will be participating in this initiative. The resolution by the Board of Supervisors to recognize April 26-30 as Reach Out Now Teach-in Week will acknowledge Chesterfield's ongoing efforts to prevent underage drinking and enhance local support for the Reach Out Now Teach-In. RECOGNIZING APRIL 26-30, 2004, AS ~REACH OUT NOW TEACH-IN WEEK" WHEREAS, in 2002, approximately 10.7 million drinkers were under legal age (ages 12 to 20); and WHEREAS, alcohol use among children and adolescents starts early and increases rapidly with age; and WHEREAS, by the time they reach the eighth grade, nearly 50 percent of adolescents have used alcohol illegally at least once, and over 20 percent report having been drunk; and WHEREAS, underage alcohol use is more likely to kill young people than all illegal drugs combined; and WHEREAS, children, with care and support from family, friends, health professionals, teachers, clergy, and others, can avoid the negative effects of alcohol and drugs; and WHEREAS, the Substance Abuse and Mental Health Services Administration in the U.S. Department of Health and Human Services encourages communities to highlight the importance of reaching children early to prevent underage alcohol use during ~Reach Out Now Teach-In Week" the last week of April; and WHEREAS, the child safety officers from the Chesterfield Police Department teach fifth-grade students about the harmful effects of underage alcohol use and how they can resist pressure to use; and WHEREAS, child safety officers from the Chesterfield Police Department collaborate with SAFE, Chesterfield's coalition to prevent underage drinking and drug use, to distribute Use, You Lose t-shirts to fifth-grade students to reinforce no-use messages; and WHEREAS, child safety officers from the Chesterfield Police Department will have provided Reach Out Now materials to the parents of over 4,000 fifth-grade students by April 30th to assist them in talking with their children about underage drinking. Subject: Consideration of Proposed Subdivision Connectivity Policy County Administrator's Comments: County Administrator: Board Action Requested: Defer consideration until such time the Emergency Access Policy is brought before the Board of Supervisors and then take both policies under consideration at the same time. Summary of Information: The Planning Commission held a Public Hearing on September 16, 2003, and recommended adoption of the proposed policy. The Board has reviewed the policy during several different work sessions and continues to be concerned about the impact of new traffic on existing subdivision streets when subdivisions are connected. The Planning Commission is in the process of reviewing a proposed Emergency Access Policy which would provide for an alternate means of access to portions of subdivisions served by a single public access when that access becomes blocked. Staff recommends that the Board defer the Connectivity Policy until after the Planning Commission takes action upon the Emergency Access Policy and then take both policies under consideration together.~ Preparer: Kirkland A. Turner Attachments: Yes ~-~No Title: Development Manager ~00009 Attachment A CHESTERFIELD COUNTY RESIDENTIAL SUBDIVISION CONNECTIVITY POLICY Purpose The purpose of street interconnectivity shall be to (a) improve public safety response time to residents by providing multiple means of access; (b) reduce travel time and distance between neighborhoods by providing alternative travel paths; (c) maintain an acceptable quality of life in the residential neighborhoods by preventing excessive through traffic on local streets where individual lots have direct access onto the street; and (d) maintain the traffic carrying capacity of arterial and collector streets. Standards 1. New streets shall be stubbed to undeveloped land unless an evaluation of the adjacent property at the time of tentative subdivision plat review determines that: (a) the undeveloped property at that location has development constraints such as but not limited to, wetlands, topographic features, size, etc; (b) a through street is not required or,,,,~,,,,.,~'~'~ ,~-~ ~'"*~,.,,~ .,,,.,,~.,...~^~"~ to conform to access requirements in the Subdivision Ordinance; (c) the street connection creates a violation of the Planning Commission's Stub Road Policy; or (d) the connection would provide sole access to non-residential property. 2. Streets in new subdivisions shall connect to all adjacent stubs unless the resultant local street pattern would create a traffic count that exceeds the Planning Commission's Stub Road Policy. Connection to a stub street within a subdivision that complies with street access requirements as specified in Section 17-76 (h) of the Subdivision Ordinance may be waived if: (a) there are a sufficient number of other stub streets to adequately disperse the traffic and not cause a concentrated use of any one stub street connection; or (b) the connection to a particular stub will cause a concentrated traffic at that location. 3. Subdivision design shall facilitate interconnectivity within its limits through the layout of the overall street network. The design concept of solely using multiple unconnected cul de sacs shall be evaluated and approved based upon circulation, topographic and environmental constraints. The following table depicts the recommended guidelines for spacing of through streets to facilitate travel through residential areas. The spacing or frequency of the streets decreases with density so as to provide more alternatives and avoid or reduce the construction of streets in excess of four lanes. The purpose of such signs shall be to advise the public that the extension of the stub is planned. Applicability This policy shall apply to any zoning case filed or any tentative subdivision plat that receives approval after (INSERT DATE). Any property that received zoning or tentative subdivision plat approval prior to the effective date of this policy and has conditions that conflict with provisions of this policy shall be governed by those conditions. The position representing the Clover Hill District has expired. Tinsley will retire from the Fire and Emergency Medical Services Department, Chesterfield County, on May 1, 2004; and WHEREAS, Lieutenant Tinsley attended Recruit School #10 in 1979 and has faithfully served the county for nearly twenty-five years in various assignments as a Firefighter at the Manchester Fire Station; as a Firefighter at the Midlothian Fire Station; as a Sergeant at the Bon Air Fire Station; as a Lieutenant at the Airport Fire and EMS Station; and as a Lieutenant at the Matoaca Fire Station; and WHEREAS, Lieutenant Tinsley was involved in a successful life save on November 13, 1982 at a house fire on Skinquarter Road; and WHEREAS, Lieutenant Tinsley was involved in a successful childbirth; and WHEREAS, Lieutenant Tinsley was recognized in October 1992 with an Emergency Medical Services award for his role in saving the life of a citizen suffering from cardiac arrest; and WHEREAS, Lieutenant Tinsley was an active member of the Hazardous Incident Team for nearly ten years; and WHEREAS, Lieutenant Tinsley is certified as a State Fire Instructor III, an adjunct instructor for the State of Virginia, an Industrial Fire Brigade instructor, a Hazardous Materials instructor, a Hazardous Materials Specialist, a Public Fire and Life Safety Educator and the coordinator for the Sixth Grade Fire Prevention Program. Summary of Information: Mrs. Humphrey~requested staff to prepare a resolution expressing support for the continued evaluation of the Powhite Parkway Extension PPTA proposals, which have been submitted to VDOT for consideration. "Powhite Parkway Partners, LLC." and "W.C. English, Incorporated/Koch Performance Roads, Incorporated" have each submitted conceptual PPTA proposals to VDOT. Summaries of each firm's conceptual proposal have previously been reviewed with the Board. District: Countywide Whereas, the Virginia Department of Transportation (V/DOT) has received two conceptual proposals under the Virginia Public-Private Transportation Act (PPTA) offering to construct a new, limited access, toll highway facility from the western terminus of the Powhite Parkway to a connection with Route 360 near Skinquarter (the "Extension"), a distance of approximately nine miles; and Whereas, the Extension is a desirable and necessary element of Chesterfield's Thoroughfare Plan, will serve county residents and businesses, and will help alleviate congestion on existing roads in the county; and Whereas, current VDOT Six Year Improvement Programs include no funding for the construction of the Extension; and Whereas, VDOT has given the county no indication that they intend to provide funding for the Extension in the foreseeable future; and Whereas, evaluation of detailed proposals is necessary before the county can formulate a position on either proposal for the Extension. Now, therefore, be it resolved that the Chesterfield County Board of Supervisors requests VDOT and the Commonwealth Transportation Board to advance both PPTA proposals to the detailed proposal evaluation stage. Be it further resolved that the Board requests both proposals include an option in their detailed proposals that provide for the Extension without a toll increase on the existing Powhite Parkway or Downtown Expressway. Summary of Information' The Board directed the Planning Commission to review and make a recommendation on a zoning ordinance amendment (Amendment A) that would require a conditional use for motor vehicle sales (MVS) on any property zoned C-3 and, the way the zoning ordinance is constructed, any property zoned C-4. Approximately sixteen (16) existing dealers would become legally non-conforming with the approval of this amendment. Those dealers could continue to operate but would need a conditional use to expand or to rebuild after major damage to their existing facility. Preparer: Thomas E. Jacobson Attachments: Yes [---] No Title Director of Planning C:DATAJAGENDAJ2004/APR28/MOTOR SALES/GOK OOO035 CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 2 of 2 In an attempt to address the Board's concerns about the potential negative impact new MVS facilities could have on some existing neighborhoods and prevent existing MVS facilities from becoming legally non-conforming, the Planning Commission considered and recommended approval of an alternative zoning ordinance amendment (Amendment B-l) that would leave MVS as a restricted use in C-3 and C-4 zoning districts. An eighth restriction, prohibiting new shopping center locations from being used for MVS facilities unless a conditional use is granted, is added to the existing list of restrictions. Existing MVS facilities located within shopping centers are "grand-fathered" and may continue to operate per today's standards. This amendment also adds restrictions for motor vehicle repair (MVR) facilities. These restrictions are similar to those for MVS facilities and will provide the same protection for adjacent property owners. Existing MVR are ~grand-fathered" and may continue to operate per today's standards. No dealers or repair facilities would become legally non-conforming with the adoption of this amendment. Based on these considerations, he shall determine that the proposed use's operating characteristics are substantially similar to, and its impact on neighboring properties no greater than, the operating characteristics and impacts of the specifically enumerated uses allowed in this district. ooo Sec. 19-637. Limitation on specific signs. (a) Changeable copy signs. (1) Changeable copy is not permitted, unless the changeable component of the sign face occupies one-half or less of the total area of the sign face. This restriction does not apply to changeable copy used in movie theater and fuel price signs. (2) If changeable copy is used, it shall abut the sign face or be integrated into the sign face, provided, however, if the sign is incorporated into a monument structure, the changeable copy need not abut or be integrated into the sign face. (a) Retaining walls shall be constructed so that they are compatible in appearance with the principal structures in the development and/or the view shed in which they are located. Compatibility shall be accomplished through the use of integrated color block or other material that is similar in appearance to the primary structures or is an earth tone acceptable to the Director of Planning. (b) Walls over ten (10) feet in height and within fifty (50) feet of, and facing, an exterior property line or public right of way shall employ landscaping along the wall base to soften the visual impact of the wall. Landscaping shall consist of any required setback planting as well as additional evergreen trees to break up large expanses of wall. When landscaping is required along the base of a wall, setbacks shall be increased, if necessary_, so that a minimum ten (10) foot planting area is provided that is free from any easements, overhead or underground utilities, or other encumbrances that might prevent the installation of required landscaping. (d) The director of planning may waive any requirements of 19-570.1(a) through 19- 570.1(c) at the time of site plan review if it is determined that the visibility or impact of a wall is minimized due to its location, orientation or other conditions in the vicinity of the wall. (e) Retaining walls four (4) feet tall and higher shall incorporate permanent fencing on the upper side of the wall, and if visible to the public, decorative fencing. Fencing shall be a minimum height of forty-eight (48) inches. This utility service is provided pursuant to a contract between the County and the developer, Gray Land and Development Company, which was approved by the Board in 2000. The contract provides for billing for wastewater service based on an assumed usage of 350 gallons per day per residential unit. This has resulted in relatively high wastewater service charges because actual usage has been lower than 350 gallons per day. In response to customers concerns, Gray Land has requested that the wastewater charge be based on actual metered volume used by the customers. Staff agrees that this approach more accurately reflects the impact on the County's wastewater system. Gray Land has also requested billing on a bi-monthly rather than monthly basis to be consistent with the meter reading schedule for their customers. Summary of Information: ONYX Industrial Services, Inc. has made a claim in which it requests payment of $21,112.65. A copy of the claim is attached. Under Virginia law, ONYX may not file a lawsuit against the County until the Board denies this claim. In April 2003, the County contracted with ONYX to clean the two maintenance bays at the County garage. The bays were being cleaned so that they could be repainted by another contractor. ONYX contracted to clean the bays for $9,800. ONYX agreed that it would not be paid more than $9,800 unless the County approved an increased contract amount in advance. Even though it had only cleaned one of the bays, ONYX walked off the job in July 2003, claiming that it had completed the work. The uncleaned bay was much too dirty to be painted and the County had to pay another contractor, Master Blaster, $4,160 to finish cleaning it before it could be painted. Staff will show the Board a video tape confirming the dirty condition in which ONYX left the second bay when the claim is presented. Preparer: Steven L. The Coalition is interested in helping Chesterfield meet its strategic goals. The opinions expressed by the Coalition are consensus, based on individual research and collaborative discussions. Background GRTC bus service to Chesterfield County was approved by the Board of Supervisors in June, 2001. In June 2003 the pilot program for local service was discontinued including the Bermuda district express (GRTC Route 80), but commuter service from Chesterfield Plaza Lowe's (GRTC Route 81) was funded. GRTC Route 82 (Winterpock Road Lowe's) service began in August 2003. As the two routes have continued, ridership has increased on both routes. Route 81 riders increased from 4,557 in July, 2003 to 5,838 in March, 2004. Route 82 ridership increased from 1,282 in August, 2003 to 2,193 in March, 2004. The Chesterfield County Board of Supervisors has stated that there is no continuing funding for commuter service in Chesterfield County. The members of Coalition for the Link seek to present information and opinions to the Board of Supervisors to obtain a committed funding for Routes 81 and 82 and to engage the Board of Supervisors in planning strategy to address mass transit issues. GRTC Commuter Routes and Chesterfield's Strategic Goals The Coalition members recognize that commuter bus service provides economical, safe, and efficient transportation for a portion of the 35,000 or more residents who work outside of Chesterfield County. The Coalition maintains that GRTC commuter routes have a positive impact on each of the County's Strategic Goals (underlined in the following paragraphs). As ._e. xemt~lar~, stewards of the public trust, Chesterfield residents have the expectation that the ownership by the County of 50% of GRTC should have some benefits to the County. If this ownership position yields no service concessions to the County, why is it in place? The County's facilities plan through 2022 places an emphasis on transportation needs, but there is more to transportation than building more roads. The Link reduces congestion by taking cars off Midlothian Turnpike and Hull Street Road. Approximately 80,500 car trips per year can be avoided because of the Link service. Continued growth in the county will only add to the existing congestion experienced by ALL Chesterfield residents. Funding road expansion and maintenance will require more and more of the county's resources. Link routes help alleviate this drain on county dollars. "Though some object to the subsidy of l)ublic transportation, this criticism is often misguided Reducing congestion and pollution are clearly in the public's interest and cannot be achieved by the private sector alone. There is no transit system in the world, even in Western Europe, that operates without public assistance. Asphalt alone cannot meet the growing demand on our transportation network." Whitt Clement, Virginia Secretary of Transportation, R TD 4/18/2004 Chesterfield County strives to provide world-class customer service to residents. The GRTC commuter service routes provide this service - not only to riders, but to all Chesterfield County drivers who are relieved of 8,000 cars on Midlothian Tumpike and Hull Street Road. Richmond Times-Dispatch on 4/13/04 quotes Trip Pollard, land and community project leader of the Southern Environmental Law Center. "The region has done so little to move towards a regional public-transportation system in contrast to other regions." Mr. Gordon Rainey, Chairman of Friends of Regional Transit informed the Chesterfield Supervisors on 3/27/2003 Page 2 that Chesterfield is the largest community in the country without a regional transportation system. This is not world-class customer service for Chesterfield citizens. "If we are going to do any wheeling and dealing on this, I want to see my constituents on the 360 corridor served. It is the biggest traffic-congested area in the county" Renny B. Humphrey, Matoaca Supervisor, RTD 6/19/2003 The Link provides a vital service to those who otherwise do not have access to a vehicle. Two out of every five customers of the Link come from households with incomes less than $30,000 and 43% did not have a car available to them to make the trip if the Link service was not available. To be acknowledged for its extraordinar~ quali.t}, of life, Chesterfield · County will have to acknowledge that infrastructure has not kept pace with growth. Providing access to mass transit will help narrow this gap. Easing the congestion on two of the County's major thoroughfares enhances every traveler's quality of life. Chesterfield County and the entire metro Richmond area have been placed on the "bad air" list by the Environmental Protection Agency. "Children miss many school days and adults miss many workdays because of asthma attacks and other problems linked to ozone". (RTD 4/16/04) One alternative to meeting air quality standards is the development of mass transit. Link service adds to Chesterfield's quality of life for all residents, not just riders "Arthur S. Warren, chairman of the Chesterfield Board of Supervisors, said he hopes the bus line will relieve traffic congestion along the heavily populated U.S. 360 corridor. 'We have to wait and see, ' he said. 'This is a long-term investment. But clearly the fact that we now have a LINK service on the corridor shouM help relieve some of that traffic '." RTD 8/6/2003 For Chesterfield to be the safest and most secure community of its size in the USA, a reduction in the incidence of traffic accidents would be a Page 3 start. GRTC commuter service helps reduce traffic congestion and thus the number of accidents. Clogged rush-hour traffic slows the progress of emergency vehicles answering urgent calls where minutes mean lives saved. VDOT figures reveal that the annual average daily traffic between Spring Run Road and Route 288 increased from 51,453 in 2000 to 66,689 in 2003, a staggering 30% increase in three years. "Five of the top ten crash intersections last year are on Route 360 from Courthouse Road to Harbour Pointe Parkway. The entrance to Brandermill recorded the highest number of accidents. The high density retail area around ChesterfieM Mall ranked second in crashes collectively." The Observer 4/14/2004 Chesterfield County would like to be the uni[vine leader o£1ocal government, a noble goal. However, City of Richmond, Henrico County, and even the City of Petersburg maintain mass transit services for residents. It would be a unifying factor for the Petersburg Express bus route to add a stop in the Chester area, to benefit Mr. King's constituents in the Bermuda district. The Henrico County Board of Supervisors scheduled and publicized a public hearing on April 27th to discuss the continuation of three Henrico bus routes. GRTC transportation was arranged for those who attended the public hearing. The City of Richmond spent $6.27 million in fy 2003 on GRTC route subsidies. Henrico County funded $2.7 million during that same time. Chesterfield County funded $48,000. "The General Assembly has had the vision to help our community establish this new service. But to be successful, Chesterfield County must shoulder its share of funding as Henrico County and the City are doing." Gordon Rainey, RTD 3/23/2003. To be the employer of choice, the County must demonstrate a commitment to its citizens and their quality of life; expand the business tax base of the county and enhance county revenue sources, and recognize the need for mass transit; all of which will support county payrolls. To be the FIRST CHOICE business communiO;, Chesterfield's outlook must focus on relieving congestion on Midlothian Turnpike and Hull Street Road. With express park-and-ride, commuters become shoppers as they arrive at the end of the day - at Chesterfield Town Centre and at Lowe's - as well as other surrounding retailers. According to an RTD article 7/11/2001, the manager at Lowe's attTibuted additional customer trips to his store because of public transportation. "GRTC officials have said ridership needed to build over time, adding that the Richmond region had already received a $4.25 return on every dollar invested in the public- transportation service." "Chesterfield officials have always rejected the idea of spending local money on LINK." RTD 5/7/2003 Countless studies have shown that public transit makes compelling economic sense. A 1998 study by Apogee Research identified a number of benefits of investing in regional transit- including a 3-to-1 return on investment, elimination of more than 13,000 automobiles from our roads, reduced traffic congestion, elimination of the need for more than 70 lane- miles of roadway, commuter savings of $18.1 million, and elimination of 207 tons per year in vehicle emissions. "In 2002, an independent study showed public transportation generated about $128 million in economic value for the regional economy, while expenses totaled $28.2 million... 'In other words, for every dollar spent on public transportation, there is a $4.55 return in benefits to the region. One person using mass transit for an entire year, instead of driving to work, can keep an average of 9.1 Page 5 pounds of hydrocarbons, 62.5 pounds of carbon monoxide, and 4.9 pounds of nitrogen oxides from being discharged into the air. Summary of Information: Economic Development recommends amending the County's BPOL ordinance to cap annual BPOL tax in the financial services category to $90,000 per year. Currently, there is no cap on the annual tax liability for financial services businesses. Economic Development believes the amendment will help retain existing businesses and recruit new businesses to the County. At least one large company located in the County was considering moving to Henrico because of the less favorable tax structure of the County's BPOL tax for financial services businesses. By law, the cap would be effective for the first time for the 2005 tax year. The proposed cap would be similar to the existing $20,000 cap currently contained in section 6-33 of the County Code for wholesale merchants. The Commissioner of the Revenue recommends amending that section to make the wording of the two sections consistent and to clarify existing law, which is that the cap is an annual cap.
