GECKER FOR HIS SERVICE ON THE COMMITTEE ON THE FUTURE WHEREAS, the Chesterfield County Committee on the Future was established in 1987 by the Board of Supervisors and the County Charter for the purpose of assessing the future and long range challenges which the County will face, advising the Board of Supervisors, and making recommendations to lessen any adverse effect on the County of future changes; and WHEREAS, Mr. Daniel A. Gecker was appointed as a member of the Committee in 1996 and served as Vice Chairman of the Committee from June 1998 through December 1999, and WHEREAS, Mr. Gecker has served the citizens of the Midlothian District with distinction for the past four years; and WHEREAS, Mr. Gecker conducted numerous Committee meetings and public forums and was instrumental in the creation of the Committee's "Youth Development" report; and WHEREAS, the Committee prepared the "Youth Development" report which creates recommendations to maximize the opportunity for Chesterfield County youth to become engaged contributors within their communities through community, church, and private organizations, voluntarism and school involvement; and WHEREAS, Mr. Gecker has dedicated countless hours to the Committee during the past four years. Project: Proposer: Description: JeffDavis Corridor Proactive Code Enforcement Specialist - 3rd Year of Funding $48,850 Chesterfield County Planning Department Full-time inspector hired within the Chesterfield County Planning Dept. Inspector is to identify, coordinate & help resolve property maintenance violations within the Jefferson Davis Corridor and the Village of Ettrick; Inspector works w/neighborhoods & business organizations & sets priorities for pro-active code enforcement. Works w/IDA. Note: The Planning Department applied for funding for a second property maintenance inspector to work within the targeted areas. The amount requested for initial funding of this position is $43,287. This position was not recommended to be funded. 2. Project' Proposer: Description: Chesterfield County Workforce Development $50,000 Fresh Start Job Development & Training Program Program is designed to provide employment testing, counseling and job placement services to low/moderate income Chesterfield County residents. Office to be located at Park Lee Apartment Complex and open during the hours of 9:00 a.m. to 5:00 p.m. Intake & Assessment will be held on Tuesdays & Thursdays. 90 day follow-up & retention of job; 3. Project: Proposer: Description: Business Revitalization Coordinator $62,300 CDBG Department - Beverley Coleman Full-time Coordinator provides technical assistance to business owners/occupants located within the Urban Enterprise Zone along the Jefferson Davis Corridor and Village of Ettrick. Serves as a liason between the JDA and the CDBG Department. Provides assistance to several neighborhood & business organizations as well as County staff. 4. Project: Proposer: Description: Business Development Opportunities $50,000 Virginia Community Development Loan Fund(VCDLF) - Timothy Hayes, Exec. Director VCDLF is a Virginia Corporation formed in March of 1995. Its mission "Creating alternative models of financing that facilitates community economic development." Since its inception the mission has been achieved primarily through its micro loan program. This program provides Fin- ancing, training and technical assistance to those individuals that lack access to traditional capital, desiring to start new business or expand an existing business. Emphasis is placed on the creation & expansion of small and minority owned businesses. 5. Project: Proposer: Description · Demolition Project - $60,000 Chesterfield County Building Inspections Department - William Dupler, Building Official Demolition and removal of a vacant church building located at the intersection of Chesterfield Avenue and Light Street in the Village of Ettrick. The building is a nuisance and has become a breeding ground for loitering as well as posses an imminent threat to the community. Public Facilities/Improvements Project' Proposer: Description: Purchase of an Ambulance - $101,479 Bensley/Bermuda Volunteer Rescue Squad Funds will be used for the purchase of an ambulance to replace Ambulance 525 for Bensley- Bermuda Rescue Squad. The replacement is part of a strategic plan developed for a schedule of upgrades & replacements for the fleet of ambulances used by the rescue squad. The ambulance is a Type III modular ambulance currently mounted on a Ford E350 chassis. In addition, the unit will be equipped for Advanced Life Support level & used for Basic Life Support incidents. 7. Project: Proposer: Description: Purchase of a Ladder Truck for Bensley Fire Station - $150,000 Chesterfield County Fire Department Funds will be used for the purchase of a standard fu'e department ladder truck for the Bensley Station located at 2836 Dundas Road. This request is for partial funding only. $540,000 will be allocated through the General Fund. 8. Project: Proposer' Description ' Camp Baker ADA Facility Conversion (Multi-Phased Public Imprvt's) $150,000 Richmond Area Association for Retarded Citizens This is a 2nd year request for a multi-phased public facility improvement at Camp Baker, a rustic facility owned by Chesterfield County and leased by the county to the Richmond Area ARC to operate programs for persons with severe disabilities that allow short-term respite for caregivers. The improvements are in accordance to a 10 year Master Plan. Project involves the continuation of on-going construction of a multi-phased project that includes a new dormitory style building at Camp Baker and renovations of several cabins. Project: Proposer: Description: Purchase of 21 Hand-Held Capnographs for CDBG eligible Fire Stations $55,000 Chesterfield County Fire Department Capnograph units will be placed on ambulances & first response vehicles located in CDBG eligible areas. The capnographs will allow skilled volunteers/career paramedics to enhance advanced life support care for residents in the Bensley& Ettrick Communities. Use of these devices will enable the rescue squad to provide critical patient care monitoring during advanced airway procedures. 10. Project: Proposer: Description: Crescent Park Sewer Line Extentiort/Installation-Final Funding $163,000 Chesterfield County Public Utilities Dept. / CDBG Department The project entails the installation ora public sewer line to serve approximately 22 households within the Crescent Park neighborhood. Those households who meet the low/moderate income criteria as defined by HUD will be allowed a grant for the lateral/connection cost. Those who fail to meet the income guidelines will be billed over a period of approximately 36 months the costs associated with the connection fees. Approximate costs will be $1,465.00 plus plumbers fees. 11. Project: Proposer: Description: Ettrick Park Basketball Courts $57,000 Chesterfield County Parks & Recreation Funds would be utilized to provide for the construction/installation of portable basketball courts at the Ettrick Park site. 12. Project: Purchase of Mobile Data Computers in CDBG eligible Communities $100,000 Proposer: Chesterfield County Fire Department Description: The first phase of a project to outfit all emergency medical and fh'e vehicles with this equipment. Devices will be linked to all hospitals which the county delivers patients. It will enable emergency providers to have direct access w/the emergency room staffconcerning patient care. The equipment allows for emergency medical providers to collect important medical information that may be faxed directly to the physician in the receiving Emergency Room. Partial funding is requested for this project. The total project cost is $750,000. Additional funds will be raised through Private & Corporate Foundations. 13. Project: Proposer: Description · Cogbill Road Sidewalk Improvements - $93,800 (Presently ineligible) Meadowdale Area Community Council Request is for match funding for the installation of lighting, sidewalks, curbs & gutters within the Dale Magisterial District along Cogbill Road, south of Chippingham Pkwy, west of Hopkins Road, north of the Meadowdale Library. Currently, there is no playground apparatus/equipment at the school previous equipment had been condemned and removed by the County's School Board. Jefferson Davis Police Precinct - 2nd Year Lease Escalation $98,880 Chesterfield County Police Department The Police Dept. proposes to lease an approximately 4,000 square foot single story office building Lease will be for 10 years with rent payable on a monthly basis. Building will be built to the spec- ification of the police department. $ 96,000 figure is based on an annual lease payment of $24 per square foot, approx. 4,000 sq. ft. building. Monthly lease payment ors 8,000 is projected. A definitive site has been chosen along Route 10 in Chester, however no conslruction to date has taken place. Winchester Greens Single-Family Housing Development/Infrastructure Improvt's. - $200,000 Better Housing Coalition - Robert Newman, Operations Director Funds are being requested for the installation of curbs and gutters within the proposed single- family development section of the Winchester Greens (formerly Park Lee) housing complex. 17. The Chesterfield County Public School Administration has participated voluntarily since January 1970. The Board's procedures are governed by Administrative Procedures Policy Number 800-4. Due to changes in staff, the membership of the JARB appointments need to be updated. Why The purpose of the JARB is to make recommendations and take actions to improve motor vehicle safety; and reduce the Public School and County's liability exposure. A driver with repeated poor driving judgement may lose driving privileges. Role The policy applies to all Chesterfield County and Public School employees and volunteers who operate County or School Board owned motor vehicles. It also applies to Chesterfield County Health Department state employees who use County or vehicles trader the COOP agreement. The JARB reviews all motor vehicle accidents to decide whether the vehicle operator did everything reasonably possible to prevent the accident. Summary of Information: Mr. McHale requested staff to initiate the process to consider a request to prohibit any through truck or truck and trailer or semi-trailer combination, except pickup or panel trucks from using Bermuda Hundred Road (Route 697) between Meadowville Road (Route 618) and Kingston Avenue (Route 4841). The recommended alternate route is Kingston Avenue (Route 4841), Route 10, Rivers Bend Boulevard (Route 4840), and Meadowville Road (Route 618). The Virginia Department of Transportation (VDOT) has five (5) criteria it considers when a prohibition is requested. Based on staff's preliminary review, this request will satisfy three (3) of VDOT's five (5) criteria for imposing a prohibition, in that: 1) there is a reasonable alternate route, 2) the route is classified as a local or collector road, and 3) there are 12 dwellings per 1000 feet of roadway along Bermuda Hundred Road. This request will not meet the remaining two (2) criteria in that 1) the volume of through trucks does not exceed VDOT's 50 per day minimum volume, and 2) the accident history of the roadway does not indicate that it is not suitable for truck traffic. VDOT provides $54 million for Route 288 from Lucks Lane to Route 60 in the current six year improvement program. Construction is anticipated to begin this summer on this section of Route 288. Powhite Parkway, from Route 288 to Coalfield Road, needs to be widened to four lanes due to the construction of Route 288 and should be considered part of the Route 288 Project. This section of Powhite Parkway carries approximately 15,000 vehicles per day and this volume is expected to increase to 40,000 vehicles per day by the year 2015. Route 360 (Swift Creek to Winterpock Road) The widening of Route 360 to eight lanes from Swift Creek to Winterpock Road should be the County's second priority. This section of Route 360 carries between 39,000 and 52,000 vehicles per day and this volume is expected to increase to between 59,000 and 79,000 vehicles per day by the year 2015. The County has completed the design and has the right-of-way needed for construction of the interchange. This project is not in VDOT's current six year program. Powhite Parkway Extension; East-West Freeway; North-South Freeway Preliminary engineering and right-of-way acquisition for thc County's "outer beltway" (Powhite Parkway Extension from Route 288 to Route 360, East-West Freeway from Route 360 to Interstate 95, and North-South Freeway from East-West Freeway to Interstate 85) should be the County's ninth priority. Preliminary engineering is needed to properly identify the location of the "beltway." Right-of-way should be acquired where growth threatens to block the corridors. This project is not in VDOT's current six year program. New Freeway (I-95/I-295 Connector) Preliminary engineering for a connector between Interstate 95 in the Walthall area and Interstate 295 should be the County's tenth priority. The eastern area of the County has been designated for major commercial/industrial development and this area of the County is developing rapidly. As development occurs, Route 10 (from Interstate 95 to the Appomattox River) will be the major highway serving the area. Route 10 will not accommodate the expected traffic from the commercial/industrial developments. Extending the County's planned East-West Freeway from Interstate 95 to Interstate 295 will help reduce traffic on Route 10. Preliminary engineering is needed to determine the feasibility of this connector. This project is not included in VDOT's current six year program. Route 360 (Winterpock Road to Otterdale Road) The widening of Route 360 to six lanes from Winterpock Road to Otterdale Road should be the County's eleventh priority. This section of Ronte 360 carries between 19,000 and 33,000 vehicles per day and this volume is expected to increase to 50,000 vehicles per day by the year 2015. This project is not included in VDOT's current six year program. Signalization (Countywide) The installation of traffic signals at various intersections should be the County's twelfth priority. Signalization requests on primary roads through Board members include; Route 360 at Lynview Drive, Route 360 at Broadstone Road, Route 10 at Ecoff Avenue, Route 10 at Parker Lane, River Road at Picket Avenue and signal improvements along the Route 60 corridor. VDOT's current six year program includes approximately $200,000 each year for signalization needs throughout the entire Richmond District. Sight and Sound Barriers (Countywide) The construction of sight and sound barriers along Powhite Parkway and Route 288 should be the County's thirteenth priority. These barriers are needed to reduce the impacts of the roadways on adjoining neighborhoods. This project is not included in VDOT's current six year program. Park and Ride Facilities (Countywide) Preliminary engineering to identify potential park and ride facility locations should be the County's fourteenth priority. These facilities will be needed in the future to help reduce Countywide traffic congestion. This project is not included in VDOT's current six year program. Remove Tolls on the Powhite Parkway Funding to retire the debt on Powhite Parkway from Chippenham Parkway to Route 288 and allow the tolls to be removed from Powhite Parkway should be the County' s fifteenth priority. VDOT's FY01 PRIMARY PREALLOCATION HEARING April 5, 2000 I am Arthur Warren, Chairman of the Chesterfield County Board of Supervisors. I appreciate the opportunity to appear before you today to present Chesterfield County's primary and interstate road needs. For the record, I am submitting Chesterfield County's priority list of highway projects. I believe you have a copy of the list. In the interest of time, I will only address our highest priorities. First, let me thank the Department for the progress we have seen on the Chippenham Parkway project. Completion of the improvements on Chippenham Parkway will be a tremendous benefit to Chesterield and the entire region. Let me again this year thank the Department for its support in getting funding for the construction of ATTACHMENT C PAGE 1OF4 Route 288. The completion of Route 288 remains Chesterfield's highest priority. We are pleased that construction on the first section of Route 288 from Powhite Parkway to Lucks Lane is underway. However, we are concerned that the start of construction on the second section from Lucks Lane to Route 60 has been deferred more than a year from the original schedule for start of construction. We ask that you move forward with advertisement of the next section of Route 288 at the earliest possible date. Also, Powhite Parkway needs to be widened to four lanes from Route 288 to Coalfield Road due to the construction of Route 288. It is requested that this section of Powhite Parkway be added to the Route 288 Project. Now let me talk with you about a couple of our other priorities that still need to be addressed. Route 360 should be widened to eight lanes from Swift Creek to Winterpock Road. This section of Route 360 is carrying 52,000 vehicles per da~. Preliminary ATTACHMENT C PAGE 2 OF 4 engineering on the project is underway. We need money for construction. We. request you transfer funds you already have in your program from the section of Route 360 from Route 288 to Genito Road to the Winterpock section to allow advertisement of this project. Developers are obligated to improve almost half of the Genito section, so the transfer would allow us to get both sections improved. Route 10 in the Enon area is the next project I want to discuss. It needs to be widened to six lanes from Route I to Meadowville Road. Construction plans have been developed for the section from 1-95 to Meadowville Road. The Commonwealth Transportation Board approved the design on this project in September, 1999 and the plans are ready to go to construction. We need funding for at least the first section from 1-95 to Ware Bottom Spring Road. Homer Park. The resolution also requests designation of the new roadway as a "Virginia Byway." Summary_ of Information: Property for Irvin J. Homer Park was purchased with funds from the 1996 Bond Referendum. Irvin J. Horner Park is designated in the Parks and Recreation Master Plan as a District Park recreational facility. Grant funds from the VDOT Recreation Access Program are required to construct the entrance road into the Park. Matching funds of $100,000 will be available in the proposed FY2001 Capital Project, to bring the project total to $450,000. Facilities in this park will include 25 acre lake, fishing areas, water access, picnic areas, ball fields, court game area, and trail system. The County's cost will be to match 50/50 the additional project costs over $250,000 as a stipulation of this grant. The $100,000 match will be paid for from bond fund dollars previously allocated to the Western Area Park project. This grant, if awarded, will provide $250,000 unmatched state dollars for construction of an access road. The next $100,000 of state dollars will need to be matched with $100,000 by the County for a total project cost of $450,000. This grant (totaling $350,000), and County bond fund dollars of approximately $1,450,000 will provide $1,800,000 total funds to develop the first phase of the Irvin J. Homer Park facility. This facility would provide general recreation found at other District Parks within the County, plus a lake. The construction of the access road is anticipated to be completed by the fall of 2001. Operating funding tbr the facility will be addressed in the FY2002 operating budget process. An additional $1,620,000 is included in the adopted FY 2000-2004 CIP for this facility. Summary of Information: At its February 23, 2000 meeting, the Board set a public hearing for May 24, 2000 to consider amendments to County Code §19-159 and to reenact those amendments with an effective date of June 21, 2000. The purpose of this action was to allow a developer who received a ruling from the Board of Zoning Appeals permitting a multifamily development to vest his right to construct that development before the new ordinance became effective. The Board previously established an effective date for the ordinance of February 1, 2000 based on staffs' representation that, once the developer had submitted his site plan to the County, his fight to develop would vest. Since that action, a question has arisen whether the site plan must actually be approved, rather than merely be filed, to give the developer vested rights. In light of this issue, the Board was asked to consider extending the effective date of the new ordinance to provide additional time for the developer' s site plan to be approved. At this time, however, the County Administrator has decided that, since the developer and the Board were originally told that vesting occurred when the site plan was filed, and since the site plan was filed prior to the current effective date of February 1, 2000, there is no need to consider further revisions to the effective date of the new ordinance and the developer's project will be considered tc have vested. In light of this history, the Board is requested to cancel the May 24, 2000 public hearing and to direct the Planning Commir~fi~on that it is no longer required to consider the proposed ordinance amendment. Lafler has been a resident of Chesterfield County for eleven years and served for six years as the manager of Cloverleaf Mall; and WHEREAS, Hr. Additional Land Subject to the Upper Swift Creek Watershed Ordinance The Planning Commission and staff agree that development on an estimated 1,000 acres within the Midlothian Area Community Plan and the Route 288 Corridor Plan, suggested for residential use of up to 2.5 units per acre and not subject to the higher quality standards of the Upper Swift Creek Watershed Ordinance, should be made subject to the 0.22 lb./acre/year standard. Specifically, the Commission feels that this density reduction will bring the Plan into compliance with the water quality standards of the Upper Swift Creek Watershed Ordinance and further bring the Plan into compliance with the residential densities of projects being developed within the watershed. Planning staff, however, does not support these density reductions. Specifically, the water quality performance standards of the Upper Swift Creek Watershed Ordinance must be met by any residential development regulated by the Ordinance, regardless of the density to which a project is built. Therefore, adequate protection of the Reservoir, without the need to further reduce Plan densities, already exists (See attached memorandum dated October 15, 1999). Summary Residential projects developed under various actual and hypothetical scenarios can yield densities of 2.2 units per acre or greater and still comply with the 0.22 standard. However, depending on topography and hydrology which influence the amount of pollutant that can be captured within a given project, compliance with the 0.22 standard can make it difficult to achieve residential densities as high as 2.0 or 2.2 units per acre for typical single family residential subdivisions. When this happens, developers of subdivisions typically choose to reduce the subdivision density to the extent needed to achieve compliance. Under the same set of topographic and hydrologic conditions, residential projects that reduce the percentage of impervious area in ratio to the overall area of a project and that further minimize land disturbance (such as cluster and townhouse projects) may achieve a higher density (units per acre) and, at the same time, comply with the 0.22 standard. An overview of Research The following briefly describes current Zoning Ordinance regulations designed to protect the water quality of Swift Creek Reservoir and anticipates how well recently approved residential projects of various densities will comply with the adopted regulations. Also included is a review of how new residenti'al developments, with a density in the range of 2.2 units per acre, can meet the water Providing a FIRST CHOICE community through excellence in public service. quality performance criteria, and a review of how compliance with this criteria is influencing residential development densities for projects in the Upper Swift Creek Watershed. Current Regulations The Zoning Ordinance addresses protection of water quality through the following Divisions of the Countywide Development Standards (Article IV.): Chesapeake Bay Preservation Areas (Division 4); Upper Swift Creek Watershed (Division 5); and Stormwater Management and Best Management Practice Basins (Division 6). The Upper Swift Creek Watershed Ordinance, in particular, requires new development which drains to Swift Creek Reservoir to meet performance criteria designed to protect water quality of the Reservoir. This criteria requires development to: minimize land disturbance; preserve indigenous vegetation; minimize impervious areas; control of stormwater runoff in a manner that limits phosphorous and other pollutants; and provide for the maintenance of best management practices (BMPs) used to achieve the water quality performance criteria. This Ordinance regulates all new residential, office, commercial and industrial development or redevelopment within the Upper Swift Creek Watershed. All new residential developments, located in areas identified by the Comprehensive Plan as appropriate for residential use of 2.2 units per acre or less, have to meet a specified water quality performance criteria (the 0.22 standard) regardless of the number of units per acre that could be developed based on current or future zoning actions, unless exceptions were granted as provided by the Ordinance. This performance criteria applies to all types of residential projects including, but not limited to, single family residential subdivisions, residential townhouse subdivisions, and multi-family and condominium complexes. Assessing the Design Performance of New Developments Relative to Compliance with Upper Swift Creek Watershed Water Quality_ Regulations Environmental Engineering staff reviewed the design of recently proposed and/or approved residential subdivisions located within the Upper Swift Creek Watershed and assessed their compliance with the 0.22 standard. The subdivisions examined included: Cloverhill Estates and Watermill Phase I, (currently under construction); Edgewater at The Reservoir, (recently recorded); Hampton Park Sections Six through Twelve, (parts of a subdivision granted tentative approval); and a possible residential scenario for DH-Spring Run Extension, part of a zoning request proposing a mix of residential, office and commercial uses along Hull Street Road (see Attachments A and B). These subdivisions range in density from 1.52 (Watermill, Phase I) to 2.27 units per acre (Hampton Park, Sections Six through Twelve). Through the subdivision review process, Environmental Engineering staff determined that these developments will comply with the 0.22 standard using on-site BMPs of various designs. Of particular interest was Hampton Park, Sections Six through Twelve. As noted herein, this subdivision achieved compliance with a density of 2.27 units per acre. BMPs for this subdivision include two wet ponds in series which capture runoff from the subdivision as well as runoff from undeveloped off-site areas. Assessing Possible Development Scenarios Relative to Compliance with Upper Swift Creek :80:3 Watershed Water Quali _ty Regulations Planning and Environmental Engineering staff also analyzed hypothetical development scenarios to determine how well various residential types might comply with the 0.22 standard under similar density and/or site characteristics. Planning staff developed four hypothetical scenarios. Three scenarios reflected conventional single family residential subdivisions having development densities of 1.91, 2.0 and 2.2 units per acre respectively. The fourth reflected a townhouse project having a development density of 2.2 units per acre (see Attachment C). For purpose of this analysis, staff assumed identical topographic and hydrologic conditions for all scenarios. Staff's analysis determined that all four hypothetical scenarios could be designed to achieve compliance with the Ordinance. Staff further determined that, under identical site conditions, the townhouse project could achieve compliance more easily than could a single family residential subdivision of conventional lots of the same or even lesser overall density. This ease of compliance was due primarily to a reduced percentage of overall imperviousness and land disturbance resulting from clustering home sites (see Attachments D and E). It should be noted that scenarios using different site criteria could demonstrate a greater or lesser ability to achieve compliance. Assessing the Impact the Upper Swift Creek Watershed Water Quality Regulations have on Residential Densities Many factors can affect the development densities within residential projects. These include, but are not limited to, market demand for residential type and/or lot size and environmental constraints such as wetlands and Resource Protection Areas. However, as noted herein, compliance with the 0.22 standard has been a significant factor in the design and density of new subdivisions in the Upper Swift Creek Watershed. Specifically, this compliance has generated lower development densities as a means of meeting the 0.22 standard. In general, staff has determined that water quality protection measures, such as BMPs, often consume land that could otherwise be used for residential development, having the effect of reducing development density in much the same way that rights-of-way for roads reduce lot yield (density) from yield calculated on a gross density basis. The ultimate density of development is, therefore, influenced as much by the requirement to comply with the 0.22 standard as by either conditions of zoning approval or the Land Use Plan suggested density. In particular, while the Land Use Plan suggested density plays an important role as a guide in zoning and subsequent project layout, it should be noted that the Plan does not factor into the review and approval process of the Environmental Engineering Department for achieving water quality compliance. Attachment A Analysis of five proposed or approved residential projects Compliance with 0.22 lb/ac/yr Water Quali~ requirement Cloverhill Estates 128 lots / 71.9 acres = 1.78 units/ac gross density. The BMP is a single 50 % efficient wetpond. Capture of the entire subdivision provided 75% of pollutant removal needed for compliance. Capture of 131.5 acres of low impervious off-site area provided the rest of the pollutant removal needed. The project is currently under construction. Watermill Phase 1 103 lots / 67.9 acres = 1.52 units/ac gross density. 30.26 ac in lots, 12.41 ac in r/w, 25.23 ac in open space, 3.48 ac in CUPD recreation and retail. Three BMPs are used. A 40 % wetpond, in series with a 65 % wetpond further downstream, and another 65 % wetpond. 50 acres on-site are captured. Only 2 acres of off-site area were available for capture. The project is currently under construction. Edgewater at The Reservoir 32 lots / 17.1 acres = 1.87 units/ac gross density. of future Woolridge Road extension. 1.5 ac in r/w. Includes compliance for 2.0 acres Three BMPs are used. Two marshy bottom dry ponds in series which capture a total of 13.2 acres on-site and 29.7 acres of undeveloped off-site area. An additional dry pond captures 1.6 acres on-site. The project has been recorded. Hampton Park, sections 6 - 12 148 lots / 65.3 acres = 2.27 units/ac gross density. 9.9 acres in r/w, 13.7 ac in open space. (Zoned prior to 2.2 requirement) Two wet the pond (35% and 50%) BMPs in series provide compliance with 0.22 requirement. 60.3 acres on-site area and 125.7 acres of undeveloped off-site area are captured. The on-site area provides 93.6% off the pollutant capture needed for compliance. Sections 6 & 7 are beginning construction. The smallest size and efficiency, 35 %, wetpond provides 0.22 compliance for all the residential and 0.45 compliance for all the commercial. Single Family An R-12 subdivision layout on 43 acres. In the absence of topographical information, it was assumed the BMP captured all the onsite and no offsite area. This topography assumption is not representative of actual projects. The site had an RPA and a BMP located in open space. Under this scenario, R-12 zoning setbacks and minimum lot widths reduced the maximum lot yield to 82, or 1.91 units per acre. Townhouse The layout of an actual project with 94 units was used. 43 acres are required to meet the 2.2 units per acre maximum density. 11 acres of the site are developed, not including the BMP easement. It is reasonable to assume capture of the entire impervious area of the site based on the typical grading and storm sewer systems. Summary_ of Information: Attachments: Airport Investment, L.L.C. is a subsidiary of Avcom which is an electronics manufacturing company that has been located in Chesterfield County since approximately 1980. Through Airport Investment, L.L.C., Avcom recently purchased a facility located at 7730 Whitepine Road in the Airport Industrial Park. Airport Investment, L.L.C. is now interested in acquiring a 2.5 acre parcel located adjacent to their current facility for future expansion. Airport Investment, L.L.C. has agreed to purchase the property for $55,000 per acre. Airport Investment has also requested as a condition to purchasing the property that the County waive the covenant that gives the County the fight to repurchase the property at the originial sales price in the event construction of improvements on the parcel does not commence within six (6) months. Airport Investment plans to construct an expansion of its existing facility on the parcel, but is only in the planning stages of the expansion. Construction is not likely to begin within six (6) months. Staff recommends approving the sale and the waiver. The right to repurchase was placed in the covenants when the Industrial Park was established to prevent speculative purchases. The park is almost completely developed and speculative purchases are not a risk. Moreover, the County still possesses in the covenants a fight to repurchase the parcel if Airport Investment ever wishes to sell the parcel. The Medicaid reimbursement contemplated by the State did not materialize because the State was delayed in receiving federal Medicaid certification approval. Subject: Amendment to § 5-6 of the County Code to Authorize the Removal of Graffiti at Public Expense CounW Administrator's Comments: County Administrator: Board Action Requested: Amend the existing ordinance to permit the County to remove graffiti at public expense. Summary_ of Information: The current ordinance permits the Building Official to repair or remove graffiti on private buildings that is visible from the public right-of-way and to charge the expense to the property owner. At Mr. Barber's request the Board held a public hearing in December to consider amending the County Code to authorize removal of graffiti at public expense. Since then, we have concluded that there is questionable legal authority to charge property owners for the cost of graffiti removal. At its February 9, 2000 meeting, the Board instructed staffto advertise repeal of the existing ordinance and to present to the Board an ordinance that permits the removal of graffiti at public expense. Under the proposed modified ordinance, the existing ordinance would be repealed and the amended ordinance would provide that graffiti will only be removed by the County at County expense in accordance with administrative procedures. (See attached procedures). Henrico and Richmond currently have similar ordinances. Staffalso investigated the possibility of the cost of graffiti removal being covered by normal property owners' insurance policies. Since standard policy deductibles would normally exceed the costs, it is unlikely that insurance would be a viable option. Further, the City Manager of Richmond has agreed to use city resources to remove a number of the existing graffiti sites in Chesterfield County at no expense to the County. Investigate complaint to determine if in compliance with County Ordinance. 2. If in violation, a Notice of Violation is prepared giving the owner thirty days to remove graffiti. Notice is mailed to the property owner and posted at the property if necessary. 3. The complainant is contacted and advised of the status of their complaint. 4. Property is reinspected thirty days after the date of the Notice of Violation for compliance. 5. If not in compliance removal contractor is scheduled by the County without further notice to owner. 6. After removal, bill for costs of removal is forwarded to property owner. If owner fails to pay within 90 days, the bill is forwarded to the County Attorney to attach a lien on the property. Proposed Process 1. Investigate complaint to determine if in compliance with County Ordinance. Owner is mailed a letter advising graffiti must be removed within thirty days or it will be removed without the owner's permission. If the owner completes an authorization form, the County will make arrangements to have the graffiti removed as soon as possible, i.e. before thirty days expires, without any cost to the owner. Complainant contacted and advised of status of complaint. If the authorization form is not returned after thirty days, Building Official will determine if funds are available to pay costs of removal and, if so, the County will schedule the graffiti for removal. The proposed Six Year Plan includes the same projects approved by the Board in May 1999 with the inclusion of one new state-funded project (Summit Road Extension), and four new federally-funded safety projects requiring a 10% state match. Two of the projects are Highway/Rail Grade Crossing Safety Improvement Projects at Ramblewood Road and Bellwood Road, and two are Hazard Elimination Safety Improvement Projects at Old Buckingham Road at Unison Drive and Hickory Road near Butler Lane. The Robious Road project (Route 60 to Woodmont) has been delayed four months. Lakeview Road/Woodpecker Road intersection project and Branders Bridge Road project (Ronte 10 to Happy Hill Road) have been delayed one year. Newbys Bridge Road project (Walmsley Boulevard to Falling Creek) and Newbys Bridge Road project (Falling Creek to Hagood Lane) have been delayed two years. The Plan has been developed based on an average $11.3 million per year allocation ($8.9 million secondary road funds, $1.4 million anticipated Richmond Metropolitan Planning Organization (MPO) Surface Transportation Program (STP) funds, and $1.0 million Chesterfield Road funds (VDOT/County matching program). The $11.3 million per year allocation is the same annual allocation that was used to develop last year's Six Year Plan. Details of the Six Year Plan are shown on Attachments A through H. The Surreywood Subdivision street paving project located in the Clover Hill District was approved by the Board on May 25, 1999, with the adoption of the FY00-FY05 Six Year Plan. This project was inadvertently omitted from the information submitted to the Board on February 23, 2000, setting the public hearing. Funding for the project will be transferred from another project in the Clover Hill District. FY01 Secondary_ Road Improvement Budget Each year VDOT requests the Board of Supervisors to approve a Secondary Road Improvement Budget. The budget reflects the first year of the proposed Six Year Plan and identifies specific project allocations for the upcoming fiscal year. Attachments I and J identify the projects and allocations for FY01. .Chesterfield Road Fund Project Development Schedule and Designation of FY01 Projects The County regularly participates in an annual VDOT matching fund program (Chesterfield Road Fund), wherein the County provides $500,000 in anticipation of an equal match (dollar-for-dollar basis) by VDOT. The exact amount of funds to.be matched by VDOT is determined by VDOT after all statewide requests for matching funds have been received. Staff will adjust the specific project allocations once VDOT makes its determination. Salem Church Road and Branders Bridge Road are designated to receive funding in FY01. The County Administrator's recommended FY01 budget includes $500,000 for Chesterfield's local match. Funding for projects is provided on a rotational basis among the magisterial districts. The last Chesterfield Road Fund Schedule was approved by the Board in May 1999. The recommended schedule (Attachment G) is a continuation of the currently approved Schedule with additional FY06 funding for the Dale and Bermuda Districts.
