The proposed increases, approximately 5% across all fee categories, are expected to generate approximately $25,100 per annum. The additional revenue will be used to offset costs associated with providing the service. Planning staff mailed copies of the proposed fees to over 100 members of the development community. On February 11 a work session was conducted with the Planning Commission to review proposed changes in the fees. A public hearing was held on February 15 after which the Planning Commission deferred any decision. On March 1, 2000 Planning staff met with representatives from the development community to discuss the proposed changes. The current rate structure requires that the cost of projects that provide additional capacity to support continued development be recovered from capital cost recovery charges. To provide the required funds, it is necessary to increase the water capital cost recovery charge (water connection fee) by $1,000 for an equivalent residential unit. Staff is recommending that the increase be phased in over four years with a $250 increase (from $2,592 to $2,842) effective July 1, 2000. Additional increases of $250 are anticipated over the next three years; however, an evaluation will be made annually prior to making a recommendation to the Board of Supervisors. Rates on all existing classes of property are to remain constant. The recommended rates are $1.08 for real estate; $3.60 for personal property; $1.00 for machinery and tools; $0.50 for airplanes; $0.96 for personal property for volunteer firefighters, rescue squads, and auxiliary members; $0.01 for wild and exotic animals; $3.24 for vehicles using clean and special fuels; and $0.96 for personal property class for vehicle trailers and semi-trailers with a gross weight of 10,000 lbs. or more. Real Property and Mobile Homes. On tracts of land, lots or improvements thereon and on mobile homes the tax shall be $1.08 on every $100 of assessed value thereof. Sec. 2. Personal Property (a) On automobiles, trailers, boats, boat trailers, other motor vehicles and on all tangible personal property used or held in connection with any mining, manufacturing or other business, trade, occupation or profession, including furnishings, furniture and appliances in rental units, the tax shall be $3.60 on every $100 of the assessed value thereof. (b) On aircraft as defined by Section 58.1-3503 and -3506 of the Code of Virginia, 1950, as amended, the tax shall be $.50 on every $100 of the assessed value thereof. (c) On motor vehicles owned or leased by members of volunteer rescue squads, volunteer fire departments, volunteer police chaplains and by auxiliary police officers as provided in Section 8-13.3, Code of the County of Chesterfield, 1978, as amended, the tax shall be $.96 on every $100 of the assessed value thereof. (d) On wild or exotic animals as defined by Section 58.1-3506 of the Code of Virginia, 1950, as amended, the tax shall be $0.01 on every $100 of the assessed value thereof. (e) On motor vehicles which use clean special fuels as def'med in Section 58.1-2101 of the Code of Virginia, 1950, as amended, the tax shall be $3.24 on every $100 of the assessed value thereof. (f) On motor vehicles, trailers, and semitrailers with a gross vehicle weight of 10,000 pounds or more used to transport property for hire by a motor carder engaged in interstate commerce, the tax shall be $.96 on every $100 of the assessed value thereof. An additional $90,300 in reprogrammed allocations identified after the proposed budget was prepared brings the new total for reprogrammed funds to $637,700 and the total FY2001 CDBG/HOME program to $2,433,100. The County's Community Development Block Grant and HOME Annual Plan for FY2001 is required to be submitted to the U.S. Department of Housing and Urban Development by May 15, 2000. The submission must follow a required public hearing by the Board of Supervisors (which was held on March 22, 2000). Project: Proposer' Description ' Demolition Project - $60,000 Chesterfield County Building Inspections Department - William Dupler, Building Official Demolition and removal of a vacant church building located at the intersection of Chesterfield Avenue and Light Street in the Village of Ettrick. The building is a nuisance and has become a breeding ground for loitering as well as posses an imminent threat to the community. Public Facilities/Improvements Project- Proposer: Description- Purchase of an Ambulance - $101,479 Bensley/Bermuda Volunteer Rescue Squad Funds will be used for the purchase of an ambulance to replace Ambulance 525 for Bensley- Bermuda Rescue Squad. The replacement is part ora strategic plan developed for a schedule of upgrades & replacements for the fleet of ambulances used by the rescue squad. The ambulance is a Type III modular ambulance currently mounted on a Ford E350 chassis. In addition, the unit will be equipped for Advanced Life Support level & used for Basic Life Support incidents. 7. Project: Proposer: Description: Camp Baker ADA Facility Conversion (Multi-Phased Public Imprvt's) $150,000 Richmond Area Association for Retarded Citizens This is a 2nd year request for a multi-phased public facility improvement at Camp Baker, a rustic facility owned by Chesterfield County and leased by the county to the Richmond Area ARC to operate programs for persons with severe disabilities that allow short-term respite for caregivers. The improvements are in accordance to a 10 year Master Plan. Project involves the continuation of on-going construction of a multi-phased project that includes a new dormitory style building at Camp Baker and renovations of several cabins. Project: Proposer: Description: Purchase of 21 Hand-Held Capnographs for CDBG eligible Fire Stations $55,000 Chesterfield County Fire Department Capnograph units will be placed on ambulances & first response vehicles located in CDBG eligible areas. The capnographs will allow skilled volunteers/career paramedics to enhance advanced life support care for residents in the Bensley& Ettrick Communities. Those households who meet the low/moderate income criteria as defmed by HUD will be allowed a grant for the lateral/connection cost. Those who fail to meet the income guidelines will be billed over a period of approximately 36 months the costs associated with the connection fees. Approximate costs will be $1,465.00 plus plumbers fees. Ettrick Park Basketball Courts $57,000 Chesterfield County Parks & Recreation Funds would be utilized to provide for the construction/installation of portable basketball courts at the Ettrick Park site. 12. Project: Purchase of Mobile Data Computers in CDBG eligible Communities $100,000 Proposer: Chesterfield County Fire Department Description: The in'st phase of a project to outfit all emergency medical and fire vehicles with this equipment. Devices will be linked to all hospitals which the county delivers patients. It will enable emergency providers to have direct access w/the emergency room staff concerning patient care. The equipment allows for emergency medical providers to collect important medical information that may be faxed directly to the physician in the receiving Emergency Room. Partial funding is requested for this project. The total project cost is $750,000. Additional funds will be raised through Private & Corporate Foundations. 13. Project: Proposer: Description · Cogbill Road Sidewalk Improvements - $93,800 (Presently ineligible) Meadowdale Area Community Council Request is for match funding for the installation of lighting, sidewalks, curbs & gutters within the Dale Magisterial District along Cogbill Road, south of Chippingham Pkwy, west of Hopkins Road, north of the Meadowdale Library. Project: Matoaca Elementary School Playground Improvements $31,000 Proposer: Matoaca Elementary PTA Description: Purchase & installation of playground equipment for Matoaca Elementary School. The playground apparatus and equipment will serve children in the kindergarden thru fifth grade As well as the residents of the Matoaca community. $2,000 of District Improvement Funds has been granted for this project. The County Administrator may, as provided herein, except as set forth in Sections 7, 12, 13, 15, 16, 17, 18, 19 and 21, authorize the transfer of any unencumbered balance or portion thereof from one classification of expenditure to another within the same department or appropriation category. The County Administrator may transfer up to $20,000 from the unencumbered appropriated balance of one appropriation category to another appropriation category. No more than one transfer may be made for the same item causing the need for a transfer, unless the total amount to be transferred for the item does not exceed $20,000. The County Administrator may increase appropriations for the following non-budgeted revenue items that may occur during the fiscal year: a) Insurance recoveries received for damage to any County property, in. cluding vehicles, for which Cotmty funds have been expended to make repairs. b) Refunds or reimbursements made to the County for which the County has expended funds directly related to that refund or reimbursement. c) Revenue not to exceed $20,000. The County Administrator may approve necessary accotmting transfers between funds to enable the capital projects to be accounted for correctly. Upon completion of a capital project, staff is authorized to close out the project and transfer any remaining balances to the funding source. This section applies to all existing appropriations for Capital Projects at June 30, 2000 and appropriations in the 2000-2001 budget. The County Administrator may approve construction contract change orders up to an increase of $15,000 and approve all change orders for reductions to contracts. The County Administrator may authorize the transfer of Utilities Capital Projects funds that are 20% or up to $100,000 of the original project cost, whichever is less, from any Utilities Capital Project to any other Utilities Capital Project. Should the actual contract price for a project be less than the appropriation, the Cotmty Administrator may approve transfer of excess funds to the funding source upon completion of the project. The approval by the Board of Supervisors to request and accept any grant of funds to the County constitutes the appropriation of both the revenue to be received from the grant and the County's expenditure required by the terms of the grant, if any. Allocation of Food Stamps will be considered a Board approved grant for purposes of this section up to the actual value of food stamps received. The appropriation of grant ftmds will not lapse at the end of the fiscal year, but shall remain appropriated until completion of the grant or until the Board of Supervisors changes or eliminates the appropriation. The County Administrator may reduce any grant appropriation to the level approved by the granting agency during the fiscal year. The County Administrator may approve necessary accounting transfers between funds to enable the grant to be accounted for correctly. All transfers to grant funds from operating funds are automatically carried over and reappropriated, unless the grant is completed and is to be closed out at June 30. Upon completion of a grant project, County Administrator is authorized to close the grant and transfer back to the funding source any remaining balances. The County Administrator is authorized to reprogram Community Development Block Grant Funds by closing program centers and transferrring funding to newly approved programs based on adoption by the Board of Supervisors. This applies to appropriations for grants outstanding at June 30, 2000 and appropriations in the 2000-2001 budget. The County Administrator may reduce revenue and expenditure appropriations related to programs funded all or in part by the Commonwealth of Virginia and/or the federal government to the level approved by the responsible state or federal agency. The Director of Accounting is authorized to make transfers to various funds for which there are transfers budgeted. The Director shall transfer funds only as needed up to amounts budgeted, or in accordance with any existing bond resolutions that specify the manner in which transfers are to be made. The Treasurer may advance monies to and from the various funds of the County to allow maximum cash flow efficiency. The advances must not violate county bond covenants or other legal restrictions that would prohibit such an advance. The County Administrator is authorized to make expenditures from Trust & Agency Funds for the specified reasons for which the funds were established. In no case shall the expenditure exceed the available balance in the fund. The County Administrator is authorized to transfer and/or appropriate funds in excess of $20,000 for supplemental retirement,Worker's Compensation,' healthcare for retirees, cost related to the coordinated pay plan, and/or any amount of Insurance Reserve funds consistent with the County's Risk Management program to departments, as needed. The County Administrator may appropriate revenues and increase expenditures in excess of $20,000 for funds received by the County from asset forfeitures for operating expenditures directly related to drug enforcement. This applies to funds currently on-hand at June 30, 2000, and all funds received in the 2000- 2001 budget year. The outstanding balance of these funds at June 30, 2000 or June 30, 2001 shall not lapse but be carried forward into the next fiscal year. The County Administrator may increase the general fund appropriation in the School Operating Fund, contingent upon availability of funds and taking into consideration any other expenditures which may have occurred, based on the following schedule: a) Increase general fund transfer/appropriation on December 15 by $1,500,000. b) Increase general fund transfer/appropriation on February 15 by $1,500,000. c) Increase general fund transfer/appropriation on April 15 by $1,500,000. Subsequent to all audit adjustments, the County Administrator may increase appropriations or authorize transfers of existing appropriations at June 30. This includes the authority to designate all available FY2000 operating funds to the general fund Reserve for Capital Projects or for subsequent years appropriations, assuming ending general fund balance is maintained at a minium of 7.5% of general fund expenditures. The County Administrator is authorized to reallocate funding sources for Capital Projects, arbitrage rebates/penalties, and debt service payments and to appropriate bond interest earnings to minimize arbitrage rebates/penalties. This authority would include the appropriation of transfers among funds to accomplish such reallocations. Budgets for specific Capital Projects will not be increased beyond the level authorized by Sections 3 and 4. This applies to funds currently on-hand in FY2000, and all funds received in the 2000-2001 budget year. The County Administrator is authorized to transfer among appropriation categories any amotmt of funds associated with implementation of the Comprehensive Services Act for at-risk youth and families and funding associated with the implementation of the VJCCCA Grant to record transactions. Salaries for Planning Commissioners will be increased equivalent to the increase given to all County employees. Effective upon adoption of this resolution, the County Administrator is authorized to approve transfers among funds and capital projects as long as total net spending is not increased. Beginning with the FY97 budget and effective upon adoption of this resolution, the Utilities Department rate stabilization reserve shall be created and maintained as per guidelines outlined below: a) The minimum annual contribution to the reserve will be 50% of the previous year's depreciation on fixed assets. b) The annual contribution to the reserve will continue until 100% of accumulated depreciation on the fixed assets is funded. If at the beginning of a fiscal year a reserve balance exceeds 100% of accumulated depreciation, a reduction in the annual contribution may be considered. b63 APPENDIX H APPROPRIATIONS RESOLUTION Sec. 23 Sec. 24 Sec. 25 c) Funds cannot be used from the rate stabilization reserve if the balance falls below 25% of that utility's fixed asset accumulated depreciation. d) The declaration of a financial emergency by the Director of Utilities and a corresponding four-fifths vote by the Board of Supervisors at a publicly advertised meeting declaring the existence of such an emergency is required to suspend Sec. 23 a, Sec. 23 b, and Sec. 23 c. No local funds are involved. Summary of Information: Chesterfield County Public Schools (CCPS) receives various grants that are approved during the annual budget process. The school division also applies for other grants during the year that can be used to enhance the current instructional program. Also, other grant funding is sometimes received after the school year begins. CCPS staff has written two new grants and two existing grants have received additional funding for FY2000. All of these now require approval by the Board of Supervisors at this time. SDecial Education Local ImDrovement (IDEA SLIVER) $ 64,.000 CCPS instructional leadership staff (general and special education) collaborate on staff development initiatives designed to prepare all students for participation in the Standards of Learning (SOL) assessments. CCPS has applied for a block grant in the amount of $64,000. A portion of these funds ($38,900) will be used to provide the necessary training to staff to accomplish the first goal. This training will include funds budgeted for substitutes, stipends, materials, and software for teachers participating in workshops as well as the cost of a consultant to provide the training. For the second goal, funds ($25,100) will be budgeted for substitutes, stipends, transportation, and materials for teachers to train special education teachers on how to use the IEP proficiency guidelines. Individualized Student Alternative Education Plan (ISAEP) $ 47,152 CCPS has developed an Individual Student Alternative Education Plan program that serves students not currently served in either the GED or Literacy Development Program. The differences this program covers is either age or academic ability. The first group of students this program will cover are those that are 16 and eligible for GED but do not have the skills to successfully complete the GED in a short period of time. The program also covers students that are 15 and do not qualify for the GED program but are academically unprepared to enter high school even though they do not lack the skills to complete the Literacy program. The goals of the ISAEP will be: 1) to adequately prepare students to enter the GED program where they can obtain a GED; and, 2) to provide students with marketable job skills. The learning experience will include two hours each of instruction in reading, writing, and math as well as two hours of technical training in a trade. Two and one-half hours each week will be spent in career counseling and on developing work readiness skills. Students will be transported from the school site to the Technical Center to participate in the PM Tech Program (an existing program that teaches trade skills to at-risk youth). Arrangements will also be made for students in the program to attend the Vocational Assessment Center to complete a three- day evaluation of their skills and interests. Evaluation of student progress will be based on attendance, participation and behavior in the ISAEP program. CCPS received notification from the State Department of Education for a special grant of $47,152 of ISAEP funds on February 23, 2000. Funds must be spent between this date and June 30, 2000. No local funds are required. SDecial Education In-Service Training Grant $ 25,000 CCPS has received notification from the State Department of Education of federal funding in the amount of $25,000 for Special Education in- service training. These funds must be used in training teachers in special education programs. The period of this grant is from February 23, 2000 to December 31, 2000. No local funds are required. Crestwood Elementary Bicycle Safety Grant $ 2,500 Crestwood Elementary School has received an approval of their grant application from the State Department of Education in the amount of $2,500. The funds have been provided for a bicycle-safety curriculum enrichment project. Under the direction of one of the teachers at Crestwood Elementary, students will have the opportunity to increase school and community bike safety awareness, and promote lifetime fitness. The funds associated with these students need to be appropriated in the Title I program where the expenses were incurred. Carl Perkins Vocational Education Grant $ 24,617 CCPS staff estimated the Carl Perkins Vocational Federal Funds for FY2000 at $423,000. CCPS received notification from the State Department of Education through Superintendent's Memo %155 dated August 20, 1999 of an award of $474,811. In December, an adjustment was made to the Carl Perkins Grant for $51,811 based on this memo. Since that time, CCPS has received the final entitlements for FY2000 from the State (Superintendent's Memo %4 dated January 7, 2000). The final entitlement is $499,428, or an increase of $24,617 over the estimate from August. The purpose of the Act is to establish balanced, community based systems of sanctions, services and programs for juvenile offenders. Services are developed to address the needs of the youth and families in our locality. Planning for services funded through the Act is conducted by an interdisciplinary planning team comprised of representatives from Youth Services, the Detention Home, the Youth Group Home, the Court Service Unit and Budget and Management. There are services for youth at intake to divert further entry into the juvenile justice system, there are enhanced supervision and treatment services to youth on probation or parole and there is a home incarceration and a weekenders program. Chesterfield County will receive $1,899,685 in FY 2001 and again in FY 2002 through the VJCCCA. WHEREAS, the Virginia General Assembly enacted the Virginia Juvenile Community Crime Control Act (the "Act"), effective January 1, 1996; and WHEREAS, the purpose of the Act is to establish balanced, community- based systems of sanctions, programs, and services for juvenile offenders; and WHEREAS, the County of Chesterfield, through an interdisciplinary planning team, has developed a plan for the development, implementation and operation of such services for juvenile offenders. NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of Supervisors endorses the County's participation in the Virginia Juvenile Community Crime Control Act and accepts funds appropriate for the purpose set forth in the Act until written notice to the contrary is provided to the Department of Juvenile Justice. Hammer Title: Deputy County Administrator Attachments: Yes ~-~ No I# RECOGNIZING "AMERICAN REVOLUTIONARY WAR WEEK" WHEREAS, Chesterfield County was the primary training depot for Virginia Continental Troops from December 1780 until April 1781 under the command of General Von Stueben; and WHEREAS, because of its military importance it was one of the primary targets of British General William Phillips' campaign of April 1781; and WHEREAS, on April 25, 1781 the Continental forces fought bravely against the overwhelming British Army at the Battle of Blandford Church before withdrawing; and WHEREAS, on April 26, 1781 the British forces then proceeded to Chesterfield where they burnt the Courthouse, 600 cabins, three hospitals and all of the Continental supplies; and WHEREAS, on April 27, 1781 the Virginia State Navy made a gallant stand against British General Benedict Arnold's army at Osbourne's Landing near Henricus Park, dueling with artillery for over an hour before being forced to withdraw losing all twenty ships; and WHEREAS, on April 28, 1781 the Virginia Militia joined with the Continental forces of General Lafayette to prevent the British Army from crossing the James River to capture Richmond forcing them to withdraw from the County; and WHEREAS, preserving the memory of our Commonwealth's role in the American Revolution is a task of great educational importance to future generations of Virginians as we carry the revolutionary spirit of our Founding Fathers into the 21st Century. Summary of Information: Ms. Humphrey has requested that the Board of Supervisors authorize the County Attorney's Office to initiate a proceeding in the Circuit Court for the judicial sale for delinquent real estate taxes ora small parcel of real property located adjacent to Midlothian Turnpike. The property consists of between .002 and .066 acres and is nearby two parcels owned by Ernest Belvin. Mr. Belvin is interested in acquiring the property at judicial sale to assist in the development of his parcels. A plat showing the location of the property and Mr. Belvin's property is attached. Pursuant to a 1949 deed, the property is listed on the County land records as belonging to Rosa A. Fields and M. Anderson. The property is the remnant of the condemnation of land by VDOT for Midlothian Turnpike. Current delinquent real estate taxes total $31.88. The County's cost for the judicial proceeding is likely to exceed $5,500, which would include costs for a title search, advertising, court fees, appraisal fees and other expenses. It is normally the policy of the County not to initiate a judicial sales proceeding where the County is not likely to recover its costs. In a judicial sale, suit papers are filed with the Circuit Court and, after certain requirements are satisfied, the property is sold (usually at auction) in order to satisfy the County's lien for delinquent taxes. The owners of the property, if located, would have the right to pay the delinquent taxes and thereby terminate the judicial proceeding. Anyone may bid for the property, including Mr. Belvin. The sale and sales price are subject to approval by the Circuit Court. Subject: A Public Hearing to Consider the Restriction of ThrouGh Truck Traffic on a Section of Bermuda Hundred Road County Administrator's Comments: County Administrator: Board Action Reques~d: A public hearinG is scheduled for April 12, 2000, to consider the restriction of through truck traffic on Bermuda Hundred Road between Meadowville Road and Kingston Avenue. Summa~oflnformation: Mr. McHale requested staff to initiate the process to consider a request to restrict any through truck or truck and trailer or semi-trailer combination, except pickup or panel trucks from using Bermuda Hundred Road (Route 697) between Meadowville Road (Route 618) and KinGston Avenue (Route 4841). The recommended alternate route is Kingston Avenue (Route 4841), Route 10, Rivers Bend Boulevard (Route 4840), and Meadowville Road (Route 618). The Virginia Department of Transportation (VDOT) has five (5) criteria it considers when a restriction is requested. Based on staff's preliminary review, this request will satisfy three (3) of VDOT's five (5) criteria for imposing a restriction, in that: 1) there is a reasonable alternate route, 2) the route is classified as a local or collector road, and 3) there are 12 dwellings per 1000 feet of roadway along Bermuda Hundred Road. This request will not meet the remaining two (2) criteria in that: 1) the volume of through trucks does not exceed VDOT's 50 per day minimum volume, and 2) the accident history of the roadway does not indicate that it is not suitable for truck traffic. A request that satisfies at least three (3) of VDOT's five (5) criteria will generally qualify for a restriction. Summary ®f Information: Fred H. Minson and Sherry M. Minson requested the quitclaim of a portion of a 50' right of way known as Banbury Road and a portion of a 60' right of way known as Wood Dale Road extended. On December 15, 1999, the Board of Supervisors authorized the conveyance of the portion of 50' right of way known as Banbury Road extended and continued the public hearing to February 9, 2000, to consider conveying the portion of 60' right of way known as Wood Dale Road extended due to opposition of the request by the adjoining owners. On February 9, 2000, the Board of Supervisors continued the public hearing to April 12, 2000, to allow the Minsons to consider development options. The Minsons and the adjoining owners have still not reached an agreement, therefore, staff recommends denial of the request to quitclaim the portion of 60' right of way known as Wood Dale Road extended.
