10-26-61 MinutesVIRGINIA: At a regular meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on October 26, 1961, at 2:00 p.m. Present: Mr. Irvin G.Horner, Chairman Mr. H. J.Britton Mr. Marshall F.D~iskill On motion of Mr. Driskil~l, seconded by Mr. Britton, it is resolved that this Board appropriate the sum of $12,000 t° Item 17E2-Maintenance of School Plant, and requests the Treasurer of the County to make this transfer. On motion of Mr. Britton, seconded by Mr.Hague, it is resolved that the request of ~r.P.L.Travis, Jr., representing the Evertrue Beneficial Club to withdraw the rezoning request on Forest Hili Avenue, be, and it hereby is approved. Mr. Charles Hartman comes before the Board complaining of the manner in which the bid for the improvement to Midlothian and Thomas Dale High School was proposed to be let and.cited cases in which advertising had not been sufficient according to law, the bids of which were not awarded. After much discussion of the merits of this procedure, it is resolved, on motion of Mr. Goyne, seconded by Mt. Hague, that the Chairman and Executive Secretary meet with the Chairman of the School, the School Superintendent,and the Commonwealth's Attorney, to discuss the purchasing procedures for the letting of School Construction bids. There appears a delegation of citizens from the Kingsland Road area, citing the fact that the water supply at the Kingsland School was insufficient and unpalatable at times. Whereupon, Mr.Britton states that the Water COmmittee had reviewed the problem and since the line was in the Master Plan of water lines, already approved, it is the Water Committeets recommendation that the 6" line be extended from the Route #1 water line along the Kingsland Road and that a 12" line be installed along the Centralia Road to the School and pointed out that the 12~ line represented a newer plan calling for an additional supply line, 12" in size generally paralleling Rt.~l. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mt.Hague, it is resolved that the recommendation of the ~,~Yater Committee be accepted and water extended from Rt.1 to the ScH~ool. In Re: Request of Enon Civic ~ssociation for Approval of Special Operating Regulations for draw span across the Appomattox River on Route #10. The Board received a request of the Enon Civic Association through its representatives, Mt. Fred Michaelsen and Mr. Ned Hatch, requesting this Board to assist the Association in asking the State Highway Department to petition the United States Corps of Army Engineers for sDecial operating regulations for the draw span on the State Highway Bridge across the Appomattox River on Route lO, which request was accompanied by certain charts and data compiled showing the necessity due to the inconvenience caused the users of the highway by the traffic conditions on State Route #lO, which papers were filed with this Board. Goyne, seconded by Mr. Driskill, Be it Resolved: That this Board doth approve, endorse and joins in the request of the Enon Civic Association to ask the Department of Highways to petition the District Engineer~ U.S. Army Corps of Engineers, for approval of soecial operating regulations fcm the existing bridge, requesting that: 1. During the months of October throug.h April the bridge be unattended, and that advance notice from any boat owner be given to the State Highway Department twenty-four {24) hours in advance of his intention to use the draw. 2. During the period of May through September the draw span be closed during the periods of peak highway traffic, specifically between the hours of 7 and 9 A.M., and 3:30 through 5:3C P.M., and further'that from l0 P.M. to 5: A.M., that the draw span be closed and subject to advance notice regulation mentioned above. Be it Further Resolved: That the Board forward a copy of this resolution to the Department of Highways together with d~a filed with this Board, requesting the ~epartment of Highwsys to take appropriate action to make effective this resolution and pcb ition. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that a Committee from this Board confer with the Department of Highways in an attempt to convince the Highwmy Department that some chan~es are necessary in the handling of the draw bridge at the Appomattox River and Rt. 10. This day the County Road Engineer in accordance with directions from this Board made report in writing upon the examination of Pineland Road-and Pineland Court in the Subdivision of Trampling Farms, Dale Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said r~ds be established as public roads. Upon consideration wP~ereof, and on motion of Mr. Hague, it is resolved that Pineland Road and Pineland Court in the subdivision of Trampling Farms, Dale District, be, and the same is hereby established as public roads. and beit further resolved that the Virginia Department of Highways, be, and it hereby is requested to take into the Secondsry Road System of Chesterfield County, Pineland Road, from a point on Rt. 643, .~3 of a mile west of Rt. 10, .05 miles north .to Pineland Court, thence .07 Of a mile westwardly to a dead end; Pineland Court, from a point on Pineland Road .05 miles north of Rt.6~3, .05 miles eastwardly and .06 miles northwardly to a scul de sac. These roads serve 11 houses. And be it further resolved, that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, rights of way of not ]~ss than 50 feet for these roads. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Upp Street in the Subdivision of Alice Heights, Section "B", in Dale Magisterial District, which sho~s that in the opinion of the County Road Engineer it is expedient'~hat said road be established as a public road. Upon consideration whereof, and on motion of Mr.HaKue, it is resolved that Upp Street, in the Subdivision of Alice Heights, Dale Magisterial District, be, and the same is hereby established as a public road. And be it further Resolved, that the Virginia Department of Highways, be, and it hereby is requested to take into the Secondary Road Systam of Chesterfield County, Upp Street from a point on Rt.2266, .18 miles south of Rt.643, .tl of a mile southwardiy to Rt.2266. This is a connecting road and serves three houses. And be it further resolved, that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, right of way of not less than 50 feet for tSis road. On motion of Mr.Driskill, seconded by Mr. Britton, the following Ordinance is re- ad opted: An Ordinance to amend the Code of the County of Chesterfield, Virginia, making notice by Certified Mail equivalent to notice by Registered Mail. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA: That the Code of the County of Chesterfield, Virginia, Volume I, Chapter 1, General Provisions, be amended to add a new section to be known as Section 1-8, as follows: Sec. 1-8. Notice by Certified Mail Equivalent to notice by Registered Mail. %'~henever in the Code of the County of Chesterfield, Virginia, any mail or notice is required to be sent by Registered M~it, it shall constitute compliance with any such section if such mail or notice is sent by Certified Mail. This Ordinance shallbe in full force and effect after its enactment as prescribed by law. A letter from the Commonwealth's Attorney was read advising the Board that it was not autherized to regulate the mooring of boats on private ponds. On motion of Mt. Hague, seconded by Mr. Goyne, it is resolved that a copy of this ruling be sent to all Rescue Squads. On motion of Mr. Goyne, seconded by Mt.Hague, it is resolved that this Board accept the easement for a drainage ditch leading northward from Willis Road given by L.R.and Rosa B. Goyne. On motion of Mr.Goyne, seconded by Mr.Driskill, it is resolved that the request of the Chester P.T.A. for the employment of safety guards at the Curtis Elementary School., be received and filed. On motion of Mr.Hague, seconded by Mr. Hagerman, it is resolved that the meeting date o~f the Board of Supervisors be changed from November 23rd to Nov~nber 3Oth because of the Thanksgiving Holiday. On motion of Mt. Hague, seconded by Mr. Driskill, it is resolved that the request of Mt. Rose for compensation for himself and four appraisers to attend the Virginia Association of Assessing Officers' meeting in Norfolk h~e and it hereby is approved. It is here noted that Mr. Goyne did not vote. On motion of Mr.Driskill, seconded by Mr.Hague, it is resolved that the salary request of the Con~issioner of the Revenue be and it hereby is received. On motion of Mr. Britton, seconded by Mt. Hague, it is resolved that the Variance requested by Mt. Thomas M.Harper be and it ~.ereby is deferred for further study and consid era%ion. On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that this Board signifies its intention to connect the sewer system of Kenmore Ridge to the sewer svstem of the City of Richmond when it i~ available to the County, or to connect same to a County sewer system, or in the event that one of these connections cannot be made, to construct a sewage disposal system at Kenmore Ridge adequate to treat the sewage collected. The County also agrees not to request more than 75 additional house connections to the Kenmore Ridge Treatment Plant, unless additional treatment facilities are provided. There appeared a delegation from the Spruce Road area citing the fact that the recent heavy rains had seriously damaged the bridge across ~he Brook and it was cited that Mr, Fauntleroy and a bridge expert from the Highway Department estimated that a bridge could be built for approximately $4100.00. Mr. C. C.Swinson cites the fact that the families livihg across the creek from R~' 10 cannot purchase oil in quantities nor receive the services of a doctor, etc. A~ter much discussion of this problem, it is on motion of Mr.Goyne, seconded by M~.Britton, resolved that the County pay the sum of $2100.00 if the citizens in the area pay $2000.00 for a bridge to be built across The Brook. And be it further resolved, that the Highway Department be requested to construct a bridge across The Brook as soon as possible at a cost not to exceed $~100.00. On motion of Mr. Hague, seconded by Mr. Hagerman, it is resolved that Sub.Section B of Section 3, of the "Organization and Rules" of the Police Department be amended to read as follows: "The Detective Bureau, which consists of such number of Detective Sergeants and Detectives as may be authorized by the Board of Supervisors, shall be under the immediate supervision of a Caotain of Detectives." WHEREAS, Mr. Edward E.Bates, has served on the Chesterfield Planning Commission for approximately six years, and has given exemplary service to the County of Chesterfield not only in this position but on numerous COmmittee assiknments in several areas of the County Government; and WHEREAS, it was necessary for Mr. Edward E. Bates to resign this position due to his employment in another State; NOW, THEREFORE, BE IT RESOLVED, on motion of Mr. Driskill, seconded by Mr. Britton, that this Board of Supervisors publicly records its appreciation and commendation to Mt.Edward E.Bates for his many services rendered to the County of Chesterfield and expresses its best wishes for the continued success and happiness for him and his family. On motion of Mr. Britton, seconded by Mr. Hague, it is resolved that a standard water co~tract with the School Board for the installation at the Crestview Elementary School, be approved in the amount of $~36.7~. On motion of Mr.Britton, seconded byMr.D~iskill, it is resolved that the contract between the Pence-Briggs Corporation, an~ the County of Chesterfield involving a private water main be and it hereby is approved. The County Engineer presented the recuest of Mr. Curtis Rudolph to be allowed to guarantee the installation of water mains and construction of roadways on two stub roads, leading westward from Lancers Boulevard, since it appears that the property west of the Subdivision of Marlboro would not be subdivided in the near future. On motion of Mr. Britton~ seconded by Mr. Hague, it is resolved that this Board request Mt. Rudolph to e~ther construct a roadway and awater line or to put up a cash bond %o cover the cost of this installation. Mt. Robert Painter, County Engineer, cited the fact that the State Auditor for the Highway Department had reviewed the costs and estimated costs of relocating the water line on Forest Hill Avenue in the vicinity of 'Bon Air, due to the widening of said road, a~J the State Highway Auditor had disallowed certain estimated costs. On motion of Mr. Britton, seconded by Mr. Hagerman, it is resolved that the County Engineer be and he herebyis authorized to pay to the State Highway Department $1045.36. Mm.Robt. Rainter, County Engineer, presented a list of delinquent accounts in the Wa~er Deoartment in the amount of $10,~75.51 covering the fiscal years 195~ through~ 1959, and recommended that the State Auditor now auditing the Utility Department accounts be allowed to purge the books of these uncollectable accounts. Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that the A6ditors be requested to purge the Utility Department accounts and charge off the $10,475.51 of delinquent accounts, a copy of which is filed with the Board's papers. On motion of Mr. Driskill, seconded by Mr.Britton, it is resolved that the Purchasing Agent be and he hereby is authorized to have sealed certain areas of the parking lot recently re-surfaced with plant-mix. On motion of ~lr.Hagerman, seconded by Mr. Britton, it is resolved that this Board go into Executive Session. Reconvening: Mr. Driskill filed with the Board a copy of a letter from the St. Edwards Rectory, thanking him and the County for the blinking lights in front of the new Catholic School on Huguenot Road. There was presented a letter from Mr. Virgil L.Wadkins requesting an additional $400.00 for compensation for a certain widening strip on Rt.6OS, east of Rt.~l. And it was cited that the County's offer of $1328.O0 would not cover the cost of the fill to re-arrange the parking lot. On motion of Mr. Goyne, s~conded by Mr. Driskill, it is resolved that the County's appropria~on be increased $400.00, making a total Of $1728.OO. On motion of Mr. Hague, seconded by Mr. Goyne, it is resolved that a Variance for an aUXiliary building less than 400 square feet used in connection with a trailer be granted to Mr. R.L.Griffin on the Salem Church Road, Box 389, Rt.15.
