Mr. Olin L.Taylor, representing the Chesterfield County Museum Committee comes before the Board requesting the Board's approval of plans drawn by Mt. Gentry of the State Penitentiary for display cases to be located in the corridors on the north side of the County~Courtroom. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Driskill, it is resolved that this Board ~pprove the recommendations of the Chesterfield County Museum Committee and authorizes the Purchasing Agent to purchase six display cases, with fluorescent fixtures at a cost of not more than $260.00 each. On motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that the two (2) Special Water contracts be and they hereby are approved: 543-A 567 Holiday Hills, Section I. Fernleigh Subd. On motion of Mr.H~gue, seconded by Mr. Britton, it is resolved that the recommendations of the Buildings and Grou. mis Committee be approved arfl the County Engineer is authorized to install the proper size copper water lines to serve the bail diamond with twodrinking fountains and two flush type spigots at an estimated cost of $1333.00. The Board generally agreed that the matter of the installation of an electric hot wa%er heater be requested as an addemdum to the renovating of the Circuit Court Building. On motion of Mr. Britton, seconded by Mr. Hague, it is resolved that the County Water Department assume the difference in the estimated and actual cost of the installstton of a 24" water line on contract No.558-Circle Shopping Center, B~elt Boulevard, on which the Board has previously agreed to refund the entire cost of the 23+" line across Belt Boulevard, at such time as the lirsNas extended in a westerly dire6tion~ the estimated cost of this line being $10,70&.00 and the actual cost being $12,797.87, it being understood that the County would absorb the difference of $2,092.97. On motion of ~r.Britton,seconded by Mr. Driskill, it is resolved that the County Treasurer be and he hereby is authorized to request the Central National Bank of Richmond, as Trustee, to invest a maKimum of $100,000 of funds held by the Trustee in the Revenue Fund of the Water Department, in U.S.Government Securities, maturing within six (6) months from date of such investment. On motion of Mr. Britton, seconded by Mr. Dr~skill~ it is resolved that the Treasurer be and he hereby is authorized to transfer $15,O20.00 from the Operating Fund of the Water Department bo the Revenue Fund, held by the Trustee, which represents the excess cash transferred by the Trustee to the Operating Fund over the estimated budget for 1961-'62. On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that the Treasurer of the County be and he hereby is authorized to invest for a period not to exceed ninety-days {90) $60,000.00 surplus cash in the Operating Fund. On motion of ~r. Driskill, seconded by Mr. Goyne,the following ordinance is adopte~: AN ORDINANCE, to amend the Code of the County of Chesterfield, Virginia, Chapter 2, to provide rabies vaccination of dogs; control of unvaccinated dogs; enforcement and control over ra~id or suspiciously rabid dogs; and to provide penalties for violations thereunder, in the County of Chesterfield, Virginia. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA. 1. That Chapter 2 of the Code of the County of Chesterfield, be amended as follows: Article I - Section 2-4 is hereby amended to read Section 2 - 4, Definitions. For the ouroose of Articles III and IV, the following words and ~hrases shall "County Nealth Officer" means the County Health Officer of the County of Chester- field or his duty authorized representative. "Dog" means every dog regardless of age. "Kennell" means an enclosure wherein dogs are kept and from which they cannot escape. "Livestock" includes cattle, sheep, goats, swine and enclosed domesticated rabbits or hares. "Owner" shall include anF person having a right of property in any dog, subject to the provisions of this z~rticle, and any person who keeps or harbors such a dog, or has the dog in his care, or who acts as its custodian, and any person who permits a dog to remain on or about any premises occupied by him. "To run at large" - A dog shall be deemed "to run at large" while roaming, running or self hunting off the property of its owner or custodian and not under its owner's or custodian's immediate control. "Poultry" includes all domestic fowl and game birds raised in capitivity. "Vaccinate", "Vaccinated" or "Vaccination" means the immunization of a dog against rabies, whether by inoculation, vaccination or any other method of treatment approved by the County Health Officer. "Veterinarian" means any licensed veterinarian.authorized to practice veterinary medicine in the State of Virginia. ARTICLE III - Section 2- 11 is amended by adding the following paragraph thereto: Every owner applying for a license for a dog after November l, 1961, shall exhibit to the Treasurer of the County of Chesterfield a vaccination certificate issued in. the form prescribed by the County Health Officer and showing that the doe was vaccinated at some time during the thirty-six months prior to the 1st day of November of the year in which a~'plication for the license is ma dewith a modified live~'virus approved by the County Health Officer or showing that the dog was otherwise treated for immunization against rabies within twelve ~onths prior to the 1st day of November of the year in whichapplication for the license is made by such other method or treatment approved by the County Health Officer. No license shall be issued for a dog if the owner fails, re~uses, or neglects to exhibit such certificate to the County Treasurer. Chapter 2 of the Code of the County of Chesterfield is hereby amended by adding a new article to be known as Article IV to read as follows: ARTICLE IV Section 2-14. Dog Pound; confinement and disposition of unlicensed and unvaccinated, etc., dogs generally, redemption by owner; pound charges. {a) The Dog ~;arden shall cause to be constructed and maintained a pound or enclosure and shall require dogs running at large without the tags required by this article or contrary to the provisions of this article to be confined therein.~ Any dog which has been so confined for a period of five days and has not been claimed by the owner thereof shall be destroyed by the dog warden or otherwise disposed of in accordance with the following section. (b) Any dog found in the County of Chesterfield after January 31, 1962, not vaccinated or not wearing an authentic vaccination tag as provided in this article shall be impounded by the dog warden for a period of five days or lonEer in the dog pound. (c) A dog, confined under the provisions of this article, may be redeemed by its owner within five days of such confinement, or within a longer period of time if such dog has not been otherwise disposed of under the provisions of this article, by producing an authorized, current valid vaccination certificate for the dog and current dog license receipt or tag, and by payment to the dog warden of a fee in the amount of fifty cents for each day that such dog has been so confined. Funds derived by the County pursuant to this section, shall be dispose of as dog license fees are disposed of. (d) At the expiration of the said five day period any dog not claimed by its owner or custodian may be disposed of by giving it into the possession of any person who pays the cost of vaccination, licensing ar~ impounding as provided in this section. Section 2-$~. Rabies vaccination required. On and after Janu~ry 31, 1962, it shall be unlawful for any person, firm or organization to own, keep hold or harbor any dog over fou~'~months of age within the County of Chesterfield unless such dog shall hare been vaccinated against rabies by a license veterinarian in accordance with the provisions of this chapter. Section 2-16. Type of a~proved vaccine. The use of a modified live virus raoies'vaccine is approved by the Count~ Health Officer for immunization against rabies. The approval of the County Health Officer must be obtained before using any other vaccine or other method or treatment for the immunization of these animals against rabies. S~ection 2-17. Certificate of Vacc~ination. Issued by vaccinating Veterinarian description. ' The veterinarian who performs rabies vaccination of a dog shall furnish the owner with a certificate showing that the vaccination has been done in a~cordance with this chapter, and the type of vaccine used ~nd the date beyond which it is yoid (expiration ~ate). This certificate may be in the form of a combined receipt and certificate. The certificate shall be carefully preserved by the owner. Section 2-18. Vaccination Tag. Use of vaccination Tag. Issued by vaccinating veterinarian. Upon completion of rabies vaccination of each dog, the veterinarian shall furnish the o~ner with a suitable vaccination tag. The vaccination tag shall be firmly attached to the dog's collar and must be worn at all times when the dog is not on the owner's or custodian's property or in the immediate control of some responsible person. Sec~tion 2-19. Application of requirements to dogs imported from other jurisdictions. Any person, f~rm or organization transporting a dog into the ~ounty of Chesterfield from some other jurisdiction shall be required to conform to the above regulations within thirty days from the date on which such dog may have been brought into the County of Chesterfield if such a dog is to be kept in the County more than thirty days. If imported from without the United States, the applicable regulations of the U.S.Public Health Service shall be enforced. Section 2-20. Reoort of animal bites required-contents of reports. (a) All animal bites of human beings shall be reported to the County ~ealth Department within twenty-four hours after their occurrence. (b) Such report shall include the name and address of the person bitten; the name and address of the owner of t~je biting animal, if obtainable; a reasonable description of the said animal; the date and time of day of the injury; the part of the body %8n which the bite was inflicted; and, if possible, whether the biting animal has .been vaccinated azainst rabies. (c) The responsibility for so reporting is mutually charged to attending physicians, veterinarians, owners of the biting animal, persons bitten, and any other persons who may have knowledge of the occurrence. Section 2-21. Quarantine of Biting Animals. All animals biting or otherwise injuring human beings or animals shall immediately be placed under quarantine for a minimum period of fourteen days. The area and conditions of quarantine shall be designated by the dog warden or other agent of the County Health Director. When proper quarantine cannot be maintained by the owner the animal shall be removed to a suitable pound and there be quarantined at the expense of the owner. Sectio~ 2-22. animals. Disposition of Animals Bitten by rabid or suspiciously rabid All animals found to be rabid or to have been bitten by rabid animals or suspiciously rabid animals shall be destroyed immediately or upon written request of the owner confined in a pound, kenn~l~ or enclosure approved by the Health Department for a period of six months at the expense of the owner; or if previously vaccinated in a manner satisfactory to the County Health Officer, be re-vaccinated in the prescribed manner at the owner's expense and held under quarantine for a minimum period of thirty days. In the event confinement shall bein the County dog pound the owner shall pay fifty cents (50~) pep day for each day of ~8onfinement. Section 2-23. Quarantine to limit extension of a widespread rabies epizootic. When in the judgment of the local County Health Officer an emergency shall be deemed to exist in theCoun~y of Chesterfield or any part thereof due to a wide- spread rqbies epizootic, for the protection of the public the CountyHea. lth Officer may declare a quarantine in the County of Chesterfield or such part thereof as may be so affected, and restrict all dogs to the owner's premises or the immediate custody of some responsible person f~ the duration of such emergency as is set forth in said order of quarantine. Any such quarantine shall remain in force and effect until modified by the County Health Officer. Section 2-2&. Rabies - Quarantine. In any section of the County from which a dog's head shall have been received by the laboratories of the Health Department of the State and by such department been positively diagnosed ~s rabid, or in any section of the County in which the County Health Officer shall positively ascertain that a rabid dog has been, it shall be unlawful to permit any dog to run at large during the peridd of forty-five days next succeeding the discovery of such condition in that section. The boundaries of such section shall be defined by the County Health Officer and shall not exceed a radius of two miles from~ such place as the County Health Officer shall positively ascertain a ~abid dog has been. Section 2-25. Violations -Penalty. Any person, firm or organization violating any of the provisions of this chapter for which no penalty is prescribed, shall be guilty of a misdemeanor and upon conviction thereof shall bepunished as provided in Chapter I. Section 1-6 of the Code of the County of Chesterfield, Virginia. This Ordinance shall be in full force and effect after its enactment as prescribed by law. On motion of Mr.Britton, seconded by Nr. Driskill, it is resolved that the Highway ii Department be and it hereby is requested to improve Pippin Lane, in the subdivision of Apple Acres, not to exceed $600.00, and charge same to the 3~ Road Fund of the Count y. And be it further resolved, that some notification from the First Federal Bank be given as to the amount of funds held in escrow for the construction of this road. The request of Mr. Louis Schline, 6400 Hull Street Road, it is on motion of Mr. Britton, seconc~ed by Mr. Driskill, resolved that this Board request the Highway Department to change "No ~arking" signs at the Manchester Drug Store to read be?wee~ "8:00 A.M. and 4:00 P.M.",' which would facilitate the operation of traffic in the area. con sidered. On motion of Mr.Goyne, seconded by Mr. Driskill, it is resolved that the Executive Secretary be authorized to deposit five (5~ checks, totalling $455.00 to the 3¢ Road Fund of the County tobe used in the construction of a bridge across The Brook in Bermuda District, provided further funds can be obtained from the citizens of the area. And be it further resolved, that the Board authorizes the Highway Department to proceed with minimum reasonable repairs on the br~ge across the Brook in Bermuda · District, and charge same to the 3¢ Road Fund of the County. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Lake ~hore Drive and Scarlet Oak Road, in the subdivision of Rock Creek Park, Section ~, Midlothian Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr. Driskill, it is resolved that Lake Shore Drive, and Scarlet Oak Road in the Rock Creek Park Subdivision, Section C, Midlothian District, be, and the same are hereby established as public road s. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System of Chesterfield County, Lake Shore Drive, and Scarlet Oak Roadin th~Rock Creek Subdivision, Section C, Midlothian District, be, and the same are hereby established as public roads. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System of Chesterfield County, Lake Shore Drive, from the end of maintenance on Lake Shore Drive, .16 miles northeast to Scarlet Oak Road; Scarlet Oak Road, from the intersection with Lake Shore Drive, .15 miles north to a dead end. These roads serve 3 houses. And be it further resolved that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, rights of way of not less than 50 feet for these roads. Dedication of said rights of way in Plat Book 12, page 1~, Chesterfield Courthouse, Virginia. Thi,s. day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Southam Drive, in the Southam Subdivision, Manchester Magisterial District, which shows that in the opinion of the County Road Engineer, it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Britton, it is resolved that South~n Drive, in the Southam Subdivision, Manchester Magis terial District, ~e, and the same are hereby established as a public road. And be it further resolved, that the Virginia DeparRment of Highways be and it hereby is requested to take into the Secondary Road System of Chesterfield'County, Southam Drive, in the Southam Subdivision, Manchester Magisterial District, from Dhe intersection of Rt. 1969 and Rt. 1758, .lO of a mile southwest to Brown Road. This road serves 5 houses. And be it further resolved, %hat the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, right of waym of not less than 50 feet for this road. Dedication of said right of way in Plat Book ll, Page 50, Chesterfield Courthouse, Virginia. There was read a letter from the Resident Engineer stating vhat the improwement of sight distance along Hopkins Road, requested by resolution dated October llth, would beimproved as soon as the weather would permit. On motion of Mr. Britton, seconded by Mr.Hazue, it is resolved that the final budget for 1961-'62 of the Sec6ndary Road System for the County of Chesterfield be, and it hereby is appro~d. Mr. Lancaster, Resident Engineer, reported that a survey had been made on the feasibility of reducing the speed zone on Treely Road and the survey showed it was not feasible to reduce the speed zone at this time. Nays: None Board. ~nereas, the abovementioned and named bids were this day received by the Now, Therefore, Be it Resolved by the Board of Supervisors of Chesterfield County, Virginia: The bid submitted by Harris Trust & Savings Bank, Manager and Associates, for the aforesaid, $1~800,0OO bonds maturing January l. 1963 to 1974~ both inclusive, at 3-1/4 per cen~um, $1,200,000 bonds maturing January l; 1~975 to 1982, both inclusive, at 3-1/2 per centum, the sum of Three Million, TWelve Thousand, Eight Hundred Ninety-nine and no/lOO Dollars, ($3,012,899.O0) is hereby accepted and the $3,000,000 school bonds of Chesterfield COunty, Virginia, dated January l, 1962, are hereby awarded to Harris Truwt & Savings Bank, Manager and Associates, and said bonds shall bear interest in accordance with the terms of said bid; a certified copy of which bid is hereto attached; which is an effective rate of 3 36619 per centum. ' 61-68. Mr. Cecil E. Hoyle comes before the Board requesting the rezoning from Agriculture to General Commercial if a parcel cf land of irregular shape, fronting 37? feet on the north line of Rt.360 ~nd 125 feet on thw west line of Rt.652, in~ ~idlothian ~a~isterial District, which request had been deferred from NSvember 8, 1961. Mr. Hoyle presented plans at this time of the proposed building, whichis to be use~ for a cabinet shop. Mr. A.J.Horner presented to the Board a petition signed by some of the members of the Tomahawk ~aptist Church, opposing any business in this area.~ Mr. ~ilton Cheatham, Mt. Daniel Harrison, Pastor, Tomahav..k Baptist Church, state their opposition to Mr. Hoyle's reGue~$. Upon consideration whereof, and on motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that the request of Mr. Hoyle be denied. Whereupon, Mr.Hague offer~ a substitute motion: That the rezoning request of Mr. Hoyle be deferred for thirty days and the Board view with Mr. Hoyle and Mr. Harrison the location and the surrounding area. Mr. Goyne seconds Mr. Ha(~ue's substitute motion. ~ Whereupon, M~.Driskill withdraws his original motion. A vote being taken on the substitute motion, all vote aye. 61-72. Mr. O. W. Rackley comes before the Board requesting the rezoning from Agriculture to General Commercial of a 2-acre parcel of land in Bermuda Magisterial District, of irregular shape, being 1150 feet southwest of Point O'Rocks Road and 900 feet southwest of Route 10 and south of the subdivision of Chesterfield Manor, stating he proposed to use a part of this s~te for a general merchandise store. On motion of MR.Goyne~ seconded by Mt. Hague, it is resolved that this request be deferred for thirty (30) days. 61-73. Mr.Fr~nk H. Rieves comes before the Board requesting a Use Permit to provide boating and fishing privileges on a pond located 'on a 32-acre Parcel of land of irregular shape, fronting 1175 feet on Route 1~, and extending westwardly to Ashen Creek, being 550 feet south of Curtis Street. There appearing no one in opposition to this request, it is on motion of Mr.' Goyne, seconded by Mt. Hague, resolved t~at the aforedescribed request of Mr. ~ieves be, and it hereby is ~ranted. ' 61-74. ~{r. A.W.Flippo comes before the Board requesting the rezoning from Agriculture to General Commercial of a 16-acre parcel of land fronting 800 feet on U.S.Route 1 and extending westwardly 870 feet, being adjacent to the intersection of U.S. Route 1 and Hatcher Street, and presently ~oned General Commercial for a depth of 300 feet, in Bermuda Magisterial District. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that light bills for all Quarterback Clubs in the County be approved for payment. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mt. Hague, it is resolved that a Committee composed of Board members and members from the leaders of the Quarterback Clubs be established to study a recreational program in the County. Mr. E.L.Mumma, Building Inspector, comes before the Board stating that both Electrical and Plumbing Inspector are new in the County employ, and that inspection calls are not being completed as promptly as he would like them to be. Mr. Mumma r~quests that the Board consider the employment, on a temporary basis, of Mr.J.M Wilkinson to help orientate the new Electrical and Plumbing InspeCtors in th~ policies in the County, the various deyet'opments of the ~ounty and the builders in the County; at a salary to be determined at a later date. E~ery owner applying for a license for a dog after No~iember 1, 1961, shall exhibit to the Treasurer of the County of Chesterfield, a vaccination certificate issued in the form prescribed by the County Health Officer and 'showing that the dog was vaccinated at some time during the thirty-six months prior to the 1st day of November of the year for which application for the license is made with a modified live virus approved by the County Health Officer or showing that the dog was otherwis~ treated for immunization against rabies within twelve months prior to the 1st day of November of the year for which application for the license is made by such other method or treatment approved by the Gounty'Health Officer. No license shall be issued for a dog if the owner fails, refuses, or neglects to exhibit such certificate to the County Treasurer.
