It ~as the general agreement of the B~ar~at )[r. McDaniel would present, for the approval of the Planning Commission, aplan for the fuDure development of his property. Mr. Graham Jennings, representing Mr. Milton Perle and others, comes before the Board requesting the approval of a contract between Mr.Fred Lord, Mr. Milton Perle, and others, in the County of Chesterfield, which contract provides for the conditions by whicha sewerage system will be installed to serve the area north of Rt.60 and ~ast of Buford Road. Upon consideration whereof, and on motion of R~r.Driskill, seconded by ~'~r.Britton, it is resolved that the proposed agreement be and it hereby is approved, subject to the Commonwealth's Attorney's app roy al. And be it further resolved, that tbs ~hairman and Clerk of this Board are authorized to sign said agreement. On motion of Mr. Britton, seconded by R~.Driskill, it is resolved that the standard water contract for the Marlboro Subdivision in the am. ount of ~11~149.50 be and it hereby is approved. On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that this Board approves the plan of the subdivision of Mr. Curtis Rudolph, paying for one-half the 12" w~t er line from the end of the contract area in the Marlboro Subdivis&a$, Manchester District, to Old Broad Rock Road~ ~nd the remaining half to be paid from the County Water Department. On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that a Special Water Contract in Westlake Hills,Section 6, be, and it hereby is approved. On motion of Mr. Driskill, seconded by Er.Britton, it is resolved that the County Engineer be and he hereby is authorized to pay to R.Stuart /~oyer & Associates, the amount of $10,343.59, which sum represents a partial payment on work completed -in the survey of the sewer line. The Board considered an Agreement between the Southern Railway System and Chesterfield County, Virginia, granting to the Cnunty permission to construct and maintain two lO-inch cast iron sewer pipe lines upon and across the right of way or property of the railroad near Robious, Virginia, being identified onprints attached to said Agreement, numbers A-13954 and A-13955. On motion of Mr. Driskill, seconded by Mr. Britton, Be it Resolved: That the Board doth approve the form of the Agreement and doth authorize and direct the Chairman and Clerk of this Board to axe=ute the Agreement on ~ehalf of the ~ounty of Chesterfield. On motion of Mr. Driskill, seconded by Mr. Goyne, it is resolved that the considera- tion of the installation of wa~r lines on Harrowgate Road, be deferred to the next meeting of the Board, and the matter of the AppomattoR Water Supply be investigated with Mr. George Brasfield and others. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that the County Engineer be and he hereby is authorized to abandon, salvage and otherwise dispose of the improvements on the property at the No.2 well in Morri~dale. On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that the sewer connection charges on existing sewer lines in the Kenmore Ridge Sewer System be set at 9200.00, if the citizens who have sewersavailable will connect to the sewer main,' or $500.00, if the connection is made at a later date. On motion of Mr.Driskill, secpnded bM Mt.hague, it is resolved that Apache Road be renamed to Hastings Drive. On motion of Mr.Britton, seconded by Mr.Goyne,it is resolved that the developer of Green Acres Subdivision, Mr.R.M.Patterson, be and he hereby is authorized to install the necessary drainage ¢~erts on County property so ~hat certain roads in Green Acres Subdivision can be connected to roads in the Woodstock Subdivision. This day Mrs. Arlene Brooks comes before the Board seeking a Variance from the Subdivision requirements to allow the construction of a dwelling on 1.1 acres of ground, connected to Rt.756, being a 20-ft. easement. After considerable discussion and review of the situation, and on motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that a Variance be granted to IMr. and Mfs.Brooks, provided sufficient land can be obtained so that the lot fronts 75 feet on Rt.756. A letter was read from Miss Lucille V. Butler requesting the inclusion of Luck's Lane into the Secondary System of roads and it was generally agreed that Mr. Driskill would confer with Miss Butler and investigate the request. The Highway~ Department notified the County that the following r~ds have been accepted into the State Secondary System: Woodmont Subdivision: Woodmont Road - From a point on Route 147, 0.29 mile west of Route 673 and running south 0.15 miles to Jason Road 0.15 mile Jason Road - from the intersection of Woodmont Road, 0.13 mile southof Route 147 and running northwest 0.14 miles to Dolefield Drive 0.14 mile Shoreham Drive - from the intersection of Routes 1781 and 2324 and running south 0.24 mile to turn-around 0.2& " Saxony Road -from a point on Shoreham Drive, 0.07 mile south of Route 2324 and running west 0.15 mile to Dolefield Road O.17 - Francine Road - from a point on Saxony Road, 0.09 mile west of Shoreham Drive and running south 0.17 mile to Sydelle Drive O.17 " Dolefield Road - from a point on Saxony Road, O.17 mile west of Shoreham Drive, and running south O.16 mile to Sydelle Drive Q.16 " On motion of Mr.Britton, seconded bM Mr.Driskill, it is.resolved that this Board request the Highway Department to investigate the feasibility of installing a cross- over from the north-south lanes at the entrance to Manchester Heights. On motion of Mr.Britton, seconded by Mr. Dr~skill~ it is resolved that this Board request the State Highway Department to put calcium chloride on Luray Drive, and charge same to %he 3¢ Road Fund of the County. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of ~arilea Road and Bradwill Road in the Bradley Hills Subdivision, Manchester Dis%rict, which sho~s that in the opinion of the County Road Engineer, it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr.Britton, i~ is resolved that ~rilea Road and Bradwill Road in the B~adley Hilla, Subdivision, Manchester District, be, and the same are hereby established as public roads. And be it further resolved, that the Virginia Department of highways, be, and it hereby is requested to take into the Secondary Road System, Marilea Road, beginning at a point on Route 18~7 at its intersection with Route 1827, extending eastwardly .11 miles-to Bradwill Road; Bradwill Road, beginning at a point on Marilea Road .11 of a mile east of route 1828, ~xtending southwardly .18 miles to a turnaround. These roads serve 6 houses. And be it further resolved, that the Beard of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, rights of way of not less than 50 feet for these roads. This County the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Rosewood Lane and Andrews Drive in the Subdivision of Sha~owbrook Heights, Section "A", Matoaca District, which shows that in the opinion of the County Road Engineer, it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr. Britton, it is resolved that Rosewood Lane and Andrews Drive in the Subdivision of Shadowbrook Heights, Section "A" Matoaca District, be, and the same are hereby established as public road s. And oe it further resolved, that the Virginia Department of Highways be, and it hereby is requested to take into the Secondary Road System, Rosewood Lane, beginning at a point on Rt.ll2? at i.ts intersection withRoute 1153 and extending southwestwardly 0.23 miles to Rt.62?; Andrews Drive, beginning at the end of existing maintenance on Route 1151, .07 miles south of Route 1127, extending southwardly 0.5 miles to Rosewood Lane. These roads serve 3 houses. And be it further resolved, that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways, rights of way of not less than 50 feet for these roads. Dedication of said rights of way in Plat Book 10, Page 6~, Chesterfield Courthouse, Virginia. This day the County Road Engineer in accordancewith directions from this Board made report in writing upon his examination of Nicolet Circle in the Forest Hill Farms, Section B, Manchester Magisterial District, wbic?~ shows that in the opinion of the County Road Engineer, it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of ~.Britton, it is resolved that Nicolet Circle, in the Forest Hill Farms, Section B, Manchester District, be, and the same is hereby established as a public road. And beit further resolved, that the Virginia Department of Highways, be and it hereby is requested to take into the Secondary Road System, Nicolet Circle, beginning at a point on Route 1956, .07 miles west of Route 19~2, extending northwardly .O~ miles to a turn-around. This road serves 3 houses. And be it further resolved that the Board of Supervisors of Chesterfield County 'guai~antees %o the Virginia Department of Highways, right of way of not less than 50 feet f~r~.this road. Dedication of said right of way in Plat 'Book , Page Chesterfield Courthouse, Virginia. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Fordham Road, Paulhill Road and Gregory Drive, in Falling Creek Earms, Section B,Dale Magisterial District, which shows that in theopinion of the County Road Engineer, it is expedient that said roads be established as public roads. Upon consideration whereof, and on motionof Mr.Hague, it is resolved that Fordham Road, Paulhill Road and Gregory Drive, in the Falling Creek Farms, Section B, Dale District, be, andthe same are hero,by established as public roads. And be it further resolved, that the Virginia Department of Highways be, and it hereby is requested to take into the ~econdary Road System, Fordham Road, beginning at a point on U.S. #60, .14'of a mile east of Route 890, southward!y .15 miles to Paulhill Road; Paulhill Road, beginning at the intersection of Paulhilland Fordham Roads extending southwardly .3C miles to Gregory Drive; Gregory Drive, beginning at the .intersection of Paulhill Road and Gregory Drive extending westwardly .13 miles to Route 890. These roads serve 5 homes. And oe it further resolved, that the Board of Supervisors of Chesterfield County guarantees %o the Virginia Department of Highways, rights of way of not less than 50 feet for thes~ roads. Dedication of said rights of way in Plat Book , Page ,Chesterfield Courthouse, Virginia. There arose a discussion on the constructionof Spruce Avenue bridge and it was generally agreed that the Executive Secretary would write to Mr.C.g. Swinson stating the policy of the Board. On motion of £~lr. Driskill, seconded by l~r. Britton, it is resolved that this Board request the Highway Department to estimate the cost of const~ructing Choctaw Drive, between Buford Road and McRae Street in Bon Air. On motion of Mr. Goyne, seconeed by ~4r. Hague, it is resolve~o that the Board request the Highway De~artment'to consider the hard-surfacing of Brook Lane in Chester and Tucker Road, lying westwardly from the Petersbuzrg Pike. Mr. John Watkins, President of the Chesterfield County Fair Associa~on and Mr. Uohn Thomas, Fair Manager, come before the Board requesting certain improvements to the Fair Grounds. Upon consideration whereof, and on motion of'Mr. Goyne, seconded by Mr. Britton, it is resolved that this Board proceed with the construction and improvements as recommended by the Fair Association, which improvements will include the construction of a fence, sewage,water and electrical connection for trailers and a new building similar to the Exhibition Building. And belt further resolved, that the Buildings @nd Grounds Committee, Mr. Thomas and the Executive Secretary, do all things necessary to expedite and accomplish these projects by Fair time. On motion of Mr. Hague, seconded by Mr.Britton, it is resolved that the matter of .liability insurance be referred to the Commonwealth's Attorney as to the necessity. And be it further resolved, that the cost of s~id insurance be investigated. On motion of Mr. Hague, seconded by ~'~r.Driskill, the following ordinance is adopted: AN ORDINANCE to amend the Code of the County of Chesterfield ,Virginia, Chapter 17, Section 17-2& thereof, to provide standards under which Use Permits may be granted by the Board of Supervisors. BE iT ORDAINED BY THE BO~RD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, ~IRGINIA: 1. That Section 17-24 of the County Code be amended and re-adopted as follows: Sec.-17-24 Applicability of Section 17-23 and standards set forth for granting use permits by Board of Zoning Appeals to apply to Board of Supervisors. The provisions of Section 17-24 requiring notice shall be complied with when a use permit is granted by the Board of Supervisors. Whenever the Board of Supervisors is author~ed under the provision of this chapter to grant a use permit then such standards and regulations are set forth for granting or dehying use permits by the Board of Zoning Aypeals in Section 17-20 of this Code shall apply tothe Board of Supervisors, in determining whether a Use Permit shall or shall not be granted. An emergency existing, this Ordinance shall be in full force and effect upon its passage. On motion of Mr.Goyne, seconded by ~r.Brittom, it is resolved that this Board pay the sum of $1470.00 as per Court Orde~ dated May 7, 1962 to Mt.William R. Shelton for legal services rendered in examining the title of twenty-one (21) parcels of land, which the County wishe~ to acquire for the widening of Rt.608. On motion of Mr.Hague, seconded by Mr.Hagerman, it is resolved that the game claims presented be approved for payment, which claims are as follows: )ir.Calvin L.Henshaw, Chester, Va. Goyne, Jr., Chester, Va. $22.50 22.40 19.60 On motion of Mr. Britton, seconded by Mr. Hague, it is resolved that the final payment to the Metropolitan Contracting Corporation for the alterations of the Circuit Court building, which payment was approved by l~'~r. Sam.Mayo, Architect~ be and it hereby is approved for payment. And be i% further resolved, that the sum of $1110.44 be paid to Mr. Sam. Mayo for architectural services in the alteration of the Courthouse. On mosion of Mr. Hague, seconded by Mr. Goyne, it is resolved that the following erroneous tax claims be and they hereby are approved for payment: Mrs. Shirley Barkley Allen Milton Lee Douglas K. Woolfolk $21.00 2.40 79.56 On motion of Mr.Goyne, sefonded by Mr. Britton, it is resolved that this Board recess for lunch - reconvening: 62-20o Mr.R.A.Cox, representing Mrs .Mary B.Stratton, comes before the Board requesting a Use Permit in Dale Magisterial District, to operate a Gravel pit on a parcel of land of irregular shape of approximately one acre, being approximately 2050 feet west of Route 10 and 650 feet southeast of Falling Creek, and contiguous of former excavations. Mr. Cox presented several petitions signed by 133 people in favor of a Use Permit an~ presented a set of provisions to be followed in the removal of gravel from the proposed area. Mr.Fre~ Gray, representing Mr.S.E.Lyttle and Mr.Beverly White and others speaks against the request and presents a petition signed by numerous people living in close proximity of the lmnd in question. After much discussion concerning this matter, it is on motion of Mr. Hague~ seconded by Mr. Goyne, resolved that the matter be deferred for thirty {30) days for a more complete study of the land in question. 62-21. ~[r. John G.Harris comes before the Board requesting the rezoning in Matoaca Magisterial District, from Agriculture to General Commercial of a parcel of land fronting 150 feet on Route 635 and extending southwardly 300 feet, being 1.3 miles east of Route 602. There appearing no one in opposition to this request, it is on motion of Mr. Hagerman, seconded by ~r.Britton, resolved that the aforedescribed parcel of land be and it hereby is rezone d for General Commercial purposes, aB1 as marked on a map filed with the Board's papers. 62-22. Mr.A.K.Leake comes before the Board requesting the rezoning in Dale Magisterial District, from Agriculture to General Commercial of a parcel of land fronting 50 feet on the east line of Route 10 and extending eastwardly 220 feet, being ~35 feet north of Tucker Road. Mr.J.A.Dotson states,in writing, that he is in favor of a Use Permit for an office building but not in favor of rezoning the property for General Business.
