Creek ~n conjunction with a sewer line to belaid along this ~reek and states that the owners of this land will changethe channel of the Creek at their expense. On motion of Mr.Britton, seconded by Mr.Driskill, it is resolved that this Board approves the request of Mt. Chase, subject to .~he final approval of the Engineers and Consultants working on the location and design of the sewer line. Mr.Alvah Brid, ges tells the Board of certain problems involved in obtaining rights of way for sewers. Upon consideration whereof, and on motion of ~".~ .Driskill, seconded by Mr.Britton, it is resolved that this Board authorizes the Engineering Department to seek advice from Mr. Rose, County Assessor, and to make offers for sewer rights of way and accept same if theybe generally in line with Mr.Rose's appraisal. It is here noted that Mr. Goyne votes "No". On motion of Mr. Britton, seconded by ~.'~r. Driskill, it is resolved that this Board approves the ~12,277.63, for payment to R.Stuart Royer & Associates for work done according to contract on sewer lines. On motion of Mr. Goyne, seconded by F~r. Hague, it is resolved that the street name of ~11 Road be changed to Strathmore Road. On motion of Mr.Goyne, seconded by Mr. Britton, it is resolved that this Board approves the proposed contract, note and general procedures in¥olved in extending credit to sewer customers desiring to pay the $200.O0 connection fee by monthly installments, provided contract, note, etc. is approved by the .Commonwealth's Attorney. Mr. Luther Roane and others come before the Board citing certain drainage problems on Beechnut Avenue, and upon consideration of this problem, it is on motion of Mr.Hagerman, seconded by ~lr. Goyne, resolved that this Board give further study to the drainage problems in this area. On motion of)ir. Hagerman, seconded by Mr. Driskill, it is resolved that the Board give further study to the drainage pro[:lem on Beverly Street. It was reported that the following roads had been officially taken into the State Highway System: Beechwood Subdivision - Preston Wood Xvenue, from a point on Route 637, 0.28 miles west of Route 2318 and runnin~ west 0.23 miles to ~Cascade Street 0.23 miles. Falling Creek Farms Subdivision: Lynchester Drive - from a point on Route 360, 0.10 mile west of Route 890 and running south O.~1 miles to Gregory Drive O.~1 mile. Gregory Drive- beginning at end of maintena~e of Route 890 and extending 0.07 miles to Lynchester Drive 0.O? mile. Callis Road - from a point on Lynchester Drive, O.0~ mile north of Gregory and running 0.04 mile west to dead end O.O4 mile ~.~eisiger Road - from a point on Route 890, O.15 mile south Of Route 806 and running O.10 mile to Lynchester Drive then O.03 mile to a dead end. 0.13 mile. There arose a discussion as to the maintenance of a drainage ditch in Raleigh Court. Mr.Lancaster reported that grass was the main problem and stated that weed killer woul~ solve most of the maintenance problems of the ditch. On motion of Mr.Britton, seconded Mr.Driskill, it is resolved that the Highway Department be requested to spray the ditch withweed killer and do such other work as is necessary ~t a cost not to e×ceed ~200.00. It .was reported that the moving of the Virginia EleCtric & Power Company's poles on Rt. 618 was the responsibility of the County and upon consideration whereof, and on motion of Mr. Hague, seconded by Mr. Hagerman, it is resolved that this Board authorizes the moving of utilit~s on Rt. 618 at a cost not to exceed ~4800.00. Thsre arose a discussion on the location of the Old Osborne Road in conjunction with the public landing at the Virginia Electric & Power 'Company's plant. It was cited that the Commonwealth's Attorney was negotiating with the Power Company and it was the general agreement that the Executive Secretary would try to get a map showing the location of the Old Osborne Road, from LaPrade Bros., Surveyors, and to conduct a further search of the records for any possible Board action on this matter. Mr. Goyne publicly thanks Mr.R.V.Lancaster, III Resident Engineer, of the Virginia Department of Highways, for his attendance at ~he Board meeting. On motion of R~r. Hague, seconded by Mr. Goyne, it is resolved that the '~ommonwealth's Attorney be requested ~o investigate the legality and responsibility in a temporary cul de sac when road roadway is extended. On motion of Mr. Goyne, seconded by R~ir. Hague, it is resolved that this Board requests the Highway Department to develop such plans as are necessary for the construction of a br~ge over The Brook at Spruce Avenue. On mo~ion of Mr.Goyne, seconded by Mr.Driskill, it is resolved that this Board grant a Variance to Mt. Harold Fulcher for the construction of a dwelling fronting 30-ft. on the Point O'Rocks Road on a parcel of land approximately 2-acres, lying at the intersection of Perch Point Road. On motion, the meeting is recessed for lunch. Rec onv ening - 62-33. Mr. Victor Lavenstein, representing Mr.V.C.Blick, requesting certain rezoning on Xt. 10, which request was deferred from July 26 and again from July tl, 1962. Mr. Blick testified as to the large number of businesses on Rt. 10 and the amount of traffic during peak hours on Rt. 10. Mr.L.L.Parker~ Real Estate expert from Petersburg,Virginia,testified that the property zoning would not affect the area since the property is below grade and that in his opinion the setback of 30-feet will h~ve no effect on adjacent pro pe rti es. Mr. Lavenstein states that the area should be generally considered commercial, and if the zoning is denied, Mr.Blick would be the only one to suffer. Mr.L.G.Grimmet~, Attorney for. the citizens in the area opposing the rezoning presents a petition signed by twenty-two (22) people and purportedly contains more than 20~ of the property owners within 500 feet of the p~perty bbjecting to the proposed rezoning. Whereupon, Mr.Goyne states that he has no objection to the building being used as a residence but he would vote against the land being rezoned for business purposes. On motion of Mr. Goyne, seconded by Mr. Driskill, it is resolved that the request of Mr.Blick be and it hereby is denied. On motion of Mr. Goyne, seco~ed by Mr.Driskill, it is resolved that the County Planner be authorized vo waive the fee of ~20.00 if Mr.Blick elects to reques~ a Variance from the Board of Zoning ~ppeals from the Zoning Ordinance to allow the 30-ft. front yard. 62-38. Mrs. Mary A. Ove'rton comes before the Board requesting the rezoning in Bermuda Magisterial District from Agriculture to General Business (2) of a 3.65 acre parcel of land of irregular shape fronting 209 feet on Route 1~ and extending northeastwardly approximately 900 feet being 5~0 feet northwest of the intersection of Route 1130 (Beechwood Drive) and Route lgg, and presents a letter signed by sixteen residents of the area saying that they did not oppose the requested rezoning. C~mes Mrs. Minetree who states that she does not object to duplexes but does object to the land being zoned for general business. There arose a discussion as to ~he possible roadway to the rear of the property. Mrs. Overton states she is aware of the necessity of dedicating the roadway. On motion of Mr.Goyne, seconded by Mr. Driskill, it is resolved that the afore- described parcel of landbe and it hereby is zoned for General Business~ the use of which is strictly limited to duplexes and multiple family dwellmngs, and further provided tha~ Mrs. Overton dedicates an equal share with the adjacent property owners for a roadway to the rear of the property. ~2-39. ~ir. Alvin P dennings reouests the rezoning from Agriculture to General Business (C-2) of a ~.8 acre parce~l of l~nd of irregular shape in Midlothian District, fronting 127 feet on Route 6C and extending southwardly approximate!v 900 feet, being 230 feet west of Route 624. There appearing no o~e in opposition to this request, it is on motion of 4r. Driskill, seconded by Mr Britton, resolved that the property fronting 127 feet ~ ' on Rt.$O bezoned for General Business to a depth of 300 feet instead of the requested 900 feet. 62-g0. [~r.C.J.Purdy comes before the Board requesting the re~.oning in Bermuda Magisterf~l District, from Residential-2 toOene]ral Business (C-21 of a 9.88 acre parcel of land of irregular shape, fronting 329 feet on ~[oute 10 and extending northwestwardly approximately 1419 feet, being north of the intersection of Route lO'and Lee SLreet. There appearing no one in opposition to this request, and upon consideration whereof, and it is on motion of Mr.Goyne, seconded by Hague, r~solved tha~ the aforedescribed property be and it hereby is re~,oned for General Business purposes. ~ 62-~1. ~f,'ir.Daniel S. Keane comes before the Board requesting the rezoning from ~tesidennial-2 no General Business (C-2) of a narcel of land of irregular shape, fronting 65 feet on RouLe 161 and extending sSuthwardly 150 feet, being 350 feet east of Brandon Road. ' ' A letter from the Field Secretary, ~,P.W.B.Speck, of the League of Virginia Counties was read explaining the schedule of proposed charges for membership dues in %he League of Virginia Counties. On motion of Mr. Hagerman, seconded by Mr.Hague, it is resolved that the following resolution is adopted: WHEREAS, in 19~5 it was found necessary to increase the contribution or dues of the member counties to support the activities of the League of Virginia Counties; and WHEREAS, since 19~5 the membership dues in the League of Virginia Counties have 6een paid on the basis of one cent per capita for each member county based on such county's current census population up to a ceiling of .$300.00; and WHeElS, the expenditures of the League of Virginia Counties have incre'ased duri~ng the 17 year~ since 19~5 both from expanded operations and from the effect of inflation; and WHEREAS, in 19 59 a number of the larger counties agreed among themselves to support on a voluntary basis the League's expanded activities and made con%ributions ~o assist in the operation of an expanded program; and WHEREAS, it is necessary to place the operations and program of the League of Virginia Counti~ on a fiscally so~nd and equitably shared basis; NOW, 'i~E~>~O~5, ~E IT RESOLVED, by the Board of Supervisors of Chesterfield County, Virginia, that this Board petition the Recording Secretary of the League of Virginia Counties to circulate to all members, not less than thirty {30) days before the 1962 Annual Meeting.~ of said League, a proposal to amend Article II (a) of the By-Laws of the ~ea~ue of Virginia Counties as follow s: Delete all of article II(a) of the By-Laws which reads: "Annual membershipaues of a counvy sfsll ~e one cent per capita, the maximum amount in any case not exceeding three hundred dollars (.$300.00). a County's population shell be determined by the last preceding United States Census." Substituting therefor the following on Article ii(c) of the By-Laws; "The Annual membership dues of a county shall be one and one-half cents (1½5) per capita. The population of a county shall be determined by the last preceding United ~tates Decennial Census." On motion of Mr. Driskill, seconded by Y~r.Britton, it is resolved that the request of the Board of Zoning ~ppeals as ~o the rip, bt to appoint a secretary other than the Executive Officer of the Board of SuperVisors,be referred to the Con~monwealth's Attorney for ruling on the wording of the present County Code as to the legality of thisproecdure a~ present. On motion of ~ir.Driskill, seconded by ~]r. Britton, it is resolved that the request of ~Ir.H.B.Gilliam, who collects by contract, delinquent real estate taxes, be referred to the Commonwealth's Attorney for investigation. On motion of ~']r. Hague, seconded by Mr.Britton, it is resolved that the Treasurer be requested to trar, sfer from the unappropriated surplus of the General Fund to the Workman's Compensation Fund, the unexpended sums remaining in the following budget years: 1960-'61 ~4,889.42 1961-'62 £,772.5~ which were the amounts left in Item 18-213 in each year's budget. Upon the advice of the Commonwealth's Attorney that the per diem ray of the Secretary of the Electoral Board may be 'set at the same rate of p~y as the other members of t[~e Board in addition to his salary as Secretary, it is on motion of M~.Hague, seconded by [,'~r.Driskill, resolved that theper diem ~ay for the Secretary of the Electoral Board be set at ~22.50. On motion of Mr.Goyne, seconded by Mr.Britton, it is resolved that the study of the operation of the Dog Wardens presently employed by the County be continued in an attempt to effect further efficiencies in the operation of this Department. On motion of Mr. Driskill, seconded by Mr.Hague, it is resolv~-d that the Building Inspector and one of his Aides be authorized to attend the State Fire ~evention and Inspection Seminar in Charlottesville at the County's expense. On motion of Mr. Hague, seconded by Mr.Britton, it is resolved that a checkin the amount of ~3033.95 for the County's share in the cutting of timber in the Pocahontas State Park be accepted into the County's General Fund. On motion of ~.Britton, seconded by Mr. Goyne, it is resolved that this Board authorizes the firm of R.Stuart Royer & Associates to ~roceed, without delay, with the completion of the plans and the securing of b~ds for the installation of sewers in the Broad Rock and Grindall Creek and Falling Creek areas, and ti~ construction of a treatmentplant on the Falling Creek. And be it further re~lved, that a schedule of finances b~ set up so.that bonds can be sold as soon as possible. On motion of ~.Britton, seconded by Mr.Driskill, it is resolved that a contract be drawn between the Woodstock Corporation and the County involving the operation of the sewerage treatment facilities in this are~ ~hic~ contract,if agreeable, to the Woodstock Corporation Be presented at the next meeting of this Board.
