Driskill, it is rezolved that .;~at~roontract for the DuPont Plaza be and it hereby is ap?roved On motion of Mr. Driskill, seconded by kr.Britton, Be it resolved by the Board of Supervisors of Chesterfield County, Virginia: That the Board of Supervisors of ,Chesterfield County does determine 'that it is necessary and expedient tb relinquish and release its rights in and to a certain well lot located on the rear ~ortions o[' Lots 6 and ?, ~orrisdate Subdivision, a ~lat cf whic~' is recorded i[~ Plat Bcok S, Page 155, in the Clerk's Office of the Circuit Court of ChetL-:~rfield Jounty, V'irginia, and ~:~lsc to release and relinouish all its rights in and to an easement following generally th~ dividing line betweenoo.~s 6 and 7 in th~ aforesaid subdivision established and heretofore used by the County of Chesterfield .ct ingress and e~ress from the aforesaid lot. Be it Further idesolved: That the Commonwealth,s Attorney of this County is authorized to prepare .~he necessary deed or other instrument on behalf of the County to relinquish and release the County's interest in the said ~e~l lot and easement. And the Chairman of this Board is authorized and empowered to execute any and all papers necessary to accomplish the purposes of this resolution. On motion of Mr. Britton, seconded by ~lr. Driskill, it is resolved that Sewer Contract F-6311D for the installation of sewers in DuPont Plaza be and it hereby is approved. Mr. Art ~,~olan comes before the Board speaking in behalf of our present, standards for sewer pipe, stating that if the standards are changed to allow standard cement asbestos that the Concrete Pipe and Products Company could not produce standard concrete pipe to meet the specifications. It was generally agreed that further study woul5 be given to this problem. Mr. Chas. Kahl comes before the Board, representing Mr. and Mrs. Ycung who live on Bolton Road and states that a portion of Botton Road had been improved to meet the minimum specifications of the Highway Department. Mr. Lancaster, Resident Engineer, statem that he will accept a portion of this road instead of the entire road a previously suggested. Upon consideration whereof, and on motion of Mr. Britton, seconded by i~.ir.Driskill, it is resolved that this Board reeuest the Highway Department to take into the Secondary System, Bolton Road, fo~ a distance of approximately 200 feet from State maintenance. There was read a notice that the State ~ighway Department had taken into the State Secondary System of roads, Treely Road in Treeland ~ubdivision, from the end of maintenance of Rt. 1152 and extending westwardly for O.5~ miles to a dead end. There was read a letter from the Highway Department citingthe fact that a traffic survey of the intereseCtion of Rts.~'lO and 646 had been completed and a ~' tra~ ,-c light was not justified at this location. On motisn of i'Jlr. Britton, seconded by Mt. Hague, it is resolved that a petition for the improvement to the drainage conditions in the Barlen Drive area be ~eceived for further study. On motion of Mr.Britton, seconded by i%r.Driskill, it is resolved that the request of the Clinton Construction Company to release a ~1000.00 Bond to the ShoosmYth Bros.Construction Company be and it hereby is approved since it is apparent that all of the road work in this area has been completed. There was read a letter from the Willow Oaks Country Club~expressing the need for the widening of Forest Hill Avenue from the Stratford Hills Shopping Genter to the Ci%y limits of Richmond. Upon consideration whereof, and on motion of Mr. Britton, seconded by ~dr. Driskill, it is resolved that this Board requests the Highway Department to study the feasibility of widening Forest Hill Avenue and the possibility of placing said road immediately into the Primary Road System. The Budget for the Secondary RoadSystem in the County was presented, which budget calls for the expenditure of ~1,O~2,O22.00 in the County of Chesterfield. Upon considsration whereof~ ~nd on motion of ~r.Britton~ seconded by ~r. Hague~ it is resolved that the budget as presented be and it hereby is approved. On motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that this Board requests the Chief of Police to investigate vandalism to the street and highway signs in the northern part of the County. On motion of Mr.Driskill, seconded by Mr. Britton, it is resolved that the Executive. Secretary be and he hereby is requested to write all Civic Clubs and other similar organizations asking that they take such steps as possible to prevent vandalism to the street and highway markers. The tentative budget for the County of Chesterfield for the fiscal year ending June 30, 196~, was advertised in the Richmond Times-Dispatch on May 28, 1963, and this date was set for the public hearing on said advertisement. After a discussion of the County budget~ and on motion of Mr.Britton, seconded by Mr. Driskill~ it is resolved %hst this Board of Supervisors of Chesterfield County, Virginia, held a public hearing in accordance with the resolution heretofore pass:ed on May 23~1963~ for informative purposes, on the contemplated budget for the fiscal year 1963-'6~. The budget ~as for informative and for fiscal planning purposes and was not apprcved, adopted or ratified by the Board of Supervisors. Ail vote Aye. On motion of I~.Britton~ weconded by R~r. On motion of Mr.Britton, seconded by Mr. Driskilt, it is resolved by the Board of Supervisors of Chesterfield County, Virginia, that the following appropriations be and the same hereby are made for the month of July, 1963, from the funds and for the functious or purposes indicated in the amount of $3,~)10~809.00. (See Page 323 for listing). Mr. Austin Minnis comes before the Board requesting the hard-surfacing of a road beside the Bermuda Colored School and it was agreed that this matter be discussed with Mr. Lancaster, Resident Engineer, Virginia Department of Highways. This day ~r. Jack Kenny comes before the Board requesting approval of the location of a sign for the Richmond National Bank and Trust Company on the ~O-ft. widening strip dedicated by ~r.J.M.Wilk~nson on the plat of Cedar Farms Subdivision, and states that said Bank will agree that the sign will be moved at the Bank's expense if t?~ property is needed for highway purposes. Upon consideration whereof, and on motion of Rlr.Britto~, seconded by Mr. Hague, it is resolved that this Board grant Mr.Kenny's request, Drovided the sign will be moved when the County has need for this widening strip. On motion of Mr. Hague, seconded by Mr.~riskill~ it is resolved that this Board grants to ~',~[r.C.H.Harris a Variance to allow kr.Harris to occupy a house built as a storage shed and to rent out existing dwellings on said lots but under no conditions can there be a separate sale of either of these dwellings. 63-48. Mr. John O. Gole comes befor~ the Board requesting the rezoning from Agricultural to General Business (C-2) of a parcel of land of irregular shape, fronting 330 feet on U.S. 1 and extending westwardly g95 feet, being 630 feet south of Route 10, presently zoned C-2 £or a depth of 3OO feet, in Bermuda Magisterial District. After considerable discussion concerning the construction of a dwelling on an unimproved road, it is on motion of Mr. Goyne, seconded by Mr. Driskill, resolved that the aforedescribed parcel of land be and it hereby is re~oned for General Business (C-2) purposes. 63-49. Mr. G.E.Sears comes before the Boa~'d requesting the r ezoning from Agricultural to General Business (C-2) specifically for a Plumbing and Heating Business on a parcel of land fronting 90 feet on Kaki Drive and extending west- wardly 175 feet, being 325 feet south of Warwick Road and better known as 622 Kaki Drive, in Manchester Magisterial District~ ~'~[r.Sears explains that he wants to continue to operate a Plumbing and Heating Shop as he has in the past. Mr. Hance, Mr. Wilkinson, Mrs. Stockner and ~lr. Francisco all opposed the rezoning because of the fact that he has not kept it clean in the past. On motion of Y~r.Britton, seconded by Mr. Driskill, it is resolved that a Use Permit for one (1) year be grante~ to ~'h~.$ears for the operation of the Plumbing and Heating business, provided the prope~t.y is kept clean; that only two (2) trucks are used, and that a.t the end of one [1) year he must go out of business or move to another location. It is here noted that Mr.Sears agrees to these conditions. 63-50. M.r.R.Pinkney Sowers, Attorney, requests that Dr. Henry A. Bullock's application for rezoning be deferred for thirty (30) days and since this is appar~ntly agreeable to the opposition in this case. Upon consideration whereof, and on motion of Mr.Driskill, seconded by l~.'ir. Britton, it is resolved that this matter be deferred until July 10, 1963. 63-51. Mr. D.J. Esposito, represented by I'~.J.J.Jewett, comes before the Board requesting the rezoning from Agricultural to Indust. ri. al of a 33-acre parcel . of land o~ irregular shape, having a frontage of 1658 feet on the north line of Proctor's Cre~k and 615 feet on the east line of the S.A.L.Railroad, beingwest of the terminus of Perlock Road, in Bermuda Magisterial District. There appearing no one in opposition to this request, it is on motion of ~dr. Goyne~ seconded by Mr. Driskill, resolved that the aforedescribed parcel of land be and it hereby is resorted for Industrial purposes. .63-52. I~]r.P.L.Travis, Jr., comes before the Board representing ~'~ir.P.L.Travis, Sr., requesting the rezoning from llesidential (R-21 to General Business on a parcel of land, fronting 100 feet on Belt Boulevard (Route 161) and extending southwardly 300 feet being 525 feet east of Brandon Ro~d and better known as 132 ~nd~l~.iEast Bel~ Boulevard, in Manchester Magisterial District. On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that since there is no opposition to this request that the aforedescribed parcel be and it hereby is rezoned to General Business. 63-53. ['~[r.Earl Northern comes before the Board, representing the Diversified Realty Investments,Inc., requesting the rezoning from Residentia!-(R-2) to General Business (C-2) on a parcel of land, fronting 75 feet on the south line of ?'~almsley Boulevard and 110 feet on the west line of Johnson's Street and better known as Lots 15, 16 and 17 im Ampthi!l Heights, in Manchester Magisterial District. Comes also,Mr. Kenneth Gordon and other'~~ presenting pictures and a petition signed b[~. a large number of property owners in the az~ea signifying their objections to this request. ~nd it appears that there is some question as to the existing zoning and the obtaining of a building permit. On motion of Mr.Britton, seconded by ~,~'~r. Dr~skill, it is resolved that this matter be deferred to July 10 so that this information may be ascertained. 63-5~. ~Ir.Thomas of Lyttle and Barnes Construction Company, representing the Rev. Spurgeon Thomas comes before the Board requestimg a Use Permit for a ~ipe and fitting storage yard for a period of five (5) years on a parcel of lan~ of triangular shape, fronting 190 feet on the south line of Chippenham Park~ay and extending southwardly 95 feet, being 90 feet northwest of Laneview Drive (Route 820) in Manchester [~1agisterial [~istrict. After considerable discussion of the merits of this ra~uest, it is on motion of' Mr.Britton, seconded by Mr. Driskitl, resolved that the request for a Use Permit on the aforedescribed parcel of land be and it hereby is denied. 63-55. ~k~. Jack Keith, representing [.~[r. Stephen Leovey, reque~ting a Use Permit to conduct a ballet school as an accessory use to a dwelling on a parcel of land fronting 100 feet ~n Arran Road and extending southwar~!y 189 feet, being 150 feet west of ~[rklow Road and better known as Lot ~ in Block H, Nottingham, Section3, in ?~iidiothian Magisterial District. l'~r. J.J.Jewett, representing some of the families in the area, cites t~at traffic is the main Opposition to this request. Upon consideration whereof, and on motion of [~.'!r. Driskill,seconded by [,[r.Britton,. it is resolved that a Use Permit to conducv a ballet school on the aforedescribed parcel of land,be,and it hereby is approved, subject to a fifteen (15) pupil limitation of each ctass~ and off the street parking ?rovided. On mo~ion of Mr. Driskill, seconded by ~r. Goyne, it is resolved that the following erroneous tax refunds be approved: Richmond Production ~ssoc. - Federal Land Bank Assoc. 1422 Brook Road, Richmond, Virginia Tax on County automobile license plate $6.50 Frank W. Littlejohn 2053 Greenway Avenue, Charlotte, N.C. Duplicate assessment of building 5.36 Ruben C. Flores, 35 OO Kensington l.~venue Richmcnd 24, Virginia Professional business license 16.12 There arose a general discussion as vo the Group Plan for hospitalization insurance for County employees and iv was cited that at least 75% of the employees would be required to join a hospitalization program in or~er to realize a reduced rate of Insurance, in that most companies require the amployers 'ho participate at least 25% of the cos~ of such insurance. It was generally agreed that the County would pay 25% of the hospitalization insurance, provided an acceptable 'program can be obtained. An audit of the County Court was received and filed with the Board's papers~ which audit showed that the Clerk of the County Court had made full accounting for all receipss of record. On motion of ~t~r.Driskill, seconded by Mr. Goyne, it is resolved that this Board approves the request of the Richmond Regional Planning Commission and pays the sum of ~3750.00, the County's share for nhe operation of the Regional Plar~aing Commission for the year' 1963-'6g. On motion of Mr. Driskill, seconded by I~'lr.Goyne, it is resolved that this Board pays to the Bon Air-Southampton Fire Department the price of 5-radio alarm signals sincethe County has authorized the purchase of 5 such signals for each fire company and the Bon Air-Southampton Fire Department has already purchased some thirty or more of vhese units. And be it further resolved, that this Board commends the Bon Air-Southampton Fire Department for this progressiye action. On'motion of Mr. Goyne, seconded by Mr.Driskill~ it is resolved that this Board reluctantly accepts the resignation of MLss Harriet Goode~ a:s Assistant Home Demonstration ~gent for ~he County and commends her for the mxcellent work she has done while in this position. On motion of i,'~r. Driskill~ seconded by Mr. Britton, it is resolved that this Board approves the request of the Bellwood Theater for a pyrotechnic display on July 4, 1963. On motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that Mr. Stanley Hague, the Board's representative to the Welfare Board, and the Executive Secretary, study the proposal of the Y~emorial Guidance Clinic and raport to the Board of Supervisors at an early date. On motion of Mr. Driskill, seconded bv Mr. Britton, it is resolved that this Board requests the Treasurer, )~.George W.Moore, Jr., to t~rn over the 1959 Personal Property Tax bills to the Collector of Delinquent taxes, as soon after July 1st as pos~ble. On motion of Mr. Driskill, seconded sv Rlr. Britton, it is resolved that Cash Bond in the amount of $8OO~O0 be accepted from Mr.W.P.Leonard to be held in escrow for completing two stub roads in t?e P~coshock Heights Subdivision. On motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that this Board reques%s the Judge of Circuit Court, the Honorable William Old, to again appoint C. W.S~ith, as Chief of Chesterfield County Police Department for the coming year. This day the matter of vacating a certain 50-ft. easement shown on the Plan of Stratford Hills, Section 5, recorded in Plat Book 12, pages 1 and 12, comes before the Board and upon consideration whereof, and on motion of Mr. Britton, seconded by Mr.Driskill, it is resolved that this vac,'~tion be tentatively approved, subject %o the Engineering Department's study and approval. On motion of Mr.Driskill, seconded by kr. Britton, it is resolved that the vacatioh of Ithaca Road be tentatively approved, provided a 30-ft. easement be retained and subject to the receipr~ of the proper legal documents. On motion of Mr.Britton, seconded by Mr.Driskill, it is resolved that the following resolution be proposed for adoption: AN ORDINANCE, amending the Code of the County of Chesterfield, Virginia, providing for the vacation, removal, repair or demolition of any building or structure which is or threatens to be a public nuisance, dangerous to the health, morals, safety, or general welfare of the people in the County of Chesterfield, Virginia, or which might ~end to constitute a fire menace; and for the assessment of the cost of vacation, removal, repair or demolition thereof against the owners of such premises, and to provide for the recovery of such costs in an action at law, by adding a new article to be known as Article 4, Section 14-50, through 14-59, inclusive. and advertised for passage July 10, 1963, at ll:OO a.m. There was received a letter from Mr.A.E.D.Howard exhorting the County %o keep inviolate the historical location of the first iron furnace of America on Falling Creek.
