SUMMARY Continued parking of a recreational vehicle (a boat) within the corner side yard of a residential lot is planned. The applicant does not plan to meet the Ordinance restriction that the recreational vehicle be parked in the rear yard. In August 2017, the Planning Department received a complaint relative to the parking of a boat measuring approximately 19 feet long, 8 feet wide and 10 feet tall within the corner-side yard. The vehicle is currently stored in the driveway within the right corner-side yard as shown in the figure below. The Zoning Ordinance permits the parking and storage of recreational equipment within a residential district with certain restrictions: No more than two (2) items of equipment permitted to be stored outside of an enclosed building; Except for loading and unloading, equipment is located in a rear yard and set back 10 feet from the rear property line and 5 feet from the side property line; Except for repair, wheels on the equipment are not removed; Equipment is not used for living or commercial purposes; and, Equipment is not connected to utility services. These ordinance restrictions are designed to minimize impacts of larger vehicles and equipment on area residential development and the streetscape. If any of these restrictions cannot be met, 418SN0661-2018APR25-BOS-RPT the use may be allowed by conditional use. The a ordinance restrictions except that the vehicle is parked within a corner-side yard. The applicant is seeking conditional use approval to permit parking and storage of the recreational vehicle in its current location. Alternative Parking and Storage Location Upon visiting the subject property, staff noted that the boat was stored in the right corner-side yard, approximately 30 feet from Elkhardt Road. In addition, the boat was covered with a blue tarp, making it highly visible from Stone River Road. The subject property narrows towards the rear lot line. This, in combination with the placement of the dwelling towards the southern property line, results in approximately 76 percent of the unimproved lot area contained in the front and corner-side yards. A significant extension of the existing driveway would be necessary to accommodate the parking of the boat in the required rear yard. Furthermore, access to the rear yard along the left side of the home is encumbered with existing trees, a mechanical unit, and a drainage ditch. In consideration of these existing constraints, there is no practical alternative location for on-site parking which would comply with the Ordinance. The storage area for the boat is tucked behind existing trees and vegetation that parallel Elkhardt Drive and conceal the boat from this road. There are also multiple trees in the front yard however the boat is visible from some locations along Stone River Road. The applicant has worked with staff to provide for additional screening which would fill in gaps between the larger trees and reduce visibility of the boat from Stone River Drive. Furthermore, the applicant plans to remove the blue tarp on the boat and purchase a cover which would blend in more effectively with 518SN0661-2018APR25-BOS-RPT existing foliage. Given the constraints of the lot and the visual impacts of the boat, staff is supportive of this request. Non-Transferable Ownership. This Conditional Use approval shall be granted exclusively to Nicholas Staniscia, and shall not be transferable nor run with the land. (P) 2. Use. This Conditional Use approval shall be for the parking of one (1) recreational vehicle (boat and associated trailer consisting of one axle) with no greater than nineteen (19) feet in length. (P) 3. Location of Recreational Vehicle. The recreational vehicle shall be parked within the corner side-yard, as shown on page 4. The vehicle shall be parked behind the front wall of the existing home. (P) 4. Landscape Screening: Screening shall be provided and maintained as generally depicted in the Exhibit located in Attachment 2. Landscape screening shall consist of a minimum of eight (8) Skip Laurel trees planted at a distance of 6 feet on center, or placed in locations satisfactory to the Department of Planning to achieve adequate screening of the recreational vehicle. Trees shall be a minimum of five (5) feet in height at the time of planting. Existing foliage along Elkhardt Road shall be maintained in its current state, however, where visual openings exist, additional Skip Laurel trees shall be planted as determined by the Department of Planning.
