SUMMARY
Continued parking of a recreational vehicle (a boat) within the side yard of a residential lot is
planned. The applicant does not plan to meet the Ordinance restriction that the recreational
vehicle be parked in the rear yard.

Proposal
The applicant has been parking a recreational vehicle on the property since 2002. In August 2017,
the Planning Department received a complaint relative to the parking of a boat measuring
approximately 21 feet long, 7 feet wide and 9 feet tall within the side yard. The vehicle is currently
stored in the driveway within the right side-yard as shown in the figure below.
The Zoning Ordinance permits the parking and storage of recreational equipment within a
residential district with certain restrictions:
No more than two (2) items of equipment permitted to be stored outside of an
enclosed building;
Except for loading and unloading, equipment is located in a rear yard and set
back 10 feet from the rear property line and 5 feet from the side property line;
Except for repair, wheels on the equipment are not removed;
Equipment is not used for living or commercial purposes; and,
Equipment is not connected to utility services.
These ordinance restrictions are designed to minimize impacts of larger vehicles and equipment
on area residential development and the streetscape. If any of these restrictions cannot be met,
the use may be allowed by conditional use.

seeking conditional use approval to permit parking and storage of the recreational vehicle in its
current location.
Alternative Parking and Storage Location
Upon visiting the subject property, staff noted that the boat was stored in the right side-yard,
approximately 130 feet from East Brigstock Road, and in front of a detached accessory building. A
septic system is located in the left side yard and a portion of the rear yard. In addition, the
property slopes downward toward Lake Patrick Henry (approximately 15% slope). As such,
expansion of a parking area into the rear yard would require significant improvements including
grading and construction of retaining walls, as well as the relocation of septic fields. Due to these
existing constraints, there is no practical alternative location for on-site parking which would
comply with the Ordinance.
The storage area for the boat is at a lower elevation than the street as well as the adjacent
property located at 2748 East Brigstock Road, and there is existing vegetation along the right side-
yard. These conditions reduce visibility of the vehicle from the street as well as views from
properties located to the north of the subject property. Due to the constraints of the lot and the
minimal visual impacts of the boat, staff is supportive of this request.

CONDITIONS
Notes: The following conditions are recommended by both the Planning Commission and
Staff.
1. Non-Transferable Ownership. This Conditional Use approval shall be granted exclusively to
Michael David Wilburn, and shall not be transferable nor run with the land. (P)
2. Use. This Conditional Use approval shall be for the parking of one (1) recreational vehicle (boat
and associated trailer consisting of one axle) with no greater than twenty-one (21) feet in
length. (P)
3. Location of Recreational Vehicle. The recreational vehicle shall be parked within the side yard,
as shown on page 4. The vehicle shall be parked behind the front wall of the existing home.
