09-26-1963 MinutesVIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on September 26, 1963~ at 2:00 p.m. Present: Mr. Ir yin G.Horner, Chairman Mr. H. T. Goyne M~. R. J. ~ritton M~. Stanley R.Hague, Jr. Mr. William G. Ritchie Mr. ~,arshall F.Driskill 63-65. Mr. Joe .Bambacus, representing Messrs. Adelman and Berlin, seeking a Use~ Permit for the construction of @ Nurshing Home on Forest Hill Avenue, which request was deferred from September 1]~ 1963, comes before the Board and states that vhe Nursing Home will provide employment for 20 or 25 persons in the area and will act as a buffer for the houses in thcs area. Mr. Ralph Page, Attorney~ representing the opponents, states that the surrounding property will suffer increased taxes, and presents a petition with notarized signatures. .Mr. Britto~ states that the particular intersection of Chippenham Road and Forest Hill Avenue will have a lot of traffic, that this is not the place for a Nursing Home and he moves that this request be denied. ~0~ereupon, Mr. Driskill seconds the motion to deny the application. Mr. Goyne states that this is a matter of policy, that the people should have a right to sell their property for profit and that he will support the passage for a Hse Permit to sllow the construction of a Nursing Home. ~r. Horner states that this perhaps is not the time, however~ the trend will be no doubt ~hat the whole intersection will be changed to General Business. A vo~e being taken on this request: Ayes Mr. Britton, ~r. Driskill, Mr. Hagus and Mr. Horner. ~ ~ Nays- Mr. Goyne and Mr. Ritchie ~'hereupon the motion for a Use Permit is denied. On motion of Mr. Britton~ seconded by Mr. Goyne, it is resolved that the contract of ~.~r. Curtis Rudolph for the installation of sewers in Falling Creek $ourt be~ and it hereby is aoproved.- On motion of ~lr. Goyne, seconded by Mr. Ri~tchie~ it is resolved that the sum of $3954.00 be appropriated from the unappropriated surplus of the County to the office of.gommissioner of Revenue, 2a-405, the same being gor the purchase of new equipment for this office. This day Mr. McManama comes before the Board seeking a Variance to allow an addition to a trailer on a 30-foot right of way off the Ott~erdale Road. Upon consideration whereof, and on mo~tion of Mr. Homer, seconded by Mr.Britton, it is resolved that this request for a Variance be and it hereby is approved. Two letters from Miss Lucy '~orr~,Supt. of Welfare were read~ requesting'the Board to appropriate ~200.00 for Christmas baskets. On motion of Mr. Ritchie~ seconded by Mr. Hague, it is resolved that the sum of $200.00 be and it hereby is appropriated to the ~,?elfare Department. There was cited the fact that one additional girl must be employed in. the Welfare Department to handle the Christmas funds in the County of Chesterfield, and that additional telephone service is needed. On motion of Mr.Goyne, seconded by Ritchie, it is resolved that an additional trunk line be installed in the lVe]fare Department. There was cited the evidence of several complaints being received ~&~' the County on the inadequate telephone service at the Courthouse. On motion of Mt. Hague, seeonded by Mr.Driskill, it is resolved that thisBoard raquests the Telephone Company to make a survey and to advise the County on the number of trunk lines necessary to'handle adequately the telephone traffic. On motion of Mr. Goyne, seconded by ~r. Britton, it is resolved that the following erroneous tax claims be and they hereby are approved for payment: William Earl Humphlett - Refund of license ~3.50 2~15 Clearfield Street,Richmond, Va. ~rs. Jean Lee Litner Harvey - Refund of license 6.50 1202 Starling Drive, Richmond,Va. Thad Gibbs - Gounty Capitation Tax ~1~26 There arose a discussion on pol$cies for the operation of the County land-fill. After conaiderabte~discussion this matter was deferred for further study. On motion of Mt. Hague, seconded by ~r. Ritchie~ it is resolved that the Board approves the salaries of Mrs. Frances Cole as Administrative Secretary, B-l, at $3~2.00 and Mra. Hazel Col~ as a Clerk-Typist, B-i, at ~25~.00 per month. There was presented a request from the Church of the Lord Jesus Christ for a' Variance to build a church on an unimproved road. On motion of I~h~.Driskill, seconded by Mr. Britton, it is resolved that this r~equest be continued for further investigation. On motion of Mr. Goyne, :seconded by Mr. Driskill, it is resolved that this Board grant a Variance to the 'Chester Junior Chamber of Commerce to allow the construction of a community center building and other facilities on th~ extension of Lee Avenue, the same being unimproved at this time, upon the condition that the Chester Ja¥cees will construct the road when required. On motion of Yr.Britton, seconded by Mr. Driskill, it is ~esolved that the following standard w~ter contracts be and they hereby are approved: R-262 Nottingham, Section 3 ~735~00 R-607 Vaughan Height s 3 ~30,00 On motion of Mr.Britton, seconded by Rlr. Driskill, it is resolved that the S~ecial Water Contract in Northlake Hills, be, and it, hereby is approved. On motion of Mr. Britton, seconded by R'~r. Hague, it is resolved that the following sewer contracts be a~ they hereby are approved: Vaugha n Heights Greenfield,[ Section "A" On motion of Mr.Driskill, seconded by Mr.Britton, it is resolved that the Co~nty Sewer System pay ~2100.00 for sewers o~ Medina Avenue in Woodmont, which is outsid~ 'of t~e sewer area contracted with Mr. Jacobs. On motion of Mr.Britton, seconded by Mr.I~riskill, it is resolved that contract 6102-15 in the amount of ~174,359.95, be awarded to F.L.Showalter, and the use of concrete pipe is s~ecified. On motion of Mr. Goyne, seco. nded by R~r.Ritchie, it is resolved that contract 6102-~ in the amount of ~180,~90.~0 be awarded t~ Ray Louder and Company from North Carolina, and the use of concrete pipe is specified. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that the County Engineer be and he hereby is a~thorized to award to the Iow bidder the contra~t No.61-2-15A, which bid will be receive~ October 1, 1963% On motion of Mr.Britton, seconded by Mr. Dr~skill, it is resolved that the time on contract 6102-19 be extended from November 16, 1963 to December 1, 1963~~ insofar as the trunk line and force main is concerned and the time for the balanc~ of construction be extended to January 2, 196~. On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that the Executiv~e Secretary be requested t~ send to the contractor ~ the s~wer job on Whitehead Road, a repair bill in the amount of ~30.20 for M~.B.J.Smith. On motion of Mr. Britton, seconded by Mr. Driskill, it iszesolv~ed that this Board tentatively approves t~e contract with the Southern Railroad for crossing at BloomfieId Road. On motion of Mr.Britton, seconded by Mr. Driskill, it is mesolved that the necessary personnel in the Water Department be authorized to attend the American Water Works ~Convention in Roanoke, Virginia. On motion of Mr. Ritchie, seconded by Mr.Driskill, it is resolved that 'street lights be placed on Perdue Avenue, Magnolia Avenue, Warren Avem~ue, Robertson Avenue, and Roosevelt Avenue in Matoaca Distriot. There wasread a letter from Mr.F.L.Gibbs, explaining the necessity for some delay in changing the regular street lights to mercury vapor lights. On motion of Mr.Britton, seconded by Mr.Driskill, be it resolved by the Board of Supervisors of the County of Chesterfield, Virginia, in regular meeting assembled that the Chairman of the Board of Supervisors, be, and it hereby is authorized to enter into an agreement with the Atlantic Coast Line Railroad Company, and to sign same on behalf of said County, whereby the said Railroad Company grants unto said CoUnty the right or license to install and maintain for the purpose of a sanitary sewer, a line of 24-inch gauge metal pipe across the right of way and under tracks of the Railroad Company near Richmond,Virginia, at a point 826 feet northwestwardly, measured a].ong the center line of the Railroad Company's northbound main track from I~'lile Post 3; as more~ particularly described in said agreement, which agreement is dated September 3, 1963, a copy of which a~reement is filed with this Board of Supmrvisors. On motion of Mr.Britton, seconded by Mr.Driskill, be it resolved by the Board of Supervisors of the County of Chesterfield, Virginia, in regular meeting assemble~ that the Chairman of said Board be, and he hereby is authorized to enter into an agreement with the Atlantic Coast Line Railroad Company, and to sign same on be. half of said County~ whereby said Railroad Company grants unto said County the right or license tn install and maintain for the purpose of a sanitary sewer, a line of pipe, together with a manhole on said Railroad Company's right of way, near Richmond, Virginia; as more particularly described in said agreement, whir. h agreement is dated S~ptember 6, 1963, a copy of which agreement is filed w~th this Board of Supe fyi sots. There was read a letter from the Highway Department concerning the status of the funds for the circumferential road and the status of the bridge investigation on Branders Bridge Road. There arose a discussion on the drainage easement leading from Beechnut Avenue and it was cited that Mr. Roane would ~ive to the County an easement leading due northwardly from Beechnut Avenue at a proposed road location. It was generally agreed that this matter b~ investigated. There was read a letter from Mr.J.J.Jewett concerning the removal of offices from the County Courthouse to the proposed Federal building in Chester. On motion of Mr.Driskil!~ seconded by Mr. Ritchie, it is resolved that officials of the Federal Government be informed that prior to moving offices away from Chesterfield Courthouse, the Board of Supervisors would appreciate a conference with those who made the decision. Mr.Britton bro~ught to the attention of the Board arequest for transportation of certain Cerebral P&~sy children to the Center for treatment and~or education. On motion of Mr.Britton, seconded by mr. Driskill, it is resolved that the Judge of Circuit Court, the Honorable'William Old, be and he hereby is requested to reappoint the following Police Officers for Chesterfield County: G. J. Teeslink C. G. Bosher C. W. Ward W. L. Lovelady, Jr. J. H. Johnston, III W. V.Driskill There was read a letter from the Secretary of Woods Methodist Church concernin~ the Health Department rules and conditions of the County Fair. It was generally agreed that a copy of this letter be sent to the Health Department and tn 'the President of the Fair Association. There was read a letter from Dr.Robert P.Daniel, President Virginia State College, regarding the right of way to the Ettrick Cemetery Road. It was generally a~reed that this hint%er be investigated further. On motion of ~r. Britton, seconded by Mr. Driskill, the following resolution is adopted: WHEREAS, W.H.Nicety is the owner of Lots #1 and #2, Block F, Section B, in the Subdivision of Longwood Acres, which plat is of record in the Clerk's Office of the Circuit Court of Chesterfield County,Virginia, in Plat Book 10~ Page 111, and WHEREAS, at the recordation of said plat an easement for drainage and extension of utilities was established at the rear of said lots~ and WHEREAS, th~ said W.H.Nicely has informed the Board of SuperVisors of his intention to ask for a relocation of the lots in accordance with a plan prepared by Foster & Miller, Surveyors, entitled "Proposed Longwood Acres Resubdivision of Lots 1 and 2 and 70' of Reserved Parcel Blom.k "E", and WHEREAS, the easement in its present location will be detrimental to said plan of relocation; and WHEREAS, it appears that no adjoining property owner will be adversely affected if said easement is abandoned. NOW, THEREFGiE, BE IT RESOLVED, That the Board of Supervisors of Chesterfield County do hereby approve the vacation of the ten {10) foot easement for drainage and utilities situated at the rear of Lots 1 and 2, BlockF, Section in n he subdivision of Longwood Acres. This resolution is conditioned upon and shall become operative when the aforementioned petitioner has executed and acknowledged for record on a form approved by the Commonwealth's Attorney an aopropriate declaration of vacation. And Petitioner executes an easement for drainage and utilities along the north boundary line of pr6posed designated "Reserved" shown on Plat of Foster and Miller, dated July 19, 1963. When such declaration of vacation ha's been approved the same shall be recorded in the Clerk's Office of the Circuit Court of this County and the Clerk shall indicate the vacation on the margin of the'plat of Longwood Acres, Sections B, which is recorded in Plat Book 10, page 111, amd shall index the same on the Grantor side of the general index of deeds. This day the County Roa~ Engineer in accordance with directions from this Board made a report in writing upon his examination of Jean Drive in Jean Court Subdiviaion, Bermuda Magisterial District, which shows that in the opinion of the County Road Engineer, i~t is expedient tha~ said road be established as a public road. Upon consideration whereof, and on motion of ~r. Goyne, it is resolved that Jean Drive in the subdivision of Jean Court, Bermuda District, be, and it hereby is established as a public road. =nd be it further resolved, that the Virginia D~partment of Hi~hways be~ and i.t hereby is requested to take into the Secondary ~oadSystem, Jean Drive, beginning at a point on Rt.6OS, .35 miles west of Route 61~ and extending northwardly .27 miles to Rive~'side Drive. This road serves 3 houses. And be it further resolved~ vhat the Board of Supervisors of Chesterfield County guarantees ~o the Virginia Department of Highways, right of way of not less than 50 feet for this road. Dedication of said right of way in Plat Book 8, Page 117, ghesterfield Courthouse, Virginia. This day the County Road Engineer in accordance with directions from this Board made report, in writing upon his exami~nationof Kildare Drive in Westover Farms~ Subdivision, Manchester Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. ~pon consideration whereof, and on motion of Mr.Britton, it is resolved that Kildare Drive in the Western Farms Subdivision, Manchester District, be, and it h~reby is established as a public road. and be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary RoadSystem, Kildare Avenue, beginning at a point on Route 1971, .03 miles west of Route 193~, and extending westwardly .10 miles vo Brannoch Drive. This road serves And be it further resolved, that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department of Highways~ right of way of not less than 50 feet for this road. Dedication of said right of way in Plat Book 13, Page 31, Dhesterfield Courthouse, Virginia. On motion of Mr.Driskitl, seconded by Mr. Goyne, it is resolved that this meeting be adjourned to October 9~ !96~ at 9:00 a.m.
