Driskill, it is resolved that the sewer contrac% S-63-30D for Marlboro, with the General Construe tion Company, be~. and it hereby is approved upon the recommendation of the County Engineer. On motion of Mr.Britton, seconded by Mr. Hague, it is resolved that the Sewer Contract S-63-29~C for the installation of sewers on Walmsley Boulevard in the amoun% of $88,~42.95 be awarded to the Van Doren Bros., with the use of cergent asbestos pipe specified. On motion of Mr. Britton, seconded by Mr.Driskill, it is resolved that the sewer contract 6102-~5A for the installation of sewers in Scottdale in the amount of $38,929.75 be awarded %o the Van Doren Bros., with the use of cement asbestos pipe soecified. The County Engineer read a proposal from the Richmond-Petersburg Toll Road Authority whereby certain properties lying eas% of the sewerage treatment plant facilities, presently owned by the Toll Road, w~uld be sold. -Upon consideration whereof, and on motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that the County of Chesterfield pay to the Richmond-Petersburg Toll Road Authority the requested price of $7550.00 for the 15~ ~cres, more or less, in the tract. On motion of ~ir. Driskill, seconded bv ~r. Britton, the following resolution is adopted: WHEREAS, Preston C. Shannon, Ann P.Shannon, Bernard E. Nierle and Marguerite E. Nierle are the owners of the land abutting Ithaca Road, said Ithaca Road being an unopened street on the plan of Mohawk recorded in Plat Book 8, page 177, in the Clerk's Office of the Circuit Court of Chesterfield County, Vir~ nia; and WHEkEaS, the said Preston C.$hannon, Ann P.Shannon, Bernard E. Nierle and ~arguerite E. Nierle have executed a Declaration of Vacation for the purpose of vacatin~ said Ithaca Road; and WHEREa~, Preston C.Shannon-~ Ann P.Shannon, Bernard E. Hierle· and Marguerite E. Nierle are the owners of property abutting aaid streeL, and wherein pursuant to Section 15-766.1 of the Code of Virginia (1950), as amended, Preston C.Shannon, Ann P. Shannon, Bernara E. Nierle and ~larguerite E.Nierle desire to vacate the aforesaid Dian of Mohawk to the extent and according to said Declaration of Vacation; and WHEREAS, the County of Chesterfield has reserved a sixteen-foot (16') easement, eight feet lying on each side of the center line of said Ithaca Road for the purpose of installing water and sewer mains,surface and underground drainage, and underground and overhead utilities, and such other utilities as may be deemed necessary by the -Board of Supervisors. WHEREAS, the proposed vacation will not interfere with any rights of any par~y havin~ any interest in the street not consenting thereto; NOW, THEREFORE, ~]iTNESSETH: That the Board of Supervisors do hereby aoprove the vacation of Ithaca Road as shown on the plan' of Mohawk m~de by John H.Foster, Certified Surveyor, dated June 22, 1950, ~and recorded in Plat Book 8, pag~ 177, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, and the Declaration of Va3ation exhibited with the petition herein shall be recorded in the Clerk's Office of the Circuit Court of tha County of Chesterfield, Virginia, and said Clerk shall indicate the vacation on the margin of the recorded plan of Mohawk, recorded in the Clerk's Office of Plat Book 8, page 177, and Shall enter the same on the Grantor side of the General Index of Deeds in the names of the parties hereto. There arose a discussion on the installation of sewer connections on the west side of Route #10 and it was generally agreed that the Board would consult further with the Engineers in an effort to seek the best financial solution to this problem o This day the matter of vacating ~ certain ~ifty foot easement for future street in ~'ian~hester District, Chesterfield County, Virginia, came before the Board. ·Upon consider@tion whereof, and on motion of Ma~.Britton, seconded by Mr.Driskill~ the following resolution is adopted: WHEREAS, application has been made in writing to the Board of Su ~ pervisors of the County of Chesterfield, Virginia, by Richard C. ~oode and Mary M.Goo~e, his wife~ and Alton L.Griz~ard and Mabel J. Griz~ard, his wife, to approve the vacating of a certain fifty foot easemen~ for future street in Manchester ]Diat~ict, as shown on a plat of Stratford ~ii!ls, Section V, dated November 10~ 1959, recorded March 24, 1960, in the Clerk's Office of the Circuit Court of this County in Plat Book 12. pa~es 1 and 2; and it a~pearing to the satisfaction of the Board that the above named persons are the owners of the land upgn which said easement was created; that said easement ]~as never been open to public use, but has remained in the undisputed use, occupation, and possession of said owers a~d their predecessors in title, and that such easement is not desirable for the development of the lands abutting i~ or any other lands and 6hat the vacation of said easement will not destroy or abridge any of the rights or privileges of other property owners within the bounds of the area of land shown on such plat or of any person, firm or corporation s~ecifically designated as the beneficiary of such easement on such plat or to whom the benefits thereof have been granted by writingduly of record; THEREFORE, BE IT ~ESOLVED, BY THE BOARD OF SUPERVISORS OF ~hesterfield County, Virginia, that it hereby approves the vacation of the fifty foot easement for future street in M~nchester District as shown on plat of record in Plat Book 12, pages 1 and 2, and that this approval be, and it is, conditioned upon the declaration of a perpetual easement for the installation of water and sewer lines under and u~on twenty feet of the fifty-foot easement vacated, the location of said easement to be determined by the County Engineer of Chesterfield County,Virginia, and such a~proval is further conditioned upon the recordation in the Clerk's Office of the Circuit Court of this County of a properly executed instrument prepared pursuant to Section 15-766.~ of the Code of Virginia, and a~proved as to form by the Commonwealth's At~rney. There was read a list of roads ~ccepted into the Secondary Road System by the Virginia Department of Highways: Roads in McKesson Place Subdivision, Holiday Hills Su[~division, DuPont Plaza Subdivision, Jessup Farms Subdivision, Staffordshire Subdivision, Westchester Subdivision, Grove Place Subdivision, and She~fiel d Court. There was re~d a tetter from Mr.D.N.Huddle, Asst. Chief Engineer, citin2 the fact that the Highway oepartment had turned down the County'~ request for transferring Forest Hill ~venue to the Primary Road System. There was read a letter from Mr.R.V.Lancaster, III, Resident Engineer, Virginia Department of Highways, citing the fact that Rt.75~, being the Coalfield Road, is included in the tentative secondary budget for widening and stabalizing; however, it was generally agreed that this road should be hard-surfaced this year, if at all possible. ~]r. Luther Roane comes before the ~oard presenting plans to drai~ Beechnu6 Avenue northwardly an~ the Engineering Department estimated that it would cost approximately ~2500.OO to dig the necessary ditch' to take care of this drainage. It was gen~ra!ly agreed that prices would be obtained in an effort to ascertain the exact cost of recommended improvements. On motion of Mr.Britton, seconded by Mr. Oriskill, it is resolved that this Board requests the Highway Department to survey ~t.637, from ~ichmond City line to the Belt Boulevard and to make such improvements as are required~ in stages if necessary, vo eliminate the traffic and drainage h~zards on this road. On m~otion of Mr.Britton, seconded by Mr. Goyne, it is resolved that the County seek the removal of utility poles on '.Vorthington Road and tn pay the cost of moving same if necessary in order that this road may be widened and hard-surfaced. ~m.Britton ~.eque~,t~ ed that a "No Thru Traffic" sign be placed on Grevstone. avenue while ~he sewer construction is underway'. On motion of Mr.Govne, seconded by Mr. Hague, it is resolved· that this Board delete the resolution passed on January 2~, 19 3~ requesting the Highway Department to abandon the Fort Darling road for maintenance. On-motion of Mr. Ooyne, seconded by I'dr. On motion of ~'ir. Dr~ skill, seconded by Mr. Britton, it is resolved that the Plan of the Blue Cross -Blue Shield Hospitalization, be, and it hereby is accepted by the ~ounty for one (1) year. On motion of Mr.Ritchie, seconded by ~lr. Goyne, it is resolved that the fee for the use of the football field at the Courthouse be cha~ged 10% of the gate receipts or $50.00 maximum charge for County schools. On motion of Mr. Brit%on, secondad by Mr. HaA~e, it is resolved that the County purchase batteries for five (5) Walkie-Talkie radios for the Dale Volunteer Fire Department, at a cost of ~10.15 per radio, with the understanding that this expenditure may or may not be repeated. It is here noted that Mr. Driskill .votes "No". 63-62. Rirs. Geraldine H.Burke comes before the Board on a request to rezone to General Business a parcel of land known as 2619 Broa~ Rock Road, which request has been deferred from August 1~, 1963. 'Mr.Walte~~ Burke (divorced husband of R~rs. Geraldine Burke) states that no one has contacted him in the last Sixty days and that he is opposed to the rezoning. ~irs. Burke states that the lawyer for Mt. Burke ~s cited the fact that no opposition would be presented. On motion of Mr.Britton, seconded by I',~lr.Goyne, it is resolved that this ~ratter be postponed to November !3~ 1963, in a~further effort to reconciling the views attendant to this case. 63-73. Therewas deferr~:d from September 11, 1953, the request, of C.A. and J.R. Rawlings for rezoning in Kovac Acres. Mr.:U.A. Rawlings requested by letter dated October 7, 196~ and received at the Courthouse on October 8, 1963 that this matter be deferred for another thirty (30)days. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mt. Hague, it is resolved that since Mt.Rawlings is not present and the request was nm de that tbi~ rratber be deferred, that the same be granted.. There appears no opposition to the request of [~lr.Rawlings and on motion of Goyne, seconded by Mr. Ritchie, it is resolved that the foregoing resolution deferrin~ the Rawlings case be and it hereby is rescinde~. Upon further discussion of t~e application of Mr. Rawlings' and th~ propos~ed use of the land, it is on motion of Mr. Goyne, seconded by Idr. Mrs. Belcher, ~rs. Richard Jones, Attorney, representin!i Mr?.H.Chandler comes before the Board requesting the rezoning from Azricultural to General Business (C-2) of a t~iangular parcel of land in Bermuda Magisterial District, fronting 799 feet on the west line of Richmond-Petersburg Toll Road, and 265 feet on the north line of Route 619, being at Walthall Interchange. There appearing no one to oppose this request, it is on motion of Mr. Goyne, seconded by Mr.Hague, resolved that the aforedescribed parcel of land be and it hereby is rezoned for General Business purposes. Mr.~.R.Malloy comes before the Board as owner of the Richmond Refining Company, Inc., requesting a Use Permit to operate a rendering plant to process animal fats and protein on approximately a 29.8 a~re parcel of land ob ~rregular shape fronting 797 feet on Bellwood Road (Route 6561 and extending northwardly 1375 feet along the east line of the SAL Railroad and extending southwardly 1530 feet along the east line of the SAL Railroad being divided by the Toll Road and Bellwood Road,and states that at present the Old Hickory Acid Plant being the site on which the Use Permit is requested, would be used as a storage site from which material would be shipped to Lynchburg and Norfolk but that at some future time the rendering plant may be built in this building. Mr. Earl Hartman, presented a petition signed by eighty people opposing the request. ~r.Robert Pollard, Attorney, representing Mr.Sam Mason, owner of the adjacent property presents Mr. Lewis Teitlebaum from Alexandria, Virginia, who states that a similar plant in that city has a substantial odor. Mr. Luther Sullivan, representing }~[r.U.Louis Reynolds, states that he does not want to deter industry, hc~ever, he wants no obnoxious odors that m~y hamper the industrialization of the area. Mr. Frank Blackwell, Engineer for the Toll Road, cites his concern of smoke and smog on the Toll Road. Mr. Rudy Bunzl, representing the U.S.Filter Corporation, cites the fact that filters manufactured in this new plant readily pick up any odors and if there were a bad odor it would create unnecessary problems in his plant. Many residents of Patterson Park and the surrounding area a~pear t~ ~rotest this proposed rezoning. Mr.Horner states that the County wishes in every way to hav~ n~w industry locate in the County, however, the chances that this new industry would affect many future industries is great. Mr. Ernest Gates~ Chairman of the Chesterfield Governmental Division Unite~ Givers Fund, requested the Boar~ '~o authorize payroll deductions for contributions to the ~nited Givers Fund from County employees. On motion of Mr. Driskill, ~econded by Mr. Goyne, it is resolved that payroll deductions be authorimed, provided the Treasurer can work out the mechanics of such a proposal. The Executive Secretary presented plans and estimates cost of remodeling the locker' plant for the Police Department. On motion of Mr.Britton, seconded by Mr. DriskiL1, it is resolved that these plans be and they hereby are referred to the Buildings and Grounds Committee. On motion of R'ir.Hague, seconded by Mr.Britton, it is ~esolved that the Board anprov.es the general recommendations on the action of the Planning Com~nission in allowing the subdivider of Royal Oaks Subdivision, Section "A", not to install County water for Lots 2, 3,'and ~ in said Subdivision. On motion of ~'[r. Goyne, seconded by Mr. Oriskill, it is resolved that this Board accepts the dedication of lO-feet for a widening strip on Rt. 1132~ the Walthall Int ercha nge. On motion of ~'~.Dri~kill, seconded by Mr. Britton, it is resolved that the County accepta adeed from ~r. John B.Compton for the w~dening of a proposed road, Twinridge Boulevard. There was read a letter from Mr.Warren Chapman, citing certain traffic irregularities. On.motion of l¥~r.Britton, seconded by ~ir. Driskill, it is resolved that copies of this letter ~e sent to Chief Smith and to the State Police Department. The Board was notified by the Compensation Board of a meeting on October 1~, 1963, at 9:30 a.m. for the purpose of f~xing salaries and expenses of Constitutional officers. On motion of' ~r. Britton, seconded by Mr. Goyne, it is resolved that the Purchasing Agent be requested to send out specifications and request bids on the hea~ting of the Exhibition Building. At the request of I¥:~r. Goyne, it was generally agreed that the Executive Secretary investigate the condition of the bulldozer for the County's landfill and ascertainl the trade-in value on a new machine. On motion of Mr. Ritchie, seconded by Mr. Goyne, it is resolved that the Executive Secretary investigate the condition of thepainting on the Ettrick Fire Depar%men%'is roof and the adequacy of current in said building and to correct these features.
