04-23-1964 MinutesVIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on April 23, 1964, at 2:00 p.m. Present: Mr. H.T.Goyne, Chairman Mr. Irvin G.Horner Mr. R. J ~Britton Mr. J.Ruffin Apperson Ur.herbert O.Browning ~ir. A .R .Martin Messrs. Floyd Gibbs, Randolph Perrow, Rigsby and Runyon of the Virginia Electric and Power Company present to the County an Industrial Survey recently published by the Virginia Electric & Power Company and explained to the Board the advantages of such a compilation of industrial sites. ~nereupon the Chairman thanked the Virginia Electric & Power Company's Officials for their interest and help in the industrialization of Chesterfield County. On motion of Mr. Apperson, seconded by Mr. Horner,.it is resolved that this Board accepts a deed from Mr.%';illiam L.Thurston, Sr. , for the widening of Thurston Road. The Chairman states that this the advertised hour for a public hearing on a proposed changein the Dog Ordinance. Aoproximately seventy-five people appeared to support the passage of more controls on dogs running at large. Various views were cited and s-ggestions given as to how this could be accomplished. The Commonwealth's Attorney states that this is ~s far as the County can go under the present State law. Upon consideration of the arguments presented and the discussion of the Board, it is on motion of Mr.Aoperson, seconded by Mr. Martin, resolved that the following Ordinance be and it hereby is adopted: AN ORDINANCE, to amend the Code of the County of Chesterfield, Virginia, Chapter 2, Section 2-5.1, controlling the running at large of dogs during the period May 1 to September 15 of each year by ~eadopting Section 2-5.1, as amended, to prohibit the running at large of dogs anytime after having been notified as prescribed by certain persons that the owner's dog is running at large. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE g~UNTY OF CHESTERFIELD, VIRGINIA 1. That Chapter 2, Section 2-5.1 of the Code of the County of Chester- field, Virginia, be repealed and readopted as follows: Sec. 2-5.1. ---Running at large. Any owner after having been notified in writing by any landowner, game warden, dog warden, or other officer of the law, either by registered or certified mail addressed to the address of the owner of such dog, or by service of notice b{T an officer of the law, that his dog is running at large, it shall be unlawful for the said o~ner of such dog to permit such dog to run at large within the County. Any person violating this section shall be punished by a fine of not less than five nor more than twenty-five dollars. This ordinance shall be in full force and effect after its enactment as prescribed by law. On motion of Mr. Apperson, seconded by Mr.Martin, it is resolved that the following Ordinance be and it hereby is adopted: AN ORDINANCE to amend the Code of' the County of Chesterfield, Virginia, Chapter 2, Section 2-11, requiring licenses for dogs, by readopting Section 2-11 to change the age requirement for ~btaining a dog license from four months to six months. BE IT ORDA1NED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD, VIRGINIA: 1. ThAt Chapter 2, Section 2-11, of The Code of the County of Chesterfield, Virginia, be repealed and readopted as follows: Sec. 2-11. Required; term; fees. It shall be unlawful for any person to own a do~ six months old or over, unless such dog is licensed, as required by this division. Dog licenses shall run by the calendar year from January first to December thirtyOfirst, inclusive, and the license tax shall be payable at the office of the Treasurer of the County and shall be as follows: Male. For a male dog, One Dollar. Female. For a female dog, Three Dollars. Uns~xed.£emale. For an unsexed (successfully spayed) female dog, One Dollar. Kennel for twenty dogs. For a kennel of twenty dogs, fifteen Dollars. Kennel for fifty dogs. For a kennel of fifty dogs, twenty-five Dollars. Am emergency existing, this Ordinance shall be in full force and effect upon its passaEe. On motion of Mr. Horner, seconded by ~r.Apperson, it is resolved that the Chairman appoint a Commtittee to study the revision of fees and charges for dog tags in the County of Chesterfield. ~'~hereupon, the Chairman appoints Mr. Homer, Mr. Martin and himself as the Committee to study this situation. On motion of Mt.Homer, seconded by Mr.Aoperson, it is resolved that the Executive Secretary be requested to contact the Health Department in an effort to promote the setting up of clinics to inoculate dogs. It was cited that this was the hour set for a discussion on the complaints of the Local UMW' on parking at the Allied Chemical Plant. Mr. R.V.Lancaster, Resident Engineer, of the Department of Highways, states that the "No Parking" signs will be placed aEain on Rt. 618 when the new parking lot is completed by the Compa, ny. Mr. Dunklau, an official of the Plant states that a new parking lot is presently being constructed, that there is sufficient soace now for all of the employees to park comfortably, and that the employees park on Rt. 618 because of its convenience. It is here noted that the Union representatives did not appear. "~.Stewart Rex, representing the Western Riders come before the Board requesting consideration of the County furnishing lights for the Western horse ring.' Upon consideration whereof, and on motion of Mr.Horner, seconded by Mr. Britton, it is resolved that this matter be studied further. On motion of Mt. Homer, seconded by N~.Britton, it is resolved that the following erroneous tax claims be aoproved for payment: H.A. Shoosmith, Jr. Corrected gross weight $10.00 Route #l Chester, Va. Billy E. Burgers 6412 Pineland Road Richmond, Virginia Corrected~gross weight 3.50 On motionof ~r. Britton, seconded by Mt. Homer, ~t is resolved that the Treasurer of the County be requested to transfer $4000.00 from the unexpended surplus to Item 14-~aintenance of Buildings and Grounds. And be it further resolved, that the Treasurer be requested to transfer $2000.00 from the unappropriated surplus of the Garage Fund to the 8perating Fund of the County Garage. On motion of ~r. Britton, seconded by Mr.Aoperson, it is resolved that the request for street lights in Worthington Farms be referred to the Light Committee. On motion of Mr.Apperson, seconded by ~ir.Martin, it is resolved that the Executive Secretary be and he hereby is authorized to have all incandescent street lights in the County changed to mercury vapor. On motion of ~h~.Apperson, sefonded by Mr. Martin, it is resolved that the request of the Ettrick Fire Department for replacing the 1949 Ford pumper at this station be referred to the Fire Committee. The Chairman appoints the following named people to be a Committee to investigate the construction of an airport facility in the County of Chesterfield and to seek interest in such a facility; Mr. Howard A. Rob ert Goyne Mr. Hunter Hones On motion of Mr. Britton, seconded by Mr.Apperson? it is resolved that this Board receives the resolution sent by the City of Norfolk, Virginia~ thankin~ the County for the services of the County Police at the funeral of General of the Army, Douglas MacArthur. And be it further resolved, that the Executive Secretary send a copy of this resolution and express to the Chief of Police the thanks of the Board for their participation in this event. On motion of Mr. Britton, seconded by Mr. Horner, it is resolved that this Board requests the Highway Department to continue the retaining wall in the Raleigh Court ditch project approximately 100 feet to safe-guard the properties of Mrs. Ethel Leber and ~. James B. Hall and charge same to the 3¢ Road Fund of the County. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Cardwell Road in ~ancheste~ Magisterial District, Chesterfield County, Virginia, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr.Britton, it is resolved that Cardwell Road in Nanchester DistriCt, be, and it hereby is established as a publi~ ro ad. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Highway Secondary Road System, Cardwell Road~ beginning at a point on Route 1628 {opposite the Atlantic Coast Line RE.Overpass), .lA miles west of Route 2205 and extending westwardly .26 miles, to an unnamed 50 ft~ road. This road serves ~ houses. And be it further resolved, that the Board of Supervisors of Chesterfield County, Virginia, guarantees to the Virginia Department of Highways, a right of way of not less than 50 feet for this road. Dedication' of said right of way recorded in Deed Book 706, ~age 263,Chesterfield Courthouse, Virginia. On motion of Mr.Britton, seconded by Mr.Apperson, itis resolved that this Board a~ppropriates from the unappropriated surplus of the General Fund the sum of $3~12.&0 to ~A-204-Binding of Books in Circuit Court Clerk's Office and the Treasurer of the County is hereby requested to make said transfer, it being understood that the firm of Charles and ~ean LeJeune will do this work by contract. On motion of Rlr.Britton, seconded by Mt. Martin, it is resolved that the Executive Secretary be authorized to pay claims for extra help to the Clerk's Office in an amount no5 to exceed ~1200.O0,which extra work would take the place of the County Registrar. On motion of ~r. Britton, seconded by Mr.Apperson, it is resolved that this Board disallow the request of the County School Board dated April 13, 196~, which request concerns the construction of a school garage on the McKesson Tract to the extent that the cost of cons~nuction should not come from the General Fund Accoun~ and if the School Board wishes to construct such a facility it is this Board's opinion that the cost be financed from School Bond money, especially since this Fund has been increased ~133,000.00 during the fiscal year 1962-'63 from interes~ earned. There was read a resolution of correction concerning certain requests of the School Board concerning the 196~-'65 budget. On motion of )ir.Aoperson, seconded by Mr.Martin, it is resolved that the request of Mt. George W.Moore, Jr.,Treasurer, concerning the repair or replacement of microfilming equipment be, and it hereby is referred to the Buildings and Grounds Committee for consideration. On motion of Mr. Apperson, seconded by Mr.Rlartin, it is resolved that the Coordinator of Civil Defense be and he hereby is authorized to sign on behalf of the County, an agreement with the Veterans Administration Hospital entitled "Claimanc y Pro c edure Agreement". On motion of ~h~.Apperson. seconded oy ~r. Martin, it is resolved that this Board authorizes the payment o~ $~699.53, plus interest at the rate of 6% for income taxe~ for the years 1961 and 1962 for the Chesterfield Police Benevolent Association. Whereas, the County of Chesterfield is in the process of installing sewer mains in many streets and public rights of w~y; and ?~hereas, said sewer lines must of necessity be installed at certain precise elevations; and Whereas, the County of Chesterfield has experienced difficulty in locating some of its sewer lines due to the installation of gas lines; Now, Therefore, Be it Resolved, on motion of Mr.Apperson, seconded by Britton, that the City of Richmond Gas Department be requested to send to the County of Chemterfield any plans for th~. installation of gas lines in the County so that the construction of utilities may be coordinated. On motion of ~4r. Britson, seconded by ~lr. Aoperson, it is resolved that this Board requests the Resident Enzineer of the Virginia Department of Highways, ~4r. R.V.Lancaster, III, not to approve the permits of any underground utility in the built-up areas of the County until the County of Chesterfield has had a chance to coordinate the location of the requested facility with the sewer system now being constructed. On motion of Mr.Apperson, seconded by Mr. Browning, it is resolved that the Commonwealth's Attorney be and he hereby is requested to prepare an Ordinance for charging an additional~20.O0 to the applicant for rezoning should said request be sent to the Planning Commission. On motion of Mr.Apper:~on, seconded by Mr. Britton, it is resolved that Standard W · ater Contract AR-597A, Deerbourne Subdivision, Section "D", For the installation of water and gas lines in the amount of $3542.80 be and it hereby is approved. It is here no%ed that the City of Richmond will pay its share in the cost of construction and the installation of gas mains. On motion of Mr.Britton, seconded by ~r.ADperson, it is resolved that Water Contract AC-215 be awarded to Lyttle and Barnes to change' the present water line layout on Rt.892 and Rt.637, which change is necessary due to construction of the circumferential road, in the amount of On mo%ion of Mr. Britton,' seconded by Mr.zpperson. it' is resoolved that Water Contract 197-B for Bruce Farms in the amo6nt of $275.00 be and it hereby is approved. On motion of Mr.Britton, seconded by R~r.Browning, it is resolved that Sewer Contract S-6&21-D for the installation of sewers in Worthington Farms, be, and it hereby is approved. On motion of Mr.Britton, seconded by Mr. Browning, it is resolved that the Board of Supervisors be requested to review the situation at the Powhite Dam in con~unction with a petition si~ned by a number of citizens in the area requesting that said dam be demolished. On motion of Mr. Aoperson, seconded by )k~.Browning, it is resolved that this Board adjourn to May 13, 1964, at 9:00 a.m.
