ym. Isbell from the Virginia Department of Highways comes before the Board to discuss
the "Stop and Go': light for the Enon Fire Department and presents a contract
setting out various regulations by which the Highway will sllow such a light tn be
installed. Upon consideration whereof, and on motion of Mt. Browning, seconded by
Mr. Apperson, it is resolved thst this Board approves the contract subject to the
final approval of the Commonwealth's Attorney.
Mr. Jack Woosley comes before the Board to discuss the drainage on Route 147,
which matter had previously been anproved by the Board; however, since certain
objections by the County Engineer and restrictions in the easement from the property
owners are evidenced, it is on motion of Mr.Browning, seconded by Mr.Apperson,
resolved that the matter be delayed until the Board can view the problem and
investigate the Conditions.
It is here noted that Mt. Homer and Mr. Britton vote Nay.
Mr.R.V.Lancaster, Resident Engineer, Virginia Department of Highways, briefly
explains the changes, in the Rural Road Addition Policy.
The nmtter of widening Rt. 619 to the American Tobacco Company's new plant was
reviewed and Mr. Lancaster agrees to expedite the preparation of the plans and
rights of way papers and forward same to said CompanN for execution.
Mr.Thomas R.Futghum, Supervisor of Transportation for the School Board, requested
certain improvements to the traffic protection of the Seaboard Airline Railroad
crossing on the Old Centralia Road and the w~dening of a narrow.bridge on said
road near State Route 144, due to the construction of a new Thomas Dale High School
which will greatly increase the traffic on this road. Upon consideration whereof,
and on motion of Mr. Goyne, seconded by ~r. Aoperson, it is resolved that the
Highway DepartmenD be requested to investigate the present and future needs of
this road and to take whatever steps possible to improve the conditions at these
two locations.
The' Highway Department officially notified the County that the following roads have
been accepted into the State Secondary Road System:
Penn Acres Subdivision:
_Trout Lane - from a point on Route 678, 0.23 mi'les south of Route 60 and running
west O.O?-miles 'to Marble Road then 0,22 miles to Jade Road then 0.03 miles to a
turn-around
0.32 miles.
Marble Drive - from a point on Trout Lane 0.07 miles west of Route 678 and
running morthwardly 0.05 miles to Emerald Lane then 0.0~ miles to a turn around
0.09 miles
Jade Road - from a point on Trout Lane, 0.29 miles west of Route 678 and running
northwardly 0.07 miles to Emerald Lane and thence 0.03 miles to a turn
around
0.10 miles
~merald Lane - from a point on Marble Road, 0.05 miles north of Trout Lane
and running westwardly 0.22 miles to Jade Road 0.22 miles
Approximately 25 people appeared relative to the proposed straightening of Rt.621.
Mr:Homer states tha5 in the interest of all concerned for the present and future
benefits, it is his recommendation that the present funds in the Highway Department
budget be tranaferred so that a new road can be built on the existing right of way
owned by the Highway that would straighten R~. 621.
Upon consideration whereof, and on motion of Mm. Homer, seconded by Mr.Britton,
it is resolved that the Highway Department be requested to transfer such funds
as are available to allow the construction of a new road on the present right of way
owned by the Highway Department that would straighten Route 621.
Complaints were registered with Mr.Lancaster, Resident Engineer, on the necessity
of hard-surfacing Brandywine Avenuein the subdivision of Quail Oaks and the western
end of Cogbill Road.
On motion of Mr. Britton, seconded by Mr.Apperson, it is resolved that this Board
requests the Highway Department to shape up the ditch on Cardwell Road, to patch
the existing holes in said pavement, and ~o construct a short section of road to
connect Cardwell Road w~th Space Road in Falling Creek Court, and charge same
to the 3¢ Road Fund of the County.
On motion of Mt.Browning, seconded by Mr.Apperson, it is resolved that this Board
deny the request of Mr. Luther Roane f6r payment of a portion of re-routing the
drainage on Beechnut Avenue, northwardly to Old Town Creek.
The matter of pedestrian markings in Ettrick was discussed with Mr. Lancaster,
Resident Engineer, of the Highway Department.
On motion of Mr. Goyne, seconded by Mr .Browning , it is resolved that this Board
requests the Highway Department to reduce %he speed limit on Rt. 615, east of its
intersection with Rt. 616.
Mr.H.T.Goyne requested the Highway Department to put up "No Dumping" signs along
a section of Happy Hill Road on which there seems to be an accumulation of trash
extending out onto the road.
On motion of Mr. Britton, seconded by Mt. Browning, it is resolved that the speed
limit on Rt. 161, coming from the City of Richmond into the County, be reduced
to 35-mph.
Mr. Gordon Shepherd, of the Department of Taxation and ~ir.H.B.%';atker, Commissioner
of the Revenue, come before the Board requesting some action by the Board on
providing additional space for the Commissioner of the Revenue, raise in salary and
additional office machines.
On $otion of Mr.Apperson, seconded by Mt.Browning, it is resolved that this Board
approves an A~reement for an essement with Mt. Raymond L. Lawless and authorizes
the Chairman and Clerk to sign said Agreement.
Mr.Phares, representing the Plantation Pipe Line Company, comes before the Board
agreeing to change the easement requested on County-owned property on the Toll Road
as suggested by the Engineering Dep~rtment and to pay to the County of Chesterfield
the sum of ~,000.00 for said easement. ·
Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr. Apperson,
it is resolved that this Board agrees to the provisions specified to cross the
County-owned property at the Falling Creek Interchange, subject to the approval
of the contract by the Commonwealth's Attorney.
Mr. Phares further discussed the crossing on roads in the County by the Plantation
Pipe Line Company and presents a list of said crossings, giving various details
as to each crossing. Upon consideration whereof, and on motion of Mr.Apperson,
seconded by Mr. Britton, it.is resolved that this Board requests the Commonwealth's
Attorney fo-draw up 9n Agreement setting forth adequate protection for the County
and allowing the Plantation Pipe Line Company to cross the requested roads in the
Count y.
This day a~ain the ~atter of paying the transportation for private school children
came before the Board.
Mrs. Dorothy Armstrong speaks agains~t the proposal, saying that it would siphon
much needed funds, that handicapped ~ children ar~ not provided transportation
and that further advances might be made by private schoOls.
Mr.J.J.Jewett states that he has already stated the position of private schools
and will not debate the issue further wdth ~4rs.Armstrong.
Mr.~4artin states that private schools ~re saving the County much money and that
the County should do everything possible to help the citizens send their children
to private schools if this is their desire.
Upon consideration whereof, }4r.Martin moves that the Board approve the request of
the School Board, which motion failed 5 to 1.
On motion of Mr.Britton, seconded by Mr. Browning, it is resolved that the Special
Water Contract AR-22A in Bradley Hills, in the amount of $12~5.96 and A2-92~,
Chester, in the amount of $8609.50, be and they' hereby are approved.
On motion of ~4r.Britton, seconded by Mt. Homer, it is resolved that the Standard
~Tater Contract R-341 for the installation of water in the Oxford Place Subdivision
in the a~ount of $300.00 be and it hereby is aoproved.
There arose a discussion on the installation of water on Petersburg Street in Chester
and 'the County Engineer presented plans for installing larger pipes in the entire
area.
It was generally a~reed that tSis matter be deferred to ascertain the possibility
of locating the pipe line on Petersburg Street in an easement by Mt. Edward Ryan.
On motion of Mr. Goyne, seconded by ~lr.Britton, it is resolved that the Agreement
between the Tower Comtruction Company for the installation of apartment houses-
on the nOrthwest corner of Route ~1 and County Road be approved and that the line
be put in according to the policy as set up by this Board of Supervisors.
On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that this Board
accepts the conveyance of land for a water tank on the Elkhardt Road.
On motion of Mr.Britton, seconded by Mr. Apperson, it is resolved that Contract
6102-1 for the installation of sewers on South Falling Ureek Line on which there is
an Agreement with the Virginia Electric and Power Company for a right of way for
the installation of sewers be aDproved, subject to the possible revision by the
Com~onwealth' s Attorney.
On motion of ~'ir. Apperson, seconded by Mr. Britton, it is resolved that the following
sewer contracts be and they hereby are approved:

On motion of ~4r.Apperson, seconded by ~4r.Browning, it is resolved that the County
Engineer be authorized to seek the vacation of existing easement along Falling
Creek in the subdivision of ~4eadowbrook Estates, provided additional easements
are granted.
On motion of Mr.Martin, seconded by Mr.Britton, it is resolved that an' Agreement
to purchase the property owned by the Brown Estate for the Powhite lagoon be
approved, with the provision that the Brown Estate be allowed to purchase the
property at the same price when the land is no longer used as a sewage lagoon.
The Chairman makes a short statement that all zoning cases advertised for this hour
have a defect in the advertisement and the Commonwealth's Attorney rules that the
Board cannot legally decide on any case at t~is time. It is generally'agreed
that all cases with the exception of 6&-23 be deferred to June 10, 1964, and that
this case involving a Use Pea'mit be heard because all p~rties to the case are
present.
~r. Robert Cox, Attorney for Mrs. Stratton gives a brief history of the case.
)ir. John L.Holt, Real Estate Broker, states that in his opinion there will be no
decrease in value becgume of the proposal gravel pit, that the people in
Wilkinson Terrace, ~r.C.E.Copley and ~lr.S.E. Lyttle would sustain no damages
due to the fact that the area is heavily wooded; that Mr. Crowtic and Mr. White
would not be materially affected.
R~r.~red Gray questions ~r. Holt as to his stand, and cites further history concerning
this case. l~r.Gray states that assuming a depth of 15 feet and the price the
State Highway Department is willing to pay of 10¢ per cubic yard, the total value
of the earth being requested to be rezon~d would be $6,OOO.O0. From this the cost
of the road and other expenses would reduce the profit to $~,450.00.
Mt. Gray produces various letters from experts stating that losses will be
sustained by the neighbors and that the six (6) lots which the gravel pit would
cover, the value of each would be approximately $4~000.00 ware it a subdivision
lot, and if the 15-ft. taken from this area there is a chance the land would not
percolate at this depth and the net loss would be $24,000.00.
Mt. Gray raises the question that Section 17-20 of the County Code prohibits
a gravel pit 200 feet from a roadway 'and cites certain annexation opinions which
would indicate that such a zoning would be detrimental to the County.
Mr.C.E.Copley, owner of the land north of the Creek, states that he is in the
process of subdividing his property and that a gravel pit across the Creek would
be a great detriment to the sale of his lots.
~r.Z.T.Murrell, 4420 Sherman Road, ~ilkinson Terrace, presents a petition signed by
41 people who state that the noise and dust emanating from such a facility would
be agreat detriment to their neighborhood.
Mr.W.C.Carnes states that )~r. Whitehurst has cancelled the construction of a home
in this area because of the gravel pit.
Mr.William Holbert, from the Gravelbrook area, .presented a petition signed by
42 p~ople opposing the proposal and cite other reasons for being against the
gravel pit.
Mr. Macon Farr speaks against ehe proposal citing traffic hazards.
Mt. Brooks Whitehurst states that he is the one who cancelled the construction of
a dwelling in this area, stating he had to move once, every five years and was
dubious about the resale of his home.

Mt. Robt. A. Cox,Atty., c~ntests the figures presented by Mt. Gray opposing the
matter that most of them will s~ffer no damages whatsoever. ~r. Gray states
that there are 122 people represented in person or by petition.
Mr.S.T.~agstaff states that the gravel pit would be of great benefit to everybody.
Mr.Apperson ascertained that there are 12 p~ople present in favor of this zoning
and five of which live within one-half mile of the area.
Mr,Homer states that the matter should be decided'in Court where it presently
is, and' makes other statements concerning the case.
Mr. Aoperson states he has made no prior commitments to anyone.
Mr.Horner asked the Commonwealth's Attorney concerning ~he 200 feet distance from
a roadway as set out in Section 17-2C of the County Code to which Mr. Gray referre~.
Mr. Gates said that no right of way had been acquired so this provision would not
be a barrier to the granting of a Use Permit. However, on another question,
whether the State Highway Dep~rtment could demand fill dirt by comdemnation,
such a ~atter is questionable under the County Ordinance.
The Chairman points out that since any decision at this time would be contrary
to law, that a vote willbe taken on June 10~ 1964, after the defects in the
advertisements have been cured.
Mrs. Re~ Fisher, residing on Forest Lake Road, Bermuda District, speaks against
the encroachment of trailers on residential property, particularly on the
Petersburg Pike and that area.
Upon consideration whereof, and on motion of Mr. Apperson, second ed by Mt.Martin,
it is resolved that the problem of placing trailers in the County of Chesterfield
be referred to ~he Ordinance Committee.
There was presented an Ordinance to amend the Code of the County of Chesterfield,~
Virginia, Section 17-23, to increase the cost of the advertising to hear an
amendment tosaid Code; provide for referral of amendments to the County Planning
Commission for its recommendation; and prescribe the holding of public hearings
a~d notice required before~such hearings are held, which was discussed briefly.
Upon consideration whereof, and on motion of Mr.Martin, seconded by Mr. Apperson,
it is resolved that this Ordinance be introduced and referred to the Planning
Comnission for recommendation.
On mo~ion of Mr.Britton, seconded by Mr.Browning, the following Ordinance is
adopted:
AN ORDINANCE to amend the Code of the County of Chesterfield, Virginia,
Chapter 1~, Seation 14-41.6, prescribing the fee for electrical permits.

requesting an additional appropriation of $9500.00 for the sewer connection of the

On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that t~e Treasurmr
of the County be and he hereby is requested to transfer the sum of $19,500
