REQUEST: Conditional Use to permit a day care center in an Agricultural (A)
District.
RECOMMENDATION
Recommend approval for the following reasons:

The request parcel lies in a transitional area between medium/high
density residential use to the north and west and light industrial
land uses to the south, as designated by the "Eastern Area Land Use
and Transportation Plan." The day care center represents a reason-
able land use transition between the land uses designated by the
Plan.

Through the Conditional Use process, the Commission and Board may
impose conditions which minimize the impact of commercial develop-
ment on existing area single family residential development.
CONDITIONS
The following conditions notwithstanding, the plan prepared by J.K.
Timmons and Associates, Inc., dated August 17, 1984, shall be con-
sidered the plan of development. (P)

The proposed structure shall have a residential appearance. The
facades shall employ subdued colors. Prior to obtaining a building
permit, colored elevations shall be submitted to the Planning
Department for approval. (P)

Ail driveways and parking areas shall be delineated by permanent
means (i.e., timber curbs, etc.). (P)
Enrollment shall not exceed thirty (30) children. (P)
Hours of operation shall be limited to between 6:00 a.m. and 7:00
p.m., Monday through Friday. There shall be no Saturday or Sunday
operation. (P)
Between the proposed parking area and Woods Edge Road, white pines,
having an initial height of five (5) feet, shall be planted to
minimize the view of the parking area from Woods Edge Road. A land-
scaping plan depicting this requirement shall be submitted to the
Planning Department for approval in conjunction with final site plan
review. (P)
Prior to obtaining a building permit, thirty-five (35) feet of right
of way, measured from the centerline of Woods Edge Road, shall be
dedicated to and for the County of Chesterfield, free and
unrestricted. (T)
A single freestanding sign, not to exceed four (4) square feet in
area, shall be permitted identifying this use. This sign shall not
be lighted. The facade of the sign shall employ subdued colors,
compatible with the proposed building. Prior to erecting the sign,
a colored rendering shall be submitted to the Planning Department
for approval. (P)

property, no anticipated drainage problems.

VDH&T may require relocation of roadside
ditches and installation of additional
pavement along Woods Edge Road. Entrance
permits must be obtained from VDH&T prior
to obtaining a building permit. Right of
way must be dedicated according to the Gen-
eral Plan 2000 - Eastern Area Land Use and
Transportation Plan. (Condition 7)
DISCUSSION
The applicant, who resides on adjacent property to the south, desires to
construct a day care center on the request parcel. A total enrollment of
thirty (30) children is proposed. (Condition 4)
The request parcel lies within the boundaries of the "Eastern Area Land
Use and Transportation Plan." The property lies in an area designated
for medium/high density residential to the north and northwest, and light
industrial to the south. The request parcel could be considered within a
transitional area, between the two land use designations. The proposed
day care center is an acceptable land use transition between the residen-
tial and industrial areas.
The area encompassing the request parcel is presently characterized by
single family residential land uses or remains vacant. The proposed use
should, therefore, be developed with a residential character (Condition
2), and particular conditions should be imposed which insure that area
residents are not subjected to nuisances normally associated with commer-
cial development. (Conditions 5, 6 and 8)
Driveways and parking areas should be physically separated from pedes-
trian areas to minimize danger to the children. (Condition 3)

mended approval of this request subject to the conditions on pages 1 and
2.
