SUMMARY The Old Dominion Chapter of the National Railway Historical Society has kept historical railroad cars and engines on the property since 1975 (Case 75AN0003). In 2012, Conditional Use approval was granted to permit the operation of a private museum by the Chapter which would periodically include special fundraising events. The 2012 approval was granted for 5 years which expired in March 2017. Approval is requested to permit continued operation of the private museum by the Chapter. RECOMMENDATION PLANNING APPROVAL COMMISSION APPROVAL As conditioned, impacts on neighboring properties are minimized. STAFF Use is compatible with existing and anticipated area development. As a private museum, the Chapter is responsible for the procurement, preservation, and display of the artifacts. While no events have been held to date, the Chapter does propose to hold periodic special events to help raise funds for the maintenance and preservation of the railroad cars and engines stored on the property. These events would typically be held on Saturdays and begin in the morning (e.g. 9:00 a.m.) and end in the early evening (7:00 p.m.). Attendance to these events will be by invitation only. During these special events, The Chapter will utilize its historic passenger coaches and engines for excursion train rides. Development Standards: Existing zoning Case 75A003 Conditions of this case would still be applicable. These conditions require tree preservation and specific road and parking treatments, and limit signage and the number of railroad cars/engines permitted. (Attachment 3) Case 12SN0169 and Current Proposal - Staff recommends the same conditions of Case 12SN0169 (Attachment 2) be imposed with this request, except that staff finds the 5-year time limit is unnecessary. There have been no known adverse impacts from the 2012 approval. The conditions would limit approval to the Chapter only, address site development standards, and establish frequency and hours of operation of special events. This request will permit the continued operation of a private museum with limited number and type of special events. The additional traffic impact of the continued operation of the museum is anticipated to be minimal. This conditional use approval shall be granted to and for the Old Dominion Chapter of the National Railway Historical Society only and shall not be transferable or run with the land. (P) 2. This conditional use approval is to permit a private museum only. (P) 3. Unless the underlying zoning district (Agricultural) requirements are more restrictive, any development for a private museum shall conform to the requirements of the Zoning Ordinance for office uses in the Emerging Growth Areas. (P) 4. Any special event held in conjunction with the private museum use shall not operate after 7:00 p.m. Only one (1) special event may be held in a one (1) month period. Special events shall be limited to fundraising and educational programs for the private museum use only. (P) 5. Within ninety (90) days of a written request by the Transportation Department, forty-five (45) feet of right-of-way, measured from the centerline of County Line Road immediately adjacent to the property, shall be dedicated, free and unrestricted, to and for the benefit of Chesterfield County.
