SUMMARY The applicant proposes the construction of a new building for church use that will provide for additional educational space and would like the option of using a private septic system to serve this new building. The property is located within a mandatory wastewater connection area, necessitating an exception to public wastewater use. (5/1998) Proposal The subject property is currently occupied by a church containing a 567-seat sanctuary (Cornerstone Baptist Church), along with a 7,500 square foot building used for church activities, a daycare and educational purposes, plus a modular office unit that is used for storage only. All buildings except the modular office unit are currently served by public water and a private septic system. Construction of a new building to serve the church use is proposed. The applicant indicates the building will provide for additional educational space and will contain approximately 6,400 square feet. The applicant is requesting to continue use a private septic system for the proposed structure. Exception to Mandatory Water and Wastewater Connections Section 18-60 of the County Code requires the use of public systems for properties located within the Mandatory Wastewater Connection Area. An exception to the use of public systems must be evaluated by the Directors of Utilities and Planning, the Planning Commission, and subsequently by the Board of Supervisors. The decision of such exceptions must be based upon the following criteria: Would the use of private systems encourage future area development inconsistent with the Comprehensive Plan; and Would the ability to extend the public system to other property be adversely affected. Comprehensive Plan and Future Area Development The Comprehensive Plan suggests area properties are appropriate for residential development at a maximum density of 2.0 to 4.0 dwelling units per acre. The Plan encourages development with the use of public utility systems. B.1.a and 18-60. B.2 of the County Code. This incidental to the church. Public water is available through an 8-inch waterline along Cornerstone Boulevard. The existing church structures are connected to the public water system. Any new structure(s) proposed for the site would be required to use the public water system. Public wastewater is not immediately available and would require the construction of an off-site gravity wastewater line of approximately 1,300 linear feet from an existing 36-inch wastewater trunk line located north of the subject property along Falling Creek. A conceptual cost estimate to construct an 8-inch gravity wastewater line to the site would be $194,000.00. Any new structure(s) proposed for the site would be required to connect to the public wastewater system. The applicant is planning to build a new structure on the subject property and has requested an exception to the use of public wastewater. The Utilities Department does not support this request because there is a viable way to serve this site with public wastewater without topographical, capacity, or other underground utility conflict issues. The church, constructed in 1996, utilized an individual septic system. While public wastewater connection was not required by code, an easement for future connection was provided on the eastern portion of the property. Zoning to permit a day care center incidental to the church was granted in 1998 with a condition of requiring connection of all buildings to public wastewater when it is extended to within 500 feet of the property. In 2001 the applicant added a new sanctuary and in 2008 an education building, both prior to that area being designated as a mandatory connection area by the County Code. systems that could ultimately benefit from a wastewater line extension by the applicant. Should the County ever receive a request for an extension of public wastewater service to those homes due to septic system failures, under current County policy the creation of an assessment district would be considered, whereby the extension costs would be passed on to those homeowners. Any wastewater line extension made by the applicant would significantly lower the individual assessment amounts to be paid by those homeowners. Any future new structures will require additional exception(s) if mandatory connection is still required by code. (U) 2.At such time as a public wastewater line is extended to within 500 feet of the property, the owner shall extend a wastewater line to a point acceptable to the Utilities Department and the child care use referenced in Condition #5 of Case 98SN0201, the new building and all future uses requiring domestic water and wastewater shall be connected to the public wastewater system. Existing uses served by a septic system not otherwise defined shall not be required to connect to the public wastewater system for as long as the existing septic system is in compliance with Health Department regulations.
