Coffey, Chesterfield Fire and Emergency Medical Services Department, Upon His Retirement County Administrator's Comments: County Administrator: Board Action Requested: Adoption of attached resolution. Summary of Information: Staff is requesting that the Board of Supervisors recognize Lieutenant Richard W. Coffey after serving the County for nearly 27 years of dedicated service to the citizens of Chesterfield County. Preparer: Frank H. Coffey retired from the Fire and Emergency Medical Services Department, Chesterfield County, on May 1, 2004; and WHEREAS, Lieutenant Coffey attended Recruit School #8 in 1977 and faithfully served the county for over 33 years in various assignments as a Volunteer Firefighter at the Midlothian Volunteer Fire Department; as a Career Firefighter at the Manchester and Bon Air Fire and EMS Stations; as a Training Officer in the Training and Safety Division; as a Company Officer at the Manchester, Bon Air and Midlothian Fire and EMS Stations; as an Assistant Fire Marshal in the Fire and Life Safety Division, Inspections and Investigations Section; and as the Burn Coordinator; and WHEREAS, Lieutenant Coffey was recognized in December 1996 with a Certificate of Recognition for exemplary service on the Critical Incident Stress Management Team, presented by the Chesterfield Community Services Board; and WHEREAS, Lieutenant Coffey and other members of the Fire Prevention Bureau were recognized in October 1995 with a Unit Citation for their performance at the Old Buckingham Apartment Fire; and WHEREAS, Lieutenant Coffey was recognized in November 1993 with an Emergency Medical Services Award for his role in saving the life of a citizen and also recognized in December 1978 with a Letter of Commendation for his role in saving the life of a citizen; and WHEREAS, Lieutenant Coffey has served as President of the Virginia Chapter of the International Association of Arson Investigators and as President of the Central Virginia Fire and Arson Association. Resolution Recognizing September 2004, Addiction Recovery Month"(Recovery Month) in Chesterfield County County Administrator's Comments: County Administrator: as ~National Alcohol and Drug Board Action Requested: The adoption of the attached resolution. Summary of Information: Recovery Month spotlights the need for alcohol and drug abuse treatment and recovery, and honors both those in recovery and treatment providers. In 2002, an estimated 22 million Americans met the medical criteria for substance dependence or abuse. Alcohol and drug use disorders also have a significant impact on families and others who are close to people with such disorders. Many people in need of recovery have difficulty obtaining treatment that can help them rejoin their families, their job, and their lives in their communities. Only 10.3 percent of Americans age 12 or older who need treatment for an alcohol or drug use disorder actually received treatment. Treatment works and is available in all communities across Virginia through local Community Services Board. Preparer: George E. Braunstein Attachments: Yes 7] No Title: Executive Director MH/MR/SA Department 000009 RECOGNIZING SEPTEMER 2004, AS ~NATIONAL ALCOHOL AND DRUG ADDICTION RECOVERY MONTH" WHEREAS, in 2002 9.3 percent of all Virginians age 12 or older reported past year dependence or abuse of illicit drugs or alcohol; and WHEREAS, only 10.3 percent of A/nericans age 12 or older who needed treatment for an alcohol or drug use disorder actually received treatment; and WHEREAS, denial and stigma associated with alcohol and drug use disorders continue to keep people out of treatment; and WHEREAS, barriers to accessing treatment facilities are significant problem for people with alcohol or drug use disorders; and a WHEREAS, such barriers include failures to identify affected people and direct them to treatment, inadequate public and private insurance coverage for treatment services, and shrinking state budgets that limit funding for treatment programs; and WHEREAS, saluting people who are in recovery from alcohol and drug use disorders, as well as those who have helped them obtain treatment, helps to overcome barriers by educating the community about the benefits of treatment, and affirming the goal that all people with alcohol and drug use disorders should have access to treatment services; and WHEREAS, to help achieve this goal, the U.S. Department of Health and Human Services, the Substance Abuse and Mental Health Services Administration, the Office of National Drug Control Policy, and Chesterfield's Community Services Board, Substance Abuse Services program that collaborates with the Office Community Corrections, Departments of Health and Social Services and Adult and Juvenile Drug Courts invite all residents of Chesterfield to participate in ~National Alcohol and Drug Addiction Recovery Month" (Recovery Month). Subject: Adoption of a Residential Connectivity Policy to Establish Standards for Access to and Between Subdivisions C°unty Administrat°r's C°mments:)//~< ~J~ ~ County Administrator: Board Action Requested: Adopt the proposed policy effective immediately. Summary of Information: B&ckground: Staff has met with the development community. The Planning Commission has reviewed the policy and voted 4-1 in favor of recommending its adoption. The Board has held several work sessions on the proposed policy and expressed concern that provision should be made to allow exceptions under specified circumstances. Of special concern are families living on older streets facing the introduction of new traffic through their quiet and often secluded community. Staff has been unable to develop quantifiable criteria which could be consistently applied in all circumstances to guide when such connections should not be made. Therefore, staff has amended the policy to allow the Board and Planning Commission the authority to waive such connections at their discretion and to emphasize their action by requiring such waivers to be granted only by separate motion from any other approval such as zoning or subdivision. Turner Title: Director of Planninq Attachments: Ycs --]No # O000~L~ CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 2 of 3 Overview .- The policy sets forth four broad purposes for street interconnectivity as: (a) improving public safety response time to residents by providing multiple means of access; (b) reducing travel time and distance between neighborhoods by providing alternative travel paths; (c) maintaining an acceptable quality of life in the residential neighborhoods by preventing excessive through traffic on local streets where individual lots have direct access onto the street; and (d) maintaining the traffic carrying capacity of arterial and collector streets. Connections To Undeveloped Property The policy sets forth four standards that would be utilized primarily at the time of tentative plat review. These standards would require a stub to undeveloped land, unless an evaluation of the adjacent property determines that: (a) the undeveloped property does not have developable potential at that location; or (b) a through street is not required or desired at that location; or (c) the street connection creates a violation of the Planning Commission's Stub Road Policy; or (d) the connection would provide primary access to property not designated for residential development on the Comprehensive Plan through the subdivision. The policy will require the subdivider to sign the stub locations advising future homeowners that the extension of that street is planned. Connections To Infill Development These connections are most frequently addressed through the zoning process though they also arise at the time of tentative plat review. Connections made between existing and infill development is often critical in providing adequate access. It had been the past practice to allow residential development to occur with the belief that future sections or the adjacent property when developed would provide the necessary access. Often these connections are not made and large numbers of lots are only accessible by a single street. 000033 CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 3 The policy requires streets in new subdivisions to connect to all adjacent stubs unless the resultant local street pattern would create a traffic count that exceeds the Planning Commission's Stub Road Policy or allows a connection to a stub street within a subdivision that complies with access requirements to be waived if: (a) there are a sufficient number of other stub streets to adequately disperse the traffic and not cause a concentrated use of any one stub street connection; or (b) the connection to a particular stub will cause a concentrated use at that location; and (c) may require pedestrian and bicycle paths to be constructed to facilitate traffic between the subdivisions. Internal Circulation In very large residential developments internal circulation is often impeded more by design than by site constraints. The lack of cross connections can increase response time and travel distance. The policy will require the subdivision design to facilitate interconnectivity within its limits. The overall street network shall be laid out to facilitate convenient internal travel based upon topographic and environmental constraints. This will not prohibit the extensive use of cul de sacs, but may potentially require some looping and through streets to be integrated into the overall layout. The design community is currently moving in this direction. Street Spacing The final aspect of the policy deals with the overall street network of through streets to facilitate travel through residential areas. The spacing or frequency of the through streets decreases with density. An improved circulation network, designed according to the policy guidelines, will provide more alternatives for traffic movement, reduce traffic loading on arterial streets and avoid the needed development of super streets in excess of four lanes. This will result in the creation of alternative parallel travel paths. 0000:1.4 CHESTERFIELD COUNTY RESIDENTIAL SUBDIVISION CONNECTIVITY POLICY Purpose The purpose of street interconnectivity shall be to (a) improve public safety response time to residents by providing multiple means of access; (b) reduce travel time and distance between neighborhoods by providing alternative travel paths; (c) maintain an acceptable quality of life in the residential neighborhoods by preventing excessive through traffic on local streets where individual lots have direct access onto the street; and (d) maintain the traffic carrying capacity of arterial and collector streets. Standards 1. New streets shall be stubbed to undeveloped land unless an evaluation of the adjacent property at the time of tentative subdivision plat review determines that: (a) the undeveloped property at that location has development constraints such as but not limited to, wetlands, topographic features, size, etc; (b) a through street is not required to conform to access requirements in the Subdivision Ordinance; (c) the street connection creates a violation of the Planning Commission's Stub Road Policy; or (d) the connection would provide sole access to non-residential property. 2. Streets in new subdivisions shall connect to all adjacent stubs designated as local streets, residential collectors or thoroughfare streets. Only those connections to a stub street within a subdivision that complies with street access requirements as specified in Section 17~76 (h) of the Subdivision Ordinance may be waived if: (a) there are a sufficient number of other stub streets to adequately disperse the traffic and not cause a concentrated use of any one stub street connection; or (b) the connection to a particular stub will cause a concentrated traffic at that location. (c) the projected traffic volume on any local street within the existing subdivision exceeds 1500 vehicle trips per day. 3. The Planning Commission or the Board of Supervisors during its review of a rezoning or a tentative subdivision request may waive connectivity requirements. Such waiver shall be by a separate motion and vote and shall be taken subsequent to the decision upon the pending zoning or preceding the subdivision request. 4. Subdivision design shall facilitate interconnectivity within its limits through the layout of the overall street network. The design concept of solely using multiple unconnected cul de sacs shall be O000:t$ evaluated and approved based upon circulation, topographic and environmental constraints. The purpose of such signs shall be to advise the public that the extension of the stub is planned. Applicability This policy shall apply to any zoning case filed or any tentative subdivision plat that receives approval after (INSERT DATE). Any property that received zoning or tentative subdivision plat approval prior to the effective date of this policy and has conditions that conflict with provisions of this policy shall be governed by those conditions. Staff is of the opinion that emergency accesses should not be used as a substitute for open, unrestricted public roads maintained by V/DOT. Closed, gated emergency accesses have great potential to become nuisances in the communities they serve by providing unsupervised gathering places for children and they may become convenient dumping places. They will require staff time and attention to maintain and respond to complaints stemming from their unauthorized use or disagreement over their acceptable level or maintenance. Overview: The policy sets forth minimum criteria for construction of emergency access. Simply, these will be streets constructed to VDOT criteria, but only as a single lane. They will be located upon 50' wide rights of way dedicated to the County and access will be controlled by one or more locked gates, depending upon length. Maintenance responsibility of these accesses is more difficult to resolve. It has been recommended that the County should assume this responsibility and the burden of maintenance funding should be borne by the developer. To this end, staff has prepared the following tiered schedule of maintenance cost over a twenty-year cycle based upon access length. 0' - 200' @ $55,000 Greater than 200' and up to 700' @ $85,000 Above 700' @ $85,000 plus $120/each additional foot in excess of 700' Payment of maintenance will be required with submission of the record plat or site plans, which includes the access. 000015 SUBDIVISION, CONDOMINIUM AND MULTIFAMILY EMERGENCY ACCESS POLICY / REQUIREMENTS/STANDARDS I. General It is the County's intent to only permit an emergency access when relief has been granted to the second access as required by the Subdivision or Zoning Ordinance. The approval of the location and phasing for an emergency access shall be established through the tentative subdivision or site plan approval process as applicable. The typical pavement section of the emergency access shall match that of the adjacent local street. The section notes the applicable requirements based upon the type of development. II. Emergency Access Requirements (Subdivision and Condominium Developments) ao The subdivider for any subdivision containing or requiring an emergency access shall meet the following requirements: The subdivider shall submit construction plans to the County for approval for the access in association with the construction plans for the lots that establish the need for the access. The construction plans shall include unit quantities for drainage, crushed aggregate base, paving, Knox box and lock, or approved equal, and gate(s). The access shall be constructed in association with those lots. The final check and record plat shall note that no occupancy permits will be issued until the emergency access is completed. ii. When the record plat is submitted, the subdivider shall provide the County with maintenance funds per the following schedule based upon the length of the emergency access: 0'- 200' $55,000 Greater than 200' and up to 700' - $85,000 Above 700' - $85,000 plus $120/each additional foot in excess of 700' iii. The record plat shall grant the County a fifty (50) foot right of way to contain the emergency access elements. Emergency Access Policy Page 2 bo The developer for any condominium development containing or requiring an emergency access shall meet the following requirements: The developer shall submit construction plans to the County for approval for the access in association with the site plan submittal for the units that establish the need for the access. The construction plans shall include unit quantities for drainage, crushed aggregate base, paving, Knox box and lock, or approved equal, and gate(s). The access shall be constructed in association with those units. The site plan shall note that the Fire Department will not approve any occupancy permits for the units that established the need for the access until the emergency access is completed. ii. When the developer requests the first occupancy permit for the affected units, the developer shall provide the County with maintenance funds per the following schedule based upon the length of the emergency access 0'- 200' $55,000 Greater than 200' and up to 700' - $85,000 Above 700' - $85,000 plus $120/each additional foot in excess of 700' iii. The developer shall record a plat depicting and granting an easement to the County for access and maintenance of sufficient width to contain the emergency access elements. m. Emergency Access Standards (Subdivisions, Condominium and Multifamily Developments) a. Location The subdivision/site plan shall isolate the emergency access to limit its desirability as an overflow parking area. Specifically the emergency access path shall not serve as sole access to any lots, units, amenities facility, and service area/facility or parking area. The access path shall be defined as the travel path between the two points where the access connects to a street, accessway or common area through which access to lots or units is provided. b. Design The emergency access shall have a pavement width of twelve (12) feet with possible pavement width extensions to facilitate two-way traffic on long accesses or curves as determined by the Fire Department, based upon the alignment and topography. An additional area clear of woody vegetation three (3) feet beyond the edge of pavement shall be provided. 2. The area above the pavement shall have a vertical clearance of a minimum of thirteen (13) 0000; 0 Emergency Access Policy Page 3 feet six (6) inches. The access shall have a maximum grade of ten (10) percent with appropriate transitions, as determined by the Fire Department, to all connecting streets, accessway or common areas. 4. The minimum outside tuming radius for any curve shall be forty-two (42) feet. o Any emergency access that crosses a drainage way shall be designed to accommodate a minimum ten (10) year storm and conform to requirements of the Environmental Engineering Reference Manual. A paved pedestrian pathway of not less than three (3) feet in width shall bypass one side of the gate(s). This pathway shall be located in the required clear area beyond the limits of the actual emergency access but shall be contained within the required easement. c. Pavement The pavement shall be designed and constructed to VDOT subdivision street requirements based upon the design requirement for local subdivision streets in Chesterfield County. A set of construction plans for the design of the emergency access shall be submitted in the standard submittal package to be routed to the Fire Department for approval. d. Gates Accesses shorter than fifteen (15) feet shall be gated at the mid point. Any access longer than fifteen (15) feet shall be gated at both ends immediately adjacent to the rights of way unless there is a privately maintained sidewalk located outside the fight of way, in which case the gate shall be located beyond the walk. The access gate shall consist of two (2) panels eight (8) foot wide by three (3) foot tall constructed of painted two (2) inch tubular steel. The gate panels shall be painted with two coats of enamel paint matching PMS 186 red and shall have one (1) inch wide by twelve (12) inch long white reflective strips on both sides of the exterior and interior of the middle vertical member. The gates shall swing on not less than two pivot pins. The gates shall be supported by a steel post of a size and with a foundation capable of supporting the individual gate panel with a two hundred pound weight at the opposite end. The bottom of the gate shall be twelve (12) inches above the pavement. The post shall be filled with concrete. The post shall conform to the gate paint specifications. The gate panels shall be designed, fabricated and installed to remain open after the closure chain is undone. 00002:1. Emergency Access Policy Page 4 e. Gate Lock The subdivider/developer shall furnish a welded link steel chain and a padlock as manufactured by Knox Company or approved equal to secure the gate panels.. f. Construction Plans All applicable subdivision plan view and profile sheets with I and drainage construction plans or site construction plans shall show the location of the emergency access. The subdivider/developer shall secure any necessary I permits and the access shall meet the visibility requirements for streets. If the location of the emergency access on construction plans is different from the approved tentative subdivision plat, the tentative subdivision plat shall be resubmitted as an adjusted tentative for approval. The review of the proposed alternate location may result in the case being referred to the Planning Commission for approval. A typical cross section for the emergency access and the design for the emergency access (i.e. type of material, pavement width and depth, adjacent parallel drainage ditches if applicable and easement limits, etc.) shall be shown to scale on the construction plans. o Alternative design and construction standards for elective accesses shall be approved by the Directors of Planning and Transportation and the Chief of the Fire Department or the Planning Commission at the time of tentative or site plan approval based upon the length of the access and the proposed length of time the access must remain in place. The installation of an elective access does not relieve the subdivider/developer of the payment to County as identified in II above. IV. Inspection and Acceptance (Subdivision and Condominium Developments) ao The Environmental Engineering and Fire Departments shall be responsible for inspecting emergency accesses and providing a punch list (if necessary) to the subdivider at the time of road inspection for VDOT acceptance for the subdivision section in which the access is located or that necessitates the need for the access as applicable or upon receipt of a written request to inspect the access from the condominium developer. bo The subdivider/developer shall furnish the Fire Department with a geotechnical engineer's report verifying the access has been constructed to the approved design at least thirty (30) day 000022 Emergency Access Policy Page 5 prior to requesting County acceptance. Co Prior to requesting the County to assume maintenance of the access, the subdivider/developer shall have granted and the County shall have accepted and recorded the required plat and/or easement and provided the County with the required maintenance funds. V. Maintenance (Subdivision and Condominium Developments) ao Maintenance of the emergency access pavement and associated gates and/or other types of facilities and any actions needed to prevent non-emergency vehicular movement on this road shall be the responsibility of the County. bo Emergency access location(s), construction requirements and maintenance responsibility shall be shown on the tentative, final check and record plats and site or construction plans as applicable. VI. Applicability These procedures shall apply to any tentative subdivision or site plan that receives approval after (INSERT DATE). Any project that was required to provide an emergency access before that date continues to have the obligations previously required. Any subdivider/developer having a previous obligation to provide emergency access may, at their discretion, apply through the tentative subdivision or site plan process to have existing conditions modified to conform to the requirements of this Policy. WHEREAS, Mr. Oliver White Hill, Sr. was born in Richmond, Virginia on May 1, 1907; and WHEREAS, his biological father, William Henry White, Jr. had roots in Chester, Virginia; and WHEREAS, Mr. Hill's grandfather, William Henry White, Sr. is listed in the 1870 census as being a resident of Chester, Virginia; and WHEREAS, while attending Howard University, Mr. Hill inherited his uncle's law books and decided to become an attorney and dedicate himself to ending the practice of legalized segregation in the Commonwealth of Virginia and the United States; and WHEREAS, Mr. Hill graduated second in his class from Howard Law School in 1933; and WHEREAS, Mr. Hill litigated numerous civil rights cases, defending the rights of African-Americans in cases involving jury duty, desegregation of public transit systems, the desegregation of public assembly and recreational areas and other landmark cases; and WHEREAS, Mr. Hill headed the National Association of Colored People (NAACP) for 20 years, leading a team of 13 lawyers who filed more civil rights cases than were filed in any other southern state; and WHEREAS, Mr. Hill's most famous case, Davis v. Prince Edward County Schools, became part of the landmark Brown v. Board of Education decision; and WHEREAS, Mr. Hill practiced law until reaching the age of 91, having practiced for nearly 60 years; and WHEREAS, Mr. Hill is a monumental historical figure in the battle for civil rights. Baugh was born in Petersburg, Virginia, graduated from Virginia State College in 1941, and has returned to Chesterfield County in retirement; and WHEREAS, Lieutenant Colonel Baugh entered the Army Air Corps as an aviation cadet in March of 1942, and was assigned in 1944 to the squadron now known as the Tuskegee Airmen in Tuskegee, Alabama; and WHEREAS, Lieutenant Colonel Baugh and the Tuskegee Airmen broke the color barrier in the Army Air Corps and established a record of success as a fighter squadron in Europe which was second to none; and WHEREAS, Lieutenant Colonel Baugh flew 135 fighter combat missions in P-40's and P-51's, amassed almost 6,000 pilot hours in more than 15 different types of planes to include more than 1,100 hours in four types of jet aircraft; and WHEREAS, Lieutenant Colonel Baugh never lost a bomber he was assigned to escort over the battlefields of Europe; and WHEREAS, Lieutenant Colonel Baugh has been awarded the Distinguished Flying Cross, the Air Medal with three Oak Leaf Clusters, the Air Force Commendation Medal, the Air Force Outstanding Unit Award, and multiple theater and campaign medals; and WHEREAS, in June of 2004, the French Government presented him with their highest and most prestigious military award, the French Legion of Honor, for his service in protecting Europe during World War II; and WHEREAS, Lieutenant Colonel Baugh retired from active military service in the United States Air Force on June 30, 1967 as a Lieutenant Colonel. Summary of Information: The Richmond Area Municipal Contractors Association (RAMCA) approached Chesterfield County to discuss concerns with home construction/development in combination with the County requirement to complete road paving at 50 percent of building-permit issuance. RAMCA's main concern being that road paving too early in the construction process, when there are far more heavy trucks than normal, would result in remedial action (i.e., patches) that would cause deterioration of the roads more quickly over time. At the same time, the Home Building Association of Richmond (HBAR) had concerns about their membership's inability to obtain additional building permits due to how quickly 50 percent of building permits are issued. In working toward an equitable solution and at the same time providing a higher and stronger quality finished product, the consensus was that a triple-pavement design was needed. The triple-pavement design would include stone, base asphalt, and surface asphalt; and the combination of the double asphalt would provide added strength when compared with the six inches of stone and two inches of asphalt currently required. Postponing the requirement to pave streets from 50 to 60 percent of the building permits will provide more time for the base stone to settle prior to installation of the base asphalt. The building community will then be permitted to receive up to 90 percent of the building permits prior to placement of the final surface asphalt. Any settlement of the base asphalt would be addressed and utilities adjusted before the final surfacing. Although the three-layer pavement design is more expensive per square yard, HBAR agreed that the ability to obtain 10 percent more permits through critical times and the overall improved aesthetics far outweigh the small increase in cost per square yard. The County will have subdivision streets that are constructed to a higher standard that should last longer and require less maintenance over their pavement life due to pavement failure. 000053 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 17-73 AND 17-76 RELATING TO SUBDIVISION OF LAND BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 17-73 and 17-76 of the Code of the County of Chesterfield, 1997, as amended, is amended and re-enacted to read as follows: Sec. 17-73. The Berry Farm is currently seeking sponsors to help defray the major costs of the event. Ail net proceeds from the music series will go to the Berry Farm. However, during the Pumpkin Festival Chesterfield 4-H will be doing fundraising events and may receive financial benefit. Chesterfield Berry Farm will assume full financial responsibility for the Festival and music series. The bands for this event have not been contracted for at this time. No separate admission fee will be charged for the music or pumpkin festival. It is anticipated that approximately 2000 people will attend the event during the Festival hours. Chesterfield Berry Farm has facilities where food, water, and soft drinks will be available for purchase during hours of operation. Portolets remain on the location throughout the October season and are serviced twice a week by Nes services. Chesterfield Berry Farm has clean-up and trash disposal. There is ample parking, and off-duty police officers will assist with parking, crowd control and other security needs. Emergency medical and fire department officials have been made aware of the event and are available to render service if needed. The music/entertainment arrangements have been reviewed by the County Attorney's Office and meet the substantive requirements of the ordinance. Code §40.1-79.1 provides that programs, which are authorized by local ordinance are exempt from the child labor laws. The proposed ordinance which is attached allows minors 16 years and older to participate in activities of a volunteer company so long as they have been properly trained and have parental consent. The County's Volunteer Firefighting squads have operated junior programs for many years, but not pursuant to a County ordinance. The rear yard shall be the yard extending between the rear line of the lot and the nearest line of the rear of the main building on the lot. (c) The owners of property zoned A, R, R-TH, R-MF, MH-1, MH-2, O and C, as defined in chapter 19, shall remove from their property any ~ inoperable motor vehicles, trailers or semitrailers which are in violation of this section, within ten days after being given notice by the county to remove such ~ inoperable motor vehicles, trailers or semitrailers. Notice to remove shall be deemed given when 1325:66300.1 000~L~[-7 mailed by certified mail, return receipt requested, to the same address to which real estate tax bills are mailed to such owners of property. If the owners of the property do not remove the ~ inoperable motor vehicles, trailers or semitrailers from the property within ten days after being given notice to do so by the county, then the county, its agent or employees may remove the ~ inoperable motor vehicles, trailers or semitrailers from the property. After giving an additional ten days' notice to the owners of the vehicles, the county may dispose of such motor vehicles, trailers or semitrailers. Notice of disposal of such motor vehicles, trailers or semitrailers is given when mailed by certified mail, return receipt requested, to the last known address of the owner of the ~ inoperable motor vehicles, trailers or semitrailers. Notwithstanding the other provisions of this section, if the owner of such vehicle can demonstrate that he is actively restoring or repairing the vehicle, and if it is shielded or screened from view, the vehicle and one additional inoperable motor vehicle being used for restoration or repair may remain on the property. (d) (e) (f) (g) The cost of removal and disposal of the inoperative motor vehicles, trailers and semitrailers shall be chargeable to the owners of the property from which the ~ inoperable motor vehicles, trailers and semitrailers were removed n~nd or to the owners of the ~ inoperable motor vehicles, trailers and semitrailers. The costs of removal and disposal may be collected in the same way that taxes and levies are collected. Every cost authorized by this section against the owner of the property from which the inoperative motor vehicles, trailers and semitrailers was removed shall constitute a lien against that property. The lien shall continue until payment of the assessed costs have been paid. As used in this section, the term "~ inoperable motor vehicle" means any motor vehicle which is not in operating condition~- ;or which for a period of 60 days or longer has been partially or totally disassembled by the removal of tires and wheels, the engine, or other essential parts required for operation of the vehicle; or on which there are displayed neither valid license plates nor a valid inspection decal. This section shall not apply to any business lawfully conducted on property that is zoned to permit the keeping of ~ inoperable motor vehicles, trailers or semitrailers; nor shall this section apply to a licensed business that on June 26, 1970, was regularly engaged in business as an automobile dealer, salvage dealer or scrap processor. Compliance with this section shall not exempt any owner of an ~ inoperable vehicle from the license tax imposed by section 13-54 of this Code. Summary of Information: Comcast has filed its annual rate forms that will allow it to raise the rate it charges for Limited Basic progr~iiing and its charges for installation and equipment such as converter boxes and remote controls. The Limited Basic tier is comprised of the first 14 channels of programming customers are required to purchase as part of their cable service. A small number of subscribers purchase only the Limited Basic tier. Pursuant to the FCC regulations, Comcast must submit to the County for review the forms calculating the maximum allowable increase under the federal regulations for basic tier programming, installation, and equipment. Currently, Comcast charges $8.76 for Limited Basic Service. Under the filings, Comcast will be permitted to increase the Limited Basic cable rate by $1.40 to a proposed maximum permitted rate of $10.16. Under the filing, Comcast could increase the charge for installation to an unwired home by $0.17 to $52.23 and to a pre-wired home by $5.37 to $31.40. A converter box could cost $1.17 more. Comcast has not yet determined the extent of the rate increase for the coming budget year. In the past, Comcast has not raised its rates by as much as the regulations permit and is currently charging less than existing permissible rates. Comcast will provide the County prior notice of the actual rate increase. No rate increase may go into effect before December 1, 2004. Under federal law, the County may not prevent the rate increases from going into effect. The federal law does permit the County to audit Comcast's records related to the rate increases and order a rate reduction if the records do not support the proposed rate increases. The County has until July 31, 2005 to undertake and complete such an audit and take action to reduce rates. Such an audit could involve hiring an outside consultant, and staff believes that an audit would likely not be cost effective. Upon the advice of staff, the Board decided not to pursue such an audit in 2002 when the Board last held a hearing on Comcast's rates. Under local ordinance, the County is permitted, but is not required, to set a public hearing and have Comcast appear and justify the reasonableness of its rate increases. Summary of Information: Beginning in 2000, as part of a continuing effort to attract and retain businesses in the county, the Board of Supervisors capped the revenue received annually from the business license tax in the budget at $15.6 million. Staff estimates that since 1997, changes to the ordinance have resulted in estimated cumulative savings to businesses of approximately $28 million. Since business license revenues significantly exceeded the cap, revisions were made to rates and exemption levels in calendar years 2001 and 2002 to provide additional tax relief to businesses. In 2002, the Board increased the exemption of gross receipts from $100,000 to $200,000, and reduced rates within most categories by 5%, except for the professional and personal service categories where the rates were reduced about 8%. Changes to the ordinance were not made for 2003 or 2004 because the license revenue in the preceding year either just slightly exceeded the cap or fell short. Revenue received from business licenses in the fiscal year just ended exceeded the cap by approximately $1.0 million. Subsequent to this meeting, staff is recommending the Board amend the rate for the professional, financial and real estate services categories from $0.53 to $0.32 per $100 in 2005 and from $0.32 to $0.20 in 2006. Staff is estimating that approximately 550 current county businesses would be positively affected by this recommendation. In addition, this change will assist in maximizing impact on business growth in the county. In addition to the above amendments, staff is recommending amendments relating to the business license tax on flea markets, craft shows and trade shows. Currently, the tax rate is $2.00 per day for each merchant participating in a show. There is not a cap on the license tax paid per show. Staff is proposing a maximum license tax of $250 per show (show not to exceed seven consecutive days). Staff estimates that this amendment would save businesses in this category approximately $10,000 per year. Staff is also recommending a change in the time payment would be due to not later than three business days following the conclusion of the show. Reductions in these categories, in conjunction with the ordinance amendment for financial services adopted April 28, 2004, would effectively bring projected 2005 and 2006 business license revenue in line with the budgeted revenue cap. The ordinance is attached. If approved, these amendments would become effective January 1, 2005. The amendment to the rate for professional, financial and business services to $0.20 per $100 in 2006 would become effective January 1, 2006 unless otherwise changed by the Board prior to this date. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 6-4, 6-23, 6-25, 6-26, 6-27, 6-28, 6-29, 6-30, 6-32, 6-33, 6-34, 6-35 AND 6-50 RELATING TO BUSINESS LICENSES FEES BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 6-4, 6-23, 6-25, 6-26, 6-27, 6-28, 6-29, 6-30, 6-32, 6-33, 6-34, 6-35 and 6-50 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Sec. 6-4. License fees. Every person engaged in a business which is licensable pursuant to this chapter shall pay an annual fee if the total gross receipts, or gross purchases in the case of wholesale merchants, from the licensable business activity are $10,000.00 or more, but less than~.~....,vv.......e~cw~ nc~c~ ru~ $200,000, during the base year. An annual license fee shall be paid for each licensable business activity. The annual fee shall be calculated as follows: TABLE INSET: Gross Receipts/Purchases of Each Licensable Business Activity Fee $1.00--$9,999.99 $ 0.00 $10,000.00- $99,999.99 $199,999.99 $10.00 Sec. 6-23. Imposition of taxes generally. No tax shall be levied pursuant to this article on any business whose base year gross receipts, or gross purchases in the case of wholesale merchants, were less than $200,000.00. If the base year gross receipts of the licensable business activity are greater than or equal to $200,000.00, the amount of such gross receipts shall be reduced by $200,000.00 for the purpose of calculating the applicable tax and the business shall pay the tax on the reduced amount or a license fee of $10.00, whichever is greater. The $200,000.00 reduction shall not apply to any estimates made under section 6-24 but shall apply to the correction of such estimates. Sec. 6-25. Contractors. (a) Every contractor shall pay a license tax of $0.14 per $100.00 of base year gross receipts. ooo Sec. 6-26. Retail merchants. (a) Every retail merchant shall pay a license tax of $0.19 per $100.00 of base year gross receipts. 0505(00) :66374. ooo Sec. 6-27. Financial services. Every person engaged in a financial service shall pay a license tax of $0.52 $0.32 per $100.00 of base year gross receipts. However, in no case shall the tax imposed under this section exceed $90,000.00 per year. Sec. 6-28. Real estate services. Every person engaged in a real estate service shall pay a license tax of $0.52 $0.32 per $100.00 of base year gross receipts. Sec. 6-29. Professional services. Every person engaged in a professional service shall pay a license tax of $0.53 $0.32 per $100.00 of base year gross receipts. Sec. 6-30. Miscellaneous services. (a) Every person engaged in a personal or business service shall pay a license tax of $0.33 per $100.00 of base year gross receipts. (b) Every person engaged in a repair service shall pay a license tax of $0.27 per $100.00 of base year gross receipts. (c) Any person, firm, or corporation designated as the principal or prime contractor receiving identifiable federal appropriations for research and development services as defined in Section 31.205-18 of the Federal Acquisition Regulation in the areas of computer and electronic systems, computer software, applied sciences, economic and social sciences, and electronic and physical sciences, shall be subject to a license tax rate of $0.03 per $100.00 of such federal funds received in payment of such contracts upon documentation provided by such person, finn, or corporation to the commissioner of the revenue confirming the applicability of this section. (d) Every person engaged in research and development, biotechnology, or biomedical research and development businesses shall pay a license tax of $0.10 per $100.00 of base year gross receipts. (e) Every person engaged in an information services business shall pay a license tax of $0.10 per $100.00 of base year gross receipts. Sec. 6-32. Commission merchants. Every person engaged in business as a commission merchant shall pay a license tax of $0.33 per $100.00 of base year gross receipts. 0505(00):66374.1 2 000 40 000 Sec. 6-33. Wholesale merchants. (a) Every person engaged in business as a wholesale merchant shall pay a license tax of $0.10 per $100.00 of base year gross purchases. However, in no case shall the tax imposed under this section exceed $20,000.00 per year. OOO Sec. 6-34. Direct sellers. (a) Every person engaged in business as a direct seller at retail shall pay a license tax of $0.19 per $100.00 of base year gross receipts. (b) Every person engaged in business as a direct seller at wholesale shall pay a license tax of $0.05 per $100.00 of base year gross receipts. OOO Sec. 6-35. Slot machines. OOO (b) Every person selling, leasing, renting or otherwise furnishing or providing a coin- operated amusement machine, as defined in Code of Virginia, § 58.1-3720, and Code of Virginia, § 58.1-3721, shall pay a license tax of $0.33 per $100.00 of base year gross receipts of such operator from amusement machines operated within the county. This section shall not apply to any person owning less than three coin machines and operating such machines on property owned or leased by such person. 000 Sec. 6-50. Flea markets, craft shows and trade shows. OOO (c) The license tax imposed by this section shall be equal to $2.00 per day for each merchant participating in a flea market, craft show or trade show during such day or any portion of such day. The maximum tax shall not exceed $250.00 for each license for a show, but each flea market, trade show or craft show shall require a separate license. Such license shall not be granted for a period of time in excess of seven (7) consecutive days. In the event that a show taxed pursuant to this section exceeds seven (7) consecutive days in length, the organizer, promoter or manager shall be required to obtain a new license for each additional seven days, and the maximum tax provided for by this section shall apply to the new license. Every person engaged in a professional service shall pay a license tax of $9.32 $0.20 per $100.00 of base year gross receipts.
