SUMMARY
Continued parking of a recreational vehicle (tow-behind camper) within the front and side yards
of a residential lot is planned. The applicant does not plan to meet the Ordinance restriction that
the recreational vehicle be parked in the rear yard.

Proposal
The applicants have been parking a recreational vehicle on the property since February 22, 2018.
On February 26, 2018, the Planning Department received a complaint relative to the parking of a
tow-behind camper measuring approximately 41 feet long, 8 feet wide and 11 feet tall within a
portion of the right side and front yards. The vehicle is currently being stored off-site on a
temporary basis, however, the applicants wish to return the vehicle to the property and keep it in
the driveway as displayed in the images below.

The Zoning Ordinance permits the parking and storage of recreational equipment within a
residential district with certain restrictions:
No more than two (2) items of equipment permitted to be stored outside of an
enclosed building;
Except for loading and unloading, equipment is located in a rear yard and set
back 10 feet from the rear property line and 5 feet from the side property line;
Except for repair, wheels on the equipment are not removed;
Equipment is not used for living or commercial purposes; and,
Equipment is not connected to utility services.
These ordinance restrictions are designed to minimize impacts of larger vehicles and equipment
on area residential development and the streetscape. If any of these restrictions cannot be met,
the use may be allowed by conditional use. The applicants recreational vehicle complies with the
ordinance restrictions except that the vehicle is parked within the front and side yards. The
applicants are seeking conditional use approval to permit parking and storage of the recreational
vehicle in as previously located on the property.
Alternative Parking and Storage Location
Upon visiting the subject property, staff noted that the camper was stored in a portion of the right-
side and front yards. The vehicle is approximately 110 feet from Charlemagne Court and adjacent
to a two-story detached accessory building. A septic field is located in a portion of the rear yard
while an 8-foot drainage easement is located along the right side of the lot. In addition, the
property slopes downward toward the rear of the lot (approximately 16% slope). As such,
expansion of a parking area into the rear yard would require significant improvements including
removal of trees, grading, construction of retaining walls, and relocation of a portion of the septic
field. Due to these existing constraints (see figure on following page), there is no practical
alternative location for on-site parking which would comply with the Ordinance.

The vehicle is located more than 100 feet from the street and is adjacent to a two-story accessory
building, which helps to reduce visual impacts of the vehicle. Staff agrees that moving the vehicle
into the rear yard would not substantially reduce visibility from Charlemagne Court. Due to the
constraints of the lot and the minimal visual impacts of the camper, staff is supportive of this
request.

Commission Discussion:
Commissioner Jones stated that the camper was difficult to see from adjacent
properties and that the property is well maintained. He noted that the
neighborhood had other maintenance issues and that a petition had been
signed by neighbors supporting the storage of the tow-behind camper on the
property.

CONDITIONS
Note: The following conditions are recommended by both the Planning Commission and
Staff.
1. Non-Transferable Ownership. This Conditional Use approval shall be granted exclusively to
Renee G. and Gerald R. Jacobson, and shall not be transferable nor run with the land. (P)
2. Use. This Conditional Use approval shall be for the parking of one (1) recreational vehicle (tow-
behind camper) having no more than two (2) axels and no greater than forty-one (41) feet in
length. (P)
3. Location of Recreational Vehicle. The recreational vehicle shall be parked within the front and
side yards, as shown on page 4. (P)
