10-27-1959 MinutesVIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the'Court House on October 2?, 1959, at 7:30 p.m. Present: Mr. Irvin G.Horner,Chairman Mr.H.T.Goyne M~.Stanley R.Hague, Jr. Mr.R.J.Britton Mr. H.K.Hagerman }.~. Marshall F.Driskill This day again the bids on truck chassis for the fire departments'come before the Board. Upon consideration whereof, and on motion of Mr. Driskill, seconded by Mr. Britton, it is resolved theft all bids be rejected and the two trucks be re-bid with a smaller motor. On motion of Mr.Goyne, seconded by Mr. Britton, it is resolved that this Board grant a variance to Mr. Jack Burge~to approve the construction of a house not less than 49.15 f-eet from Mason Avenue, the same being Lot 24, of the Grove Place Subdivision, which subdivision has a 50-foot setback building line. This day again Mr. William M.Benton comes before the Board requesting a Use Permit to mine grevel on an 8.7 acre parcel of land in Midlothian Magisterial DistriCt, which land is bounded by the properties of the Virginia Industrial School, Mr. Peter Brown mnd Mr. W.G.James, and presents a letter setting out the various restrictions he intends to follow in the removal of gravel from this property. Upon consideration whereof, and on motion of Mr.Driskill, seconded by Mr. Goyne, it is resolved that a Use Permit for mining gravel on the aforedescribed parcel of land be and it hereby is granted. This day Mrs. Long andothers from the Bon Air P.T.A. come before the Board requesting better fire proteftion at the Bon Air School, and requested specifically a fire hydrant in the immediate vicinity of the school. Rir; Harold Hughey presented the matter for the P.T.A.Group. Upon consideration whereof, and~on motion of Mr. Driskill, seconded by P~r. Britton, it is resolved that Mr. Painter, County Engineer, be requested to investigate the cost of installing a fire hydrant at the Bon Air School and to make investigation of supplying other s~hools with fire hydrants where water is available in the area. It is herenoted that a resolution is received from the School Board supporting the inst~all~tion?oD a fire hydrant at~ the Bon Air School. This day the Executive Secretary read a Court Order appointing the members of the Board of Zoning Appeals. A brief discussion arose as to the responsibilities, dutis and organization of said grOup. On motion of Mr. Driskill, seconded by Mr.Britton, it is resolved that the Executive Secretary be and he hereby is appointed a member from~Chesterfield County of the Technical Advisory Committee of the Regional Highways, which Con~nittee is to assist the Regional Planning Commission in the development of a reEiional Highway Plan. On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that the bill presented by Mt. John Pearsall for representing the County in its litigation with the City of Colonial Heights when the status of said City chan~ed~from a towm to a city of the second class, which~bill is in the amouht of $11,750.00 be, and it hereby is approved for payment. On motion of ~.Britton , seconded by ~.Driskill, it is resolved that this Board request the Virginia Department of Highways to pavethe following roads in the Windsorview Subdivision, charging same to ~he 3¢ Road Fund of the County: Windsorview Drive ~rom Sequoyah to Buckhill Drive Sequoyah Drive from Windsorview Drive to Marlboro Drive All of Marlboro Drive from Buckhill to Sequoyah Buchhill Drive f~om Marlboro Drive to Windsorview Drive This day again the mtter of draining certain portions of Willis Road comes before the Board and the Executive Secretary read a letter from the Highway Department citing the fact that a drainage survey ~had been made, and the Highway Department reiterates its position that the Highway has no responsibility in this nmtter and cites ~ts willingness to survey the area should the Board be willing to pay for such a survey. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Hague, it is resolved that this Board request the Resident Engineer to give an estimate on the cost of extending the drainage eastwardly along k~illis Road to effectively drain said road. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Kingsport Lane, Fairbank Lane and Badenoch Lane in the Southaven SubdiviSion, Section 2, Manchester Magisterial District, which report shows that in the opinion of the County Road Engineer it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr. Britton, it is resolved that Kingsport Lane, Fairbank Lane and Badenoch Lane in the Southaven Subdivision,Section 2, Manchester Magisterial District, be and they are hereby established as public roads. And be it further resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road Syste~,Kingsport Lane, from a point et 'the northern end of maintenance of Rt.2284,.07 of a mile northwardly to Badenoch Lane, thence .03 of a mile northwardly to a turn-~round; Fairbank Lane, from a point at the north~n end of maintenance of Rt.2293, .07 of a mile northwardly to Badenoch Lane; Badenoch Lane, from its intersection with Kingsport Lane, .06 of amile eastwardly to Fair- banks Lane, thence .02 of a mile eastwardly to a turn-around. These roads serve 2& houses. And be it further resolved that the Board of Supervisors of Chesterfield County guarantees a right of way of not less than 50 feet to the Virginia Department of Highways for these roads. Dedication of said rights of way recorded in Plat Book 9, Page 55-56, Chesterfield Court House, Virginia. This day the County Road Engineer in accordance with directions from this Board made report in writing uponhis examination of Kingsway Road and Cross Road in the Barleth Heights Subdivision,' ~ection B, in Manchester Magisterial District, which report shows that ih the opinion of the County Road Engineer it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr.Britton, it is resolved that Kingsway Road and Cross Road in the Subdivision of Barleth Heights, Section B, Manchester District, be, and they hereby-are established as 'p~lic roads. And be it further resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary RoadSystem, Kingsway Road, from a point on Rt.1683, .06 of a mile East of Rt. 2107, .18 of a mile northwardly to Cross Road; Cross Road, from a point on Rt. 2107, .18 of a mile north of Rt. 1683, .06 of a mile eastwardly to Kingsway Road. These roads serve 5 houses. and be it further resolved that the Board of Supervisors of Chesterfield County guarantees a right of way of not less than 50 feet to the Virginia Department of Highways for these roads. Dedication of said rights of way recorded in Plat Book ll, Page 28 , Chesterfield Court House, Virginia. This day the County Road Engineer in accordance with directions from thisBoard made report in writing upon his examination~ of Balleau Road in the subdivision of Crestwood Farms, Section B, Midlothian Magisterial District, which report shows that in the opinion of the County Road Engineer it is expedient that said read be established as a public road. Upon consideration whereof, and on motion of Mr.Driskill, it is resolved that Belleau Road in Cre~wood Farms Subdivision, Section B, Midlothian District, be and it hereby is established as a public road. And b~e it further resolved that the Virginia Department Of Highways, be, and it hereby is requested to take into the Secondary RoadSystem, Belleau Road, from a point on Rt. 1712, .05 of a mile west of Rt. 1733, .22 of a mile northwardly to Rt. 1729. This road serves 4 houses. And be it further resolved, that the Board of Supervisors of Chesterfield County guarantees a right of way of not less than 50 feet for this road. Dedication of said right of way recorded in Plat Book 8, Page 206-207 , Chesterfield Court House, Virginia. T~is day the County ~oad Engineer in accordance with directions from this Board made report in writing upon his examination of Bloomfield Road~ Brentford Drive, and Stonehenge Drive, in the subdivision of Cre~twood Fa~s,Section E, Midlothian ~]agisterial District, which reoort ~hows that in the opinion of the County Road Engineer it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr. Driskill, it is resolved that Bloomfield Road, Brentford Drive, and Stonehenge Drive, in the subdivision of Crestwood Farms, Section N, be, and they hereby are established ~s public rcads. And be it further resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary RoadSystem, Bloomfield Road, from the intersection of Rts. 17~1 and 1733 .25 of a mile northwardly to Brentford Drive; Brentford Drive, from the intersection with Bloomfield Road,.17 of a mile eastwardly to Stonehenge Drive, thence .13 of a mile eastwardly to Chambray Drive; Stonehenge Drive, from a point on Rt. 1733, .15 of a mile east of Rt. '~1741, .21 of a mile northwardly to Brentford Drive. These roads serve 6 houses. And be it further resolved that the Board of Supervisors of ~hesterfield County guarantees a right of way of not less than 50 feet to the Virginia Department of Highways lot £hese roads. Dedication of said rights of way recorded in Plat Book t%, Page 28 , Chesterfield Court House, Virginia. On motion of Mr.Britton, seconded by ~r. Driskill, it is resolved that a variance be granted to Mt. James H. Cherry to allow the division of a tract of land on the German School Road into several parcels as shown on a sketch filed with the Board's papers, provided the proper right of way be granted for the future widening of the German School Road and the plat be surveyed by a certified engineer. This day the Executive Secretary read a request from the Manchester Volunteer Fire Department for one additional 500-gpm pumper. Upon consideration whereof, and on motion of Mr. Britton, seconded by Mr.Driskill, it is resolved that this request be received for further consideration. The Board's attention was called to the annual meeting of the League of Virginia Counties to be held November 9,10, in Charlottesville, Virginia, and the Chairman appoints Mr. Goyne to receive the 25-year award to be awarded to the County of Chesterfield. On motion of M~.Hague,.seconded by Mr.Hagerman, it is resolved that this Board pay to Mr. Joseph Darling $10.00 f~r one milk goat killed by dogs. ~n motion of Mr.Britton, seconded by Mr.Hague, it is resolved that the following standard water contracts be and they hereby are approved: Fuqua Farms Oxford Subdivision Granite Road School Alice Heights Reynolds Metals Company Chatham Subdivision $17,338.50 16,024.00 6,514.00 '775.00 18,000.O0 On motion of Mr.Driskill, seconded by Mr.Britton, it is resolved that the name of Willis Road in Bon Air be changed to Lancroft Road. On motion of Mr. Britton, seconded by Mr. Hague, it is resolved that this Board adjourn to executive session. Reconvening: On motion of Mr. Britton, seconded by Mr .Dri skill, it is resolved that this Board accept the report of the Consulting Engineer, R.Stuart Royer & Associates, concerning the removal of manganese from the water filtration plant by the use of Zeolite and authorize the first phase of this work to be done at an amount of approximately $1120.50. On motion of Mr.Britton, sefonded by Mr. Driskill, it is resolved that this Board authorize the installation of the quick-call radio apparatus for the activating of sirens in the various volunteer Fire Departments. On motion of Mr.Goyne, seconded by Mt. Hague, it is resolved: That the Board doth determine that it is necessary and expedient for the construction, operation and maintenance of the Chesterfield County !~ater System to acquire the right, privilege, and perpetual easement and right of way for the purpose of installing, constructing, maintaining, operating, repairing, altering, replacing and removing water mains, pi. pc, pipelines, meters and other appurtenant facilities, for the transmission and distribution of water, through said water mains, under, through, upon and across the property of the William S. Miller Estate located in Bermuda District, Chesterfield County, Virginia, and shown on a certain plat entitled "Plan of 15 foot Water Easement located 10 feet south of the South Line of Kingsland Road,East of the Richmond-Petersburg Turnpike (Rt. 95) Bermuda District, Chesterfield County,Virginia", made by Engineering Department, Chesterfield County, Virginia, dated OcDober 23, 1959, a copy of which is hereto attached, and that the Board has been unable to purchase said interest for the total sum of $50.00 from the landowners whose names are set forth as follows: Giles Bland Miller, Jackton T. That pursuant to Chapter 382 of the Actsof Assembly of Virginia, 1958, the Board does determine that an emergency exists and it is necessary to enter upon and take possession of the aforesaid lands on the t~,lth day of December, 1959, and proceed with the construction and maintenance of the said County water facilities. The Clerk of this Board is directed to notify the above landowners by registered mail at least Bhirty (30) days before said date that the County intends to enter upon and take possession of the said easement on the llth day of December 1959, and that the Board will pay the landowners the total amount of $50.00 as compensation of the interest to be acquired and for damages to landowners' remaining property by reason of the taking. BE IT FURTHER RESOLVED, that the Commonwealth's Attorney ofthis County is authorized to institute the necessary proceedings on behalf of the County to acquire said interest in said land by the exercise of the right of eminent domain and to represent the Board if the landowners contest the manner of said taking. Further Resolved, the Clerk of this Board is authorized to deposit with the Clerk of the Circuit Court of this County the sum of $50.00 as set forth above, being the Board's estimate of the interest taken and damages done, when requested to do so by the Commonwealth's Attorney.
