01-28-1960 MinutesVIRGINIA: At a regular meeting of the Board of Supervisors of Chesterfield County, held at the Courthouseon January 28, 1960, at 2:00 p.m. Present: Mr. Irvin G. Homer, Chairman Mr. H. T.Goyne, Mr. Stanley R. Hague, Jr. Mr .R.J .Bri tton Mr. ~arshall F. Driskill Absent: Mr.H.K.Hagerman Mr. O.B.Gates, Sheriff, gives the invocation. Mr.C.O.Jones comes before the Board requesting a variance from the building code to permit the construction ~'f a house on an unimproved public right of way. Upon consideration whereof, and on motion of Mr.Goyne, seconded by Mr. Britton, it is resolved that the Building Inspector be and he hereby is authorized to issue a building permit to Mr.C.O.Jones, provided he constructs a road leading southwestwardly from the Harrowgate Road to meet the State's specifications. It is understood that the first 338 feet w~ll have at least a 40-foot riEht of way and the next 200 feet will have not te ss than a 50-foot right of way. Mr.J.D.Shelton comes before the Board representing a delegation of approximately 20 people opposing the location of a proposed sanitary landfill on Rt.618, approximately one-mile east of Rt.#l, citing the fact that such a public dump would contaminate the water supply and generally decrease property values. Mt.Herbert Boyd, Mr. Harry Goyne, Mrs,Ethel Jones and Mr. James Friend and others come also opposing the proposed land fill. Upon consideration whereof, andon motion of Mr. Goyne, seconded by Mr.Driskill, it is resolved that the study of this proposal be continued. On motion of Mr. Hague, seconded by ~Ir. Britton, it is resolved that the following erroneous assessments be and they hereby are approved: ~s. Elizabeth C. Bruce Emmett C. Mathews Ray$ond Newcomb Ethel M.Young and Ann Y.Hale $29.70 24.96 2.52 63.36 On motion of Mr.Driskill, seconded by Mr.Britton, it is resolved that a Variance from the Building Code be granted to Mr.A.D. Stroud to allowthe construction of a residenceon an unimproved 50-foot right of way which must be provided by Mr.Stroud upon the condition that the County will not be responsible under any circumstances for the constr'ostion of said road. ~ir. Stroud's property is on a 50-foot right of way near the intersection of ~dkins Road and Reams Road. On motion of Mr. Britton, seconded by P~.Driskill, it is resolved that the contract with the City of Colonial Heights for the purchase of certain sewer lines and water mains, lying within the City of Colonial Heights be and it heregy is approved and the Chairman and Clerk of this Board are hereby authorized to sign said contract. The report of the 'County Assessor was read and filed with the Board's paDers. The Board discussed again the relocation of State Route 620 in Bermuda District of this County. Mt.Robert H.Patterson, Attorney of Richmond, Virginia, eappeared before the Board and advised that his cliehts, Messrs. John Roberts and Parke Lecky, wouldpay for the right of way for the relocation of' State Route 620 whether it be acquired by purchase or condemnation; however, Messr.~. Roberts and Lecky reserved the right to refuse to ~ay for the purchase of any part o~ parts of the right of way for which the consideration was believed by them to be excessive and if the property was unable to be acquired by purchase and condemnation proceedings were instituted, they would have the same right to refuse pay for an excessive award. Mr.Patterson stated that M~ssrs. Roberts and Lecky would pay all costs incident to the acquisition of the land by purchase or condemnation, including, but not limited to, appraisals, surveys, legal fees and court co,ts. Now, Therefore, on motion of M~.Goyne, seconded by Mr. Driskill, Be it Resolved, that the Board of Supervisors doth dtermine that it is necessary and expedient to acquire for public purposes sufficient right of Way for a proposed relocation of State Route 620 as shown on the map made by the Department of Highways, Commonwealth of Virginia, dated October 6, 1959. Be it Further Resolved, that if the County.is unable to purchase said property from the landowners at the appraised price, then the Con~nonwealthts Attorney of this County is authorized to institute on behalf of the County of Chesterfield, proceedings exercising the r~ght of eminent domain to acquire the said rights of way. The price to be paid for the land under the exercise of the right of eminent domain shall be reported to this Board to determine whether or not the County desires to take the property at the amount awarded by the Commissioners to be aDpoin~ed for that purpose in said proceedings. Be it Further Resolved, that the Board understands that Messrs. Roberts and Lecky have the privilege to reject the payment of the amount if awarded in their opinion they determine the amount awarded is excessive and to reject the purchase price of any part of Parts of the right of way if the consideration is believed by them to be excessive. However, Messrs. Roberts and Lecky have represented to the Board that they will pay the cost of any proceedings as required by law which the County of Chesterfield may be required to pay. On motion of Mr.Raymond J.Britton, seconded by Mr.Marshall K. Driskill, the Board ha~ing found that State Highway Rt.650 at its intersection ~ith the northern line of Belmont Road is in the State Highway System, that a portion of s~id highway Rt. 6~0 extending northwardly from its intersection with the northern line of Belmont Road for approximately ~8.27 geet has been altered and a new road, which serves the s~me citizens as the old r~ad has been constructed in tiem thereof and approved by the State Commissioner~ it is resolved that the Board of Supervisors of Chesterfield County declsres abandoned the following described oid road: That c~rtain strip of land in Manchester District, Chesterfield County, Virginia, extending northwardly from the northern line of Belmont Road and more particularly described as follows: Beginning at a point on' the northern line of Belmont Road 57.12 feet east of the intersection of the eastern line of the present North road vrith the northern line of Belmont Road; thence N.32°56, W. 1~1.25 feet to the eastern line of North Road; thence N. l&°lO~ ~;~. along the eastern line of North Road ~J+.3& feet to a point; thence northwardly along the ~astern line of North Road along a curve to the left the radius of which is 67~.25 feet, a distance of 221.17 feet ~o a point; thence S., 32°56' E. along the eastern line of former road 398.27 feet to the northern line of Belmont Road; thence S. 55° 05 feet ]~;. along the northern line of Belmont Road 50.03 feet to the point of beginning, containing 0.261 acres as shown on "l, lap of Two ~arcels of Land Situated at the Intersection of North and Belmont Roads, Chesterfield County, Virginia", fade November 12, 1959, by Phillip H.Brooks and Kenneth L.Barton, Certified Land Surveyors. ~A letter from the ~County Treasurer was read which letter requested the Board of Supervisors to authorize the Treasurer to dispe~e with the policy of the Treasurer's Office to sit at designated places during the month of November for the convenience of citizens w~o wish to pa~-their taxes without coming to the Courthouse. Upon consideration whereof, and on motion of Mr. Britton, seconded by Mr.Driskill, it is resolved that this Board determines that the s~tti~s of the Treasurer at designated places for the convenience of citizens who wish to pay their taxes without making a trip to the Courthouse are not justified, and the Treasurer be and he hereby is authorized not to continue this p~oli~y~~ provided he will properly notify the citizens of the County of his action. On motion of Mr.Britton, seconded by Mr.Driskill, it is resolved that the Purchasing Agent be and he h~reby is authorized to purchase 8 Police cars from the McCoy Motor Company, at a price of $2176.12 each. It is here noted that Mr. Goyne votes "No". On motion of Mr.Britton, seconded by Mr.Driskilt, the Board having found that State Highway No.651 at its intersection with Pocoshock Creek is in the State Highway Secondary System, that a portion of said Highway No.651 extending northwardly from its intersection with Pocoshock Creek has been altered and a new road which serves the same citisens as the old road has been constructed in lieu thereof and approved by the State Highway ~Eon~nissioner, it is resolved that the Board of Supervisors of Chesterfield County declare abandoned said old road which is enclosed in red lines on "Map Showing Proposed Relocation of Secondary System of State Highways Road No.651 Known as Route 651 Bridge and Approaches over Pocoshock Creek in Chesterfield County, Virginia," made November 2~,1939 by Virginia Department of Highways, Divisionof Surveys and Plans, approved September 3, 19~O, a copy of which is attached to this resolution. On motion of Mr.Britton, seconded by Mt. Hague, it is resolved that the standard water contra~cts for Longwood Acres in the amount of ~1117.50 be and it hereby is approved, and the Chairman and Clerk of this B~ard a~e authorized to sign said co~tract. On motion of ~'h~.Goyne, seconded by Mt.Hague, it is resolved that the street names in the area of Patterson Park be and they hereby are changed as follows: Sth avenue be changed to Gettings Lane 6th Avenue be changed to ~.~yron ~venue ~th Avenue be changed to Gayland Avenue 3rd ~venue to changed to Alcott Road Chesterfield Avenue be changed to Elliham Avenue 2nd Avenue be changed to Gwynn Avenue let Avenu~ be changed to ~derriewood Road On motion of Mr.Britton, seconded by Mr.Driskill, it is resolved that a petition signed by a number of citizens concerning house numbers on Riverside Drive be and it hereby is received, and filed _for further study. On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that the salary of Mrs. Ida Dewelt be and it hereby is increased to ~3720.00 per year, beginning January 1, 1960. On motion of ~P.Driskill, seconded by Mr. Britton, it is resolved that the salary of Mr.Calvin Viar be increased to ~3200,00, beginning January 1, 1960. On motion of Mr. Goyne, seconded by 5ir. Britton, it is resolved that, the salary of the Planning ~ommissiOn members and the Board of Zoning Appeals be and thew hereby are fixed at ~300.00 per year, beginning January 1, 1960. On motion of Mr. Driskill, seco~ed by Mr. Goyne, Be it ~esolved, that the Board of Supervisors doth appoint Mr.T.A.Keck and Mr.S.E.Hardwick, as members of the Chesterfield County Planning $ommission for a term of B-years, and Mr.E.E.Bates and ~r. ~.P.Eagles for a term of 3 years ~he term of office of such members or successors in office to sum. h members, shall thereafter be for a term of four years, beginning at the expiration date of this appointment. The Executive Secretary shall be a member of the County Planning Commission and Mr.Raymond J.Britton, a member of the Board of Supervisors, is hereby aDpointed for a term of one year to the Planning Commission. On motion of I¥~.Driskill, seconded by Mr.Britton, Be it Resolved, that [~[r. Stuart Shumate is appointed to the Richmond Regional Area Planning Commission as a citi'zen member to fill the unexpired term of Mr. J.J.Jewett. Mt.Harold T.Goyne,Sr., is appointed a member of the Regional PlanninE Co~ission, representing the Board of Supervisors, who shall hold office on the Conm:ission coincident with his term of office as a member of the said B~ird of Supervisors and Mr.Sam E. Hardwick, Jr., is appointed a member of the Regional Planning Commission as a Planning Commission member of Chesterfield County and shall hold office coincident w~th his term of office on the Chesterfield County Planning Commission. This day the matter of Scholarship ap[~lications for ~9 pupils eligible to go to County schools now going to private or other public schools comes before the Board: and it is on motion of M~.Goyne, seconded by Mr. Driskill, resolve~l that the consideration of scholarships requested be continued ,~ntil the next meeting of this Boa rd. On motion of Mr.Britton, seconded by Mr.briskitl, it is resolved that this Board request the Virginia Department of Highways to study Rt.653, between Rts. 60 and 360, for the purpose of makins said road a Prima.fy.Highway. And be it further resolved, that the Highv~at Department be and it hereby is requested to study Rt.64?, from Rt. 1 to Rt.360 in relation to making said road a Primary right of way. On motion of ~'.~r.BrittSn, seconded by MriGoyne, it is resolved that the Highway Department be and it hereby is requested to study the drainage on Hopkins Road from the City limits to the Belt Boulevard, said drainage offering great hazards to the traveling public. On motion of Mr.Britton, seconded by i'.~.Driskill, it is resolved that the Highway Department be and it hereby is requested to put up guard rails on Rt.63? at the County reservoir and on Rt. 10 at the County reservoir to be protection for the trav~ing public. On motion of Mr.Hague~ seconded by Mr. Goyne, it is resolved that this Board request the Highway Department to re-arrange the stop signs and put route numbers on the Kingsland Road at its intersection with Rt. 10. On motion of ~[r. Goyne, seconded by Mr.Britton, it is resolved that the request of the Bensley Volunteer Fire Department to purchase an auxiliary truck to be used as a hose truck in fire fighting operations be and it hereby is approved, and the County will be responsible for the insurance and operation of said truck. On motion of Mr. Driskilt, seconded by Mr.Britton, it is resolved that the Virginia Department of Highways be and it hereby is requested to improve the subdivision roads of the ~.~ellington Subdivision and to ~ard-surface s~ne as soon as possible, charging said c~t to the County's 3¢ Road Fund. And be it further resolved, that the foregoin~ resolution be forwarded to the Highway Department upon receipt of ~600.00 from the owner of lots in said subdivision. On motion of R~.Driskill, seconded by Mr. Britton, it is resolved that the recommenda- tion of the Buildings and Grounds Committee to authorize the architectural firm of Hinnant, Addision and Hinnant, to prepare tentative plans for a 60' x 150' Fair building'to be located on the Fairgrounds]~ be amd it hereby is approved. On motion of Mr. Driskill, seconded by Mr.Hague, it is resolved that the recommendations of the Buildings and Grounds Committee to request Mr.Samuel Mayo, Architect, to prepare preliminary plans for a County garage to be designed to service a].l the vehicles owned by the County and the School Board, be, and it ~ereby is approved. On motion of Mr.Britton, seconded by F~r. Driskill, it is resolved that this Board approve the recommendation of the Buildings and Grounds Committee for blanket insurance for the buildings at theCourthouse and request said Committee to study further the matter of allocating the insurance coverage to various a~encies.
