VIRGINIA: At a regular meeting of the
Board of Supervisors of Chesterfield County,
held at the Courthouse on March 2&, 1960,
at 2:00 p.m.

A delegation from th~ Willis Road drainage area appears bef~.~ the Board to
complain about the Board's decision to.fallow the recommendation of the Highway
Department in routing the surface water southwardly from the Willis Road along
Burge Avenue, thence eastwardly to the present ditch in Bellwood Manor.
The delegation cited the fact that an increase in water would flood certain areas,
that it would be quite expensive to increase the size of culverts under the
existing road s and that by ditching Willis Road eastwardly from Burge Avenue,
the surface water cou~.d be handled to affect the best interest of the most people.
Nr.R.V.Lancaster, Resident Engineer, stated that before making further commitments
he would have to have legal advice. Upon consideration whereof, and on motion
of Mr. Goyne, seconded by Mr. Britton, it is resolved that this Board request the
Highway Department to re-survey the water problems with a view to channeling the
water on the southside of Willis Road and to ascertain what part the Highway
Department and the Toll Road would share in the expense of this program.
Mr. Lancaster, Resident Engineer, discussed with the Board further steps necessary
to install the traffic control light for the Ettrick~ Fire Department. Upon
consideration whereof, and on motion of Mr. Hagerman, seconded by Mt.Hague, it
is resolved that this Board request the Highwway Department to have their Traffic
and Planning Section recommend the position of a light or lights at the Ettrick
Fire house, and to in~tall same when said survey is completed.
On motion of 5~.Goyne, seconded by Mr.Hague, it is resolved that this Board
request the Highway Department to survey and ascertain the cost of/proposed road
to the Chester Fire Department, the length of which would be aoproximately
150 feet.
Mt.Carl Lindner, Mr.C.C.Wells, and Mr. Fred Thompson, come before the Board
explaining that the County's water pressure and volume at the new high school on
Forest HillAvenue are not sufficient for the peak needs of the school and that
it would cost $20,015.00 to install a tank and pressure pump to guarantee adequate
pressure and volume of water at all times. On motion of ~r.Britton, seconded by
Mr.Hague, it is resolved that this Board record its agreement to paying the
difference between $20,015.00 and the cost of erecting 150,000 gallon over-head
tank, which tankwould serve not only the school adequately but the entire area.
And be it further Resolved, that this Board request the School Board to allocate
$20,D~5.00, the sum it would cost the School Board to assure sufficient water
to the school toward the erection of a 150,000 gallon overhead tank to be placed
on the school property at a site mutually agreeable to the School Board and the
County Engineering Department.
The Commonwealth's Attorney advises that he has been served with a warrant against
the County suing for $3&.5~ by Mr.James W. Gauldin,who maintains that the County
Water Department has overcharged him said amount.
It was agreed that the Commonwealth's Attorney would represent the County in
said suit.
On motion of Mr. Goyse, seconded by ~Ir. Hager~an, the following resolution is
adopt ed:
Concurrent Ordinance and Resolu% ion Relating to the Creation of
A water Authority to be known as Appomattox River %~ater Authority
and Setting Forth the Articles cf Incorporation of Such Authority.
Be it Ordained and Resolved by the Council of the City of Petersburg,
the Council of the City of Hopewell, the Council of the City of
Colonial Heights, the Board of Supervisors of the County of Prince
George, the Board of Supervisors of the County of Chesterfield and
the Board of Supervisors of the Coumty of Dinwiddie, in seoarate
m~etings assembled, a s follows:
Section 1. The Councils of the City of Petersburg, the City of
HopewAll, the City of Colonial Heights, a~d the Boards of Supervisors
of the County of Prince George, the County of Chesterfield and the
County of D~nwiddie, hereby signify their intention to create a water authority
which shall be known as the "Appomattox River ~ater Authority, pursuant to the
Virginia Water and Swwer Authorities Act, as enacted by Chapter 22.1 of Title
15 of the Code of Virginia, as amended.
Section 2. The purpose or purposes for which such Authority is to be created
are those which are stated in the Articles of Incorporation hereinafter set forth.
Section 3. The Articles of Incorporation of said Authority shall be as
follows:
ARTICLES OF INCORPCRATION OE APPOMATTOX
RIVER WATER AUTHORITY
In compliance with the Virginia Water and Sewer Authorities Act ICh~p~er
22.1 of Title 195 of the Code of Virgi~nia, as amended) the undersigned who are
the governing bodies of the City of Petersburg,the City of Hopewell, the City of
Colonial Heights, the County of Prince George, the County of Dinw~ddie, and the
County of Chesterfield, have determined that the Articles of Incorporation of Appomattox
River Water Authority, a public body ~o~itic and corporate created pursuant to
said Virginia Water and Sewer Authorities Act, shall be as follows:
(1) The name of said authority shall be "Appomattox-River Water Authority"
and its principal office shall be located at Petersburg, Virginia.
(2) The names of the incorporating political subdivisions, each of which is a
political subdivision of the Commonwealth of Virginia, are: The City of Petersburg,
the City of Hopewell, the City of Colonial Heights, the County of Prince George,
the County of Chesterfield and the County of Dinwidd~ie.
(3) The names, addresses and terms of office of the first members of the
Board of said Authority are, respectively as follows:

The term of ~ fi~e of each member shall begin on the date of his appointment.
~ (4) The purpose of which said AuthOrity is to be created is the construction
of a water reservoir or water reservoirs suitable to provide a supply of water,
robe located on' the Appona ttox River, including water distribution sy~cems,intakes,
mains, laterals, pumping stations, stand pipes, filtration plants, purification
plants and the equipment or appurtenances necessary· or suitable therefor and
including the acquisition of any properties, rights, easements or franchises
rela~ing thereto and ~eemed necessary or convenient by the Authority for th~r~.
operation. The preliminary estimate of the capital cos~ of said imp~rovements,
as certified by Wiley and Wilson, who are responsible engineers, is $18,100,000.00.
IN WITNESS WHEREOF, the Councils of the City of Petersburg, the City of
Hopewell, the City of Colonial Heights, and the Boards of Supervisors of the
County of Prince George, the County of Chesterfield and the County of Dinwiddie,
have caused these Articles to be executed in the names of the City of Petersburg-,
the City of Hopewell, the City of Colonial Heights, the County of Prince George,
the County of Chesterfield and the County of Dinw£'ddie, by the Mayors of the
said Cities and by the Chairmen of the Boards of Supervisors of said Counties,
and the seals of said Cities and Counties to be affixed hereto and attested by
their respective Clerks or Secretaries, this day of . . ,1960.
Section 4. This ordinance and resolution shall t~ke effect at the time
and in the manner provided by law.
WHEREAS, the concurrent ordinance and resolution entitled "Concurrent
ordinance and resolution relating to the creation of a water authority to be knov~n
as Appomattox River Water Authority and setting forth the articles of incorporation
of such Authority", has been duly adopted by the Board of Supervisors of the
County of Chesterfield and has ~ecome effective, and it is necessem-y to hold
a hearing thereon as provided by ~he Virginia Water and Sewer Authorities Act;
Now, Therefore, Be it Resolved, that said ordinance and resolution shall
be published with a notice in substantially the following form:
PLEASETAKE NOTICE that the ordinance and resolution entitled "Concurrent
ordinance and resolution relating t~ the creation of a water authority to be
known as Appomattox River ?JaterAuthority and setting forth the Articles of
incorporation of such Authority~ published h~rewith was duly adopted on the
2&th day of March, 1960, and has become effective, and that the Board of Supervisors
of the County of Chesterfield will hold a public hearing thereon at Chesterfield
Courthouse, Virginia, in the County Cour Room, the regular meeting place of said
Board on the 13th day of April, 1960, at which all p,rsons interested w~ll be
heard.

FURTHER RESOLVED, that the Clerk 6§ hereby directed to make such publication
in Richmond News Leader, a newspaper published in Richmond, Virginia, and having
general circulation in the County of Chesterfield'at least l0 days prior to the
date fixed for the holding of said public hearing.
FURTHER RESOLVED. that the proper officers of the Board of Supervisors of
the County of Chesterfield are hereby authorized to emecute the Articles of
Incorporation of ~he AppOmattox RiVer Water Authority set forth in said concurrent
ordinance and resolution.
On motion of ¥~r. Goyne, seconded by Mr. Britton, the following resolution is adopted:
RESOLVED~ that the Boa rd of Supervisors of Chesterfield County,
Virginia, hereby approves and-consents to the vacation of the plat
entitled "Fernleigh Section A, Midlothian District, Chesterfield
County, ~irgi. nia," made by Foster & Miller, Engineer-Surveyors, dated
April 30$1958 and recorded in the Clerk's Office of the aforesaid
County in Plat Book lO,'page 90, except the portion of the said plat
comprising Lots l, 2, 3, and 4 of Block B, Fernleigh Section A, this
Board having been duly requested to aoprove and consent to said
vacation by Herman Novenber and Irene G. November, Partners trading
as Herman Realty Company, George Margolis and Anne Marie McCabe
Margolis. Cecil C. mrumley and Barbara Brumley, W.H.Metzger~ and E.H.
Copple, Trustees, and The Central National Bank of Richmond, Virginia,
noteholder, who are all the pereons having a proprietary interest
in and to the lots on the said plat.
On motion of ~ir. Britton, seconded by Mr.Goyne, it is re~ lved that the Board approve
the payment of $15.0& to Er. Joseph G.Bowden, who paid said taxes to the County
after paying same to the City of Richmond.
The BOard received a resolution from the School Board approving six (6) Scholarship
applications in the amount of $706.26, which resolution requests the Board of
Supervisors to appropriate to a Special Fund the said amount of money for the pay-
ment of saix six ~6) Scholarships.
On motion of I~ir.Goyne, seconded by Mr.Britton, it is resolved that this Boated
appropriat9 $706.26 to the Special Fund from which scholarBhips are dispersed, said
amount of $706..26 being for the six (6) scholarship applications approved by the
School Board on March 16, 1960.
~On motion of Er. Hague, seconded by Mr.Goyne, it is resolved that the Executive
Secretary be requested to get an estimated cost from the County Surveyor for the
preparation of maps showing Precinct lines and Magisterial District lines, using the
information established by the Commonwealth's Attorney's Office.
On motion of Mr. Hagerman, seconded by Mr. Goyne, it is resolved that the following
be and it hereby is adopted:
An Ordinance, prohibiting any person, association or corporation
from the parking of automobiles, trucks or any other authmotive equipment
on or alongside the rc~ds, highways and streets of the Uounty or of the
State in the County of Chesterfield when the same are parked for commercial
purposes; exempting from the operation thereof certain ~ehicles and
prescribing for the violation thereof.
BE IT ORDAI~D BY THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY:
1. That it shall be unlawful for any person, association, or corporation
in the County of Chesterfield to park automobiles, trucks or any other
automotive equipment on or alongside the roads, hiEhways and streets of the
County or of the State of Virginia in the County of Chesterfield when such
person, association or corporation is parking any such aotomobile, truck or
automotive equipment in pursuance of commercial purposes.
2. The provisions of this ordinance shall not'apply to motor vehicles
carriers when picking up or discharging passengers, nor to delivery vehicles
while making deliveries to property adjacent said street, road or highway.
3. Every person, association or corporation who violates the provisions
of this ordinance shall be guilty of a misdemeanor and upon conviction thereof
shall be punished by a fine.of not less than five dollars ($5.00) nor more than
one hundred dollars (100.O0),or by imprisonment in Jail for not less than
one nor more than ten days, or by both such fine and imprisonment.
4. This ~rdinance shall be effective thirty (30) days ~fter its passage,
March 24, 1960.
On motion of Mr.Britton, seconded by Mr. Goyne,
BE IT RESOLVED: That the Board of Supervisors authorizes the Building~Inspector
to include as an amendment to the Building Code in the codification of same, a
provision allowing non-bearing partitions to be constructed of 2" and 3" studs set
the three inch way for a distance not to exceed twelve (12) feet where no
openings are included, and six (6) feet where openings are included; and
BE IT FURTHER RESOLVED, the Building Inspector is authorized to issue
building permits for such construction from the effective date of this resolution.
This resolution shall take effect immediately.
On motion oF Mr. Hague, seconded by Mr. Goyne, it is resolved that the v~rious
requests received by the Executive Secretary from several fire companies be and
they hereby are referred to the Fire Committee of the Board.
On motion of Mr. Hague, seconded by Mr.Goyne, it is resolved that this Board
tentatively establishes the policy that all applications for future hard-
surfacing be sent to the Highway Department.
The Board considered the request of Mr.Ernest L.Ellett for constructing a house
to replace a present home not fronting on a hard-surfaced road, and it was
generally agreed that this letter be referred to ~r. Stanley Hague, Supervisor of
the District.
A delegation from the Enon Community appears requesting that the Board waive the
tax on the yearly festival put on by the Enon Association. On motion of Mr.
Goyne, seconded by Mr. Hague, it is resolved that this Board hereby waives the
tax on a carnival or festival put on by the Enon Civic Association.
The Enon delegation further requested consideration by the Board of improving
its water supply. Whereupon considerable discussion arose as to the possibility
of selling additional vonds, bringing water from Hopewell to the Enon area, and
extending water lines eastwardly from Route #l.
On motion of Mr.Britton, seconded by Mr.Hague, it is resolved that the County
Engineer be and he hereby is authorized to purchase an automatic chemical feeder
to be used at the water filtration plant.
It was generally agreed that April 5, 1960, at 7:30 p.m. be the time and date
set aside for discussion of the proposed retirement plan and insurance plans.
On motion, the meeting is adjourned to April 7, 1960, at 7:30 p.m.
