Mr. V.L. Wadkins comes before the Board seekin further action on the requested
traffic light at the intersection of Routes 60~ and Rt.#l. On motion of Mr.
Goyne, seconded by Mr. Driskill~ it is resolved that a Committee be appointed to
ascertain from the Highway Department the progress of channelization of traffic,
installation of a traffic light and the construction of Rt.608. The Chairman
appoints Mr. Goyne, Rjr. Homer and Mr. Burnett to serve as such a Committee.
The County Engineer comes before the Board and presents several water contracts.
On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that standard water
contracts with the -

be and they hereby are approved.
On motion of Mr. Britton~ seconded by Mr.Driskill, it is resolved that a special
water contract ,5~6 for Apple Acres, be and it hereby is approved.
On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that the County
Engineer be and he hereby is authorized to offer $850.00 for the property and
necezsary easements on the southwest corner of Mr. Batdwin's land on Rt. 10, said
land to be used for a pumping site and other water facilities.
On motion of Mr.Britton, seconded by Mr. Driskill, the following resolution is
adopted:
WHEREAS, Mr. Clinton D.Rice and Elizabeth H.Rice are owners of two
certain lots or parcels of land lying and being in Manchester District, Chesterfield
County, Virginia, and designated as Lots 81 and 82 on a Plan of "Chestervale"
by W.W.LaPrade and Bros., Civil Engineers, and recorded in Plat Book 8, Page 127~
in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia~ to
which plat reference is hereby made for a more particular description of said
subdivision and lots; and
WHEREAS, McCtinton D. Rice and ElizAbeth H.Rice wish to use said
Lots 81 Lots 81 and 82 as shown on the said recorded plan as a contiguous parcel,
said parcel being more fully shown on plat by Kenneth L.Barton, Certified Land Surveyor,
dated December 13, 1960~ attached hereto and made a part hereof; and
WHEREAS, in order to use same as a contiguous parcel it is necessary
to vacate that portion of the aforesaid plan of subdivision as established a
ten (10) foot easement for utilities between Lots 81 and S2, five (5) feet of
which is on Lot 81 and five (5) feet of which is on Lot 82; and
WHEREAS, no use is now being made or has ever been made of said easement
for any utility or other purpose; and
WHEREAS, the water line serving the subject property and adjoining lots
is l'aid under the south side of &~th Street and not within the easemerm s; and
WHEREAS, the property is served by a septic tank and t~are are no sewer
pipes; and
WHEREAS, the only recorded easement with reference to this property
is one granted ~o Virginia Electric & Power Company which gave the Company an
easement across the front and rear of the said lots but act between the lots; and
WHEREAS, the proposed vacation will not interfere with any rights of any
p~rty having any interest in the subdivision except the parties hereto; and
WH~£.~S, said easement does not constitute a street, alley, or passageway;and
WHE~aS, pursuant to Section 15-766.3 of the Code of Virginia (1950) as
amended, I'~'lcCiinton D. Rice and Elizabeth H.Rice, desire to vacate that portion of the
aforesaid plat of subdivision as shown on the plat by Kennet~ L.Barton dated
December 13, 1960 and referred to above.
NOW, THEREFORE, BE IT ~{ESOLVED:
That the Board of Supervisors do hereby approve the vacation of that
portion of th~ "Plan of Chestervale", plat of which prepared by W.~.LaPrade & Bros.,
is recorded in hhe Clerk's Office of the Circuit Court of Chesterfield County,
Virginia, in Plat Book 8, page 127~ as is shown on the plat by Kenneth L.Barton,
dated December 13, 1960, entitled "Map Showing Property with Improvements thereon
No. 1806 East &&th Street ......... ".
This resolution is conditioned upon and shall become operative when the
aforementioned petitioners shall h~ve executed and acknowledged for record on a
form approved by the Commonwealth's Attorney an appropriate declaration of vacation.
%qhen such a declaration of vacation has been approved, the same shall be recorded
in the Clerk's Office of the Circuit Court and said Clerk shall indicate the
vacation on the margin of the recorded Plan of Chestervale, recorded in the Clerk's
Office in Plat Book 8, Page 127, and shall enter the same on the grantor side of
The General Index of Deeds in the name of the parties hereto.
On motion of Mr. Goyne, seconded by Mr.Hague, it is resolved that the Commonwealth's
Attorney be and he hereby is requested to prepare a contract ',o cover the transfer
of water facilities of Bassville area from the Ettrick Sanitary District to the
County ';a%er System.
On motion of i,'lr.Britton, seconded by Mr. Driskill, it is resolved that the low bid
for the purchase of a dump truck for the W~ter Department be and it hereby is

building which would house the Commission of t~e Revenue, the Treasurer, County
Assessing Office and the License inspector's Office.
On motion of ~r. Britton, seconded by Mr. Driskill, the following ordinance be and
it hereby is adopted:
AN ORDINANCE, to control t~e construction and development of
dedicated streets, highways, public right of way and easements
in 'Chesterfield County, andproviding a penalty for the violation
the reef.
BE IT ~RDAINED BY THE BO;~RD OF SUPERVISORS OF CHESTERFIELD COUNTY,
VIRGINIA.
1. It shall be unlawful for any person, firm or corporation to do
any work of any kind in any street, highway, public right of way, easement
or any other area dedicated to the public use within the County of Chesterfield,
Virginia, without having first made application (accompanied by a plan or
sketch) to the Board of Supervisors, and having received from it a permit to
do the work.
As herein used a "Public right of way"shall be any street,road,
avenue, alley or other right of way providing a means of ingress and egress
to the general public or in which the general public enjoys an easement
in, whet~er opened by dedication, prescription, or otherwise, and whether
or not said public road has been heretofore or shall hereafter be accepted
as a road by the County of Chesterfield, except that this ordinance shall
in no wise affect or b~ inconsistent with the provisions of Title 33 of the
Code of Virginia ~f 1950, as amended, or affect any provision of the County
Subdivision relating to the dedication and opening of any public right of way.
2. Ail construction or repair work of any nature performed by any
individual, firm or corporatimn shall be performed according to the plans
and specifications submitted by the applicant after them ~avebeen examir~d
and approved and by the written instructions of the Board of Supervisors.
The Executive Secretary, however, is hereby vested with the authority to
waive the requirement of formal plans and/or specifications where the work
to be ~one is of a routine nature and is ~o limited in scope as not to
require detailed plans and specifications for its proper execution. The
Executive Secretary shall be notified immediately ypon completion of the
work for which the per, nit was granter in order to enable prompt inspection
of the work done.
SECTION II:
Any person who violates the provisions of this ordinance shall be guilty
of a misdemeanor and shall be punished by a fine not exceeding ~500.00, or
imprisonment not exceeding twelve (12) months, or both.
On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that the
Commonwealth's Attorney be and he hereby is requested to prepare an Ordinance to
allow the County of Chesterfield to adopt Daylight Saving Time.
~ir. John S.Brittingham, representing the Railroad Brotherhood, appaars before
the Board citing facts and figures and requesting the County to oppose the merger
of the SAL,ACL RRs.
On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that this Board
accept an easement from Mr. Parker, President Stratford Hills Center, Inc., which
easement would run from Forest Hill Avenue northwardly the extent of the property
and lie on its eastern boundary line, provided the objections of the County
Engineer and Commonwealth's Attorney are removed.
On motion of Mr. Driskill, seconded by Rir. Britton, it is resolved that this Board
recess for lunch.
Mr. Robert Lloyd, representing Mr.F.G.Dailey, again comes before the Board
requesting the rezoning to General Commercial of the property lying on the east
side ofRt. 1 and ~00 feet south of Sherbourne Road and amends his request, in
writing, for a restrictive zoning to' allow only the use of the land to be rezoned
to be for underground sewage disposal. ~4r. kartin Hutcherson, Attorney,
representing the Bensley Civic AssociatiOn, cites the objections of the people
in the area in that such a use would be an exception and speaks at length for its
opposition, and presents a notarized petition signed by a number of adjacent
prop erty ~ owner s.
Mt. Fred Pease, President of the Bensley Civic Association, speaks in opposition.
Mr. Fred Gray, presents a statement, in writin%, citing the fact that his clients,
Mr. and Mrs. Joles and Mr. and Mrs. Jennings, do not object to the present
reduced request.
Mr. Lloyd agrees to have the Board of Supervisors approve the plans of the
proposed building to be pla ced on the presently zoned area.
Mr. Goyne speaks at length against the request.
Upon consideration whereof, and on motion of Mr.Driskill, seconded by Mr. Britton,
it is resolved that the land as noted on the map filed with the Board's papers
be and it hereby is rezoned to General Commercial with the following resti~ictions:
That the land agreed to by the plat filed with the Board's
papers he and it hereby is rezoned to General Commercial,
with limited conditional use for underground.:sewage disposal.
That the property designated in "red" as C-2 on said plat
be subj~t to the condition that no building shall be
constructed thereon until the exterior design and location
be approved by the Board of Supervisors.
It is here noted that Messrs. Hague, Britton, Driskill and
Homer vote -Yea.
Mr. Goyne votes - Nay.
The Commonwealth's Attorney advised the Board that under Section 15-861 of the
Code of Virginia, four-fifths vote of all members of the.Board is required in
the case where the owners of 20% or more of the land within 5OOfeet or, the
requested rezoning duly sign a protest; and that
';;hereas, this Board is composed of six meffoers, one of which is absent an~ one
of which votes against the requested rezoning, in his opinion the motion does
not carry if the petition meets therequire~ents of the law.
This day again, Mrs. Annie E. Martin, requests the rezoning from Agriculture to
General Commercial of a parcel of land in Dale Magisterial District, fronting
210 feet on the south line of Rt.638 and 285 feet along the east line of Rt.637,
the same request having been deferred from December 1~, 1960, becausm of the
possibility of the circumferential roadway including partly this land.
And it was pointed out that most likely the new circumferential road would
have no effect on the negotiations, it is on mo~ion of Mr. Hague, seconded by
Mr.Driskill, resolved that the aforedescribed parcel of land be and it hereby is
rezoned for General Commercial use.

Miss Dorothy P.Furman comes before the Board requesting the rezoning

Rout e 690.
And there app~ring no one in opposition to this request, it is on

shape fronting ?16 feet on Route 1, and extending eastwardly 1280 feet,
its north boundary being Falling Creek, the northeast part being presently
zoned Industrial.
