Mr.N.A.Vaughan requests a Use Permit to remove gravel from a parcel of landor irregular shape in Manchester Magisterial District, fronting 240 feet on Tablert Street and extending westwardly 202 feet along the south line of the Atlantic Coast Line Railway and cites the fact that it is his desire to remove the gravel on the parcel described to level off the land to provide a ball field for the children of the neighborhood. A delegation of citizens living in the surrounding area questions the procedures but offered no substantial opposition to the request. Upon consideration whereof, and on motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that a Use Permit to minegravel be granted to Mr.N.A.Vaughan on the above described parcel of land, provided the operational plan is approved by the Executive Secretary. 61-22. The Board of Supervisors requests the rezoning from Agriculture to Residential-1 of that parcel of land in Midlothian Magisterial District, bounded by Woodmont on the west, the Southern RR. on the South, Brookwood and Cede~r Crest t{oads on the East, and a line parallel to Rt. l&?, being 300 feet south of same. Thereappearing no one in opposition to this request on motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned for Residential-1 purposes. Mr. Ivy P. Blue,Jr;, Attorney, representing Mt. Wheeler, beer licensees On Rt.#l, comes before theBoard stating that some ruling should be given from the excessive license t~x and loss of business in the County of Chesterfield due to its limitations on the sale of beer and stating further th~c it is proposed to have a test case unless a referendum is called by the Board of Supervisors. At the invitation of the Chairman no Board member wished to introduce an Ordinmnce calling for a referendum. On motion of Mr.Goyne, seconded byMr. Hague, it is resolved that th~ original Civil War C0mm~ttee for Chesterfield be the agent on a contract between the County of Chesterfield and Guided Tour Productions, dated April 12, 1961. On motion of Mr. Goyne, seconded by Mr. Hague, it is resolved that this Board approve the contract with Guided Tour Productions and authorizes the Shairman and Clerk of this Board to sign said contract, which contract calls for the production of a movie of Chesterfield County robe used in conjunction with the Civil War Centennial. Dr. Phil Wagner comes before the Board citing some of the problems of the Health Department in the control of rabies, and cites the need for an ordinance which would requi~re the vaccination of all dogs in the County against rabies. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that an ordinance to amend the Code of the Coumty of Chesterfield, Virginia, Chapter 2, to provide rabies vaccination of dogs; control of unvaccinated dogs; enforcement and control over rabid or suspiciously rabid dogs; and provide penalties for violations Dhereunder, in the County of Chesterfield, Virginia, be introduced and advertised for public hearing. On motion of Mr. Britton, seconded by Mr. Goyne, it is resolved that an ordinance establishing and naming ElectionDistricts in Chesterfield County; changing the boundaries of present election districts and designating the voting places therein, be continued for final determination on May 22, 1961, at 10:00 o'clock A.M., by the Court. Whereas, Dixon Corporation, a Virginia Corporation, James A.Schacht and Virginia L. Schacht, his wife,Richard C.Baird and Pearl W.Baird, his wife, Earl I. Peck and Leslie Y.Peck, his wife, Ellis William Hamm and Jeane Schirer Hamm, his wife, Hines Engineering Company, Incorporated, Lien Creditor, and Archie C. There wa~ read a copy of the School Board's resolution requesting the creation of the County of Chesterfield into a separate School Division and also there was presented a copy of a resolution from the City of Colonial Heights requesting that the City of Colonial Heights be set aside as a separate School Division. On motion of Mr. Goyne, seconded by Mr. Hagerman, it is resolved that this Board approve, ratify and join with the School Board in requesting the State Board of Education to constitute the County of Chesterfield as a separate school division. Mr. Britton abstains from voting. On motion of Mr. Britton, seconded by Mr. Hagerman, it is resolved that this Board authorizes the signing by the School~Board of all contracts with all teachers, principals, assistant principals, instructional supervisors, and all other instructional personnel, for the 1961-'62 session in accordance with budget figures submitted. A discussion arose as to the best method of obtaining water f~r the Southside High School and it was generally agreed that the County Engineer would confer with the School Superintendent and discuss further this problem. On motion of Mr.Hague, seconded by Mr. Hagerman, it is resolved that there be appropriated from the unappropriated surplus of the General Fund the sum of $8000.00 to 6C and $6000.00 to Item 18, and the Treasurer of the County is requested to make said transfers. On motion of Mr. Britton, seconded by Mt. Hague, it is resolved that this Board gives from the unappropriated surplus of the General Fund the sumof $~660.00 to the Capital Outlay Account of the School Board as the County's share of running the water line to the Err,rick Colored School. It is requested that the Schoo~ Board transfer to the Construction Fund of the Water Department the sum of $9660.00, which is the estimated cost of said water line. The Treasurer of the County is requested to transfer the sum of ~&660.00 from the General Fund of the County to the Capital Outlay Account of the School Board. There was read a resolution from the School Board requesting the Board's appropriation of sufficient additional funds to pay the salaries for the re~aining part of the fiscal year 1960-'61 for the two new positions to be filled by the School Board. On motion of Mr. Goyne, seconded by Mr.Britton, it is resolved that this Board author~es the employment of the two proposed Officials and hereby guarantees the salaries for the remaining time in this fiscal year. On motion of M~.Hagerman, seconded by Mr. Goyne, it is resolved that this Board give to the Ettrick Fire Department the sum of $200.00 to finance the sending of five (5) volunteer firemen to Lansing, Michigan for the new fire truck. On.motion of Mr. Britton, seconded by Mr. Goyne~ it is resolved that the price of the code of the County of Chesterfield be set at $10.00 per volume or a total cost of $20.00 per set. On motion of Mr.Britton, seconded by Mr. Goyne, Be it Resolved: -That the Board of Supervisors doth ad6pt and a~prove ~she provisions of Article 2, Chapter 4, Title 27 of the Code of Virginia in its entirety, and from and after this date the provisions thereof shall be effective in this County. This resolution shall certified copy o£ thi~ resolution to the Clerk o£ the Circuit Court of thi~ ¢ount~ and to the Secretary of the various Volunteer Fir'e Departments or companies in this County. On motion of Mr. Britton, seconded by Mr. Ha~ue, it is resolved that the Executive Secretary be and he hereby is authorized to give to the Electrical Examining Board and the Plumbing Board, Volume II of the County Code. It was generally agreed that the Executive Secretary send to the League of Virginia Counties a copy of the minutes. On motion of Mr. Hague, seconded by Mr. Goyne, it is resolved that since numerous complaints have been received from the citizens in the area and apetition signed by approximately 75 people opposing the southern alterna, te of the circumferential road, which road would go close to the Gravelbrook Subdivision, that this Board recommends to the Highway Department that the "A" Alternate being known as the Northern Route, as the best route of the circumferential road, through the Dale District. On motion of Mr.Britton, seconded by Mr. Goyne, it is resolved that this Board authorizes the Chairman, Mr. Horner to meet with the ~'Jlayor of the City of Richmond, the Honorable Claude Woodward, to hear the proposal of the Council of the City of Richmond. On motion of Y~r.Goyne, seconded by Mr. Hague, it is resolved that a petition to improve a road in Jean Court, be ~snd it hereby is received and filed for further consid era ti on. On motion of Mr.Goyne, it is resolved that a letter from the Enon Civic Association thanking the Board of Supervisors for its courtesies,be filed with the Board's papers. WHEREAS, the officials of the Virginia State College and the officials of the State of Virginia have recognized the need for additional fire protection; and WHEREAS, there has been great cooperation on the part of all State Officials involved in this matter; NOW. THEREFORE, BE IT RESOLVED', on motion of Mr. Hagerman, seconded by Mr. Goyne~ that this Board of Supervisors records its heartiest thanks to the officials of the Virginia State College and the State of Virginia, and publicly commends same for aiding the ~ounty in furnishing better fire protection to the Virginia State College end the citizens of the area. Re: Acquisition of the necessary right of way for the construction of a roadway and water line between the Subdivision of Marlboro and Manchester Heights. On motion of Mr. Britton, seconded by Mt. Hague, Be it Resolved: That this Board doth determine that it is necessary and expedient tO acquire the necessary rights of way for the purpose of contructing a roadway and the installation of a water main on Lancers Boulevard Extended, between the Subdivision of Manchester Heights and the ex~nsion of said road in the subdivision of Marlboro. That the Executive Secretary is authorized to obtain an appraisal of said property by J.T.Rose, Sr., Real Estate Assessor, for the County of Chesterfield, and upon receipt of said appraisal ~o make anoffer to the landowner in accordance with said appraisal to acquire the following property by purchase, to-wit: A parcel of land fifty {50) feet in width extending southwardiy from Lancers Boulevard got approximately 125 feet on the property of the proposed Marlboro Subdivision, now or formerly owned by Dan Keane, et als. If the Executive Secretary is unable to obtain the said property by purchase in accordance with said appraisal, then the Commonwealth's Attorney of this County is authorized to institute the necessary proceedings on behalf of the County to acquire said interest and said land from its owner by the exercise of the right of emiaent domain and ~o represent the County in acquiring said property, and pursuant to Chapter 3~2 of theActs of Assembly of Virginia of 195~, the Board doth determine that an emergency exists and its is necessary toenter upon and take possession of the aforedescribed land on the 20th day of July, 1961, and proceed with the construction of a water line and an improved street. The Clerk of this Board is directed to notify the landowner should he be unwilling to sell said property to the County, by registered mail, at least thirty {~0) days before said date, that the County intends to enter upon and take possession of the necessary property on the 20th day of July, 1961, and that the Board will pay the land owner the total amount offered as compensation for the interest to be acquired and the damage to the land owner's remaining property by reason of the taking in accordance with the ~ppraisal made by J.T.Rose, Sr., Real Estate Assessor.
