Summary of Information: The Boulders is a 220-acre development offering a quality working environment with a unique identity offering value, prime location, distinctive architecture, quality construction, exquisite landscaping and responsive on- site management. Based upon the Board's approved Business Appreciation and Recognition Award criteria, the Board gives four awards annually, one each to Large, Medium and Small Business, and one to the Developer of the year. The committee submits The Boulders and CB Richard Ellis, Incorporated for your approval as the recipient of Chesterfield's 2001 Business Appreciation and Recognition Award. SHARON RANDOL, QUALITY COORDINATOR FOR HER CONTRIBUTIONS TO CHESTERFIELD COUNTY WHEREAS, Ms. Sharon Randol is Chesterfield County's Quality Coordinator and joined the county in that capacity in 1995; and WHEREAS, Chesterfield County earned the prestigious United States Senate Productivity and Quality Award in 1994, and Ms. Randol came on board the following year to direct the county's continued commitment to quality and excellence in public service; and WHEREAS, Ms. Randol has been a valuable member of the county's Leadership Group; and WHEREAS, Ms. Randol has shepherded the county's continuous improvement efforts from that point until the present, including attainment of the Award for Continuing Excellence in May 1999; and WHEREAS, among her achievements are leading the TQI Steering Committee and the county to new levels of success in the quality arena; helping to establish the TQI University; and providing recognition and support to the more than 600 graduates from the university; and WHEREAS, Ms. Randol was responsible for overseeing the development, implementation and measurement of two vital citizen satisfaction surveys undertaken to help the county to measure its progress on its total quality improvement journey; and WHEREAS, Ms. Randol helped to conduct an organizational climate assessment in keeping with the county's strategic goal of being the "employer of choice," and WHEREAS, in these and many other endeavors, Ms. Randol has greatly assisted the Board of Supervisors, county staff and the citizens of Chesterfield County to enjoy the benefits of improved customer service and a broad array of other improvements in local government performance; and WHEREAS, Ms. Randol is relocating to Arlington County, Virginia in January 2002. Subject: Consideration on an Emergency Basis of An Ordinance Extending the Period for Leaf Burning County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to adopt the attached ordinance on an emergency basis and to schedule a public hearing for January 23, 2002 to readopt the emergency ordinance. Summary of Information: The County Code permits residents of the County to burn leaves on property where they reside only from March 15 to April 15 from 4:00 p.m. to midnight Monday through Thursday and November 15 to December 15 from 8:00 a.m. on Monday to noon on Friday. Due to the recent drought, Governor Gilmore imposed a leaf-burning ban that precluded County residents from burning leaves during much of the November 15 to D~cember 15 leaf-burning period. As a result, many citizens were unable to take advantage of the fall leaf- burning period. Staff believes that it would be appropriate for the Board to extend the fall leaf-burning period this year until January 15, 2002, to allow residents additional time to burn leaves in the designated leaf burning areas only. Leaf burning dates and times. Subiect: Nominations/Appointments to the Disability Services Board County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to reappoint/appoint members to serve on the Disability Services Board. Summary of Information: The purpose of the Chesterfield Disability Services Board is to provide input to County agencies on service needs and priorities of persons with physical and sensory disabilities; to provide information and resource referral to local government regarding the Americans with Disabilities Act; and to provide such other assistance and advice to local government as may be requested. The Bermuda, Clover Hill, and Midlothian districts are in need of one additional new member. The DSB would like to have Susan Watts (highly recommended by Mrs. Humphrey, Matoaca District) appointed as a member of the Disability Services Board. This vacancy term is from 1/01/02 to 12/31/2002. The terms of Ms. Janice Johnson, Matoaca District representative, Ms. Anne McKenney, At-large representative, Ms. Margaret Connor, At-large representative and Ms. Judy Rossi, Chesterfield County staff representative will expire on 12/31/01. They are each eligible for an additional three-year term to run from 1/1/02 to 12/31/04. The Board of Supervisors concur with these reappointments. Shackleford to serve another term on the Personnel Appeals Board. Summary of Information: The purpose of the Personnel Appeals Board is to conduct impartial panel hearings of employee grievances that have not been resolved at the Supervisor, Department Director, or County Administrator level. On December 16, 1998, the Board of Supervisors appointed Michael M. Shackleford to serve as a member of the Personnel Appeals Board for an At Large appointment, effective January 1, 1999, through December 31, 2001. The Office of the Chief Medical Examiner (OCME) serves as the clearinghouse of information and provides technical assistance to localities that choose to review family or intimate partner fatalities. Between 1996 and 2000, Chesterfield Police report 15 deaths as a result of domestic homicide that could be considered for review by the Fatality Review Team. Summary of Information: The Board of Supervisors has asked Planning staff to review the zoning requirements for accommodating elderly family members within single family homes. Two methods of aiding citizens in the care of elderly were researched -adult day care and Parent/in-law suites. Staff recommends that the zoning ordinance be amended to permit adult day care in the same manner as children's day care. This would allow day care services for five (5) or fewer adults in a private residence without zoning approval. Day care for six (6) or more adults would be permitted with a Conditional Use from the Board of Supervisors. The application fee should be reduced to $250. The staff recommends that no changes be made to the County's definition or processing of zoning changes for single family homes or duplexes because the current ordinance gives considerable flexibility and is equally or more lenient than most of our neighbors. Yes Jacobson [--]No Director of Planning C:DATA/AGENDA/2001/DEC 1901.1/GOK Parent/In-Law Suites SINGLE FAMILY VERSUS TWO FAMILY DWELLINGS Recommendation The zoning ordinance provides considerable flexibility for children to move elderly family members into their single family home without the need for a conditional use for a two family dwelling. No change to the standards that determine what is a single family dwelling versus what is a two family dwelling is recommended. Background There has been much discussion lately about the inability of many elderly residents to continue to maintain their own private homes. Most individuals do not need nursing home assistance and want to maintain as much privacy and independence as possible. The Planning Department receives approximately 250 - 300 requests from families dealing with this matter each year. Zoning regulations concerning parent or in-law "suites" are designed to provide ways for families to take care of relatives within their single family home, but also to discourage the use of single-family homes for duplexes or investment purposes. The zoning ordinance provides wide latitude for families in this situation. The easiest and least costly solution is to move elderly family members into their children's home with minimal modifications to the home. If the existing home is not converted into a duplex (a home with two (2) completely separate living, sleeping, bathroom and kitchen facilities), no zoning approval is needed. The zoning ordinance permits separate living, sleeping and kitchen facilities if the home contains shared bathroom facilities. Separate living, sleeping and bathroom facilities are permitted if the home contains a shared kitchen. An area with a sink and small appliances such as a microwave, hot plate, toaster oven and portable refrigerator is not considered a kitchen which allows the elderly family members to maintain significant privacy and independence without zoning approval. The reasoning behind such regulations is that the home is less likely to be used as rental property in the future if it doesn't have separate kitchens or bathrooms. A County family recently added onto their home to care for an elderly family member. (Floor plan attached) This addition did not require a Conditional Use. Attached is an extract from an article, prepared by County staff for the Community Shopper explaining these opportunities in single family zoning districts. County staff will use this publication to explain options available for our residents. Chesterfield is more flexible than Hanover or Henrico Counties in determining what is permitted in a single family home without special zoning approval. Hanover has a streamlined process and a lower fee if zoning approval is needed (See chart below). For many families, the easiest and most economical solution may be hav- ing a relative who is in need of care move in and share the use of an exist- lng home. This involves minimal cost and will not require any zoning approvals from the county. A homeowner may, however, decide to add a suite, or second-dwelling unit, to their home. In that case, the home- There are many considerations families must make when bringing a loved one in need of care into their home. One decision is whether accommodations, such as a suite, should be added to an existing residence to provide additional space and comfort. The Chesterfield County Planning Department is providing the following information so that citizens may understand both the zoning regulations that are in place for additions, or suites, and so that they are aware that a level of flexibility is designed into the county's Zoning Ordinance. This document is meant to serve as a preliminary guide to assist homeowners, however, it is not the Zoning Ordinance. owner should always consult with the Chesterfield County Planning Depart- ment to determine whether a zoning amendment is required before building the addition. Zoning regulations concerning "parent or in-law suites" are designed to provide ways for families to take care of relatives at home, but also to ensure that single- family homes aren't modified to the extent that they become duplexes. Residential neighborhoods in Chester- field County generally are zoned for single-family homes. The Zoning Ordinance is designed to minimize the impact to families, while also minimizing the likelihood that an added suite transforms a residence into a duplex, which could be used as rental or investment property. Whether a suite for a relative is considered a second dwelling depends heavily on its design and its kitchen and bathroom facilities. A relative may have (CONTINUED ON BACK) Adding suite takes PLANNING (CONTINUED FROM FRONT) separate living, sleeping and bathroom areas without the need of a conditional- use permit if the home has only one shared kitchen; a relative may have sep- arate living, sleeping and kitchen areas if he or she shares bathroom facilities with the homeowner. The reasoning behind such regulations is that a suite is less likely to be used as a rental property in the future if it does not have either a kitchen or a bathroom. The Planning Department defines a kitchen as an area with a sink and any major appliance, such as a full-size refrigerator or range. An area with a sink and small appliances, such as a microwave, hot plate, toaster oven and portable refrigerator (3.5 cubic feet or smaller), is not considered a kitchen. Therefore, such an arrangement could be combined with a bathroom and be in compliance with the zoning ordinance. The zoning ordinance, of course, per- mits a parent or other relative to live within a house with their family. It also permits that relative to have a separate bedroom and bathroom. The ordinance also pertains to persons who are not relatives but are living in a home for the purpose of providing services to a family. Conditional-use requests regarding the additions of suites to homes come before the county eight to 10 times per year. The County's personnel administrative procedures normally provide for employees on military leave to receive 15 work days of paid military leave at their full County pay. After the 15 work days, they are placed on military leave without pay and draw only their military pay. In September, the County Administrator extended the military leave period until December 31, 2001 and paid active duty employees the difference between their military pay and their County pay. This extension, which is consistent with the County's action during the Desert Storm war, was confirmed by the Board of Supervisors on September 26. The County Administrator recently announced his intention to extend the military pay period for this conflict until March 31, 2002. Because of the Board of Supervisors' interest and support we ask that the Board vote to confirm the amendment to the military leave administrative procedure described above as a show of support for all County employees who actively protect America as servicemen and servicewomen during this conflict. Subject: Consideration of Amendments to the Zoning Ordinance Relating to VUSBC/BOCA Code Regulated Uses County Administrator's Comments: County Administrator: Board Action Requested: Board is requested to approve amendments to the zoning ordinance relating to VUSBC/BOCA code regulated uses. Summary of Information: Prior to and through the 1970's the Virginia Uniform Statewide Building Code/Building Officials and Code Administration (VUSBC/BOCA Code) contained only one section that regulated "high hazard", uses. These were primarily uses that posed a threat of explosion or severe fire. The Board of Supervisors concerned that these requirements were not sufficient, amended the Zoning Ordinance to prohibit "high hazard" uses in all office, commercial and industrial districts except in the Heavy Industrial (I-3) district where Conditional Use permitted them. As time passed, the VUSBC/BOCA Code has been amended to recognize a greater range of hazards and now have fire sections, which identify and regulate a range of hazards from medical and environmental to severe fire and explosion. This increased awareness and regulation by the VUSBC/BOCA Code has resulted in many of our industries having some portion of their processes being classified high hazard. Staff has worked with industry over the recent years to gain compliance with the zoning prohibition against high hazard uses by mitigating any attendant hazard. In light of these changes in regulations in the VUSBC/BOCA Code, staff is recommending that any restriction based upon high hazard be removed from the Zoning Ordinance. Staff also reviewed the Ordinance to determine if uses were appropriately classified in terms of hazard or risk to surrounding properties and people. As such, minor changes to permitted locations for tire recapping and laboratories are recommended. These proposed code amendments are attached. The Planning Commission reviewed the proposed amendments at their October 16, 2001, meeting and unanimously recommended adoption. While it is not the practice of the General Assembly to grant local real estate tax exemptions in excess of the amount supported by the locality, state law authorizes the General Assembly to grant an exemption up to the entire amount of local real estate tax generated by the property, notwithstanding the Board resolution or any local Board policy. ARC owns Rockwood Village, an apartment community for low income senior citizens, on 7.4 acres in the Matoaca District. Rockwood Village is located at the intersection of Genito Road and Price Club Boulevard and contains eighty-two residential units. The Assessor's Office reports that the assessed value of the entire complex is $4,542,500 which generates $49,059 per year in County real estate tax. Pursuant to the Board's policy. ARC has submitted correspondence and a site plan certifying that its tax exemption request only applies to a single tax parcel (Tax ID 748-683-1456- 00001), which was specifically created as a subparcel of the entire 7.4 acre parcel, to satisfy the $5,000 real estate tax limit. ARC's application meets the criteria set forth in the Board's policy and the requirements of the Code of Virqinia and the Constitution of Virqinia. Affordable Residences in Chesterfield II Mary Tyler McClenahan Child Care Center Affordable Residences of Chesterfield, II ("ARC, II"),also a non-profit affiliate of the Richmond Better Housing Coalition, is seeking a real estate tax exemption for a 1.62 acre parcel that is the site of a day care center known as the "Mary Tyler McClenahan Day Care Center." The property was developed as part of Winchester Greens Apartments in the Bermuda District. Winchester Green is a housing development operated to meet the needs of low income citizens. The property is leased to another non-profit agency that operates the day care center. ARC II's goal is to provide low income parents living at Winchester Greens and surrounding communities with a clean and affordable day care center. The center serves approximately 141 children. The 1.62 acre parcel is assessed at a total value of $1,230,200 and generated $13,284 in county real estate tax this year. Pursuant to the Board's policy, ARC II has submitted correspondence and a site plan certifying that its tax exemption request applies to a single tax parcel (Tax ID 790-679-7189-00001) which, like the previous request, was specifically created as a subparcel of the entire parcel to satisfy the $5,000 real estate tax limit. Foundation ("Foundation") is a non- profit corporation which provides services to underprivileged citizens of Chesterfield County, as well as scholarships to graduating seniors of Chesterfield public high schools. The Foundation was recently given 0.323 acres located at the intersection of the easterly line of Gill Street and the southerly line of Railroad Street in Chesterfield County. This property is contiguous to a 5.3 acre parcel which received a tax exemption last year by the General Assembly after receiving support from the Board. Prior to the exemption, the larger parcel was assessed at a value of $60,000 and generated $684 in County Real Estate Tax. The Foundation is developing the large parcel into a community park for the use and benefit of the general public and historic Chester community. The Foundation intends to use the new parcel to expand the park's total acreage. In 2001, the smaller .323 acre parcel was assessed at a value of $3,000.00 and generated $32.40 in County Real Estate tax. The Foundation's application meets the criteria set forth in the Board's policy and the requirements of the Code of Virqinia and the Constitution of Virqinia. The parcel will be used for park and playground purposes, and the lot is in compliance with the zoning code. IV. First Tee Chesterfield First Tee Chesterfield ("First Tee") is a non-profit organization which provides golfing opportunities for children by operating an 18-hole golf course at Iron Bridge Park. First Tee has applied for an exemption from personal property tax on its operating equipment, including golf carts, golf clubs, and golf balls. First Tee's tangible personal property has been assessed at $206,565 and will generate $8,179.87 in County personal property tax. Staff has reviewed First Tee's application and reports that it meets all of the criteria set forth in the Board's policy and the requirements of the Code of Virqinia and the Constitution of Virqinia. The golf course is in compliance with all County laws including the building, zoning, and tax codes. As reported previously, First Tee is subject to a zoning condition to provide a 50-foot landscaped buffer between the golf course and an adjacent neighborhood. The planting of the trees and shrubs which comprise the buffer was completed in early December. A public hearing is required for these appropriations. 0 0134 Attachment The objective of the studies is to assure that Lucy Corr can be financially viable without county support while maintaining its reputation for providing high quality nursing home services. The "study' funds will be divided into two areas: (1) updating Lucy Corr's financial proformas to assess whether Lucy Corr is sustainable and capable of paying its debt and operating expenses over the next 3 years and (2) a legal study of the necessary steps and actions necessary to dissolve the Health Center Commission and convert Lucy Corr to a "stand alone" nonprofit not associated with the County government. The financial proforma study will include assessing present market conditions and trends in Lucy Corr's service area. Issues relating to pay scales, compensation, and benefit practices compared to the local market will also be evaluated. Recommendations to improve the revenue resources will also be covered. The legal study will evaluate the steps and costs relating to converting Lucy Corr to a "stand-alone" nonprofit. It will include asset transfer and debt-restructuring issues related to the HUD Section 232 mortgage financing. It will also identify all public and administrative actions necessary for the conversion. The cost of both studies estimated to total $60,000. studies will take 90-160 days to complete. The proposed ordinance provides that the County may bill a flat fee of $100 or a "minute-by-minute" accounting of the actual costs incurred. The maximum amount that can be collected for any one accident is $1,000. Actual costs include all costs of providing law-enforcement, fire-fighting, rescue, and emergency medical services. There are approximately 200 accidents per year caused by intoxicated drivers in the County. In addition, there are approximately 1,300 DUI arrests in the County that do not involve an accident. (b) In determining the "reasonable expense," the County may bill a flat fee of $100 or a minute-by-minute accounting of the actual costs incurred. As used in this section "appropriate emergency response" includes all costs of providing law-enforcement, fire-fighting, rescue, and emergency medical services. Summary of Information: The 2001 General Assembly amended the Virginia Code to allow Chesterfield County to increase the penalties for unlawful parking. Under existing County Code Section 13-41, the penalty for unlawful parking is $15.00. On November 28, 2001, the Board voted to hold a public hearing to consider increasing the penalty for such violations from $15 to $25. This increase is intended to deter unlawful parking in both residential and commercial areas. Funds generated from parking offenses are retained by the County. The penalty for unlawful parking in handicap zones is $100 and was not affected by the new state legislation. Currently, the ordinance only prohibits unlawful parking in reserved handicap spaces at shopping centers and offices. This provides a loophole for some freestanding commercial outlets, such as convenience stores, which has hampered police enforcement of the existing ordinance. Finally, the process for contesting parking notices in Section 13-41 has been streamlined to allow the Treasurer's Office to certify directly to the General District Court the appeal of a parking notice by a citizen. This change is technical in nature and conforms to the procedure outlined in the state enabling legislation. The Police Department, the Treasurer's Office and the Clerk of the General District Court have participated in the drafting process of the amendments and support the changes. Unlawful parking generally. (a) No person shall park a vehicle on county-owned or other public property in violation of any of the provisions of this subsection (a). Any person who receives written notice from a police officer that he has committed any of the offenses listed in this subsection may waive his right to appear and be formally tried for the offense. The waiver shall be effective when the person (i) voluntarily pays $15.00 $25.00 to the county treasurer's office within five days after receipt of the notice or (ii) voluntarily places $15.00 $25.00 in the reply mail envelope on which the notice of violation is printed and mails it to the county treasurer's office so that it is postmarked within five days after receipt of the notice. Such person shall not thereafter be required to appear before the general district court for trial upon the charge offense set forth in the notice. The chief of police shall enforce such regulations pursuant to the requirements of this section. As agent for the county, the chief of police shall, when appropriate, provide for towing and removing motor vehicles in violation of this subsection pursuant to the authority set forth in Code of Virginia, §§ 46.2-1231--46.2-1233, as amended. On or in any street, alley or parkway for the purpose of selling or offering the vehicle for sale or rent. Summary of Information: Chesterfield County Public Schools (CCPS) receives grants from various funding sources each year. The FY02 School Board Approved Financial Plan included an appropriation of $14,684,600 and 272.2 full-time equivalent (FTE) positions in the School Grants Fund for twenty-nine (29) grants plus Grants Administration. In addition, the School Board applies for additional grants during the year to enhance the instructional program. CCPS staff has written three new grants and twenty-five (25) existing grants have received awards for FY02. One grant, Title IX 21s: Century Community Learning Grant for $314,600 with one FTE was not approved for FY02. These revisions need to be reflected in the School Grants Fund for an additional appropriation of $1,887,347. Crestwood Bicycle Safety Grant $~,749 CCPS received notification from the State Department of Education of a grant award for Crestwood Elementary School for bicycle safety. Funds have been received from the State and the funds need to be appropriated to purchase the bicycle shed that was requested in the grant proposal. No local funds are involved. Virginia Advisory Education of the Gifted Committee 5,000 CCPS has been requested to serve as fiscal agent to administer activities for the Virginia Advisory Education of the Gifted Committee in FY02. The State has awarded CCPS $5,000 for anticipated expenses relative to this committee. These funds need to be appropriated in order to correctly account for these expenditures. Summary of Information: In 1996, the Board entered into an agreement with the School Board to consolidate school grounds maintenance under the County's Parks and Recreation Department. The County maintains most exterior property such as ballfields, signs and playground equipment while School Board personnel maintain interior courtyards, parking lots, sidewalks, security and flashing lights and electrical and plumbing facilities. Although these maintenance crews of the County and School Board are performing similar maintenance duties at the same location, they are subject to different rules governing background checks. School personnel are required by state law to undergo extensive background screening and are subject to termination or disciplinary action if they have ever been convicted of a felony or a Class 1 Misdemeanor. Even though Parks and Recreation maintenance crews have access to school children that equals or exceeds that of school personnel, they are currently subject to less stringent employment standards than the School Board employees. Staff recommends amending the County Code to require background checks so that Parks and Recreation maintenance crews at the schools and School Board employees are treated similarly. Steven L.
