Request: Amend 3.1-796.93.1 (D) (2) of the Code of Virginia to allow localities to accept surety bonds, cash bonds, or letters of credit in the amount of $50,000 in lieu of liability insurance for control of dangerous or vicious dogs. Problem Definition: Citizens have difficulty obtaining at a reasonable cost the insurance coverage required by the Code. Chesterfield citizens requested exemptions to the Code requirements due to difficulty in obtaining insurance and requested alternatives which allow compensable damages if an incident occurs. Board of Supervisors request. To Be the Safest and Most Secure Community_ of its Size in the USA 2. Request: Amend 58.1-3735 of the Code of Virginia to allow the Board of Supervisors to delegate authority to issue summons for violation of the un-licensed and inoperative vehicle code to other county staff as appropriate. Problem Definition: Responsibility for the enforcement of the County Code relative to un- licensed and inoperative vehicles was given to the Zoning Enforcement staff in the Planning Department to facilitate pro-active inspections and efficient enforcement of violations. Because these inspectors cannot issue summons for violations they must request a summons from the Magistrate and the Police Department must then deliver the summons. The proposed change would eliminate three to four weeks in the enforcement process. Planning Department request. Tax Exemption Requests 1. Richmond Animal League- real property at 11401 International Drive. In 1997 the real estate taxes on this property were $4,918.20. The corporation is a 501(c)(3) corporation and provides temporary shelter for stray and abandoned dogs and cats. 2. Chesterfield Alternatives- property located at 4104 Coastline Circle, Chester Station Subdivision, 10713 Ridge Run Road, Great Oaks Subdivision, 200 North Pinetta Drive, Brighton Green Subdivision. In 1998 the real estate taxes on these properties totaled $3073.68. The corporation is a 501 (c) (3) corporation and provides housing for Chesterfield citizens with mental disabilities. 3. Richmond First Tee-personal property to be located at 6400 White Pine Road. Support / Oppose Requests 1. Support an amendment to the Appropriations Act which increases funding for H.B. 599 allocations for localities with Police Departments. Chesterfield's allocation has been frozen at $1.8 million per year since FY92. If ll.B. 599 allocations had kept pace with growth in the state budget as specified in the Code of Virginia, Chesterfield's allocation would be approximately $4.1 million, or an increase of $2.3 million over the current statewide allocation of $67 million. However, the Code contains a provision which allows the H.B. 599 allocation to be capped at the dollar level specified in the Appropriations Act. County Administration and Police request. 2. Support the legislative requests of the Coalition of High Growth Localities. The Coalition has endorsed the following five legislative items: authority to assess impact fees and continue to allow localities to accept cash proffers; authority to enact an adequate public facilities ordinance; passage of clarifying amendments to the vested rights statute approved by the 1998 General Assembly; continued and expanded school construction funding assistance from the Commonwealth; continue to allow localities creative use of special exceptions to deliberately review large subdivisions before approving them (Fauquier County-H.B. 1362). County Administration request. 3. Support legislation increasing the $2 for Life Program to $4 for Life. The 1998 General Assembly passed H.B. 951 and S.B. 177 which increased the vehicle surcharge used for emergency medical services purposes from $2 to $4. Governor Gilmore vetoed both bills and the vetoes were not overridden. The fiscal impact on Chesterfield is approximately $90,000. Fire Department request. 4. Support the passage of Volunteer Fire and Rescue Retirement legislation as a state funded initiative if it is introduced in the 1999 session. Legislation was introduced in the 1998 General Assembly to create a voluntary defined contribution retirement plan for certain eligible volunteer firefighters and rescue squad workers to be administered with the assistance of the Virginia Retirement System. The plan was to be funded by the state and the volunteer members. H.B. 437 passed the House but did not pass the Senate. Fire Department request. 5. Support an amendment to the Appropriation Act which fully funds existing Compensation Board staffing standards for Clerks of Circuit Court Offices, creates additional positions in Clerk's offices as a result of the increased funding, and hold harmless those localities whose staffing currently exceeds standards as a result of Compensation Board allocations. Management Services request. 6. Support legislation to amend the Virginia Tort Claims Act to provide civil actions may not be brought against local governments, employees or appointees based upon the failure of a computer, software program, database, network or information system to interpret, produce, calculate, generate or account for a date which is compatible with the Year 2000 date change. The state granted this immunity to all state agencies in the 1998 session of the General Assembly. County Attorney request. 7. Support an amendment to the Appropriation Act which brings funding for Juvenile Detention Homes (both operations and capital contributions) to fifty percent. Human Services request. 8. Oppose any efforts to limit local government exemptions under the Freedom of Information Act. County Attorney request. 9. Oppose any legislation to impose a per ton waste fee on local governments to fund state environmental clean-up efforts. The fiscal impact on Chesterfield of draft legislation released recently by Senator Bolling from Hanover is about $40,000 each year and will rise as tonnage disposed increases. Management Services request. Future Legislative Initiatives These items are not recommended for introduction in the 1999 session of the General Assembly but will be held for a future legislative session: 1. Clarify provisions in the Code of Virginia regarding the printing and distribution of fact sheets for proposed bond referenda. 2. Reconcile language in section 5.4 of the Chesterfield County Charter referencing the county's appropriation ordinance with language in section 5.3 of the charter referencing the county's appropriation resolution. 3. Exempt local governments from the requirement of providing a point of service health care provider if the local government only offers HMOs to their employees. Subject: Unified Pay Plan Study, including the County Administrator's recommendations on salary compression increases. County Administrator's Comments: County Administrator: ~ Board Action Requested: Implement the new Pay Plan and approve the County Administrator's recommendations and actions as outlined below. Summary of Information: In a work session on October 14, the County Administrator presented recommendations on implementing a uniform pay system and a plan to address salary compression. The County Administrator's recommendations and the cost of this recommendation is outlined in Attachment I. At the conclusion of the work session, the Board requested that the item be presented for consideration at the October 28 meeting. Additional information was requested regarding the cost of two alternative proposals for addressing salary compression. The alternative proposals are: (1) April, 1999 increase salaries of full time employees by $100 for every year of County service, and April, 2000, a similar $100 increase; and (2) similar monetary adjustments as above, effective July, 1999, and July, 2000. The estimated cost of the two proposals is outlined in Attachments II and III. The proposal for $100 in April, 1999 and $100 in April, 2000 would cost an additional $300,000 in FY2000 and an additional $1.4 million in FY2001, when compared to the County Administrator's recommendation. The proposal for the $100 adjustments effective July, 1999 and 2000, would cost the same at full implementation as the $100 in April, 1999 and April, 2000 proposal. Summary of Information: On September 23, 1998, staff reviewed FY98 Results of Operations with the Budget and Audit Committee. As oualined in the attachment, undesignated ending fund balance was primarily comprised of approximately $8.6 million in unspent appropriations and a revenue shortfall of approximately $3.8 million (both figures are net of reserves), resulting in a net addition to fund balance of approximately $4.8 million. Staff recommends that the following actions be taken with respect to undesignated ending fund balance. Summary_ of Information: ~ For the past ten and a half years the Commonwealth's Attorney's Office has received no increase in operating expenditure funding each time a new Assistant Commonwealth's Attorney has been hired. These shortages have been absorbed in the overall budget over the years but have now placed tremendous stress on the budget. Continuing legal education is mandatory for all attorneys and monies for this purpose have not been provided for FY99. Ranisey, County Administrator Date: September 3, 1998 Subject: Request for Budget Increase On August 5, several of my staffmet with you to discuss your request for additional operating funds. At the conclusion of the meeting, you agreed to withhold submitting a request to the Board until October when financial results for FY98 would be known. I appreciate your consideration. However, I thought it important to communicate to you what my position on the issue will be to the Board of Supervisors. Over the past ten years, your total budget has grown by almost 300%, from $465,000 in FY87 to $1.79 million in FY99. Similarly, your personnel budget has grown as your staff'has increased fi'om 12 to 31 positions. You now have 19 full-time attorneys and 13 full-time support personnel, almost one support person for every two professional positions. Of your full-time support personnel, one is devoted exclusively to budget/financial-related issues and the other to automation issues. Your office is unique in this regard; no other general fund'department of similar size is in a position to utilize full- time staff in this manner. One concern you have expressed is that the County has not kept pace with the growth in your~ over the years. However, in FY87, the county supplement for your~ce was approximatel~ your total budget; for FY99 the supplement will be approximatel ~y{,~ofyour total budget. Additionally, in FY98, the Board approved an additional $35,500 for furnishings and renovation costs in your office. At the end of FY98, your department's budget was overspent by $132,000 (prior to adjustments). As a result, the County had to provide an additional supplement/appropriation from another general fund department to cover this shortfall. As you are well aware, the allocation/spending ofyour annual appropriation is within your discretion. Quite frankly, it appears that much of the overspending is a direct result of recent reclassifications and special salary adjustments. These decisions have limited your flexibility to resolve your budget problem short of requesting a special appropriation from the Board. However, it is critical that every manager be committed to making whatever budgetary decisions are necessary to prevent overspending. Su~ect: Streetlight Installation Approvals County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of Streetlight Installations in the Dale and Matoaca Districts. Summary of Information: Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Virginia Power for each request received. When the quotation is received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: Streetlights should be located at intersections; There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection, or 400 VPD if the requested location is not an intersection; Petitions are required and should include 75 % of residents within 200 feet of the requested location and if at an intersection, a majority of those residents immediately adjacent to the intersection. The Board, upon presentation of the cost quotation may approve, defer, or deny the expenditure of funds for the streetlight installation. If the expenditure is approved, staff authorizes Virginia Power to install the streetlight. A denial will cancel the project and staff will so notify the requestor. A deferral will be brought before the Board again when specified. The purpose of the study was to analyze the benefit of video arraignment and project any associated costs as well as identify any cost savings. The study found that positions could be reallocated from security or transportation areas to other areas within the department. The study recommends the implementation of video arraignment in Chesterfield County. The Sheriff's Office has submitted a Capital Improvement Program request for the installation of video arraignment within the parameters of the courthouse and jail. In addition, the Department has researched several alternatives for funding which is the basis for this request to the Board. The Department requests approval to apply for a Department of Criminal Justice Services Grant which will provide hardware for six permanent video arraignment stations with the General District and Circuit Courtrooms, one portable unit for the Juvenile and Domestic Relations Courts, two portable units for the Colonial Heights Court and various equipment and communication needs. This project is a joint venture among various departments and funding will be shared accordingly. This grant is a one-time, non-renewable grant, which will provide funding for one-time capital costs associated with video arraignment. Video arraignment will be established in all four General District courtrooms and two Circuit courtrooms; one portable unit will be provided in the Juvenile and Domestic Relations Courthouse, and two courtrooms in Colonial Heights. Ongoing operating costs are approximately $26,200 which will provide ISDN line usage charges, fax machine papers and IST computer support fees. If this grant is approved in FY99, funding would be needed to provide hardware in the new Juvenile and Domestic Relations courthouse. Three instructional aides were added for this fiscal year and the 0.5 FTE part-time bus driver for this program was made full-time (+0.5 FTE). The FY99 budget was estimated at $1.9M; however, CCPS received State Superintendent's administrative memo #57, dated August 21, 1998 indicating a grant award of $1,864,832, a decrease of $35,168 from the FY99 Approved Budget. FY99 Title II Grant 16,974 0.0 The Eisenhower Grant provides funding to localities to improve the professional skills of elementary and secondary teachers primarily in math and science. Summary. of Information: The original 60/147 Drainage District was established by the Board of Supervisors in 1975, and Stonehenge, Phase III was designed in late 1995 and approved in early 1996. At that time, the new golf-course management personnel were not comfortable with the drainage plans because a large portion of the project paralleled the golf course and crossed one fairway. The plans were then put on hold. Golf course management has since changed personnel and is now willing to move forward with Phase III of the project. During preliminary meetings with golf course management, Stonehenge Association representatives, and affected citizens, it was determined that plan revisions are needed to reflect stream changes through the area, addition of a golf-cart crossing, adjacent changes made by residents, and permit obtainment from the U. S. Army Corp of Engineers. The project is located within the 60/147 drainage district and will be paid for with developer contributions (no local funds are involved). Staff Recommendations: Recommend that the Board of Supervisors appropriate $10,000 from the 60/147 drainage district account for design revisions of Stonehenge, Phase III, and authorize the County Administrator to enter into a contract with Timmons for the design of construction plans and associated work in an amount not to exceed $9,000. Board Action Requested: Summary_ of Information: "Operation Save our Children" is a collaborative project of the Chesterfield new car dealers, Chesterfield Alliance for Drug Rehabilitation and Education (CADRE) and Children At Risk Today (C.A.R.T.). Its purpose is to educate the community about safety issues related to driving. The Chesterfield new car dealers are distributing a packet of literature provided by CADRE and C.A.R.T. to customers purchasing new and used vehicles. The literature contains information about underage drinking, illegal drug use, impaired driving, child safety seat use and recent laws relating to automotive safety. The dealers are also planning special events in November and December to educate the community about proper installation of child safety seats and about impaired driving. Summa~ of Information: On April 22, 1998, the Board of Supervisors adopted amendments to the Northern Area Land Use and Tran ~sportation Plan by adopting the Eastern Midlothian Plan. As part of this Plan, the Board adopted Zoning Ordinance amendments to regulate uses that may contribute to decline in the area such as bondsmen, flea markets, motor vehicle consignment lots, pawnbrokers and occult science operators. In reviewing the County's regulations for these professions, staff and the Planning Commission realized that there were some inconsistencies between the definitions and treatment of these professions by the zoning, business license and police permit chapters of the Code. Therefore, the Planning Commission asked staff to review these chapters and conform them as much as possible to the Zoning Ordinance. A two member committee of the Planning Commission was formed (Messrs. Shewmake and Cunningham) to work with staff. Staff members from the License Inspector's Office, the Commissioner of Revenue's Office, the Police Department, the Planning Department, and the County Attorney's Office drafted and reviewed the proposed changes and provided them to the Committee. The Committee held meetings with Planning and County Attorney's Office staff to review the proposed amendments. Restriction on keeping inoperative motor vehicles; removal of such vehicles. (a) It shall be unlawful for any person, firm or corporation to keep, except within a fully enclosed building or otherwise shielded or screened from view by a method provided below, on any property zoned A, R, R-TH, R-MF, O and C, as those zoning classifications are defined in chapter 19, any motor vehicle, trailer or semitrailer, as such are defined in Code of Virginia, § 46.2-100, as amended, which is inoperative. The only permissible methods of shielding or screening an inoperative vehicle outside a fully enclosed building or structure shall be as follows: (1) A form fitted, defect-free cover specifically designed and manufactured to completely shield the motor vehicle, trailer or semitrailer from view; (2) A hedge or dense evergreen landscape planting not less than six feet high and ten feet wide that is neat and well maintained; and (3) An opaque masonry wall or treated wood fence of a stockade, board and batten, panel or similar type design in good repair of not less than six feet high and ten feet wide, provided such wall or fence meets the restrictions set forth in chapter 19. (b) Notwithstanding subsection (a) above, not more than one motor vehicle, trailer or semitrailer, as such are defined in Code of Virginia, § 46.2-100, as amended, which is inoperative may be kept outside of a fully enclosed building and shielded or screened from view pursuant to subsection (a)(1), (2) or (3) above on any property zoned A, R, R-TH, R-MF, MH-1, MH-2, O and C as defined in chapter 19 if the vehicle is kept in the rear yard of the property. The rear yard shall be the yard extending between the rear line of the lot and the nearest line of the rear of the main building on the lot. (c) The owners of property zoned A, R, R-TH, R-MF, MH-1, MH-2, O and C, as defined in chapter 19, shall remove from their property any inoperative motor vehicles, trailers or semitrailers which are in violation of this section, within ten days after being given notice by the county to remove such inoperative motor vehicles, trailers or semitrailers. Notice to remove shall be deemed given when mailed by certified mail, return receipt requested, to the same address to 1314:23507.1 1 9/11/98 3:03 PM which real estate tax bills are mailed to such owners of property. If the owners of the property do not remove the inoperative motor vehicles, trailers or semitrailers from the property within ten days after being given notice to do so by the county, then the county, its agent or employees may remove the inoperative motor vehicles, trailers or semitrailers from the property. After giving an additional ten days' notice to the owners of the vehicles, the county may dispose of such motor vehicles, trailers or semitrailers. Notice of disposal of such motor vehicles, trailers or semitrailers is given when mailed by certified mail, return receipt requested, to the last known address of the owner of the inoperative motor vehicles, trailers or semitrailers. (d) The cost of removal and disposal of the inoperative motor vehicles, trailers and semitrailers shall be chargeable to the owners of the property from which the inoperative motor vehicles, trailers and semitrailers were removed and to the owners of the inoperative motor vehicles, trailers and semitrailers. The costs of removal and disposal may be collected in the same way that taxes and levies are collected. Every cost authorized by this section against the owner of the property from which the inoperative motor vehicles, trailers and semitrailers was removed shall constitute a lien against that property. The lien shall continue until payment of the assessed costs have been paid. (e) As used in this section, the term "inoperative motor vehicle" means any motor vehicle which is not in operating condition;: or which for a period of sixty days or longer has been partially or totally disassembled by the removal of tires and wheels, the engine, or other essential parts required for operation of the vehicle or on which there are displayed neither valid license lat alid i ctio de al --'-:-'- '--- '- .... In addition, each application shall be reviewed by the county departments charged with enforcing the business license, zoning, building, plumbing, utility, health, electric and fire prevention codes, as needed~ and no permit shall be issued if the applicant's business in the county does not comply with these and any other applicable county or state laws or regulations. (e) Any changes in the ownership or principals of the business entity to which the permit is issued or in the managers of the business itself will automatically make the permit void. Such changes shall be reported to the chief of police or his designee, and a new application ma_v be submitted for review. (b) If the chief of police or his designee revokes a permit, he shall notify the permittee in writing of such action, the reasons for the revocation, and the permittee's tight to request a hearing. To receive a heating, the permittee must make a written heating request which must be received by the chief of police, or his designee, within ten days of the date of the revocation notice. If a timely heating request is not received by the chief of police, or his designee, ~ uay~ ut m~ ~ ~vu~auun notice, the ~ decision shall be final. If a hearing is properly requested, it shall be held within ten days from receipt of the hearing request. The heating shall be presided over by the chief of police or his designee. The filing of the petition with the circuit court shall not postpone the effective date of the decision of the chief of police except by order of the court.
