For the purpose of this Ordinance,~ a dog shall bc deemed"to run at large" while roaming, running or self huntin off the property of its owner or custodian and not under its owner's or custodian's immediate control. The word "owner" as used in this Ordinance shall include any person having a right of property in such dog, and any person who keeps or harbors such dog, or has the dog in his care, or who acts as its custodian, and any person who permits a dog to remain on or about any premises occupied by him. No person shall be charged with a violation of this Ordinance unless the complainant shall appear before a justice of the peace or other officer authorized to issue criminal warrants and make complaint thereof and request a warrant to be issued charging such violation. Upon the issuance of such warrant, the police officer executing the warran may summons in writing the person charged in warrant to appear before the. No person, firm or corporation shall install, alter or repair any connection intended to connect the sewerage facilities of any premises covered by the provisions of Contract between the City of Richmond and County of Chester£~Al~, dated April 30, 1956, until such person, firm or corporation complies with theterms of this O~dinance. Sec. 2. Whenever any person, firm or corporation covered by the provisions of the aforesaid contract, desires to connect the sewerage facilities of such premises to the facilities operated by the County, he, they or its, duly authorized representative, shall make application to the County on forms supplied by the County and simul~taneously make application to the proper authorities of the City of Richmond. Before any work shall commence, applications must be a~proved both by the County and City of Richmond and payment made of the requisite ~ees as set forth in this Ordinance in advance to the proper' authorities. Sec. 3. All connections to the facilities of the County shall be made in compliance with all rules and regulations adopted by the City of Richmond arid County of Chesterfield covering the manner of installation, size and material of conn. ctions, the inspection and approval thereof, including the payment of any fees charged by the City of Richmond. :_;ec. ~. The ownership of connections between premises and main · sewers, including those portions located within the rights of way of public or private streets, shall be vested in the owners of such premises. The Board of Supervisors shall not be responsible for the operation and maintenance of such connections. The Board of Supervisors shall not be responsible for the repair of any connection unless the necessity for such repair can be proven to be caused by or tohave been caused by the improper functioning of the main sewer to which it is conr~ectedo Sec. 5. ~11 owners of premises who have connected, or who shell hereafter connect, the sewerai~e facilities of such premises to the sewer mains of the County shall pay for the use of samela monthly charge equal to 100)~ of the monthly water bill, with a minimum charge of $5.OO per mont~ for each individual water connection, facility or user, located within th~: area covered by the aforesaid contract. The County may alter the servicecharges from time to time as the Board of Supervisors ~ay, in its discretion, determine to be neo~ssary, Upon request of the owner of p~.emises, the County will bill the tenant of the owner for the service rende~i.ed,providing the t~.nant depgsits with the County the sum of ~25o00. The owner of the premises wher~ the s ewer2ge facilities of the County are connected to, shall be liable for tlc payment of all charges made for service reordered to ~uch premises until such owaer makes application for discontinuance of service on forms furnished by the County. The Utilities Department shall keep accurate records of all premises and owners which are ~erved by the sewer facilities of the County' and bills will be mailed to the owners or tenants as directed by the Board of Supervisors. Sec. 7. The charge made for sewer ser¥~ce, if unpaid shall be a lien oh the real estate served by such sewer and the owner of such premises shall be li~ble for the ~aymant ~f such charges. No premises and buildings shall be used for any purpose listed in the foregoing paragraph, until an application in writing is filed ~zith and a conditional use permit has been granted by the Board of Supervisors, after a public hearing, and such operations conducted in conformity with the following conditions: 2. Ail equipment, buildings an~ premises used for such purpose shall be constructed, maint~lined and operated in such a manner as far as practicable, as to eliminate noise, dust or vibrations, which are injurious or annoying to persons living in the vicinity. B. That the excavations shall be oonfined to areaz distant at least 100 feet from any and all adjoining proper~y lines in any Residential, Business or Agricultural District and distant at least 200 feet from any dwelling or any and all property lines of any platted subdivision except that excavations may be conducted within such limits provided the written consent of the owners of such adjoining properties is secured. G. That the excavations shall be confined to areas distant at least 200 feet from the right of way line of any existing or platted street, road or highway, except that excavations may be conducted within such limits in order to reduce the elevation thereof to conf6rm to the existing or established elevation of the adjoining or platted street, road or highway. D. That any building containing power-driven or power-producihg~ machinery or equipment shall be distant at least 600 feet from all adjacent property in any Residential, Business or Agricultural,District, or the right of way lines of any existing or platted street, road or highway. g. That all roadways on,and all vehicular entrances and exists from, the private properties on which such operations are conducted to any public roads shall be located to secure safety, to lessen congestion and to facilitate transportation and shall be so maintained as to eliminate any nuisance from dust to neighboring properties. F. That a plan of operation shall be submitted for approval to the Board o~' Supervisors which shall provide in all respects for the adequate safeguarding and protection O~fnOthe~ nearby interests and the gene~'al public health, safety, convenie ce, prosperity and welfaz'e and which shall include a satisfactory plan and program for restoring the land to a safe and usable condition, so as to reduce the peaks and depressions, minimize erosion due to rainfall, and be in substantial conformity to the land area immediately surrounding. G. ~hat whenever the permit issued by the Board of Supervisors, shall have expired or whenever the operation of any gravel Dr sand pit or excavation shall have been discontinued for any period, exceeding 12 consecutive months, then all plants, buildings, structures (except fences), stockpiles and equipment shall be entirely removed from the property, and the property shall be restored to a safe and usable condition, a s required by subsection "F" above. H. If the property to be used for such excavation is within ~,100 feet of any residential zone, it shall be enclosed along the exterior boundaries the~~eof as excavation progresses by a fence as prescribed by the Board of Supervisors. I. No excavation shall take. place, .or plant operalted on any property except between the hours of ?:00 a.m. and 9:00 p.m., except in case of a public emergency, or whenever any reasonable or necessary repairs to equipment are required to be made. The provisions of paragraph "A" shall also apply to this paragraph. J. That a bond or other suitable guarantee be furnished prior to undertaking any work under the permit guaranteeing the faithful performance of all of the applicable requirements set out in this ordinance. K. That whenever the permit issued by the Board of Supervisors shall have expired, such permit may be renewed by said Board after a public hearing, provided an application is filed within 60 days before any expiration date with the said Board of Supervisors as provided herein in case of original application and provided the applicant is carrying out the requirements of his existing permi't in good faith. L. The provisions of this section shall not prohibit the filing of an application for, or the granting of, a special use permit for such use subject to no conditions, or to less or different conditions than those specified in this section. Goyne, it is resolved that the C and Clerk of this Board be authorized to sign a waiver of deed restrictions on a lot owned by the County for the installation of a water tank in the subdivisio] of Bon Air Court.
