Robert Lloyd, Attorney, appeared before the Board requestin~ that some further consideration be given to the roao to the Isaac Walton Park, which road is known as the Railey Hill Road,and presented a deed to certain rights of way along said road, which covers the entire length with the exception of the propertv owned by Mr.Benson. Upon consideration whereof, and on motion of Mr.Britton, seconded by ~ir.Hagerman, it is resolved that the deed presented by M~. I~oyd be and it hereby is acceoted. (2) The provisions of this section shall apply to any person who has a definite place of business or maintains mn office in the County and to any person who maintains an office or has a definite place of business outside the County and solicits or engates in said business in the County. Where such other locality levies a local license tax and the same is measured by volume, the volume o~ which the tax shall be computed shall be the volume attributable to the business in such other locality. Ail volume attributable to the business in any such other locality which levies a local license tax thereon shall be deductible from the base in computing the local license tax by volume imposed herein. If any such person engages in said business in the County and he has no definite place of business or office either within or without the County, then the local license tax imposed herein shall be computed on volume of business done in the said County. Every person engaged in said business which is mobile in characDer, where principal and essential acts constituting the doinG of such business takes plac~ in Chesterfield <County, although the person may have a definite place of in another locality, shall pay a license tax as provided herein. On motion of ~ir.Brit~on, seconded by Mr. Hagerman, it is resolved that this Board grant a variance to Annie Bell Woolridge for the construction of a home on a pri2ate road, leading southwardly from the Granite Road, just west of the Stratford Hills Shopping Center. On motion of Mr. Hagerman, seconded by Mr.Britton, it is resolved that a variance requested by Mr. Louis Plakas b~ and it hereby is denied. On motion of Mr. Goyne, seconded by Mr.Driskill, it is resolved that Mr. Stanley Hague be and he hereby is appointed Shairman of a Committee to make the r~cessar arrangements for a reception at the new office building, at which time the office building will be shown to allcitizens of the County. And be it further resolved that the Chairman of this Committee shall have the right to choose his own committee to work with him in the preparation of said plans. And be it further resolved, that Mr.Hag~e be requested to present to the Board of Supervisors a proposed plan for this ceremony. On motion of Mr.Hagerman, seconded by Mr. Dri,~kill, it is resolved that the Purchasing Agent be and he herebyis authorized to purchase 500feet l-l/2" hose for the Ettrick Fire Department. On motion of ¥~.Goyne, seconded by Mr. Driskill, it is resolved that this Board of Supervisors be appointed as a Committee to view the respective sites of two zoning cases on the Toll Road, which had been deferred to December 10, 1958. On motion of Mr. Driskill, seconded bY Mr. Goyne, it is ~resolved that a communica- tion from the Bon Air Community Association recording its heine in', favor of fluoridation of the Chesterfield County water supply, be, and it hereby is received and filed with the understanding that this letter will be reviewed when the fluoridation of the County water supply is considered by ~hesterfield County authorities. On motion of Mr.Britton, seconded by Mr. Driskill, i6 is resolved by the Board. of Supervisors of Chesterfield County that this Board doth recommend to the State Highway Commission that interstate Rt.6& to the west of Richmond be located over the new proposed Route U.S.360 or parallel thereto. And be it further resolved that a copy of this resolution be sent to the Chairman of the State Highway Commission. On motion of Mr.Driskill, seconded by Mr. Hagerman, it is resolved that the following ordinance be and it hereby is adopted: An Ordinance relating to the appointment, powers and duties of ~ dog warden and deputy dog wardens and for the collection and disposition of dog license taxes, and punishment for violation of same. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY: 1. The enforcement of the dog laws shall be vested in a'dog warden and such deputy dog wardens as may be appointed. Deputy dog wardens shall have all the powers and duties of a dog warden. The dog warden and deputy dog wardens shall have all the powers and duties of a game war~en in the enforcement of the dog laws. 2. Such officers shall be appointed by the Judge of the Circuit Court pursuant to Chapter 29-184.2 of the Code of Virginia of 1950, as amended, and such officers shall have exclusive jurisdiction as to the enforce~ent of the dog laws in said County. Such officers shall be paid such compensation as the Board of Supervisors may prescribe, and shall be under the supervision of the Board of Supervisors or its Agent. 3. Before entering upon the discharge of his official duties, the dog warden and each deputy dog warden, shall qualify, giving bond with some guaranty company, authorizing to do business within this State, as surety, in the penalty of one thousand dollars, payable to the Commonwea~ of Virginia, with condition that he will faithfully perform all of the duties enjoined upon him by law. 4. It shall be unlawful for any person to own a dog four months old or over, unless such dog is licensed, as required by this ordinance. Dog licenses shall run by the calendar year, namely, from January first to December thirty-first, inclusive, and the licensm tax shall be payabl at the c~ice of the Treasurer and shall be as follows: Male - For a male dog, One Dollar. Unsexed female-For an unsexed (successfully spa~ed) female dog - One Dollar. Female - For a female dog, three dollars. Kennel - for twenty dogs - For a kennel of twenty dogs, Fifteen dollars. Kennel, for fifty dogs - For a kennel of fifty dogs, twenty-fi~'e dollar s. 5. The funds collected for dog license taxes shall be paid into a speci fund and may be disposed of as provided in Section 29-184.2 of the Code of Virginia of 1950, as amended. 6. Any person who shall make a 1f~!.$9 statement in order to secure a dog license to which he is not entitled, shall be fined not less tha~ five dollars sot more than one hundred dollars. Any person convicted of failure to pay the license tax prior to February first of any year, or as otherwise provide~ in this ordinance, on any dog owned by him, shall be fined not le ss than the amount of the license tax required by law to bepaid on such dog, nor more than ten dollars, and be required to obtain proper license forthwith, and u~less the fine and license tax is immediately paid, the trial court shall order the dog killed by the dog warden or some other officer, but the killing of such dog sh~ll not relieve Zts owner of the payment of the fine and the license tax already due. Any person who pmeeents a false claim or received any money on a false claim under the provisions of Section 29-202 of the Code of Virginia, 1950, shall be fined not exceeding one hundred dollar or imprisoned in jail not exceeding three months or both. Any violation of this ordinan~'e, for which specific penalty is not provided shall be a misdemeanor. An emergency existing, this ordinance shall be in full force and effect upon date of its passage. On motion of ~r. Hagerman, seconded by Mr. Driskill, it is resolved that the minutes of October 14 and 21, be and they are hereby approved.
