On motion of Mr.Britton, seconded by Mr. Driskill, it is resolved that this Boar
request the Highway Department to survey the drainage ditch, draining the
Hollandale area eastwardly to Rt. 10, in an attempt to establish sufficient
fall to drain the area.
This day Mr.F.A.Holmes, comes before the Board citing the fact that a culvert
placed across the Dyer Road, recently ~mproved by 3¢ Road Funds, is partly
on his property. On motion of Mr.Britton, seconded by Mr. Driskill, it is
resolved that the Resident Engineer and the ExecutiveSecretary investigate the
matter.
This dav a notice was read that the Highway Department had abandoned certain
sections of Rt. 10, transferred others to the Secondary. System. all in
accordance with the resolution of the Board dated December 10, 1958, which
notice is received and filed.

public roads. Upon consideration whereof, and on motion of Mr. Goyne, it is
resolved that Prince George Road, Rifhmond Street, and Bermuda Avenue in
Chesterfield Manor Subdivision, im Bermuda District, be, and the same are
hereby established as public roads.

A resolution was read from the Prince William County Board of Supervisors
pertaininE to the loss of Secondary Road funds, which resolution was filed
with the Board's paoers.
This day again the Highway Department notified the Board of Supervisors in
writinK that it fould not take care of the storm drainaEe at the intersection
of McRae and Granite Roads in the new Granite Road improvement project. It
was generally agreed that the Executive Secretary arrange a conference with
Mr.A.J.N/lls and Mr.J$ D.Clark to discuss this hatter.
This day the Executive Secretary read a letter from Mr. James Sowers pertaining
to the drainage on German School Road. Upon consideration whereof, and on
motion of Mr.Britton, seconded by Mr. Drisk~ll, it is resolved that the Executiw
Secretary write to Mr. Sowers informing him that the Highway admits its
reapensibility in the r~tter and will improve this condition as soon as funds
are available.
This da~ a letter from Mr.D.E.Bethel, was read for the Board's hearing, which
letter concerned itself with the aDparent hazardous condition of Cherokee
Road. Mt. Bethel cited several accidents that had hanpened in recent weeks,
whereupon, it was agreed that the Executive Secretary write to Mr. Bethel
inform~ing him that this Board had requested on several previous occasions
that the Highway Department put in a better sign system on said road, so that
certain hazardous curYes could be marked properly.
This day ~r.R.V.Lancaster, Resident Engineer, reported to the Board that the
request for funds from the Industrial Road Construction Fund for Rt. 618 had
been denied, andthat funds were available for Rt. 613, provided th~ County
could obDain the necessary rights of way. %rnereupon, theChairman requested
that Nr. Lancaster send a copy of the letter notifying him of such action to
theBoard. Upon consideration whereof, and on motion of Mr. Ha~.ue, seconded
by Mr. Driskill, it is resolved that th~ right of way on Rt.613, be investigated
as to the necessity of movinE utilities and as to the availability of the
rights of way.
On motion of ~r. Ha~erman, seconded by Mr. Hazue, it is resolved that this Board
request the Highway Department to improve Hopkins Street, from Ru~ledEe Avenue
eastwardly to the home of Mrs. Woodruff, at a cost not to exceed $500.00,
it bein~ understood that said improvement would then allow this road to come
into the Secondary System of Highways.
On motion of Mr. Britton, seconded by Mr. Driskill, it is resolved that this
Board request the Highway Department to improve 3?0 feet of ~ullen Road,
running northwardly from Cooks~ Road and 300 feet extension on the western
end of Cranford Avenue to Catalina Drive, which road would serve the
Green Elementary School at a cost not to exceed $935.00.
On motion of Mr. Britton$ seconded by Mt. Hague, it is resolved that the
Executive Secretary be and he hereby is requested to contact the developers
of Seaton Acres ~o ascertain the intent of the developers toward the drainage
situation in the area.
On motion of Mr. Britton, seconded by Mr.Driskill, it is resolved that this
Board request the Highway Department to hard-surface a small portion of
Sunlight Avenue, running westwardly from Greystone Avenue, at a cost not to
exceed $100.OO, said cost to be charged to the 3¢ Road Fund of the County.

by and between the COUNTY OF CHESTERFIELD, VIRGINIA, a political
subdivision of the State of Virginia, hereinafter referred to as
,,County,', party of the first part, and~BE~AD ROCK LAND CORPORATION,
a Virginia Corporation, hereinafter called "Owner", party of the second
part.
WHEREAS, owner and county did enter into a certain Water ~asemenl
Agreement, dated Feb~mayy 19, 1958, recorded June 12, 1958, in Deed
Book 552, page 38 in the Clerk's Office ef the Circuit Court of
Chesterfield County, Virginia; and
WHEREAS, said A~reement da~ed February 19, 1958, provided that
upon the request of Bro~d Rock Land Corporation, its heirs, successors
and assigns, the County of Chesterfield will lower or r~locate such
water line to be installed on easement granted therein at no co st to
said Broad Rock Land Corporation, its heirs, successors and assigns.
If relocation is requested at a point not within the bounds of easement
therein referred to, Broad Rock Land Corooration, its heirs, mmccessors,
and assigns, agreed to grant unto the County the required 10-foot easeme~
at another location, upon vacation by ~he parties to that agreement
of the original easement referred to in plat attached thereto and ~de
a pm rt thereof; and
WHEREAS, owner has requested the county to ~baddon its rights
heretofore obtained in said easement;
NOW, THEREFORE, in consideration of the ~tter above recited,
and of the sum of One Dollar ($1.00), czsh in hand paid to county by
owner, receipt whereof is now acknowledged, the Countv of Chesterfield
doth hereby grant and convey and release unto owner all its rights,
title and interest in and to the easement granted by the aforesaid

the Forest View Recreational Association, and charge what expense there may be

On motion of Mr. Driskill, seconded by Mr. Britton, it is resolved that the
following Ordinance which was adopted as an emergency ordinance on January
1959, be, and it hereby is re-adopted:

An ~Qrdinance to amend an ordinance adopted December 11, 19&5,
commonly called the Zoning Ordinance of Chesterfield County,
dividing the unincorporated area of Chesterfield County
into districts and in~such districts to regulate the use of
land and the use, construction, height ar~ location of buildinEs
and other structures, the open spaces about buildings and
other structures and the density of population and to establish
building lines; to provide for the enforcement of such regulations;
and to provide penalties for the violation of this c~dinance, to
amend Section III R-1 Districts to limitthe use to one (1) family
dwelling and to permit the use of two {2) family dwellings only
upon the obtaining of a Use Permit.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD ~OUNTY; that the
Zoning Ordinance of Chesterfield County adopted December il, 19A5, be
amended by the reenactment of SectiOn III R~i Districts, paragraoh "A"
as follows:
R-1 DISTRICTS: ONE FAMILY RESIDENTIAL DISTRICTS
The following regulations shall apply in all R-1 Districts:
A. Uses Permitted:
1. One-family dwellings
2. Churches and other places of worship, including parish houses~ and
and Sunday Schools.
3. Schools, colleges, public libraries and public ~useums.
4. Publicly operated parks, playgrounds and athletic fields, including
buildings customarily aopureenant thereto.
5. Offices of resident members of recognized professions, but no such
office shall be conducted except as an accessory use in a dwelling

other than domestic use in any R-1 district, except by use permit.
9. The following uses subject to the obtaining of a Use Permit for
each such use:
a. Hosnitals, sanitariums and scientific laboratories.

c. Clubs, lodges, and grounds for games and sports.
d. Social, recreational and community buildings.
e. Cemeteries, crematories and other places for the disposal of the
human dead.
f. Public utility uses, including railroads and their facilities
(except railroad yards), water and sewage works, telephone
exchanges, transformer stations.
g. Governmental buildings.
Greenhouses at which the products thereof are sold or offered
for sale.
i. Airports
j. Two family or multiple family dwellEngs.
h. Dog kennels
1. Such other uses as may be granted by the governing body upon application
to the Board of Supervisors. Such use to be governed by restrictions
applicable to such uses.
An emeEgency existing, this ordinance shall be in full force and effect
upon the date of its passage. Adopted January 6, 1959.
This day Mr. Fred Gray, representing ~r.A.T.Brickhouse comes before the
Board requesting a Use Permit to operate a perpetual care cemetery in Bermuda
Magisterial District on a parcel of land fronting lll& feet on Rt. lO and
extending 2174 feet southwardly to the Hundred Road, said parcel bein~ 4500 feet
est of the intersection withRt. 618. Comes also, Mr. Uhas. Synan, presenting
petition against the rezoning of this property for a cemetery, which petition
s signed by some 43 persons residing in the area, Comes also, other citizens in
he area opposing this request. Upon consideration whereof, and on motion of

This day Mr.R.V.Grantham comes before the Board requesting a parcel of land in
Bennuda Mmgisterial District be rezoned, fronting 1OO feet on Chesterfield Avenue
and extending southwardly to Third Avenue, the same being the eastern portions
of LoGs 3 and 6 of the Patterson Park Subdivision, from Residential-2 to General
Business, and there appearing no one in opposition to this request, upon
consideration whereof, and on motion of Mr.Goyne, seconded by Mr. Britton, it is
resolved that the aforedescribed parcel of land be and it hereby is rezoned for
General Business purposes.

to construct and operate a motor court in Bermuda Magisterial District on a

This day Messrs. Martin & Hozwood come before the Board seeking the rezoning from
Agriculture to General Business of a parcel of land in Manchester Magisterial
District, fronting ~0 feet on Rt.60 and extending southwardly 192 feet, the same
beinE Lot 6, Block a, of the Pinehurst Subdivision.

This day Mr. Cornelius Lively comes before the Board seeking the rezoning from
Agriculture to General Business of a triangular parcel of land in Dale
Magisterial District, fronting 300 feet on the Bradley Bridge Road and 300 feet
on the Branders Bridge Road. Thereappearing no opposition to this request,
upon consideration whereof, and on motion of Mt. Hague, seconded by Mr. Britton,
it is resolved that this matter be delayed for thirty days pending the submissio~
of suitable plans for the construction of a service station on the afore4escribed

This day Mr. Frank Burton comes before the Board requesting a Use Permit for the

Whereas, Gray Realty Corporation is the owner of Lots ~, 14 ~nd 15, Block F, on
a Plan of "Southampton Acres", Section 2," recorded in the Clerk's Office,
Circuit Court of Chesterfield County, Virginia, in Plat Book 8, pages 1~7 and
148; and
Whereas, Gray Realty Corporation has contracted to sell a portion of Lot 1~,
and a portion of Lot 15, BlockF, on Plan of Southampton Acres, Section 2, to
Thaddeus ~. Crump, ~d N~Mcy B;Crump, his wife, said portion of Lots 14 and ~
being shown in red on plat attached; and
Whereas, Thaddeus T.Crump and Nancy B.Crump, his wife, desire a vacation of the
16-foot easement as presently located alone the dividing line between Lots l~
and 1~, Block F, of said subdivision and its relocation alon~ the new boundary
line between the property they ~ve contracted to purchase from Gray Realty
Corporation and the residue of Lot 1~, Block F, to be retained by Gray Realty
Corporation; and, the topography of the land required that the said Theddeus T.

in order to property construct their dwellings and to comply with the zoning

W~nereas, the new location of the said 16-foot easement will not interfere with

Now, Therefore, Be it Resolved, that the Board of Supervisors doth approve the
vacation of the 16-foot easement along the dividing line, of Lots 14 and 15,
Block F, Southampton Acres, Section 2, as requested and doth approve the
relocation of said 16-foot easement along the dividing line of the property
to be purchased by the aaid Thaddeus T. Crump and NancyB.Crump, his wife, and
the property to be retained by Gray Realty Corporation, said relocation being
more fully shown on plat of survey prepared by Gec~ge M.Stephens, Jr., dated
November 13, 195~, and attached hereto and made a part hereof.
This resolution is conditioned upon and shall become operative when the afore-
mentioned petitioner shall have executed and acknowledged for record on a form
aoproved by the Commonwealth Attorney and the County Engineer an approprdate
declaration of vacation and relocation. When such declaration of vacation
and relocation has been approved, same shall be recorded in the Clerk's Off, ce
of the Circuit Court and said Clerk shall indicate the vacation and the
abandonment of the said 16-foot easement and the relocation of said easement

unappropriated surolus of the County $1000.00 to item 14-215~ and $2500,00
to item 1A-218 and $65.00 to item 12-317.
And be it further resolved, that the Treasurer be and he hereby is requested to
transfer from the unaopropriated surnlus of the Dog T~x Fund $65.00 to item

On motion of ~r. Hague, seconded by Mr. Hagerman, it is resolved that the

Execrative Secreary be and he hereby is requested to have instal]ed two street
lights, one at the corner of South Street and the Atlantic Coast Line property
in Ettrick and one at the Jahnke Road Baptist Church.
On motion of Mt. Hague, seconded by Mr. Hagerman, it is resolved that this Board
deny the request of Mr. Cordle to build on twn lots on the Elkhardt Road
without platting said lotsand submitting same as a subdivision.
And be it further resolved, that Mr. Cordle~be granted a buildinm permit when
the proper plats are presented and approved.
On motion of Mr. Britton, seconded by Mr.HaEue, it is resolved that the request
of the Manchester Rescue Squad be granted, and that a variance be allowed for
the construction of an addition ~o the Rescue Squad ~eadquarters ~ot~.less than
2 feet from the rear and side properties.
