Summary of Information: This time has been set to continue work sessions on the County Administrator's FY2006 Proposed Budget. This is the second of six budget work sessions. On February 9th, staff presented FY2006 projected revenues and the Community Services Board budget. During today's work session the Police Department and School Board budgets will be reviewed. School Board Budget presentation materials will be provided on February 23, 2005. On March 7th budget presentations are planned from the Social Services Board, Human Services Division, Constitutional Officers, and Fire and Emergency Medical Services. On March 9th, a review of the County Administrator's overall Proposed FY2006 Expenditure Budget is scheduled, in addition to a presentation from the Management Services Division. Presentations from the Community Development Division and the Community Development Block Grant Office are scheduled for March 23rd. A final work session is scheduled for April 13th. Summary of Information' Public hearings are scheduled for March 23, 2005 on proposed tax rates, the Proposed FY2006 Biennial Financial Plan, the Proposed FY2006-FY2011 Capital Improvement Program, the Proposed FY2006 Community Development Block Grant Program, and other ordinance changes. Advertisement requirements differ depending on the item. The County Administrator's FY2006 Proposed Biennial Financial Plan will include a recommendation for an increase in certain revenues to cover the cost of services. Dickson Attachments: 0 Yes Title: Director of Budqet & Management No O0004Z CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 2 of 4 Meeting Date: February 23, 2005 Summary of Information (continued) Fees Requiring a Public Hearing and Ordinance Amendment Utilities Fee Changes: A cost of service study was conducted to determine if current rates were covering the operating expenses involved in delivering water and wastewater services. The outcome of the study indicates that a rate increase in the capacity and customer charges for water and wastewater is warranted in order to cover services being rendered. These proposed changes will increase a typical bi-monthly water bill by $2.58 and a typical wastewater bi-monthly bill by $3.00. A typical combined water and wastewater bi- monthly bill will increase by $3.54. Base charges were last adjusted in 1992 and commodity charges in July 2003. Even after the proposed rate increases (assuming a typical bill for combined services), Chesterfield County's rates are still below neighboring localities. In addition, there are several other increases proposed. Increases in these areas last occurred in 1992 or prior. Installation charges for water service lines are proposed to increase depending on the size of the line. The increases are: from $465 to $777 for a 5/8" line, from $610 to $981 for a 1" line, from $900 to $1,641 for a 1 ~" line, and from $1,000 to $1,836 for a 2" line. Staff is also proposing to increase the bacteriological test fee for new construction from $16 to $21.50 and the portable water meter deposit (which is refunded upon return) from $550 to $750. The increased revenue will offset operating cost increases including the cost of purchased water (City of Richmond and Appomattox River Water Authority), chemicals, and payments for wastewater treatment (City of Richmond). In addition, increases in capital projects to comply with Chesapeake Bay requirements as well as to maintain the integrity of the county's water and wastewater facilities contributed to the need for the increased rates. Treasurer-Fees Imposed for Collecting Delinquent Taxes and Other Charges: The FY2005 Adopted Budget included an increase in the delinquent collection fee from $20 to $30 if the treasurer collects subsequent to 30 or more days after notice of delinquent taxes or other charges, but prior to judgment and in the administrative fee from $25 to $30 if the treasurer collects the taxes or other charges after judgment. The treasurer's cost to pursue these cases exceeds the fee. 000043 CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 4 Meetin,cj Date: Februar~ 23i 2005 Summary of Information (continued) Staff is requesting an additional modification to the ordinance effective immediately upon adoption that would remove the stipulation that the delinquent fee shall not exceed 20% of the delinquent tax bill. This ordinance change clarifies the collection of fees imposed on delinquent taxes and other charges and aligns the county code with the state code. Fee Adjustments Not Requiring A Public Hearing Waste and Resource Recovery-Gate Fee, Second Year Increase: In the FY2005 Adopted Budget, user fee changes were implemented to move toward the approach of a "pay as you throw" system and the elimination of citizens paying for programs in which they do not participate. Included in the adopted 2005-2006 Biennial Financial Plan was a planned two-year increase in the gate fee at the transfer stations. The gate fee was increased from $5 to $7 from FY2004 to FY2005 and is planned to increase from $7 to $8 in FY2006. The increase to $8 is included in the FY2006 Proposed Financial Plan. This increase is expected to generate an additional $246,000 to help defray expenditure increases in the Waste and Resource Recovery department. This fee is not governed by an ordinance; and therefore, adjustments do not require a public hearing. Proposed Tax Rates: The Board must advertise a rate of assessment for each tax classification for the 2005 tax year. Advertisement of a specific rate leaves the Board the flexibility to adopt any rate up to the advertised rate. The proposed tax rates are: Real Estate (January, 2005) $1.07 Personal Property $3.60 Personal Property Tax for members of Volunteer $0.96 Rescue Squads, Volunteer Fire Departments, Volunteer Police Chaplains, and Auxiliary Police Personal Property Tax for Wild and exotic Animals $0.01 Personal Property Tax for Motor Vehicles that use $3.24 "Clean and Special Fuels" Personal Property Tax for Motor Vehicles, Trailers, $0.96 And Semi-Trailers with a gross weight of 10,000 Pounds or more Airplanes $0.50 u6vv CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 4 of 4 Meeting Date: Februa~ 23, 2005 Summa~ of Information (continued) Personal Property Tax for Specially Equipped Motor Vehicles Machinery and Tools $0.01' $i.oo *The Board of Supervisors created this new tax classification in the fall, 2004, but did not establish a tax rate at that time. A rate of $.01 is being recommended for tax year 2005. The Code of Virginia requires that public hearings on the budget and on tax rates be held at different times, but can be on the same day. Therefore, public hearings are planned to be advertised for March 23, 2005 as follows: Proposed Ordinance Changes: 7:00 p.m. Proposed Tax Rates: 7:05 p.m. Proposed FY2006-FY2011 Capital Improvement Program: 7:10 p.m. Proposed FY2006 Community Development Block Grant Program: 7:15 p.m. Proposed Amended FY2006 Biennial Financial Plan: 7:20 p.m. Finally, last summer the Board was provided information regarding 2004 legislative changes allowing for optional Board action. The Board has indicated a desire to pursue the legislative items related to volunteers. Personal Property Tax Rate for members of Volunteer Rescue Squads, Volunteer Fire Departments, Volunteer Police Chaplains, and Auxiliary Police: Current county policy allows one vehicle per household to be classified separately and eligible for the lower tax rate. This amendment expands the ordinance so that if a volunteer rescue squad or fire department member and an auxiliary member are members of the same household, that household shall be allowed two vehicle special classifications rather than one. This change is estimated to cost about $4,000 annually and would become effective January 2006. The other amendment expands the ordinance so that vehicles not only owned or leased by an active member but also active auxiliary member of a volunteer rescue squad, fire department, or auxiliary police unit can be exempt from the decal license fee. The projected present value savings as a percentage of refunded par of 5.59% could result in an estimated present value savings of $1.1 million. Edwards, Jr. Title: 2® Deputy Fire Chief Attachments: Yes [---] No #0O0052 RECOGNIZING LIEUTENANT CHARLES PERRY TAYLOR UPON HIS RETIREMENT WHEREAS, Lieutenant Charles Perry Taylor retired from the Fire and Emergency Medical Services Department, Chesterfield County, on January 1, 2005; and WHEREAS, Lieutenant Taylor attended Recruit School #3 in 1973, and has faithfully served the county for over thirty-one years in various assignments including as a Firefighter at the Manchester Fire Station #2 and Ettrick Fire Station #12; as a Sergeant at the Ettrick Fire Station #12, the Manchester Fire Station #2, the Chester Fire Station #1, the Clover Hill Fire Station #7, the Wagstaff Fire Station #10, and the Bon Air Fire Station #4; and as a Lieutenant at the Bon Air Fire Station #4; and WHEREAS, in 1976, Lieutenant Taylor submitted a recommendation to form a scuba rescue team and became a charter member of the team; and WHEREAS, Lieutenant Taylor received a unit citation award in 1991 for the rescue of two citizens from their balcony on East Coal Hopper Lane; and WHEREAS, in 1995, Lieutenant Taylor received a unit citation award for participation in a rescue of a victim from a smoke stack at the Dutch Gap power station; and WHEREAS, Lieutenant Taylor came to the rescue of a fellow firefighter during a fire at Darryl's Restaurant by providing lifesaving buddy breathing while assisting him safely out of the building; and WHEREAS, Lieutenant Taylor has mentored and trained many firefighters, of whom more than six have become respected Fire Officers in the department; and WHEREAS, Lieutenant Taylor has been ready to respond to every need of the department within his capability, including his dedication to public service, his willingness to work long hours without complaint, and his creativity in performing a variety of jobs have earned him the respect and admiration of the entire Fire and Emergency Medical Services Department. The music will be held on Sundays from May 7 through May 29, 2005. A Strawberry Festival will be held on May 7 and 8, which will also include music. The Berry Farm is currently seeking sponsors to help defray the major costs of the event. All net proceeds from the music series will go to the Berry Farm. Chesterfield Berry Farm will assume full financial responsibility for the Festival and music series. The bands for this event have not been contracted for at this time. No separate admission fee will be charged for the music or strawberry festival. It is anticipated that approximately 3000 people will attend the event during the Festival hours. Chesterfield Berry Farm has facilities where food, water, and soft drinks will be available for purchase during hours of operation. Portolets remain on the location throughout the May season and are serviced twice a week by Nes services. Chesterfield Berry Farm has clean-up and trash disposal. There is ample parking, and off-duty police officers will assist with parking, crowd control and other security needs. Emergency medical and fire department officials have been made aware of the event and are available to render service if needed. The music/entertainment arrangements have been reviewed by the County Attorney's Office and meet the substantive requirements of the ordinance. These arrangements provide adequate measures to insure public safety, fire prevention, medical protection, sanitation, traffic control, insurance coverage, relevant permits and security. Although the Board of Supervisors may require a bond to insure compliance with the permit, the Board traditionally has not required a bond except when the event occurs on County property. Chesterfield Berry Farm, located at 20501 Skinquarter Rd., Moseley, Virginia, is both the applicant and event promoter. We will receive all net proceeds from our music series and our Strawberry Festival. We plan to have family oriented outdoor music during our Strawberry season on the lawns of Chesterfield Berry Farm which is located at 26002 Pear Orchard Rd. Moseley, Virginia. The music will be held on Sundays from May 7, 2005 thru May 31, 2005. We also plan to have a Strawberry Festival on May 7 and 8, 2005, which will also include music. Chesterfield Berry Farm opens at 8:00am with music beginning at 11:00am. Music will end at 3:00pm and all other activities will end at 4:00pm. Chesterfield Berry Farm is assuming full financial responsibility for the Festival and music series. We are currently seeking corporate sponsors to help offset some of our major costs. We are currently in the process of acquiring bands for our music series and Festival. We will not be charging admission for music on Sundays or for the Strawberry Festival. We anticipate having 3000 people on the farm during the Festival hours. We have existing portolets at Chesterfield Berry Farm and they will remain there throughout our Strawberry season. They are serviced twice a week by Nes services. Chesterfield Berry Farm currently has clean-up and trash disposal. We have dumpsters located on the farm and Tranium picks up the trash twice a week. We are alerting the Manchester Rescue Squad and Clover Hill Fire department of our event's dates and times. Outdoor lighting will not be used during our events as our events occur during day hours. Music both live and taped will be played in such a manner that the sound will not be a nuisance to adjacent property owners. Heavy evergreen buffers are already in place between Chesterfield Berry Farm property and adjacent property owners. All sound issues are under direct control of Shannon Mangnuson (General Retail Manager) with Chesterfield Berry Farm. We have an agreement in place with the Chesterfield County Police Department to employ off-duty police officers who will assist our staff with parking, crowd control and all other security components of our Festival and music series. Chesterfield Berry Farm carries a general $2 million liability insurance policy to insure against injury or damage. Statements authorizing Chesterfield County principals to enter the property during our music series or Festival are attached herewith. Our application fee is attached. Subiect: Set Public Hearing to Consider Amendments to the County's Massage Therapy Ordinance to Allow Massages to be Performed for Compensation by Massage Therapy Students County Administrator's Comments: /~)~~ ~~~ County Administrator: Board Action Requested: The Board is requested to set a public hearing for March 9, 2005 to consider amendments to the massage therapy ordinance to allow massages to be conducted for compensation by massage students in a post-secondary school under the supervision of a certified massage therapist. Summary of Information: With some exceptions, the County's massage therapy ordinance requires that a massage performed for compensation be performed by a massage therapist who is (i) certified by the state and (ii) permitted by the County through the Chief of Police. Further, in most instances, the massage must be performed in a massage clinic that has received a permit from the County. Recently, the Virginia School of Technology, a proprietary technical school with campuses at the Boulders and in Virginia Beach, approached County staff seeking changes in the massage therapy ordinance. The School offers instructional training for health related occupations such as massage therapist, medical assistant, practical nurse, and medical office specialist. Currently, massage therapy students at the School receive over 600 hours of massage therapy training and, as part of that training, provide massages to Preparer: Steven L. These massages comply with the County's massage therapy ordinance because the massages are not offered for compensation. The School would like to begin charging customers for these massages in order to recover overhead costs such as supplies and instructor time. After meeting with representatives of the School and the Police Department, and after consultation with the Health Department, Staff recommends that the Board consider the attached amendments to the massage therapy ordinance. The proposed amendments would apply to public universities, public colleges and post secondary schools that are certified or approved by the State Council of Higher Education for Virginia. The amendments would allow qualifying educational institutions to charge for massages performed by their massage students provided that (i) the massages are performed as part of a course of massage therapy instruction at the school, (ii) the school holds a valid massage clinic permit from the County and (iii) a certified massage therapist holding a County permit is present at all times in the room with the massage therapy student. The ordinance amendments would also allow a massage clinic to be located at a qualifying university, college or school. Staff believes that requiring the school to obtain a permit for a massage clinic from the County and, also, to be a public university or college, or a post secondary school approved or certified by the State Council, provides sufficient safeguards against abuse of the ordinance exception by fraudulent businesses claiming to be massage schools. The Police Department and Health Department do not have any objections to the proposed ordinance amendments. Staff recommends that the Board set a public hearing for March 9, 2005 to consider the ordinance amendments. 1923(05) :68218.1(68197.1) 000:1.03 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 15-91, 15-92 AND 15-93 RELATING TO MASSAGE THERAPY PERFORMED BY MASSAGE THERAPY STUDENTS OF A POST SECONDARY EDUCATIONAL INSTITUTION BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 15-91, 15-92 and 15-93 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: ARTICLE V. MASSAGE CLINICS Sec. 15-91. Definitions. For this article, the following words and phrases shall have the following meanings: Barber shop: An establishment which provides one or more of the following services in exchange for consideration: hair care, makeovers, facials, manicures, pedicures, or body waxing. Beauty salon: An establishment which provides one or more of the following services in exchange for consideration: hair care, skin care, makeovers, facials, manicures, pedicures or body waxing. Care facility: A hospital, nursing home, convalescent care facility, assisted living facility, life care facility, or group care facility. Certified massage therapist: Any person who administers a massage to another person, in exchange for consideration, and who has qualified as a certified massage therapist pursuant to the requirements of Code of Virginia, §§ 54.1-3000 and 54.1-3029, including but not limited to a massage clinic operator. Chief of police: The Chesterfield County Police Chief or his designee. Client: A person receiving a massage. Consideration: Anything of value given in exchange for services rendered, including, but not limited to, money, goods, services or advertising. Health club: An establishment which provides health and fitness equipment and programs for its client's use in exchange for any form of consideration. A health club may be located in a hotel or motel but not in a guest room in a hotel or motel. Massage: The treatment of soft tissues for therapeutic purposes by the application of massage and body work techniques based on the manipulation or application of pressure to the muscular structure or soft tissues of the human body. Massage clinic: A fixed place of business where a certified massage therapist gives a client a massage. A massage clinic shall either be freestanding or located within a health club, tanning salon, hotel or motel (but not in a guest room in a hotel or motel), beauty salon~ o~ barber shop or within a public university, public college, or post-secondary school that is certified or approved by the State Council of Higher Education for Virginia. Massage clinic operator: The person who files and signs the application for a massage clinic permit and who is responsible for the day-to-day operation of the clinic. The massage clinic operator need not qualify as a certified massage therapist if he or she does not intend to administer massage. Public gathering: Any event occurring in the county that is open to the general public and involves more than 50 persons. Seated massage: A massage of the upper body or feet when the massage client is fully clothed and seated in a chair. Tanning salon: An establishment which has as its primary business the provision of tanning services in exchange for consideration. Sec. 15-92. Permit required. No person shall administer or perform or permit to be administered or performed a massage in exchange for consideration in or upon any premises within the county unless: (a) The massage is performed for medical, relaxation, remedial or hygienic purposes; and (b) The person performing the massage is a certified massage therapist and holds a valid county permit. (c) If a massage is performed in a massage clinic, a valid county massage clinic permit has been issued for the premises. Sec. 15-93. Exclusions. Section 15-92 shall not apply to massages administered for medical, relaxation, remedial or hygienic purposes by (i) a physician, surgeon, chiropractor, osteopath or physical therapist duly licensed by the Commonwealth of Virginia; (ii) a licensed nurse acting under the prescription or direction of any such physician, surgeon, chiropractor, osteopath, or physical therapist; o~ 1923:68197.1 2 000~.05 (iii) a certified massage therapist acting on the premises of any such physician, surgeon, chiropractor, osteopath or physical therapist and under his prescription or direction. Section 15- 92 shall not apply to barber shops or beauty salons in which massage is given to the scalp, face, neck or shoulders only:; or (iv) a student of massage therapy enrolled in a course of instruction for massage therapy at a public university, public college, or post-secondary school that is certified or approved by the State Council of Higher Education for Virginia, provided also that the massage is performed as part of a course of instruction for massage therapy at a massage clinic holding a valid county permit and that a certified massage therapist with a permit from the County is present in the room at all times with the massage therapy student. In addition, Section 15-92 shall not apply to barber shops or beauty salons in which massage is given to the scalp, face, neck or shoulders only. Appropriation of $89,500 in State Wireless 911 Services Board Funds County Administrator: Board Action Requested: Appropriate $89,500 in state wireless 911 funds to address equipment needs related to the county's automated 911 system. Summary of Information: The Emergency Communications Center receives funding from the Virginia Wireless Egll Services Board annually for taking wireless 911 calls locally. The county receives these funds on a quarterly basis. At the end of the fiscal year, the county must demonstrate that the state funds were spent on wireless 911 related items. The Wireless Board reimburses localities if the locality spends more than the original allocation. This is the case for Chesterfield. The state Wireless Board in December 2004 reimbursed Chesterfield and as a result, the county currently has excess revenues over the amount originally budgeted which should be appropriated. Using the $89,500, the Emergency Communications Center has been able to address several needs, including the automation of volunteer firefighter dispatch and the purchase of other related equipment for the Center's automated 911 systems. Summary of Information: At the Board of Supervisors' June 25, 2004 growth management retreat, the Board directed the Planning Commission to review a number of issues that were discussed at the Board's retreat and report its findings to the Board. Attached is a summary of the status of such items. The Planning Commission has made its recommendations on the issues of differential cash proffers, cash proffer transportation methodology and the timing of the cash proffer in compliance with the Board's request for action on those issues by the end of 2004. In addition, while no deadline was established for Planning Commission action on the issues of cash proffers for roads in subdivisions, elimination of R-12 zoning, road stripping and side yard setback requirements, the Planning Commission has had the opportunity to study and make its recommendation on those issues.
