LUCY MERCHAN FOR HER SERVICE ON THE KEEP CHESTERFIELD COUNTY CLEAN ADVISORY BOARD WHEREAS, Keep Chesterfield County Clean has been in existence since 1980 with the objective of educating the public about the problems of littering and the benefits of recycling; and WHEREAS, the Board of Supervisors annually appoints one representative from each of the five magisterial districts to serve on the Keep Chesterfield County Clean Board as a Director; and WHEREAS, Mrs. Merchan has been a leading advocate of the program serving as one of the original volunteer ~Waste Watchers" in 1990 and helped hundreds of children and adults become involved in the Program throughout the years in such activities as the Clean Business of the Month Program, Neighborhood Cleanup Campaigns, recycling displays and exhibits; and WHEREAS, Mrs. Merchan was appointed to serve in 1998 as the Midlothian District Representative, and has continued to serve three consecutive terms as a volunteer to the Keep Chesterfield Clean Program since; and WHEREAS, Mrs. Merchan has given of her personal time and commitment to improve the overall appearance and beauty of Chesterfield County with special attention to the Midlothian Magisterial District; and WHEREAS, it is the desire of the Chesterfield County Board of Supervisors to recognize Mrs. Merchan's faithful service to Keep Chesterfield County Clean. This work session is the fourth of five work sessions during which staff will present proposed revenues and expenditures for FY2002. On February 21st, staff presented projected revenues for FY2002. On February 28th, the School Board and Community Development budgets were reviewed. On March 12th, the County Administrator's FY2002 Proposed Budget, Management Services Division and Fire and Emergency Medical Services budgets were presented. During this work session, the Police Department and the Community Development Block Grant Program will be presented. On March 21st, Human Services and Constitutional Officers will present. Su~ect: Streetlight Installation Approvals County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of Matoaca District. new ~reetlight ~stallations in the Summary of Information: Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections; o There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection, or 400 VPD if the requested location is not an intersection; o Petitions are required and should include 75% of residents within 200 feet of the requested location and if at an intersection, a majority of those residents immediately adjacent to the intersection. Summary of Information: At its October 25, 2000 meeting, the Board approved the Watershed Management Plan & Maintenance Program for the Swift Creek Reservoir. That plan included a program for the use of a series of measures and practices that will reduce pollutants resulting from new development in the watershed. One of those measures calls for the prohibition of certain activities within designated floodplain areas in the watershed. Activities to be prohibited include clear-cutting of trees and filling. The prohibition of such activities will result in a benefit to the water quality in the Swift Creek Reservoir. At that time, staff discussed the claim in Closed Session with the Board, and based on those discussions staff denied the claim. The Estate is now making a formal claim pursuant to Virginia law as a preliminary step before filing a lawsuit. Staff recommends, as. it did last June, that this claim be denied. As was explained in the attached June 29, 2000 letter from the County Attorney's Office to the Estate's attorney, the County currently provides a better benefit package to volunteer firemen and other volunteer emergency personnel than would be available under workers' compensation coverage. Additionally, the County has already arranged to make $500,000 in bridge improvements on Old Buckingham Road in fiscal year 2003. Based on numerous meetings with residents in the Old Buckingham Road area, these are the improvements that staff and the community believes need to be made to Old Buckingham Road at this time. With regard to the Estate's claim for $1.5 million, the County's commercial insurance policy through Selective Insurance Company protects the County, County fire personnel and volunteer firefighters against liability in this case. The Selective policy provides $2 million of insurance coverage. An excess insurance policy with States Risk Retention Group affords $10 million additional coverage. This claim has already been submitted to those carriers for coverage. The County pays premiums for this coverage in order to protect the County's Risk Management Fund. Accordingly, payment for this claim should come from the insurance carriers. Accordingly, I am prepared to respond on behalf of the County to all three aspects of your demand at this time. First, with regard to Mr. McNeer's request that the County include volunteer firefighters under its workers' compensation policy, our review of the benefit package which we provide to volunteer firefighters convinces us that the benefit package currently available to volunteers is far superior to workers' compensation coverage. At the time of Bradley McNeer's death, volunteers were provided with commercial health insurance coverage which provided for a $50,000 payment for accidental death and dismemberment (a payment which the McNeers have received). In contrast, if the County had provided workers' compensation coverage instead of the accidental death and dismemberment policy, the McNeers would have received payment, in an amount not to exceed $10,000, which would have covered only their out-of-pocket funeral and burial expenses. As a result of Bradley's death, the Fire Department has increased the accidental death coverage from $50,000 to $100,000 and has also increased other health benefit coverages to better protect volunteers. I am enclosing a copy of a memo from Chief Elswick to all volunteer firefighters describing these increases in health and accidental death benefits. Second, with respect to Mr. McNeer's request for improvements'to Old Buckingham Road, the County has already responded to the accident by working with VDOT to advance the project to rebuild the Old Buckingham Road bridge. The bridge improvements will now be constructed in FY- 2003 at a cost of approximately $500,000. Other improvements to the road have already been made by VDOT. The County has also conducted numerous meetings with residents in the Old Bruce M. Marshall, Esquire June 29, 2000 Page 2 Buckingham Road area, and the consensus of the residents is that no improvements should be made to Old Buckingham Road at this time other than the improvements to the bridge, For that reason, we cannot commit to any other improvements to Old Buckingham Road at this time. Because the County has used public funds to purchase insurance coverage for emergency fire response claims, it would be improper for the County to waive that coverage by providing any monetary compensation to your client. Summary of Information: At its October 25, 2000 meeting, the Board approved the Watershed Master Plan & Maintenance Program for the Swift Creek Reservoir Watershed, including the siting and construction of a system of regional BMPs. The Board also approved the establishment of a pro-rata fee program that would fund the construction of the regional BMPs. Staff was directed to implement the Plan, including the development of applicable ordinances. Fees collected under this program would be utilized to pay for land acquisition, construction, wetland mitigation and other costs related to the implementation of the regional BMPs called for in the Watershed Management Plan and Maintenance Program for the Swift Creek Reservoir. The pro-rata fee payments shall be due prior to the signature of the Department of Environmental Engineering on the record plat for residential development, and prior to the Environmental Engineering Department's approval of the site plan for non-residential development. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY ADDING A NEW ARTICLE VI TO CHAPTER 12, RELATING TO PRO-RATA SHARE PAYMENTS FOR THE CONSTRUCTION OF WATERSHED LEVEL BEST MANAGEMENT PRACTICE FACILITIES IN THE SWIFT CREEK RESERVOIR WATERSHED BE IT ORDAINED by the Board of Supervisors of Chesterfield County: That a new Chapter 20 of the Code of the County of Chesterfield, 1997, as amended, by adding to read as follows: ARTICLE VI. BEST MANAGEMENT PRACTICE FACILITIES FOR THE SWIFT CREEK RESERVOIR WATERSHED Sec. 12-71. Purpose and intent of chapter. The purpose and intent of this chapter is to require all developers of land to pay their pro-rata share of the cost of providing necessary facilities to control the volume and quality of runoff generated by new development in the Swift Creek Reservoir Watershed. The locations, type and size of such facilities has been established in the Management Master Plan & Maintenance Program for the Swift Creek Reservoir Watershed, adopted by the Board of Supervisors in October of 2000 (the "Plan"). The Plan shall constitute the general improvement program required by §15.2-2243 of the Code of Virginia. The Plan covers a 61 square mile area encompassed by the Swift Creek Reservoir Watershed. This designated area has common stormwater runoff and drainage conditions in that all runoff generated by new development drains to the Swift Creek Reservoir. The Plan establishes a program for the strategic location of six types of structural and non-structural regional Best Management Practice facilities (BMP's) throughout the Swift Creek Reservoir Watershed. The designated BMP's are denoted on a map entitled "Swift Creek Watershed Siting Scenario 5" which is on file in the office of the Director of the Department of Environmental Engineering. The purpose of the system of regional BMP's is to control the increased volume, velocity_ and quality of stormwater runoff that will be caused by anticipated development in the Swift Creek Reservoir Watershed. Section 12-72. Basis for the Pro-Rata Share Fee. The pro-rata fee has been calculated based on the increased volume of stormwater runoff, expressed as an increase in impervious area, resulting from projected development in the Watershed. The projected costs on which the fee is based include design, land acquisition, construction, wetland mitigation and other factors related to the implementation of the regional BMP's enumerated above and are enumerated in the Watershed Management Plan and Maintenance Program for the Swift Creek Reservoir Watershed which is on file in the Office of the Director of Environmental 0505:52432.1 1 Engineering. The formula developed for calculating the fee by the Department of Environmental Engineering, which is hereby adopted as the formula for determining pro rata shares, reflects the product of the amount of impervious area and the established fee per impervious acre. The formula shall be updated weekly to reflect changes in construction costs by applying the Engineering New Record Construction Cost index value. Sec. 12-73. Pro-Rata Share Contributions. Anyone proposing to develop land within the Swift Creek Reservoir Watershed shall be required to pay the pro-rata share of the cost of providing the Regional BMP's enumerated above, as provided for in the Watershed Management Plan and Maintenance Program for the Swift Creek Reservoir Watershed. Payment of the pro-rata share fee shall be due prior to the signature of the Department of Environmental Engineering on the record plat for residential development, and prior to the Environmental Engineering Department's approval of the site plan for non-residential development. Sec. 12-74. Pro-Rata Share Accounts. The pro-rata payments received shall be kept in a separate account for the implementation of the Watershed Management Plan and Maintenance Program for the Swift Creek Reservoir and expended only for improvements and associated costs made in accordance with the approved Plan. Any interest that accrues on such payments shall accrue to the benefit of the County. Section 12-75. Pro-Rata Fee Payments. Pro-rata fee payments received shall be expended only for necessary engineering, related studies, land acquisition and the construction of those facilities identified in the Watershed Management Plan and Maintenance Program for the Swift Creek Reservoir. A copy of the ordinance approved by the Planning Commission is attached. The ordinance approved by the Commission doss not exempt apartments from the fee requirement. Accordingly, staff is recommending that the Board approve the version of the ordinance attached as Attachment 2. The Planning Commission also requested that staff present the Board with three options for when the fee should be collected: (1) at time of tentative subdivision approval; (2) at time of final recordation of the subdivision plat; or (3) at the time the building permit is issued. It does not make sense to collect the fee at the time of tentative approval, as the number of dwelling units shown on the tentative may be different on the final recordation plat. Additionally, because the developer is given the option of providing the fee through a bond collecting the fee at the time of the building permit is not practical. There would be insufficient time for the developer to obtain the bond. Accordingly, staff recommends that the fee be collected at the time of recordation of the subdivision plat.
