WEST - 78S174 REQUEST: Rezoninq from Residential (R-7) to Office Business (O) plus'Conditional Use for Planned Development. Applicant plans to construct building for professional offices. GENERAL LOCATION: Bermuda Magisterial District; property fronts north line of W. Hundred Road and located approx. 270 ft. east of its intersection with Ecoff Ave. TM 115-6 (6) Nunnally's Addition Lot 18 (Shee~ 32). SUBJECT PARCEL: .75 acres, zoned Res (R-7). Residential use. ADJACENT PROP.ERTY: use. Zoned Res (R-7) and Off Bus (O). Residential UTILITIES, SOILS, DRAINAGE AND EROSION, EASEMENTS: and sewer available to serve property. Public water Soils are sandy loam, gently sloping to sloping and under present conditions, have only slight chance for erosion. Soils are well suited for proposed use. Parcel lies in Great Branch drainage area. Prior to clearing or construction, site plan and erosion control plan must be approved by County. PUBLIC FACILITIES: Property will be served by Chester Fire Station, Company Number 1. Fire service capability adequate to serve property. TRANSPORTATION AND TRAFFIC: Vehicular movements will be distributed over W. Hundred Road which is adjacent to property and in good condition. LAND ASSESSMENT: Appraised value - $28,900. Use should not have adverse effect on adjacent and area property value. GERNERAL PLAN: Commercial use. DISCUSSION: Applicant has entered into real estate purchase contract with Clara Mitchell, property owner. Applicant requests rezoning from Residential ~R-7) to Office Business (O) plus Conditional Use for Planned Development. He plans to construct building for professional offices. See attached site plan. The applicant met with Staff to review intended development of the parcel in question. It was determined that because of the size and the shape of the parcel, it will be difficult to accommodate the intended use without variation or exception to the bulk require- ment applicable in a commercial zone. As a result, the applicant has requested that consideration of his current application be deferred to the November 21, 1978 Planning Commission meeting so that the request might be amended to seek rezoning to Office Business (O) instead of the originally requested Convenience Business (B-l). In addition, the amended application will also request a Conditional Use Planned Development for exceptions to certain bulk requirements. STAFF RECOMMENDATION: 1978 MEETING. RECOMMEND DEFERRAL TO THE NOVEMBER 21, CASE HISTORY CPC 10 17 78: AT THE REQUEST OF THE APPLICANT, THE COMMISSION DEFERRED THIS REQUEST 30 DAYS SO THAT THE APPLICANT COULD AMEND HIS APPLICATION TO REQUEST A CONDITIONAL USE FOR PLANNED DEVELOPMENT. Staff has received an amended site plan depicting the proposed parking and building layout. After further study, Staff recommends approval of rezoning to the Office Business (O) classification with a Conditional Use Planned Development subject to the imposition of the following conditions: 1. The plan prepared by Robert L. Borum, dated October 18, 1978, shall be considered the plan of development as well as the Master Plan. 2. The Commission upon approval of this request shall also grant schema=lc approval of the site plan dated October 18, 1978. 3. Forty-five (45) feet of right-of-way from the centerline of Route 10 shall be dedicated to and for Chesterfield County, free and unrestricted. This dedication shall be accomplished prior to the release of any building permit. 4. The uses permitted shall be limited to those under the Office Business (O) District. Specifically, business, governmennal or professional offices, libraries, medical clinics and pharmacies (drug stores) provided they are located within the same building or structure housing medical offices or clinics. -2- 5. The applicant shall be granted the following exceptions to the bulk requirements: a. A fifteen (15) foot exception to the twenty (20) foot side yard building setback requirement, adjacent to the eastern property line. b. A twenty (20) foot exception to the fifty (50) foot building setback requirement from major arterials (Route 10). c. An exception to the requirement that the parking area be screened from the property located to the west (Coon's property). 6. A six (6) foot high solid board fence Or vegetative screen shall be constructed/planted along the northern and eastern property lines ~adjacent to all parking areas. 7. Prior to the release of any building permits, detailed site plans shall be submitted to the Division of Development Review for approval. 8. In conjunction with final site plan review, a landscaping plan shall be submitted to the Division of Development Review for approval. 9. The above noted conditions notwithstanding, all bulk requirements of the Office Business (0) District shall be applicable. CPC 11 21 78 CASE HISTORY Recommended approval of Office Business (O) rezoning and a Conditional Use for Planned Development subject to imposition of Conditions ~1 thru ~9 as stated above.
