REQUEST: Rezoning from Agricultural (A) to General Business (B-3)

GENERAL LOCATION: In Midlothian Mag. Dist.; property fronts east
line of Grove Road and located approximately 1070 feet south of its
intersection with Midlothian Turnpike. Tax Map 16-12 (2) Sunny

SUBJECT PARCEL: 2.73 acres, zoned Agr (A) and occupied by single
family dwelling.
ADJACENT PROPERTY: Zoned Comm Bus (B-2) and A~r (A).

UTILITIES, SOILS, DRAINAGE AND EROSION: Public water may not be
feasible for use on property. A 16" water line is located along
Route 60 approximately 1100 feet north of parcel.
Property located in Falling Creek sewage drainage area. Public
sewer may not be feasible. Closest trunk sewer located approximately
1200 feet southwest in Stonehenge subdivision.
Soils are sandy loam, gently sloping and under present conditions,
have only a slight chance for erosion. Soils are good for proposed
use if public sewer is issued and fair if a septic tank system
is employed.
Property located in Falling Creek drainage area. There are no on
or off-site drainage problems. Prior to clearing or construction,
site plan and an erosion control plan must be approved by County.
PUBLIC FACILITIES: Property will be served by Midlothian Fire Station,
Company Number 5. Fire service capability adequate to serve property.
TRANSPORTATION AND TRAFFIC: Vehicular movements will be distributed
over Grove Road which is an existing 30 foot right-of-way and in
fair ~condition. Highway Department's 1977-1976 Primary and Secondary
road average daily traffic counts are shown on attached maD.
LAND ASSESSMENT: Appraised value - $20,380. Use should not have
adverse effect on adjacent and area property values.
GENERAL PLAN: Single family residential use.
DISCUSSION: Applicant requests rezoning from Agricultural (A)
to Genera~ Business (B-3). Applicant is agent for individual
who plans to operate plumbing contractor office on property.

This request is located in an area which is experiencing transition
from single family residential use to various commercial uses.
In the past, the Commission and the Board has recognized this
transition and attempted to monitor it through the Conditional Use
process versus approval of traditional euclidean zoning. In this
case, the Commission and Board should make a decision as to whether
or not this policy will continue or whether traditional zoning
should be employed.
It should also be noted that the proposed use can be accommodated
under the Community Business (B-2) District thereby precluding
any outside storage which heretofore the Commission has attempted
to prohibit in this area. The applicant has indicated verbally
that there will be no outside storage with the proposed operation.
STAFF REC~4ENDATION: SHOULD THE COMMISSION SEE FIT TO APPROVE
COMMERCIAL ZONING, STAFF RECOMMENDS THAT COMMUNITY BUSINESS ,(B-2)
BE APPROVED VERSUS THE REQUESTED GENERAL BUSINESS (B-3).
