78S204STAFF REPORT DATE: December ~3, 1978 APPLICANT & CASE NUMBER: HORACE H. HINES, II - 78S204 REQUEST: Conditional Use for operation of landfill. GENERAL LOCATION: Clover Hill Magisterial Dist.; property fronts west line of Taylor Road and located approx. 1540 feet south of its intersection with Hembrick Road. Tax Map 123 (1) Part of Parcel 8 (Sheets 35/36). SUBJECT PARCEL: 36 acres, zoned Agri. (A) and vacant. ADJACENT PROPERTY: Zoned Agri (A) and for most part vacant. UTILITIES, SOILS, DRAINAGE AND EROSION: not available to serve property. Public water and sewer Soils are land wet, sandy loam, gently sloping and under present conditions, have only slight chance for erosion. Soils are poorly suited for proposed use due to wetness and sticky plastic subsoils. See attached soil study map. Property located in Robertson Creek drainage area. Because of topography, there are drainage problems on parcel. Because of soil conditions and drainage problems pri~r to development an erosion control and site plan must be approved by County. PUBLIC FACILITIES: Property will be served by Clover Hill Fire Station, Company Number 7. Fire service capability adequate to serve property. TRANSPORTATION AND TRAFFIC: Vehicular movements will be distributed over Taylor Road which is adjacent to property and in fair condition. Highway Department's 1977-1976 Primary road average daily traffic counts are shown on attached map. LAND ASSESSMENT: Appraised value - $31,700. Properly controlled and screened, use should not have adverse effect on adjacent pro- perty values. GENERAL PLAN: Agricultural use. DISCUSSION: The applicant has Contract of Sales Agreement to purchase property from Ira Robertson Trust Estate. Applicant requests Conditional Use to permit operation of landfill for dis- posal of stumps and construction material over period of ten years. Applicant states that site will be operated by full-time employee who will be responsible for directing dumping and insuring site is covered over with fill dirt periodically. See attached site plan. This request is located in an area which is primarily undeveloped and therefore, properly controlled should not be any detriment to the area. Conversely, if the Board sees fit to approve this request, however, proper screening should be required in order to insure that an unsightly situation does not occur. STAFF RECO~ENDATION: If approved, Staff recommends that this Conditional Use be subject to the imposition of the following conditions: 1~ This Conditional Use shall be gra~ted to and for Horace H. Hines, II, exclusively and shall not be transferable nor run with the land. 2. No dumping shall be permitted closer than 100 feet from any property line~a~-a-il-d~umping ~ar of-3a4~-parcel. This 100 feet shall be considered a buffer zone and shall not be cleared or regraded. 3. Only one access shall be p&rmitted. This access shall be located so as to provide for the best sight distance along Taylor Road. This access shall be secured so as to prohibit the indes- criminate dumping of materials and the applicant shall be respon- sible for the removal of any materials dumped along either the access road or Taylor Road in front of the subject parcel. 4. This landfill shall be restricted to the dumping of stumps, land cleared materials and building materials. At the end of each week, all dumping shall be covered to a depth of not less than six (6) inches and this area shall be seeded. 5. Prior to dumping~closer than 250 feet to the front property line, an earth berm having a height of not less than eight (8) feet shall be constructed along the entire frontage of the landfill. This berm shall be sufficiently high to screen the dumping area from sight. This berm shall be planted with appropriate ground cover which shall be approved by the Division of Development Review. 6. This Conditional Use shall be granted for a period of time of not to exceed 10 years from date of approval and may be renewed upon satisfactory reapplication and demonstration that the opera- tion has been of no detriment to adjacent and area properties. 7. Prior to the dumping of any materials, the State Health Depart- ment shall be contacted and grant approval of the operation. 8. No dumping shall be permitted except between the hours of 8:00 a.m. and 6:00 p.m., Monday through Saturday. 9. Upon completion of the operation, the land shall be stablized with top soil and seeded so as to preclude any erosion problems.
