Summary of Information: Austin Brockenbrough has agreed to donate surveying and design services toward construction of the trail. The Parks and Recreation Department is developing a demonstration fitness trail system on the Government Center Campus titled ~Government Center Demonstration Fitness Trail". The plan calls for a system of inter-connected trail and sidewalks linking all major areas of the complex with over six miles of soft surface trail at plan build-out. The CIP Budget provides $50,000 in funding for the first two-mile segment, to be completed in the fall of 2005. The master planning effort for the trail system involved county volunteers serving on focus groups and participating in design workshops to conceive the plan. Ten county departments serve as a technical advisory committee to assist the department in project development. The Department of Parks and Recreation has partnered with local engineering firms, vendors and the Bird High School and Technical Center students to augment funding by over 100% in goods and services. Summary of Information: This time has been set to continue work sessions on the County Administrator's Proposed FY2006 Biennial Financial Plan. This is the fourth of six budget work sessions. On February 9th, staff presented FY2006 projected revenues and the Community Services Board budget. On February 23rd, staff presented the Police Department budget and the School Board presented its budget. On March 7th, presentations were made by the Social Services Board, Constitutional Officers, the Human Services Division and Fire and Emergency Medical Services. This work session will include a review of the County Administrator's Proposed FY2006 Expenditure Budget, in addition to a presentation from the Management Services Division. Presentations from the Community Development Division and the Community Development Block Grant Office are scheduled for March 23rd A final work session is scheduled for April 13th' At this work session, changes to the proposed financial plans will be reviewed prior to adoption. Subiect: Streetlight Installation Cost Approval (Deferred) County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of a new streetlight installation in the Bermuda District deferred from the February 24, 2004 and July 28, 2004 Board meetings. Summary of Information: Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Dominion Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Projects cannot be deferred for more than 30 days due to quotation expiration. Quotation expiration has the same effect as a denial. Subiect: Street-Name Change County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to approve renaming a portion of Center Pointe Parkway to Lucks Lane. Summary of Information: Currently, Lucks Lane and Center Pointe Parkway merge in the center of the Route 288 right-of-way. There are no signs however along Route 288 that indicate access or interchange from Lucks Lane to Center Pointe Parkway. To accomplish adequate signage, six signs on the northbound lane of Route 288 and two signs on the southbound lane would require modifications. These very large, directional signs along Route 288 are very expensive to replace or modify. An alternative to this expense is a street-name change for an approximate 1500 feet of Center Pointe Parkway, necessitating replacement of only two, small street-name signs. Center Pointe Parkway would remain intact from its intersection with Charter Colony Parkway west along the northern access to Saint Frances Hospital. This name change would not affect any businesses and will alleviate any confusion of citizens traversing the area. The Federal Emergency Management Agency (FEMA) worked with County staff to inspect areas of Falling Creek with three areas qualifying for FEMA reimbursement. Four bids were received February 14, 2005 ranging from $72,633 to a high of $283,000. The contract includes preparation of a burn area and removal and transport of all debris from the creek channel in three locations to the burn site. Risk Management confirmed that FEMA has currently provided $76,192.06 for this project. At closeout of the project, FEMA will contribute an additional $8,465.78. The County's share based on FEMA's formula will be less than $10,000. The additional funds above the contractor's price will be used to pay for load-inspection services that will record estimates of volume as required by FEMA. Summary of Information: Currently, the Police Department has the authority under state law to remove and dispose of motor vehicles which are immobile or left unattended on primary highways. As part of its Community Policing Program, the Police Department is requesting the authority to remove and dispose of vehicles when left unattended on other roads, such as subdivision roads, or on private property. State enabling law permits the Board to adopt an ordinance granting the Police Department such authority. The attached ordinance provides this authority. Under the ordinance, any such vehicle may be towed when it constitutes a traffic hazard; when it is illegally parked; when it is left unattended for 10 days or more; or when it is immobilized by weather conditions or other emergency situations. In such circumstances, the Police Department will contact the vehicle's owner, explain the law to the owner and work with the owner to attempt to gain voluntary removal of the vehicle. The Police Department will only tow vehicles when it is apparent that the owner will not cooperate voluntarily. Such vehicles would be towed pursuant to the County's already existing contracts with towing companies. The towing companies would collect the costs of towing and storage from the vehicles' owners, and dispose of any vehicles not claimed, all at no expense to the County. Preparer: Steven L. (1) That Section 13-64 of the Code of the County of Chesterfield, 1997, as amended, is hereby enacted to read as follows: Sec. 13-64 Removal and disposal of unattended or immobile motor vehicles. The County, its agents or employees, may remove to a storage area for safekeeping any motor vehicle that: Is left unattended on a public highway or other public property and constitutes a traffic hazard; (2) Is illegally parked; Is left unattended for more than ten days either on public property or on private property without the permission of the property owner, lessee or occupant; or Is immobilized on a public roadway by weather conditions or other emergency situations. (b) For purposes of this section, the term motor vehicle shall also include trailers, semi-trailers and any part or parts of a motor vehicle, trailer or semi-trailer. c~ Removal shall be carried out by or under the direction of the Chief of the Police Department or his designee, who shall be a law enforcement officer. (d) No motor vehicle shall be removed from private property without the written request of the owner, lessee or occupant of the premises. However, upon such request such motor vehicle shall be removed upon a showing by the owner, lessee or occupant that it has complied with the posting requirements of Va. Code § 1215. Additionally, the person making such written request shall indemnify the County against any loss or expense incurred by reason of removal, storage or sale of the motor vehicle. (e) As promptly as possible after removal of the motor vehicle, the Chief of the Police Department or his designee shall report the removal of the motor vehicle to the office of the Commander of the Police Department's Uniformed Operations. Since the Governor's School is a regional public school facility and is legally independent of the Chesterfield County School Board, the School Board will have to take action to authorize the transfer of the total $500 payment to the Governor's School. Accordingly, if the Board of Supervisors approves the transfer of the funds to the School Board, the money cannot be given to the Governor's School unless the School Board also takes action to approve the transfer to the Governor's School. The remaining requests for funds originally came from each school's PTSA or Prom Committee. The County is not legally authorized to transfer funds to these organizations or committees. The County is authorized to transfer funds to the School Board but only if the transfer is contingent on the money being placed in capital projects or school operating accounts to be applied to appropriate school-funded post-prom activities. The school system must also write checks directly to vendors who will be supplying goods or services to post-prom events and these goods and services must be purchased in accordance with the Virginia Public Procurement Act. Executive Summary: These amendments would provide (a) a change in the minimum pavement design in new subdivisions to a three-layer system to include base stone, base asphalt, and surface asphalt; (b) a change in the number of building permits allowed to be issued prior to application of base asphalt from 50 percent to 60 percent; and (c) a change in the number of building permits allowed to be issued prior to state acceptance from 80 percent to 90 percent. McEIfish Title: Director, Environmental En.qineerinq Attachments: Yes -]No # oooZoo CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 2 of 3 Background Information: In April 2004, a meeting was held with representatives of the Richmond Area Metropolitan Contractors Association (RAMCA), Virginia Department of Transportation (VDOT), and the County's Utilities and Environmental Engineering Departments to discuss the lack of compaction over utility lines. The County's requirement of road paving at 50-percent completion of subdivisions was also discussed at this meeting as hindering the process. RAMCA requested that VDOT modify requirements for all roads in new subdivisions to be constructed with a three-layer desiqn system (i.e., stone, base asphalt, and surface asphalt). VDOT representatives explained that the VDOT local residencies did not have this authority as the quidelines had been established for and need to be flexible to include residencies within the entire State of Virginia. At this meeting, VDOT suggested that RAMCA discuss this issue with the County. In May 2004, RAMCA approached Environmental Engineering to discuss the road paving issue. RAMCA's main concern being that road paving too early in the construction process, when there are far more heavy trucks than normal, would result in remedial action (i.e., patches) that would cause deterioration of roads more quickly over time. At the same time, the Home Building Association of Richmond (HBAR) had been expressing concerns to Environmental Engineering regarding their membership's inability to obtain additional building permits due to how quickly 50 percent of building permits are issued. HBAR noted that approximately 30 percent of developers were already using a three-layer system and advocated that all developers should use the three-layer system. In June 2004, several meetings were then held that included representatives of RAMCA, HBAR, VDOT, and the County's Planning and Environmental Engineering Departments (the Committee). This group was working toward a solution of providing a higher and stronger quality finished product and agreed that a triple-pavement design was needed. The triple-pavement design would include stone, base asphalt, and surface asphalt; and the combination of double asphalt would provide added strength when compared with the six inches of stone and two inches of asphalt currently required. Postponing the requirement to pave streets from 50 to 60 percent building permit issuance will provide additional time for base stone to settle prior to installation of base asphalt. HBAR agreed that if the ordinance was also amended so they could receive up to 90 percent of building permits prior to placement of the final surface asphalt and State road acceptance, any settlement of the base asphalt could be corrected before final surfacing. Continued Next Page CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 3 Background Information (continued): Although the three-layer pavement design is more expensive per square yard, HBAR agreed that an ability to obtain 10 percent more permits through critical times and overall improved aesthetics far outweigh the small increase in cost per lot. The $300 in additional costs was generated by RAMCA and confirmed by HBAR. The County will also have subdivision roads constructed to a higher standard that should last longer and require less maintenance over their pavement life due to pavement failure. The Environmental Engineering Department agreed to this and, with the approval of the Committee, this amendment was brought forward to the Board, and the enclosed, proposed amendments to Sections 17-73 and 17-76 were referred to the Planning Commission by the Board at the September 22, 2004 meeting. At the Planning Commission's public hearing, HBAR requested that the 90-percent State road acceptance requirement be changed to 100-percent since the County has the option of pulling developer bonds to ensure completion of roads in subdivisions. It was noted that the original 80-percent requirement has worked very well since its inclusion in the ordinance in 1989. The Planning Commission after lengthy discussions voted three to two in favor of requiring the three-layer system, changing 50-percent building permits to 60 percent prior to paving, but changing 80-percent building permits to 100 percent prior to State acceptance. State recommends that the Board amend Sections 17-73 and 17-76 of the Code of the County of Chesterfield as presented by the Committee to the Planning Commission by changing the 50-percent paving requirement to 60 percent; changing the 80-percent State road acceptance requirement to 90 percent; and approving the three layer paving system. Summaryoflnformation: Mrs. Humphrey received a request to restrict any through truck or truck and trailer or semi-trailer combination, except pickup or panel trucks, from using McEnnally Road (Route 702) between North Spring Run Road (Routes 662 and 702) and Winterpock Road (Route 621). The recommended alternate route is Winterpock Road (Route 621), Hull Street Road (Route 360), and North Spring Run Road (Route 702). The Virginia Department of Transportation (VDOT) has four criteria it considers when a restriction is requested. A requested restriction must meet the first two criteria, in that: 1) a reasonable alternate route is provided; and 2) the character or frequency of truck traffic on the route proposed for restriction is not compatible with the effected area. Evaluation of the second criterion will include safety issues, accident history, engineering of the roadway, vehicle composition, and other traffic engineering related issues. Summary of Information: With some exceptions, the County's massage therapy ordinance requires that a massage performed for compensation be performed by a massage therapist who is (i) certified by the state and (ii) permitted by the County through the Chief of Police. Further, in most instances, the massage must be performed in a massage clinic that has received a permit from the County. Recently, the Virginia School of Technology, a proprietary technical school with campuses at the Arboretum (and formally at Boulders) and in Virginia Beach, approached County staff seeking changes in the massage therapy ordinance. The School offers instructional training for health related occupations such as massage therapist, medical assistant, practical nurse, and medical office specialist. Currently, massage therapy students at the School receive over 600 hours of massage therapy training and, as part of that training, provide massages to the public under the supervision of certified massage therapists. The School would like to begin charging customers for these massages in order to recover overhead costs such as supplies and instructor time. After meeting with representatives of the School and the Police Department, and after consultation with the Health Department, Staff recommends that the Board consider the attached amendments to the massage therapy ordinance. The proposed amendments would apply to public universities, public colleges and post secondary schools that are certified or approved by the State Council of Higher Education for Virginia. The amendments would allow qualifying educational institutions to charge for massages performed by their massage students provided that (i) the massages are performed as part of a course of massage therapy instruction at the school, (ii) the school holds a valid massage clinic permit from the County and (iii) a certified massage therapist holding a County permit is present at all times in the room with the massage therapy student. The ordinance amendments would also allow a massage clinic to be located at a qualifying university, college or school. Staff believes that requiring the school to obtain a permit for a massage clinic from the County and, also, to be a public university or college, or a post secondary school approved or certified by the State Council, provides sufficient safeguards against abuse of the ordinance exception by fraudulent businesses claiming to be massage schools. The Police Department and Health Department do not have any objections to the proposed ordinance amendments. Staff recommends that the Board adopt the attached ordinance amendments. 1923 (25): 68316.1 (68197.1) 000209 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 15-91, 15-92 AND 15-93 RELATING TO MASSAGE THERAPY PERFORMED BY MASSAGE THERAPY STUDENTS OF A POST SECONDARY EDUCATIONAL INSTITUTION BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 15-91, 15-92 and 15-93 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: ARTICLE V. MASSAGE CLINICS Sec. 15-91. Definitions. For this article, the following words and phrases shall have the following meanings: Barber shop: An establishment which provides one or more of the following services in exchange for consideration: hair care, makeovers, facials, manicures, pedicures, or body waxing. Beauty salon: An establishment which provides one or more of the following services in exchange for consideration: hair care, skin care, makeovers, facials, manicures, pedicures or body waxing. Care facility: A hospital, nursing home, convalescent care facility, assisted living facility, life care facility, or group care facility. Certified massage therapist: Any person who administers a massage to another person, in exchange for consideration, and who has qualified as a certified massage therapist pursuant to the requirements of Code of Virginia, §§ 54.1-3000 and 54.1-3029, including but not limited to a massage clinic operator. Chief of police: The Chesterfield County Police Chief or his designee. Client: A person receiving a massage. Consideration: Anything of value given in exchange for services rendered, including, but not limited to, money, goods, services or advertising. Health club: An establishment which provides health and fitness equipment and programs for its client's use in exchange for any form of consideration. A health club may be located in a hotel or motel but not in a guest room in a hotel or motel. Massage: The treatment of soft tissues for therapeutic purposes by the application of massage and body work techniques based on the manipulation or application of pressure to the muscular structure or soft tissues of the human body. Massage shall not include the diagnosis or treatment of illness or disease or any service or procedure for which a license to practice 1923:68197.1 1 0002~.0 medicine, nursing, chiropractic therapy, physical therapy, occupational therapy, acupuncture or podiatry is required by law. Massage clinic: A fixed place of business where a certified massage therapist gives a client a massage. A massage clinic shall either be freestanding or located within a health club, tanning salon, hotel or motel (but not in a guest room in a hotel or motel), beauty salon~ ~ barber shop or within a public university, public college, or post-secondary school that is certified or approved by the State Council of Higher Education for Virginia. Massage clinic operator: The person who files and signs the application for a massage clinic permit and who is responsible for the day-to-day operation of the clinic. The massage clinic operator need not qualify as a certified massage therapist if he or she does not intend to administer massage. Public gathering: Any event occurring in the county that is open to the general public and involves more than 50 persons. Seated massage: A massage of the upper body or feet when the massage client is fully clothed and seated in a chair. Tanning salon: An establishment which has as its primary business the provision of tanning services in exchange for consideration. Sec. 15-92. Permit required. No person shall administer or perform or permit to be administered or performed a massage in exchange for consideration in or upon any premises within the county unless: (a) The massage is performed for medical, relaxation, remedial or hygienic purposes; and (b) The person performing the massage is a certified massage therapist and holds a valid county permit. (c) If a massage is performed in a massage clinic, a valid county massage clinic permit has been issued for the premises. Sec. 15-93. Exclusions. Section 15-92 shall not apply to massages administered for medical, relaxation, remedial or hygienic purposes by (i) a physician, surgeon, chiropractor, osteopath or physical therapist duly licensed by the Commonwealth of Virginia; (ii) a licensed nurse acting under the prescription or direction of any such physician, surgeon, chiropractor, osteopath, or physical therapist; ~ 1923:68197.1 2 0002 .'1 (iii) a certified massage therapist acting on the premises of any such physician, surgeon, chiropractor, osteopath or physical therapist and under his prescription or direction. Section 15- 92 shall not apply to barber shops or beauty salons in which massage is given to the scalp, face, neck or shoulders only:; or (iv) a student of massage therapy enrolled in a course of instruction for massage therapy at a public university, public college, or post-secondary school that is certified or approved by the State Council of Higher Education for Virginia, provided also that the massage is performed as part of a course of instruction for massage therapy at a massage clinic holding a valid county permit and that a certified massage therapist with a permit from the County is present in the room at all times with the massage therapy student. In addition, Section 15-92 shall not apply to barber shops or beauty salons in which massage is given to the scalp, face, neck or shoulders only.
